The excavation shall be limited to a bottom elevation of -6.3 ft. NGVD. All disturbed areas proposed for lake excavation shall be excavated to a minimum elevation of -2. 0 ft. NGVD. 2 . Off-site removal of material shall be subject to "Standard Conditions" imposed by the Transportation Services Division in document dated 5/24/88 (copy attached) . 3. The lake littoral zone shall be created and planted as indicated on the Plan of Record. 4. In order to ensure a minimum eighty percent (80%) coverage of littoral zone planting areas, a performance guarantee, based on a cost estimate to replace the original installed littoral zone plans, will be required upon completion and acceptance of the excavation (LDC 3.5.7.2 .5) . No blasting will be permitted unless issued a separate permit by Collier County Project Plan Review. 8. If trees are to be removed as a result of the excavation operation, a Vegetation Removal Permit required by Collier County Land Development Code Division 3.9, shall be obtained from Collier County Current Planning Section before work shall commence. 9. A twenty foot (20') maintenance easement shall be provided around the perimeter of the lake and a twenty foot (20' ) access easement to it shall be provided. The easement shall be provided to Collier County, however, maintenance will be provided by the applicable homeowner's association. 9. Stockpiling shall be limited to those areas shown on the Plan of Record. If the excavation operation is discontinued for sixty (60) calendar days, the remaining stockpiles shall conform to the following criteria: a. The side slopes shall not be steeper than 4: 1. b. The stockpile shall be stabilized by seed and mulch. c. If the stockpile exceeds 4 feet in height, 4 foot high fencing shall be provided. 10. A South Florida Water Management District (SFWMD) permit shall be obtained prior to issuance of this excavation permit. 11. In order to ensure a minimum eighty percent (80%) coverage of littoral zone planting areas, a performance guarantee, based on a cost estimate to replace the original installed littoral zone plants, will be required upon completion and acceptance of the excavation (LDC 3.5.7.2.5) . 12 . No more than two lakes secured by the same performance guarantee shall be active at any one time and one of the two lakes must be completed prior to the issuance of an excavation permit for any additional lake. Environmental: 1. The petitioner shall conduct and submit surveys for burrowing owls, in accordance with Florida Game and Fresh Water Fish Commission guidelines prior to excavation permit issuance. If burrows exist in the location of proposed lakes, Florida Game and Fresh Water Fish Commission shall be consulted for habitat management guidelines and preservation areas. NAME OF PETITIONER/PROJECT: Petition No. : Commercial Excavation Permit No. 59 . 514 Petition Name: "Maplewood Unit Two" Applicant/Developer: Michael Crane Trust Engineering Consultant: Christopher O. Wright, P.E of Wilson, Miller, Barton & Peek, Inc. II. LOCATION: Section 31, Township 49 South, Range 26 East; bounded on the north, west, and south by Briarwood PUD an on the east by an FP&L easement on the Southwinds Mobile Village property. Two hundred (200±) feet of the southern property line borders Radio Road. III. PROJECT DESCRIPTION: The petitioner proposes to excavate a 10. 2 acre lake within the Maplewood PUD and remove approximately 100, 000 cubic yards of excavated material offsite. Two separate destinations for the material have been selected. The Leawood Lakes PUD approximately 4 mile east of Maplewood and the Sabal Lakes PUD approximately 2 miles east of Maplewood, both on Radio Road. The fill will be split between these two destinations with 60% going to Leawood Lakes PUD and the remaining 40% going to Sabal Lakes PUD. The balance of approximately 99, 760 cubic yards will remain on-site and stockpiled as shown on the plan of record. The water management system for Maplewood was previously reviewed and approved by the EAB at the meeting of August 4 , 1993 . Plan of Record: Water Management: Maplewood Unit Two "Master Paving and Drainage Plan" sheet 4 of 21 dated September 12 , 1994 , one revision, "Drainage Details" sheet 15 of 21 dated September 27, 1994, two revisions, and "Clearing Plan" sheet 21 of 21 dated October 14, 1994 , three revisions. STAFF COMMENTS: Water Management: The project site is located within the Golden Gate Canal Drainage Basin. The proposed on-site water management system for all of Maplewood consists of two lakes, the subject 10. 2 acre lake for Unit Two and the existing one acre lake for Unit One. The downstream control elevation is 5. 7 feet NGVD. Discharge from this structure will be conveyed by pipe and swale into Lake No. 6 of the Briarwood PUD water management system. Eventual discharge is into the Golden Gate Canal after passing through the Briarwood system of interconnected lakes. The discharge from Maplewood after development is completed will be limited to 0. 06 cfs/acre or 3 . 87 cfs. The proposed water management system meets the requirements for water quality and water quantity per South Florida Water Management District criteria. Environmental: The Maplewood PUD was reviewed and approved by the EAB on August 4 , 1993 . V. RECOMMENDATIONS: Staff recommends approval of Commercial Excavation Permit No. 59 . 