Water Management:
1. A copy of South Florida Water Management District
(SFWMD) Permit or Early Work Permit with staff
report is required prior to construction plan
approval. Also, a copy of SFWMD Permit
Modification for Lely PUD accounting for Sierra
Meadows PUD storm water discharge plus the surface
runoff from the west into the Lely water
management system shall be submitted prior to
construction plan approval.

Environmental:
1. Amend Section 3.4 of the PUD document to read

Sentence number three of that same Section shall
be amended as follows: "Modifications can be made
to the boundaries of preservation areas depicted
on the PUD Master Plan subject to the review and
approval of the Site Development Review Director
or his or her designee and other necessary
applicable environmental agencies.
2. Delete the last sentence of Section 4.14 of the
PUD document.
3. Correct Section 7. 6 to read "Conservation Tracts
B and G", not B and F.

STIPULATIONS:
Water Management:
1. A copy of South Florida Water Management District
(SFWMD) Permit or Early Work Permit with staff

2 . An Excavation Permit will be required for the
proposed lakes in accordance with Division 3.5 of
the Collier County Land Development Code and SFWMD
rules.
3. A Big Cypress Basin (SFWMD) right-of-way permit,
allowing the projects discharge into the Immokalee
Road canal shall be provided prior to final
construction plan approval.
Environmental:
1. Make the following changes to the PUD document:
a) Amend Section 2.2 (A) to read as follows:
Regulations for development of Carlton Lakes shall
be in accordance with the contents of this PUD
document, applicable sections of the Collier
County Land Development Code and Collier County,
County Growth Management Plan which are in effect
at the time of issuance of final development
order.
b) Amend Section 6.2 (A) (2) to read as follows: Lakes
aiding the natural vegetation provided they are
constructed on land in excess of the required
twenty-five percent (25%) retained naive
vegetation.
c) Delete Section 7. 6 (A) .
d) Amend Section 7. 11 to read as follows:
ENVIRONMENTAL
The development of this PUD Master Plan shall be
subject to and governed by the following
conditions:

A. Consistent with LDC Section 3.9.5.5.3,
twenty-five (25) percent of the viable
naturally functioning native vegetation on
site shall be retained. Project acreage is
245.77 of which 220.57 acres have been
determined to be viable naturally functioning
native vegetation; therefore, a total of 55
acres shall be identified. A minimum of
three-quarters of this requirement (41 acres)
shall be from the identified wetland and
upland conservation tracts noted on the PUD
Master Plan (Tracts D1 through D10) . The
remaining 14 acres shall be identified prior
to platting and may include perimeter buffers
when appropriately planted.
2 . Amend the last note on the PUD Master Plan to read
as follows: ***** Perimeter landscape buffer not
required adjacent to preservation, golf course,
and open space features of adjacent developments.
3. All jurisdictional wetlands and/or mitigation
areas shall be designated as
conservation/preservation tracts or easements on
all construction plans and shall be recorded on
the plat with protective covenants per or similar
to Section 704.06 of the Florida Statutes.
4. All proposed mitigation for wetland impacts to
Collier County jurisdictional wetlands shall
comply with Appendix 7 of the South Florida Water
Management District (SFWMD) rules and be subject
to review and approval by Community Development
Environmental Review Staff.
5. Buffer zones which extend at least fifteen (15)
feet landward from the edge of wetland preserves
in all places and average twenty-five (25) feet
from the landward edge of wetland preserves shall
be required.
6. An exotic vegetation removal, monitoring, and
maintenance (exotic-free) plan for the site, with
emphasis on the conservation/preservation areas,
shall be submitted to Community Development
Environmental Review Staff for review and approval
prior to final site plan/construction plan
approval.
7. This PUD is located within Collier County
Groundwater Protection Zone No. 1-4 and shall
comply with the appropriate sections of the
Groundwater Protection Ordinance No. 91-103 at the
time of final development order approval.

8. The perimeter landscaped buffer shall be reduced
from fifteen (15) feet to five (5) feet of width
at the environmental/property line section of the
project's circulation system; location is
identified on Exhibit "A" PUD Master Plan. This
reduction is to reduce the impact of the roadway
on the adjacent conservation area. The tree and
planting requirements of this buffer will be
increased by reducing the spacing of required
trees by fifty percent (50%) .

II. LOCATION:
The subject property is an undeveloped ninety (90) acres parcel
located at the southwest corner of Rattlesnake Hammock Road and
County Road 951 in Section 22 , Township 50 South, Range 26 East;
bounded by undeveloped Agricultural zoning on the north, west and
east. The property to the south is zoned PUD and is part of the
Lely DRI .
III. PROJECT DESCRIPTION:
Sierra Meadows PUD is a 90 . 8 acre multi-use development. This
development will contain single family homesites, multi-family
development and an area of commercial development.

