II . LOCATION:
Section 33 , Township 49 South, Range 26 East; a part of the
Berkshire Lakes P.U.D. bounded on the north by I-75, on the west
by Santa Barbara Boulevard, on the south by Radio Road and on the
east by Green Heron PUD.
III . PROJECT DESCRIPTION:
The project in question was originally issued a permit by Collier
County on May 18 , 1984 to excavate three lakes to supply on-site
fill to provide fill material for the construction of Santa
Barbara Boulevard between Golden Gate City and Radio Road. On
April 16, 1985 the Board of County Commissioners approved a
modification to the permit to allow removal of the material
off-site for a period of three years. By May 15, 1990, the County
was notified that within the previous 12 months no activity had
occurred. No activities occurred for a period of over two (2)
years and the project had to obtain a new excavation permit. By
August 24 , 1991 a modification permit for Lake #3 only was issued.
On July 14 , 1992 the County approved the removal of 12 , 000 cy of
material from the referenced site for use on the County' s
Goodlette-Frank Road project.
This petition is to modify the existing permit by revising the
configuration of Lakes #2 and #3 and making it one large lake.
The previous approval required that any modifications to Lakes #1
or #2 needed approval by the EAB and BCC. The petitioner proposes
to excavate a 23 . 4 acre lake to use the material on-site and
off-site.

IV. STAFF COMMENTS:
Water Management:
The parcel in question will not be developed at this time for any
subdivision improvements. The proposed lake is the only proposed
activity on the site and it will collect any runoff that presently
drains on the site. Future development plans will require at a
minimum construction of a perimeter berm to the 25 year flood
elevation and an outfall structure. At that time, detail water
management plans and calculations will be submitted for review and
approval.
This project is required to obtain a Surface Water Permit from
SFWMD for the lake only, prior to issuance of an excavation
permit.
Environmental:
The acreage of the single lake will be approximately the same as
the previously approved lakes. However, the change in
configuration indicated that an updated survey for red cockaded
woodpeckers (RCW) would be required, since RCW' s have been
documented on adjacent property.
The attached report by Mr. Craig Schmittler of Wilson, Miller,
Barton & Peek, Inc. was the result of an initial survey on April
1, 1993 . Personal communication with Mr. Schmittler indicated
that subsequent surveys were conducted during the mornings of
April 7 , 9 , and 13 , and during the evenings of April 15 and 19 .
He reported no evidence of RCW's after all the surveys.
V. RECOMMENDATIONS:
Staff recommends approval of Commercial Excavation Permit No.
59 . 192 "Berkshire Lakes Parcel "E" with the following
stipulations:
Water Management:
1. The excavation shall be limited to a bottom elevation of -9 . 0
ft. NGVD (total depth of 20 feet) .
2 . All provisions of Collier County Ordinance No. 92-73 , Division
3 . 5 shall be adhered to.
3 . Off-site discharge of groundwater during construction shall be
only through approved discharge structures after water quality
treatment approved by Project Plan Review.

4 . Excavated material from the lake shall not be removed from the
property until appropriate road impact fees, based on a site
specific impact statement to determine the lane impacts per
Ordinance 85-55, have been paid. Off-site removal of material
shall be subject to "Standard Conditions" imposed by the
Transportation Services Division in document dated 5/24/88
(copy attached) .
5 . Upon completion of the project, the site shall be left in a
clean and orderly manner.
6. Copy of South Florida Water Management District
construction/operation permit or early work permit shall be
provided prior to excavation permit approval.
7 . Where groundwater is proposed to be pumped during the
excavating operation, a Dewatering Permit shall be obtained
from the South Florida Water Management District, and a copy
provided to Project Plan Review for approval prior to the
commencement of any dewatering activity on the site.
8 . No blasting will be permitted unless issued a separate permit
by Collier County Project Plan Review.
Environmental:
1. A Collier County Vegetation Removal Permit shall be obtained
for the lake, access, and stockpile areas.

