"Naples Landfill"

REQUESTING: The petitioner proposes to perform excavation work
which is incidental to and part of drainage
improvements necessary to bring the existing
landfill site into compliance with the recently
issued South Florida Water Management District
permit. The petitioner has requested substitutions
to the construction requirements set forth by
Section 3 . 5 . 7 of the Land Development Code.

Commissioners the same recommendations as EPTAB.
MOTION: Made by Mr. Neale, seconded by Mr. Hermanson and
carried 5/2 , to forward to the Board of County
Commissioners, the following recommendations:
1 . EAB supports the critical wildlife areas on Sand
Dollar Island, as limited and defined by original
legal description in Florida Game and Fresh Water
Fish Commission (FGFWFC) order and supports the
remainder of the beach to be for recreational use.
2 . EAB requests that County Staff investigate
feasibility of a movable, expandable boardwalk to
enhance beach access.
3 . EAB requests that County Staff amend Marco Beach
raking permit to permit raking to occur in areas
which became vegetated as a result of being a
critical wildlife area and which have ceased being
critical wildlife areas.
4 . EAB recommends, in concurrence with EPTAB that the
County conduct an educational seminar in the Marco
Island area on coastal barrier systems and their
functions and values.
5 . EAB recommends in concurrence with EPTAB that the
County investigate an environmental interpretive
program at Tigertail .

II . LOCATION:
Approximately three miles east of C.R. 951, just south of 16th
Avenue S. W. and just east of 17th Street S. W. , generally bounded
on the north and west by property zoned Estates, on the south by
undeveloped property zoned Agricultural, and on the east by land
zoned Agricultural and PUD; located in Sections 17 , 20 and 29,
Township 49 South, Range 27 East, Collier County, Florida.
III . PROJECT DESCRIPTION:
The subject property is a six hundred seventy-six (676) acre tract
zoned Agricultural with an adjacent four acre tract zoned Estates.
The proposed use is for the expansion of an existing earthmining
operation (Warren Brothers PUD) . Approximately five hundred
sixty-two (562) acres of the site are proposed as the envelope for
excavation activities. The remaining one hundred eighteen (118)
acres will be in conservation/mitigation areas (91. 7 acres) ,
buffer and setbacks (17 . 3 acres) and adjoining parcels zoned
estates (3 . 7 acres) and agricultural (5. 3 acres) .

IV. STAFF COMMENTS:
Water Management:
The proposed earthmining operation will be located solely within
Section 20 with ingress/egress through a four (4) acre Golden Gate
Estates tract owned by the petitioner. This four acre tract will
facilitate a haul route from the proposed excavation site to an
existing material processing area within the Warren Brothers PUD
(also owned by the petitioner) .
The petitioner proposes to perform the excavation with no
dewatering, but due to existing claimed wetlands on site, a South
Florida Water Management District (SFWMD) Surface Water Permit
will be required. The petitioner proposes to provide water
quality for the haul road only since dewatering (and impoundment)
will not occur.
The maximum permitted depth per the Land Development Code is
twenty feet (20' ) unless greater depths are supported by the
"fetch formula" or comparative water quality studies. Since the
"fetch formula" for this excavation yields an effective depth of
sixty-five feet (65' ) and the adjacent Warren Brothers PUD was
previously permitted to fifty feet (50' ) maximum depth or top of
confining layer, whichever is more restrictive, the petitioner
proposes to follow suit with the existing Warren Brothers PUD
permitted depths. In summary, the petitioner requests a maximum
depth of fifty feet (50' ) or the top of the confining layer,
whichever is encountered first.
Project Plan Review has contacted Dr. Gail Gibson of the County
Pollution Control Department for technical assistance in the
determination of the depth to the confining layer based on the
soil boring logs provided. Pursuant to a meeting with the
petitioner, Dr. Gibson, and Project Plan Review, it was agreed
that prior to the Board of County Commissioners (BCC) hearing an
additional boring to fifty-one foot (51' ) depth would be performed
with samples (either cores or cuttings) to be provided to Dr.
Gibson for his review. Dr. Gibson will ultimately make a
recommendation to Project Plan Review for the maximum permitted
depth which will be presented to the BCC.
Environmental:
Vegetatively the site consists of the following plant communities;
pine flatwoods (271 . 9 acres) , cropland/pastureland (237 . 0 acres) ,
cypress forest (47 . 6 acres) , palmetto prairie (40 . 0 acres) ,
freshwater marsh (35 . 1 acres) , cabbage palm thicket (24 . 3 acres) ,
disturbed (cleared) land (14 . 0 acres) , wet prairie (4 . 8 acres) ,
live oak hammock (3 . 5 acres) and Brazilian pepper stands (1. 4
acres) . 71 . 8 acres of Collier county jurisdictional wetlands
occur on the property.