8, three revisions and "Off-site Drainage Details" sheet 5 Of 8,
two revisions both sheets dated September 2 , 1994 .
Environmental:
Environmental Impact Statement (EIS) for Sierra Meadows Planned
Unit Development, prepared by Kevin L. Erwin Consulting Ecologist,
Inc. , dated November, 1993 .
IV. STAFF COMMENTS:
Water Management:
The water management system for Sierra Meadows PUD will consist of
pre-treatment swales discharging into on-site wetlands.

Off-site discharge will be through a control structure located
along the southern border of the property. This discharge will be
conveyed by swale into Lely Phase II to the south.
The discharge rate for the project will be limited to 0. 15
cfs/acre or 13 . 62 cfs or as approved by SFWMD.
Environmental:
The subject property is an undeveloped ninety (90) acres parcel

County Road 951 . Eighty percent of the site is pine flatwoods
some of which has exotic invasion and some of which is
transitional to the wetland areas. A little over eighteen percent
of the property is cypress or pine/cypress wetlands. The
remaining acres are presently used as an agricultural nursery.
More than thirty-six (36 . 8) acres are proposed to be preserved and
will be placed under conservation easement. This is approximately
forty (40 . 5) percent of the total site. The 36 . 8 acres is
comprised of 13 . 6 acres of preservation and restoration of
existing wetland habitat and the preservation and restoration of
21. 9 acres of existing upland habitat.
The 27 acres of contiguous wildlife preserve on the western half
of the property contains previously known red-cockaded woodpecker
habitat and two inactive cavity trees. This preserve will
maintain the two inactive cavity trees and also serve as a
wildlife corridor connecting the property to the south with the
areas north of Rattlesnake Hammock Road.
RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No.
PUD 94-1 with the following stipulations:
Water Management:
1. A copy of South Florida Water Management District (SFWMD)
Permit or Early Work Permit with staff report is required
prior to construction plan approval . Also, a copy of SFWMD
Permit Modification for Lely PUD accounting for Sierra Meadows
PUD storm water discharge plus the surface runoff from the
west into the Lely water management system shall be submitted
prior to construction plan approval .
2 . Authorization to direct storm water runoff into the existing
Lely water management system shall be provided prior to
construction plan approval.

Environmental:
1. Amend Section 3 . 4 of the PUD document to read "Conservation
Tracts B and G" , not B and F. Sentence number three of that
same Section shall be amended as follows: "Modifications can
be made to the boundaries of preservation areas depicted on
the PUD Master Plan subject to the review and approval of the
Site Development Review Director or his or her designee and
other necessary applicable environmental agencies.
2 . Delete the last sentence of Section 4 . 14 of the PUD document.
3 . Section 7 shall be amended as follows:
Delete 7 . 1, 7 . 2 , 7 . 3 , 7 . 4 , and 7 . 5. Replace them with the
following statement: "This PUD shall be subject to the
environmental sections of the Collier County Land Development
Code and the Growth Management Plan Conservation and Coastal
Management Element at the time of final development order
approval. "

II. LOCATION:
The project site is a 245 . 8 acre parcel located on the north side
of Immokalee Road (C.R. 846) between I-75 and Airport-Pulling Road
(C.R. 31) . The property is generally bordered on the north by
undeveloped property zoned agriculture, on the east by Regency
Village of Naples PUD and on the west by the Collier County
Reserve Wellfield and future Livingston Road in Section 19 ,
Township 48 South, Range 26 East, Collier County, Florida.
III. PROJECT DESCRIPTION:
Carlton Lakes is a planned community including a mixture of
single-family and multi-family dwelling units, commercial
facilities and recreational, conservation and water management
related elements.

IV. STAFF COMMENTS:
Water Management:
The water management system for Carlton Lakes PUD will consist of
19 . 3 acres of existing natural wetlands, 45 acres of proposed
lakes and a stormwater collection system with a controlled
discharge. The perimeter of the water management system will be
bermed.
On-site storage and treatment of stormwater runoff will occur in
the proposed lakes and existing wetlands . The lakes will be
interconnected by a pipe network which will also collect runoff
and direct it to the lakes for storage. After treatment
stormwater runoff will be discharged through a control structure
to the Immokalee Road Canal.
Discharge from the site will be limited to 0 . 04 cfs/acre.
Environmental:
The subject property is composed mainly of pine flatwoods with
graminoid, saw palmetto and/or muscadine grape understories.
Cypress domes, stands of melaleuca, disturbed area (Brazilian
pepper) and a 6 . 2 acre muhly grass marsh make up the remainder of
the property. Native vegetation on the north half of the property
has benefited due to the effects of fire which swept through the
area back in may of 1994 . Melaleuca, grape and Brazilian pepper
were greatly suppressed by the flames .
The current Carlton Lakes PUD requires the preservation of 1. 6
acres of scrub oak on the southern portion of the property. Staff
and the petitioner agree that the habitat is of low quality and
both parties would prefer the preservation of the high quality
flatwoods labeled D10 on the proposed PUD Master Plan.
Wildlife species currently utilizing the property include typical
flatwoods species of the region and include 54 observed species,
(12 herps, 32 birds and 10 mammals) . Wildlife species of listed
status include gopher tortoise (Gopherus polyphemus) and big
cypress fox squirrel (Squirrus niger avicennia) .
Gopher tortoises occupy the pine/oak area in the site's southern
quarter. Eight active adult-sized burrows are known at this time
with an estimated population of 2-4 animals. These tortoises will
be relocated to the palmetto preserve in the northwest corner of
the property (Conservation Tract D9 on the proposed PUD Master
Plan) . This offers the elevation, soil, food and cover
conditions required by tortoises.