Berkshire Lakes P.U.D. Parcel "E" lake expansion and stockpile area located in Section 33,
Township 49 South, Range 26 East, Collier County, Florida is the focus of this report.
An environmental inspection has been conducted on site specifically to determine the status of
gopher tortoises and red-cockaded woodpeckers in the area of the proposed clearing and lake
excavation.
A single flicker, two red-bellied woodpeckers, and numerous song birds were observed during
the inspection of this parcel. No red-cockaded woodpeckers were observed and no nest cavities
or start holes were found on site. Adjacent development to the east and lack of dense seedling
pines as suitable forage may be two factors in their absence from the site.
No gopher tortoises, fox squirrels or other endangered/threatened species were observed during
the site inspection.
The site is vegetated predominantly by slash pines (Pinus elliottii) in varying densities with
scattered cypress (Taxodium cligighpm), occasional dahoon holly (l_lex game), cabbage palm
(Sabal palmetto), and melaleuca (Melaleuca quinquinervia) as the canopy species. The shrub
layer consists of numerous large dense palmetto (Serenoa repens) communities throughout the
parcel. Other vegetation present in these thickets included buck thorn Wumelia celastrina),
tarflower (J3efaria racemosa), rusty lyonia (Lyonia ferraginea), love vine (Cassytha filiformis),
Bracken fern (Pterin longifolih), snowberry (Chiococca alba), Brazilian pepper (Schinus
terebinthefolius) and wax myrtle (Myrica cerifera). The sparse ground cover consisted of the
following:
poison ivy (Toxicodendron radicans)
wild grape (Vitis mtrrisoniana)
lantana (Lantana camara)
dog fennel (l upatorium capillifolium)
wire grass (AritWa rhizomophora) •
false maidencane (Amphicarpum muhlenbergianum)
penny royal (Satureja rigida)
.broomsedge (Andropogon yirginicus)
perriwinkle (Catharanthus foseus)
A considerable number of the slash pines on the eastern edge of the property have been killed
by past fires. Additional pines and cypress were blown down by hurricane Andrew last summer
and the no-name storm this winter. Melaleuca is becoming very dense on the southern part of
this parcel.
The site appears to be very dry due primarily to altered historic sheet flows as a result of
adjacent road construction. The ground cover vegetation supports this assumption.
It appears that the proposed lake excavation will cause no adverse impacts to this or the adjacent
properties. No impacts to endangered/threatened species are anticipated from the proposed
clearing and excavation.

"STANDARD CONDITIONS"
EXCAVATION PERMIT APPLICATIONS INVOLVING
OFF-SITE REMOVAL OF MATERIAL
The intent of these "Standard Conditions" are to provide excavation
permit applicants a summary of conditions. which may affect their
projects and which should be taken into consideration during all
stages of project development:
1. Haul routes between an excavation site and an arterial road
shall be private with property owner(s) approval or be a public
collector road built to standards applicable to handle the
resulting truck traffic. Where residential areas front
collector roads, appropriate turn lanes, bufferand bikepath
shall be required as minimal site improvements and if
recommended for approval, shall be so with the condition that
the Transportation Services Administration reserves the right
to suspend or prohibit off-site removal of excavated material
should such removal create a hazardous road condition or
substantially deteriorate a road condition; such action by the
Transportation Services Administration shall be subject to
appeal before the Board of County Commissioners.
2 . Haul routes utilizing public roads shall be subject to road
maintenance and road repair or an appropriate fair share by the
permittee in accordance with Excavation Ordinance No. 88-26 and
Right-of-Way Ordinance No. 82-91.
3 . Off-site removal of excavated material shall be subject to
Ordinance No. 85-55 (Road Impact Ordinance) . A traffic and
road impact analysis shall be made by the County to determine
the effects that off-site removal of excavated material will
have on the road system within the excavation project's zone of
influence. If appropriate, road impact fees in accordance with
Ordinance No. 85-55 shall be paid prior to the issuance of an
excavation permit.
4 .- The Transportation Services Administration reserves the right
to establish emergency weight limits on public roadways
affected by the off-site removal of excavated material; the
procedure for establishment of weight limits shall be the
presentation of an applicable resolution before the Board of
County Commissioners. Should weight limits be instituted, the
permittee shall be responsible to implement measure to assure
that all heavy truck loadings leaving the permit's property
conform to the applicable weight restriction.
5. The Excavation Performance Guarantee shall apply to excavation
operations and also the maintenance/repair of public roads in
accordance with current ordinances and applicable permit
stipulations.