Approximately 9 . 1 acres of disturbed isolated on-site wetlands
will be impacted by the proposed excavation activities. To
mitigate for these impacts, 12 . 9 acres of herbaceous marsh will be
constructed contiguous to the northern end of the southeast
wetland system on the site. The 58 . 4 acre wetland in the
southeast corner of the property is the least hydrologically
disturbed system on site and is part of a contiguous wetland
system that extends onto adjacent properties. The smaller
isolated wetlands provide limited wetland function due to past
hydrologic alterations and exotic plant infestation.
Listed wildlife species on site include gopher tortoise, big
cypress fox squirrel and little blue heron. A pair of
red-cockaded woodpeckers were also observed foraging two hundred
feet (200' ) off-site near the southwest corner of the property.
An approximately 3 . 0 acre upland preserve located adjacent to the
southeastern wetland preserve will be utilized as a recipient site
for gopher tortoises. The habitat consists of palmetto prairie
surrounded by pine flatwoods.
One individual big cypress fox squirrel was observed in a pine
flatwood area located in the southwest corner of the property.
This area also contained four squirrel nests (species unconfirmed)
built in large melaleuca trees. Squirrel activity was not
observed on or near these nests. This parcel of land is presently
zoned agricultural and is not within the proposed envelope for
excavation.
A letter dated November 15 , 1993 to Andy Woodruff, Kevin Erwin
Consulting Ecologists, Inc. , from Marion F. Smith, Jr. ,
Supervisor, Florida Site File, State of Florida, Division of
Historical Resources indicates no archaeological sites or
historical standing structures to be recorded within the project
location. The letter also indicates the possibility of unrecorded
archaeological sites on the property.
V. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No. CU-94-2
and Commercial Excavation Permit No. 59 . 499 , "APAC - Earthmining
Section 20" with the following stipulations:
Water Management:
1. A copy of South Florida Water Management District Permit or
Early Work Permit (with staff report) is required prior to
excavation permit issuance.

2 . An additional soil boring to fifty-one feet (51' ) below
existing grade with a geotechnical engineer's classification
and core samples shall be provided to the County Pollution
Control Department prior to the Board of County Commissioner's
hearing for maximum permitted depth determination.
3 . The lake littoral zone shall be created and planted as
indicated on the Plan of Record. No vegetation other than
that approved for planting shall be used in the littoral zone.
4 . All provisions of Collier County Ordinance No. 92-73 , Division
3 . 5 shall be adhered to.
5. Where groundwater is proposed to be pumped during the
excavating operation, a Dewatering Permit shall be obtained
from the South Florida Water Management District, and a copy
provided to Project Plan Review for approval prior to the
commencement of any dewatering activity on the site.
6. No blasting will be permitted unless issued a separate permit
by Collier County Project Plan Review.
7 . Off-site removal of material shall be subject to "Standard
Conditions" imposed by the Transportation Services Division in
document dated 5/24/88 (attached) .
8 . No Excavation Permit shall be issued until the road impact
fees have been paid.
9 . Prior to the excavation permit issuance, a cost estimate of
the installed cost of the littoral plantings shall be provided
in accordance with Section 3 . 5 . 7 . 2 . 5 of the Land Development
Code.
Environmental:
1. Permits or letters of exemption from the U. S. Army Corps of
Engineers, Florida Department of Environmental Protection,
South Florida Water Management District and Florida Game and
Fresh Water Fish Commission shall be submitted prior to
issuance of excavation permit.
2 . All conservation/mitigation areas shall be designated as
conservation/preservation tracts or easements on all
construction plans and shall be recorded on the plat with
protective covenants per or similar to Section 704 . 06 of the
Florida Statutes.

In the event the project does not require platting, all
conservation/mitigation areas shall be recorded as
conservation/preservation tracts or easements dedicated to an
approved entity or to Collier County with no responsibility
for maintenance and subject to the uses and limitations
similar to or as per Section 704 . 06 of the Florida Statues.
The tracts or easements shall be indicated on all future site
plans noting Official Record Book and Page of the public
records.
3 . Buffer zones which extend at least fifteen (15) feet landward
from the edge of wetland preserves in all places and average
twenty-five (25) feet from the landward edge of wetland
preserves shall be required.
4 . Prior to issuance of excavation permit, the petitioner shall
submit a mitigation plan to Project Plan Review Environmental
Staff for review and approval . The plan shall include, at
minimum, mitigation ratios, areas to be re-vegetated, methods
of re-vegetation and timetables for evaluation of success
criteria.
5. An exotic vegetation removal, monitoring and maintenance
(exotic free) plan for the site, with emphasis on the
preservation areas, shall be submitted to Project Plan Review
Environmental Staff for review and approval prior to issuance
of excavation permit.
6. If during the course of site clearing, excavation, or other
construction activities, an archaeological or historic site,
artifact, or other indicator is found, all development within
the minimum area necessary to protect the discovery shall be
immediately stopped and subject to the procedures in Section
2 . 2 . 25, Collier County Land Development Code.
7 . An agricultural clearing permit for the site shall be issued
pursuant to Division 3 . 9 Collier County Land Development Code.