514 , "Maplewood Unit Two" with the following stipulations: Water Management: 1. Date Senior Project Manager COLLIER COUNTY TRANSPORTATION SERVICES "STANDARD CONDITIONS" EXCAVATION PERMIT APPLICATIONS INVOLVING OFF-SITE REMOVAL OF MATERIAL The intent of these "Standard Conditions" are to provide excavation permit applicants a summary of conditions which may affect their projects and which should be taken into consideration during all stages of project development: 1. Haul routes between an excavation site and an arterial road shall be private with property owner(s) approval or be a public collector road built to standards applicable to handle the resulting truck traffic. Where residential areas front collector roads, appropriate turn lanes, buffer and bikepath shall be required as minimal site improvements and if recommended for approval, shall be so with the condition that the Transportation Services Administration reserves the right to suspend or prohibit off-site removal of excavated material should such removal create a hazardous road condition or substantially deteriorate a road condition; such action by the Transportation Services Administration shall be subject to appeal before the Board of County Commissioners. 2 . Haul routes utilizing public roads shall be subject to road maintenance and road repair or an appropriate fair share by the permittee in accordance with Excavation Ordinance No. 92-73 and Right-of-Way Ordinance No. 82-91. 3 . Off-site removal of excavated material shall be subject to Ordinance No. 92-22 (Road Impact Ordinance) . A traffic and road impact analysis shall be made by the County to determine the effects that off-site removal of excavated material will have on the road system within the excavation project's zone of influence. If appropriate, road impact fees in accordance with Ordinance No. 92-22 shall be paid prior to the issuance of an excavation permit. 4 . The Transportation Services Administration reserves the right to establish emergency weight limits on public roadways affected by the off-site removal of excavated material; the procedure for establishment of weight limits shall be the presentation of an applicable resolution before the Board of County Commissioners. Should weight limits be instituted, the permittee shall be responsible to implement measure to assure that all heavy truck loadings leaving the permit's property conform to the applicable weight restriction. 5. The Excavation Performance Guarantee shall apply to excavation operations and also the maintenance/repair of public roads in accordance with current ordinances and applicable permit stipulations. 6. Based on soil boring information per Ordinance No. 92-73 , a blasting permit may be appropriate. Should a blasting permit application be submitted and should residential areas exist within one mile of the excavation site, the County reserves the right to deny a blasting permit based on concerns for off-site impacts from blasting at an excavation site. Should a blasting permit be considered and approved, the minimum conditions of approval in addition to conditions per Ordinance No. 92-73 are as follows: A. Structure inventory/monitoring and applicable property owner release as required by the Development Services Director. B. Security bond applicable to private property damage acceptable to the County. C. Control of size/depth/number of charges per blast by the Development Services Director. D. The right of the County to suspend and/or revoke blasting permit authority should be determined that blasting activities are creating unacceptable off-site conditions either in terms of private property damage and/or related physical effects of blasting operations. 7 . No excavation permit shall be issued until receipt of a release from the Transportation Services Administration applicable to proper mitigation of off-site impacts, meeting of applicable provisions of Ordinance No. 82-91, Ordinance No. 92-22 , and Ordinance No. 92-73 . LOCATION: Section 23 , Township 48 South, Range 27 East; generally bounded on the north by Oil Well Road, on the eat by the Golden Gate Canal, on the south by Randall Blvd. and on the west by Immokalee Road. III. PROJECT DESCRIPTION: The petitioner proposes to excavate thirteen lakes, a total of 60 acres, that will ultimately comprise the major portion of the surface water management system serving Valencia at Orangetree, a proposed 718 acre golf course residential community. Lake 4-2 was previously reviewed and approved for a commercial excavation by the EAB on December 1, 1993 . It is now being excavated. The conceptual water management system for Valencia was reviewed and approved by the EAB on July 1, 1992 as part of the Preliminary Subdivision Plat review. The purpose of this petition is to obtain a Commercial Excavation overlay for the thirteen remaining lakes to allow excess material to be hauled offsite. An excavation permit application will be submitted for each lake. Lake 4-1 is now being reviewed. As a stipulation to approval of this petition no more than two lakes secured by the same performance guarantee shall be active at one time and one of the two lakes must be completed prior to the issuance of an excavation permit for any additional lake. Should the petitioner wish to excavate additional lakes under the same