6. Based on soil boring information per Ordinance No. 88-26, a
blasting permit may be appropriate. Should a blasting permit
application be submitted and should residential areas exist
within one mile of the excavation site, the County reserves the
right to deny a blasting permit based on concerns for off-site
impacts from blasting at an excavation site. Should a blasting
permit be considered and approved, the minimum conditions of
approval in addition to conditions per Ordinance 88-12 are as
follows:
A. Structure inventory/monitoring and applicable
property owner release as required by the County
Engineer.
B. Security bond applicable to private property damage
acceptable to the County.
C. Control of size/depth/number of charges per blast by
the County Engineer.
D. The right of the County to suspend and/or revoke
blasting permit authority should be determined that
blasting activities are creating unacceptable
off-site conditions either in terms of private
property damage and/or related physical effects of
blasting operations.
7 . No excavation permit shall be issued until receipt of a
release from the Transportation Services Administration
applicable to proper mitigation of off-site impacts,
meeting of applicable provisions of Ordinance No. 82-91,
Ordinance No. 85-55, and Ordinance No. 88-12 .

Sections 7 and 8 , Township 48 South, Range 26 East; bounded on
the north by the Lee County/Collier County Line, on the west by
I-75, on the east by the Parklands DRI , and on the south by Quail
Creek.
III. PROJECT DESCRIPTION:
The petitioner proposes to amend the existing Quail West PUD by
adding 323 . 19 acres of area to the PUD for a total of 854 . 19
acres. This addition was previously a part of the Parklands PUD
which document was amended to delete the 323 . 19 acres.
The proposed project is planned as a three phase, security gated
residential community which will contain two 18 hole golf courses
and a maximum of 766 single family homes. The project is located
partially in Collier County and partially in Lee County.
The land breakdown consists of 349 . 29 acres of single family
homesites and streets, 230. 55 acres of golf courses, lakes,
country club complex, ancillary common and utilitarian areas and
facilities, 274 . 35 acres of natural open space.

Environmental:
Approximately ninety-five percent (95%) of the added acreage is
currently actively farmed. The remaining sixteen (16) acres is
made up of nine (9) acres of altered uplands and seven (7) acres
of wetlands. One third (1/3) of the wetlands are cypress
dominated with the remainder being classified as freshwater marsh.
The project will preserve the 2 . 4 acre cypress wetland and
mitigate accordingly for the loss of the 4 . 6 acre marsh.
IV. STAFF COMMENTS:
Water Management:
Phase I of Quail West was approved by the Water Management
Advisory Board in the meeting of April 11, 1990 which has been
constructed already. Phase I of the project is proposed to be
modified to relocated roadway alignments and water management
features to accommodate Phase II and III construction.
The proposed water management system for Phase III is designed to
work on its own and discharging into Phase I forming a cascading
water management system with a maintained water elevation in Phase
III held at ±12 . 75 and the maintained water elevation in Phase I
held at ±12 . 50 . This system will consist of wet detention lakes
which will be interconnected and drainage basins for water quality
storage and treatment prior to discharge. Culvert pipes and sheet
flow from the golf courses will convey the runoff to the lakes.
Discharge as per Collier County is 0. 04 cfs/acre or 12 . 6 cfs for
Phase III .
The proposed water management system meets the requirements of
water quality and quantity in accordance with SFWMD criteria.
V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No.
PUD-89-3 (1) "Quail West" with the following stipulations:
Water Management:
1. An Excavation Permit will be required for the proposed lake (s)
in accordance with Division 3 . 5 of Collier County Ordinance
No. 92-73 and SFWMD rules.
2 . A copy of SFWMD Permit or Early Work Permit is required prior
to final site plan approval.

1. Petitioner shall add the following language under section 4 . 5
of the PUD: At the time of proposed development of any
Collier County jurisdictional wetlands in Phase III, the
petitioners shall present mitigation plans, for review and

"Native species shall be utilized in the site landscaping
plan. A landscape plan for all landscaping of the development
shall be submitted to Current Planning for review and approval
in compliance with Division 2 . 4 of the Collier County Land
Development Code. "

III. PROJECT DESCRIPTION:
The petitioner proposes to rezone ±65. 64 acres of land adjacent to
Foxfire PUD into a Planned Unit Development (PUD) to be used for
nine holes of golf. Also, to change the permitted uses to 1. 25+
acre tract of the Foxfire PUD from a fire station site to a master
wastewater pumping station and effluent storage tank site.