"STANDARD CONDITIONS"
EXCAVATION PERMIT APPLICATIONS INVOLVING
OFF-SITE REMOVAL OF MATERIAL
The intent of these "Standard Conditions" are to provide excavation
permit applicants a summary of conditions which may affect their
projects and which should be taken into consideration during all
stages of project development:
1. Haul routes between an excavation site and an arterial road
shall be private with property owner(s) approval or be a public
collector road built to standards applicable to handle the
resulting truck traffic. Where residential areas front
collector roads, appropriate turn lanes, buffer and bikepath
shall be required as minimal site improvements and if
recommended for approval, shall be so with the condition that
the Transportation Services Administration reserves the right
to suspend or prohibit off-site removal of excavated material
should such removal create a hazardous road condition or
substantially deteriorate a road condition; such action by the
Transportation Services Administration shall be subject to
appeal before the Board of County Commissioners.
2 . Haul routes utilizing public roads shall be subject to road
maintenance and road repair or an appropriate fair share by the
permittee in accordance with Excavation Ordinance No. 92-73 and
Right-of-Way Ordinance No. 82-91.
3 . Off-site removal of excavated material shall be subject to
Ordinance No. 92-22 (Road Impact Ordinance) . A traffic and
road impact analysis shall be made by the County to determine
the effects that off-site removal of excavated material will
have on the road system within the excavation project's zone of
influence. If appropriate, road impact fees in accordance with
Ordinance No. 92-22 shall be paid prior to the issuance of an
excavation permit.
4 . The Transportation Services Administration reserves the right
to establish emergency weight limits on public roadways
affected by the off-site removal of excavated material; the
procedure for establishment of weight limits shall be the
presentation of an applicable resolution before the Board of
County Commissioners. Should weight limits be instituted, the
permittee shall be responsible to implement measure to assure
that all heavy truck loadings leaving the permit's property
conform to the applicable weight restriction.
5. The Excavation Performance Guarantee shall apply to excavation
operations and also the maintenance/repair of public roads in
accordance with current ordinances and applicable permit
stipulations.
6. Based on soil boring information per Ordinance No. 92-73 , a
blasting permit may be appropriate. Should a blasting permit
application be submitted and should residential areas exist
within one mile of the excavation site, the County reserves the
right to deny a blasting permit based on concerns for off•-site
impacts from blasting at an excavation site. Should a blasting
permit be considered and approved, the minimum conditions of
approval in addition to conditions per Ordinance No. 92-73 are
as follows:
A. Structure inventory/monitoring and applicable property
owner release as required by the Development Services
Director.
B. Security bond applicable to private property damage
acceptable to the County.
C. Control of size/depth/number of charges per blast by
the Development Services Director.
D. The right of the County to suspend and/or revoke
blasting permit authority should be determined that
blasting activities are creating unacceptable off-site
conditions either in terms of private property damage
and/or related physical effects of blasting
operations.
7 . No excavation permit shall be issued until receipt of a
release from the Transportation Services Administration
applicable to proper mitigation of off-site impacts,
meeting of applicable provisions of Ordinance No. 82-91,
Ordinance No. 92-22 , and Ordinance No. 92-73 .

2 . 2 . 24 . 8 Exceptions. Where land has an "ST" designation
and the proposed alteration or development area
contains twenty (20) acres or less in gross
area, and where no transfer of development
rights are involved, the Development Services
Director may approve a Site Alteration Plan or
a Site Development Plan. Prior to such
approval, the Development Services Director
shall make a finding that the following
conditions exist:
1. The proposed site alteration or site
development plan will not require any
modification, with the exception of exotic
vegetation removal, of the topography,
drainage, flora, or fauna on the site.

I. EAB supports the critical wildlife area} on Sand
Dollar Island, as limited and defined by original
legal description in Florida Game and Fresh Water
Fish Commission (FGFWFC) order and supports the
remainder of the beach to be for recreational use.

2. EAR requ4-ts that County Staff investigate
feasibility of movable, expandable boardwalk to
enhance beach access .
3. EAB requests that County Staff amend Marco Beach
raking permit to permit raking to occur in areas
which vegetated as a result of being a
critical wildlife area and which have ceased being
critical wildlife areas.

County conduct an educational seminar in the Marco
Island area on coastal barrier systems and their

As I was preparing my Board Room calendar for 1994 , I ran into a
"snag" . The EAB always meets on the first Wednesday of each
month at 9 : 00 . In February the State is having an Intangible Tax
Seminar - which they have every year - at the same time as your
meeting. Is there some way (because it is still early enought)
that we could reschedule your meeting? Please advise.
