Environmental Advisory Board Michel Saadeh, Chairman Page 2 Item V. I. ENVIRONMENTAL ADVISORY BOARD STAFF REPORT MEETING OF NOVEMBER 3 , 1993 I. NAME OF PETITIONER/PROJECT: Petition No. : ST-93-13 Petition Name: "Morris Single Family Residence" Applicant/Developer: Debi Kay Lee, agent for Mark Morris II. LOCATION: The parcel is located on Tamiami Trail East (U. S. 41) in Section 16, Township 53 South, Range 33 East; bounded on all sides by the Big Cypress National Preserve. III. PROJECT DESCRIPTION: The subject property is a 1. 48 acre parcel zoned CON-ACSC/ST on U.S. 41 in the Big Cypress National Preserve. The petitioner proposes to demolish an existing wood frame house and construct a single family stilt residence, septic system and driveway extension, with alterations limited to 9 . 3% of the site. Plan of Record: Environmental: Site plan submitted by Debi Kay Lee dated 6/27/93 , as revised on 10/7/93 . IV. STAFF COMMENTS: Environmental: A site inspection was conducted on October 20, 1993 by Stephen Lenberger and Fred Reischl, County Environmental Staff and Debi Lee, agent for the property owner. The property involved is located in a cypress wetland about 2 miles north of Roberts Strand in the Big Cypress National Preserve. The dominant vegetation in the surrounding swamp consists mainly of cypress (Taxodium sp. ) and saw grass (Cladium lamaicense) . Other types of vegetation in the swamp included pond apple (Annona glabra) , willow (Salix sp. ) , arrowhead (Sagittaria sp. ) , maidencane (Panicum hemitomon) , glades lobelia (Lobelia glandulosa) , climbing hempvine (Mikania scandens) , moonvine (Ipomoea alba) and primrose willow (Ludwigia peruviana) . The water in the swamp averaged about a foot deep and various species of fish could be seen in the water. Water clarity was very good. EAB Meeting 11/3/1993 ST-93-13 Page 2 The subject property contains both natural forested wetlands and an area of pre-existing fill. The fill site is apparently mowed on a regular basis and was covered mainly with lawn grasses interspersed with a variety of roadside weeds. Standing water was observed in places on the fill area. The petitioner proposes to construct a house, septic system and gravel driveway extension within the existing fill area on the property. The petitioner also proposes to demolish a wooden house presently located in wetlands on site. Since the owner proposes impacts that are less than ten percent of the site, this petition qualifies for an exception per Collier County Land Development Code, Section 2 . 2 . 24 . 8 . 2 . V. RECOMMENDATIONS: Staff recommends approval of Special Treatment Development Permit No. ST-93-13 with the following stipulations: Environmental: 1. Permits or letters of exemption from the Department of Environmental Protection (DEP) , South Florida Water Management District (SFWMD) , U. S. Army Corps of Engineers (ACOE) and the Big Cypress National Preserve, shall be presented prior to issuance of County Building Permit. 2 . Minor changes may be administratively approved by the Site Development Review Director or his/her designee. 3 . Upon issuance, the building permit is subject to a forty-five (45) day appeal period by the Florida Department of Community Affairs.