IV. STAFF COMMENTS:
Water Management:
Golf Course
The existing condition of the project site consists of pine
flatwoods covering the entire site. No wetland jurisdiction has
been identified on this site. The majority of the site lies
within the natural drainage basin of Rock Creek with a minor
portion within Haldeman Creek. The natural drainage of the site
is in a westerly direction to a point midway on the projects

western border, where the overland flow drains into the headwaters
of Rock Creek. Rock Creek, in turn, discharges into the Gordon
River and Naples Bay at a point just north of U. S. Highway 41 and
southwest of the Naples Airport.
The proposed water management system will consist of three
interconnected lakes which will provide the required water quality
and quantity storage volumes. Excess runoff will pass through the
lakes and a control structure to an existing drainage ditch to the
north.
The discharge rate after development is completed will be limited
to 0. 06 cfs/acre and a total of 3 . 9 cfs.
The proposed water management system meets the requirements for
water quality and water quantity per SFWMD criteria.
Environmental:
The proposed addition to the Foxfire PUD is currently zoned RMF-6.
The entire addition falls within wellfield protection zones WS-1,
WS-2 , WS-3 and WS-4 of the Glades Wellfield, as regulated by the
Groundwater Protection Ordinance (No. 91-103) .
The soils over the entire site have been classified by the Soil
Conservation Service as Oldsmar fine sand (non-hydric) .
Vegetatively, the site is classified as pine flatwoods with slash
pine (Pinus elliottii var. densa) and saw palmetto (Serenoa
repens) as the dominant species. There are no Collier County
jurisdictional wetlands on site.
The petitioner proposes to retain 23 .72 acres (approximately 36%)
of the pine flatwoods in its natural state. This is consistent
with Collier County Land Development Code Section 3 . 9 . 5. 5. 3 which
requires retention of at least twenty-five percent (25%) of
viable, naturally functioning native vegetation on site.
The petitioner states that no listed species were observed during
transects walked on January 27 , 1993 .
The petitioner states that no historical or archaeological
information is available for the site and that no historic sites
were observed.
V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition
PUD-93-5, "Foxfire PUD" with the following stipulations:

Water Management:
1. An Excavation Permit will be required for the proposed lake(s)
in accordance with Division 3 . 5 of Collier County Ordinance
No. 92-73 and SFWMD rules.
2 . A copy of SFWMD Permit or Early Work Permit is required prior
to final construction plan approval.
3 . At the time of final construction plans approval, it must be
demonstrated that the golf course discharge will not exceed
the capacity of the off-site ditch or proposed improvements.
Any necessary improvements to the ditch will be at the
Developer's expense. This does not exclude cost sharing by
all parties impacting discharge volumes.
4 . The PUD document shall include the above mentioned
stipulations.
Environmental:
1. A minimum of 16. 41 acres of pine flatwoods (25% of the golf
course expansion area) shall be retained in its natural state.
2 . All Collier County wellfield protection zones overlaying the
site (as identified in Collier County Ordinance No. 91-103 , as
amended) shall remain in effect unless otherwise modified by
Collier County.

This letter is written in response to recent disc s.ions that you have had with the Board of
County Commissioners for combining or abandoiii tg`certain County Advisory Boards. At
our March 3, 1993 meeting, EAi3 members discussed this matter. We passed a resolution
(5 to 0) to authorize me as Chairman to write you a letter on this matter.
It was the opinion of all I AB:.:mctml ers .pr.sent at the meeting that the EAB should
continue in existence gat, 3{:,iS toda}y :fent would be serious mistake to modify the board
or combine it with EP;TAB: .:.Thie rel sOOns are two-fold:
First of all, the EAB and EPTAB werecreated at the same time with two distinct functions.
EPTAB was to review proposed ordinances, land development code amendments, and
growth management plan amendments relating to environmental matters in land
development. This•.is a .very distinct function from the EAB. The EAB was organized to
review zaiiing and otllerlaitd development petitions which have significant environmental
impacts in Collier County.
The''cit£ ei± i c.. in these?two functions is very distinct, and separate boards should be
maintained>:to`,``i r.form:•these two distinct functions. To combine the boards would be to
combine strategic:.environmental planning with implementation of these policies through
review of land development petitions.
It may be well at times to promote interaction between the hoards to see how planning and
implementation work together. This can be easily accomplished by setting up workshops
between members of each board to, for example, give EPTAB input as to how previous
ordinances are being implemented by EAB. This could be valuable in future planning.
However, to combine the boards permanently with these two responsibilities, we feel,would
be a mistake.