permit number, a separate performance guarantee shall be submitted. Again, no more than two lakes secured by the same performance guarantee shall be active at one time. STAFF COMMENTS: Water Management: The proposed lakes lie within the South Florida Water Management District (SFWMD) sub Basins No. 4 & 5 as permitted under Orangetree Conceptual Surface Water Management Permit No. 11-00418-S. Runoff generated by Valencia at Orangetree will be conveyed to the lakes via catch basins, pipes and swales. After the runoff is collected for water quality and water quantity it will be discharged via control structures, offsite. Sub Basin No. 4 will discharge south into the Randall Blvd. right-of-way and eventualy to the Golden Gate Canal. Sub Basin No. 5 will discharge east directly into the North Golden Gate Canal. The water management system has been designed in accordance with the South Florida Water Management District (SFWMD) criteria for water quality and water quantity. Environmental: The site is a sparsely vegetated former farm field. There is potential for this pasture land to be used by burrowing owls as they currently reside throughout other similar habitats on the Orangetree PUD property. V. RECOMMENDATIONS: Staff recommends approval of Commercial Excavation Permit No. 59 . 523 , "Valencia at Orangetree - Lakes #4-1 through #4-14 excluding Lake #4-2 with the following stipulations: Water Management: 1. Mulhere Date Acting Current Planning Manager COLLIER COUNTY TRANSPORTATION SERVICES "STANDARD CONDITIONS" EXCAVATION PERMIT APPLICATIONS INVOLVING OFF-SITE REMOVAL OF MATERIAL The intent of these "Standard Conditions" are to provide excavation permit applicants a summary of conditions which may affect their projects and which should be taken into consideration during all stages of project development: 1. Haul routes between an excavation site and an arterial road shall be private with property owner(s) approval or be a public collector road built to standards applicable to handle the resulting truck traffic. Where residential areas front collector roads, appropriate turn lanes, buffer and bikepath shall be required as minimal site improvements and if recommended for approval, shall be so with the condition that the Transportation Services Administration reserves the right to suspend or prohibit off-site removal of excavated material should such removal create a hazardous road condition or substantially deteriorate a road condition; such action by the Transportation Services Administration shall be subject to appeal before the Board of County Commissioners. 2 . Haul routes utilizing public roads shall be subject to road maintenance and road repair or an appropriate fair share by the permittee in accordance with Excavation Ordinance No. 92-73 and Right-of-Way Ordinance No. 82-91. 3 . Off-site removal of excavated material shall be subject to Ordinance No. 92-22 (Road Impact Ordinance) . A traffic and road impact analysis shall be made by the County to determine the effects that off-site removal of excavated material will have on the road system within the excavation project's zone of influence. If appropriate, road impact fees in accordance with Ordinance No. 92-22 shall be paid prior to the issuance of an excavation permit. 4 . The Transportation Services Administration reserves the right to establish emergency weight limits on public roadways affected by the off-site removal of excavated material; the procedure for establishment of weight limits shall be the presentation of an applicable resolution before the Board of County Commissioners. Should weight limits be instituted, the permittee shall be responsible to implement measure to assure that all heavy truck loadings leaving the permit's property conform to the applicable weight restriction. 5. The Excavation Performance Guarantee shall apply to excavation operations and also the maintenance/repair of public roads in accordance with current ordinances and applicable permit stipulations. 6 . Based on soil boring information per Ordinance No. 92-73 , a blasting permit may be appropriate. Should a blasting permit application be submitted and should residential areas exist within one mile of the excavation site, the County reserves the right to deny a blasting permit based on concerns for off-site impacts from blasting at an excavation site. Should a blasting permit be considered and approved, the minimum conditions of approval in addition to conditions per Ordinance No. 92-73 are as follows: A. Structure inventory/monitoring and applicable property owner release as required by the Development Services Director. B. Security bond applicable to private property damage acceptable to the County. C. Control of size/depth/number of charges per blast by the Development Services Director. D. The right of the County to suspend and/or revoke blasting permit authority should be determined that blasting activities are creating unacceptable off-site conditions either in terms of private property damage and/or related physical effects of blasting operations. 7 . No excavation permit shall be issued until receipt of a release from the Transportation Services Administration applicable to proper mitigation of off-site impacts, meeting of applicable provisions of Ordinance No. 82-91, Ordinance No. 92-22 , and Ordinance No. 92-73 .