One individual fox squirrel has been seen on the subject property
in the high quality flatwoods labeled No. 19 on the Carlton Lakes
FLUCCS Map. Of this area, 3 . 7 acres will be preserved
(Conservation Tract D10 on the proposed PUD Master Plan) . No fox
squirrel nests have been found on the subject property.
Over the past five years several surveys have been made by three
different field consultants in search of red-cockaded woodpecker
(RCW) use of the project site. During the surveys no sigh of RCW
activity was recorded. The concern for RCW welfare on this site
is based on the on-site presence of four cavity trees (three from
the 1990 surveys, one dead and down tree from the present survey) .
All of these cavity trees bear signs of being inactive for, at
least, several seasons.
A letter dated July 18 1994 from George W. Percy, Director,
Division of Historical Resources and State Historic Preservation
Officer indicates that no significant archaeological or historical
sites are recorded for or likely to be present within the project
area.
V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No.
PUD-87-36 (1) with the following stipulations:
Water Management:
1. A copy of South Florida Water Management District (SFWMD)
Permit or Early Work Permit with staff report is required
prior to construction plan approval .
2 . An Excavation Permit will be required for the proposed lakes
in accordance with Division 3 . 5 of the Collier County Land
Development Code and SFWMD rules.
3 . A Big Cypress Basin (SFWMD) right-of-way permit, allowing the
projects discharge into the Immokalee Road canal shall be
provided prior to final construction plan approval .
Environmental:
1. Make the following changes to the PUD document:
a) Amend Section 2 . 2 (A) to read as follows: Regulations for
development of Carlton Lakes shall be in accordance with
the contents of this PUD document, applicable sections of
the Collier County Land Development Code and Collier
County, County Growth Management Plan which are in effect
at the time of issuance of final development order.

b) Amend Section 6 . 2 (A) (2) to read as follows : Lakes aiding
the natural vegetation provided they are constructed on
land in excess of the required twenty-five percent (25%)
retained naive vegetation.
c) Delete Section 7 . 6 (A) .
d) Amend Section 7 . 11 to read as follows:
ENVIRONMENTAL
The development of this PUD Master Plan shall be subject
to and governed by the following conditions:
A. Consistent with LDC Section 3 . 9 . 5 . 5 . 3 , twenty-five
(25) percent of the viable naturally functioning
native vegetation on site shall be retained. Project
acreage is 245 . 77 of which 220 . 57 acres have been
determined to be viable naturally functioning native
vegetation; therefore, a total of 55 acres shall be
identified. A minimum of three-quarters of this
requirement (41 acres) shall be from the identified
wetland and upland conservation tracts noted on the
PUD Master Plan (Tracts D1 through D10) . The
remaining 14 acres shall be identified prior to
platting.
2 . Delete the following note from the PUD Master Plan:
***** Buffer not required adjacent to located preservation,
golf course, and open apace features of adjacent developments.
3 . All jurisdictional wetlands and/or mitigation areas shall be
designated as conservation/preservation tracts or easements on
all construction plans and shall be recorded on the plat with
protective covenants per or similar to Section 704 . 06 of the
Florida Statutes.
4 . All proposed mitigation for wetland impacts to Collier County
jurisdictional wetlands shall comply with Appendix 7 of the
South Florida Water Management District (SFWMD) rules and be
subject to review and approval by Community Development
Environmental Review Staff .
5. Buffer zones which extend at least fifteen (15) feet landward
from the edge of wetland preserves in all places and average
twenty-five (25) feet from the landward edge of wetland
preserves shall be required.

6. An exotic vegetation removal , monitoring, and maintenance
(exotic-free) plan for the site, with emphasis on the
conservation/preservation areas, shall be submitted to
Community Development Environmental Review Staff for review
and approval prior to final site plan/construction plan
approval .
7 . This PUD is located within Collier County Groundwater
Protection Zone No. 1-4 and shall comply with the appropriate
sections of the Groundwater Protection Ordinance No. 91-103 at
the time of final development order approval .