The second reason has to do with the time available for board members. It must he kept
in mind that these board positions are volunteer, non-payitig::JObs. While most board
members, I am sure, are glad to give of their time, this should not be carried to an excess.
If these two hoards were combined, the time commitment's would so demanding that it
would be difficult to get good people to volunteer. :Ve tIliiikthat the scope and
responsibility of the boards should be kept to a reasonab101100::.sO that board members can
freely give of their time without being over extended.
We sincerely hope you will consider the position of this board on thi$:tilatter. We would be
happy to discuss it further with you and/or the Board of County Commissioners if you so
desire.

3. A letter of no objection from Collier County
Utility Division that no impacts on the
percolation ability of the adjacent wastewater
treatment ponds will occur as a result of the Pine
Ridge Canal relocation shall be provided prior to
subdivision construction plans approval or
Preliminary Work Authorization, which ever occurs
first.
4 . All off-site flow collection and routing
facilities shall be reviewed and approved by
Collier County Project Plan Review at the time of
subdivision construction plan approval.
5. The fixed crest weir with emergency underflow gate
which replaces the existing amil gate will be
reviewed and approved by Collier County at the
time of Cocohatchee Strand Program construction
plan approval or Preliminary Work Authorization
approval.
6. As long as Collier county has operation and
maintenance authority over the existing Pine ridge
Canal amil gates on Immokalee Road (CR 846) , WCN
or the Pelican Marsh UCDD will pay for the design
and construction costs associated with the
rehabilitation of the said amil gates. The
rehabilitation will be limited to normal
refurbishment of the gates (including the bearings
and access walks) and the gate seals (if
required) . Replacement of the gates, cradles,
structures, or foundations, if required, will not
be the responsibility of WCN or their assigns.
Collier County will contribute $9, 000. 00 to the
cost of design and construction. The
rehabilitation shall be completed by the time the
Cocohatchee slough restoration plan is certified
complete to South Florida Water Management
District.

7 . If legally and physically possible, the Pelican
Marsh Community Development District will maintain
that portion of the Pine Ridge Canal from the
north border of the PUD to a point immediately

cease at the time of final development order for
the property encompassing said portion of canal.
The District will not be responsible for capital
improvements to the canal or improvements to make
reasonable access to and along the canal possible.
9 . Section 6.8 of the PUD document shall contain the
above mentioned stipulations.
Environmental:
1. The petitioner shall contact the Florida Game and
Fresh Water Fish Commission for a "nest buffer"
recommendation for the osprey nest in the southern
portion of the site.

shall be subject to the following standards:
b) The accessway shall not be considered a road
or right-of-way, as set forth in the Collier
County Land Development Code, but rather is to
be considered a private vehicular access;
c) The accessway shall be limited to one-lane
where it crosses wetlands and shall be
widened, or provided with pull-offs in the
upland areas, to allow for two-way traffic;
d) The accessway shall have a non-asphaltic
surface;
e) The accessway shall be elevated where it
crosses jurisdictional wetlands as required by
federal and state permitting agencies;
f) The accessway shall be utilized to provide
access to limited pervious parking spaces,
boardwalks, nature trails, recreational
shelters, picnic facilities, self-contained
restroom facilities and boat launching
facilities (to include non-motorized
watercraft and/or watercraft with electric
motors only) ;

g) The accessway and associated passive
recreational facilities shall be designed to
meet the minimum stormwater management
requirements permitable by South Florida Water
Management District and;
h) Any recommendations and/or comments from the
Rookery Bay National Estuarine Research
Reserve Staff regarding the proposed accessway
and associated passive recreational facilities
shall be considered as part of the County's
development review process according to
current County codes and regulations.
2 . At the time of Preliminary Subdivision Plat
submittal, the Petitioner shall submit further
documentation, both qualitative and quantitative
in nature, based on environmental principles and
practices, which support the routing of the
north-south spine road to ensure that the location
of the crossing of the major slough area and other
naturally functioning wetlands is located and
constructed so as to minimize wetland impacts,
while acknowledging the need to address historic
hydrological considerations.
3. A conservation easement or platted tract is
required pursuant to Collier County Land
Development Code Section 3 .2 . 9 .2 . 6 for wetland
preserve/conservation areas. The final
construction shall reflect the requirements of
Collier County Land Development Code Section
3 .2 .8. 4 .7 .3, containing protective criteria
similar to those in Section 704 . 06 (1) (a-h) ,
Florida Statutes (1992) . The
preservation/conservation area (s) shall contain a
minimum of 570 acres of wetlands/mitigation areas,
the location and configuration of which shall be
subject to Collier County Project Review Staff
approval.
4 . All proposed mitigation for impacts to Collier
County jurisdictional wetlands shall comply with
Appendix 7 of the South Florida Water Management
District Rules. Mitigation areas shall be
surveyed and designated as preserve/conservation
tracts or easements on the construction plans/plat
pursuant to Sections 3 .2 . 9 .2 . 6 and 3 .2 .8. 4 . 7.3 of
the Collier County Land Development Code on the
final plat, and contain protective criteria
similar to those in Section 704 . 06 (1) (1-h) ,
Florida Statutes (1992) .

5. The applicant shall supply to Collier County
Project Plan Review all applicable wildlife
habitat management plans and/or permits,
jurisdictional determinations, waivers, and/or
information required by all applicable state and
federal agencies prior to an approval of a final
development order. Design of the golf course
layout, lakes, buildings and associated
structures, and infrastructure shall be adjusted
to comply with the requirements of all applicable
state and federal agencies.
6. Lake placement shall not impact the jurisdictional
wetlands, unless the lake or lakes are permitted
by the South Florida Water Management District to
meet the minimum stormwater management
requirements.
7. The Petitioner shall coordinate with Collier
County Project Plan Review Environmental Staff
during the clearing plan process for the golf
course to ensure that the maximum amount of native
vegetation is retained, consistent with golf
course design parameters set forth by National
Golf Association.
8. Endangered plant species and those which may be
observed during each development phase shall be
protected from injury or relocated on site. The
existing locations as well as the transplantation
locations, if warranted, shall be identified on
the site clearing plan for each phase of
construction.
9. Xeric scrub and gopher tortoise habitat areas to
be retained on-site shall be shown on the
construction plans/plat as preserve/conservation
tracts or easements pursuant to Collier County's
Land Development Code. The applicant shall be
entitled to mitigation credit for wetland impacts
for preserving/conserving xeric scrub areas. At
the time of Preliminary Subdivision Plat submittal
for areas containing gopher tortoises or suitable
gopher tortoise habitat, the applicant shall
provide Collier County Project Plan Review
Environmental Staff with applicable permits and/or
approved management plan from Florida Game and
Fresh Water Fish Commission for review for
consistency with Policy 7 . 3 . 5 of the Conservation
and Coastal Management Element of Collier County's
Growth Management Plan and Division 3 . 11 of the
Collier County Land Development Code.

10. If the subject site is within the primary or
secondary zone of protection as determined by
Florida Game and Fresh Water Fish Commission using
U. S. Fish and Wildlife Service Bald Eagle
Management Guidelines, the applicant shall submit
to Collier County Project Plan Review
Environmental Staff a Bald Eagle
Management/Protection Plan which has been approved
by the Florida Game and Fresh Water Fish
Commission prior to any preliminary subdivision
plat or preliminary site development plan approval
for those lands with the primary or secondary
protection zones.
11. The Petitioner must obtain all appropriate state
approvals for storing and handling hazardous
materials prior to construction plan approval of
the golf maintenance facilities. Petroleum
storage shall be in above ground storage
facilities constructed and maintained in
accordance with Environmental Protection Agency
and Florida Department of Environmental Regulation
standards. Prior to construction plan approval,
the Petitioner shall submit to Project Plan Review
Staff for review and comment contingency plans
approved by appropriate state and federal
agencies, where applicable, for clean up and
mitigation of unauthorized release of hazardous
materials.
12 . In order to comply with Section 3 .2 .8. 4.7 (3) of
the Collier County Land Development Code, the
applicant shall revise the following items in the
PUD document:
A) Section 3 . 4 .E. shall be revised as follows:
*Rear Yard: A parcel or lot which abuts a golf
course: zero (0' ) feet. Where a lot or parcel
abuts a natural area identified for preservation:
zero (0' ) feet, provided buffering required by
South Florida Water Management District is
accommodated. Where a lot or parcel abuts a lake:
zero (0' ) feet may be allowed providing approval
is obtained from Project Plan Review at the time
of subdivision construction plans submittal.
B) Section 5.3 .N. (Table 1) Notes, shall be
revised as follows: **Rear Yard: a parcel or lot
which abuts a golf course: zero (0' ) feet. Where
a lot or parcel abuts a natural area identified
