entire twenty-seven (27) acre parcel. The site
shall be maintained exotic free in perpetuity.
PETITION NO: Commercial Excavation Permit No. 59.224,
"Swamp Buggy Days"

REQUESTING: The project in question was issued a permit by
Collier County on September 3 , 1986. The excavation
activities started, but were discontinued and never
completed with the approved permit. The petitioner
is requesting that the Board of County Commissioners
allow the excavation in its current condition {i.e.
four to five feet (4 ' to 5 ' ) deep} since rock exists
at an average of five feet (5 ' ) depth.

2 . The existing Cypress Dome shall be fenced for
access control, in conformance with the
requirements of the Department of Environmental

shall be granted by the owner as a conservation
easement consistent with the requirements of the
Land Development Code.
3 . The owner shall post restrictive access signage
around the excavation area to prohibit use by
any fuel powered vehicles.
PETITION NO: Planned Unit Development, PUD-92-8
"White Lake Industrial Park"

Environmental Advisory Board.

be filed with Collier County prior to January 1,
1993 . If a report is not filed, the excavation
permit will be considered void in accordance
with the Land Development Code and a complete
resubmission will be necessary.
3 . The water management plan shall be revised to
discharge northerly to the Golden Gate Canal.
If the discharge is in a southerly direction, a
complete analysis of the outfall route shall be
made and be submitted to, and approved by
Project Plan Review. This analysis shall
include a study of the physical and legal means
by which this project would discharge in a
southerly direction. Documentation shall also
be provided to show that the Tollgate Commercial
project has capacity to handle the discharge
from the subject petition.
Environmental:
1. Revise PUD document Section 2 . 10 to include
Collier County Land Development Code Division
3 . 9 .
2 . Wetland preserve/conservation areas shall be
surveyed prior to construction plan/plat
approval. A conservation easement similar to or
as per Chapter 704 . 06 Florida Statutes shall be
created and indicated on the plat, and shall be
recorded in the public records of Collier
County.
3 . If required by Florida Game & Fresh Water Fish
Commission, a management plan for retention of
Big Cypress fox squirrel habitat and/or
red-cockaded woodpecker forage habitat shall be

RESOLUTION
SUPPORTING THE PROPOSED OUTSTANDING FLORIDA WATER DESIGNATION
FOR THE WIGGINS PASS/COCOHATCHEE RIVER AREA
WHEREAS, The Conservancy, Inc. has submitted a petition to the Florida
Department of Environmental Regulation proposing the designation the
Wiggins Pass/Cocohatchee River (WPCR) area as Outstanding Florida
Waters (OFW); and
WHEREAS, the intent of an OFW designation is to maintain existing water quality
standards through the application of higher permitting standards; and
WHEREAS, an OFW designation for the WPCR area would form a linkage between
the Estero Bay Aquatic Preserve OFW to the north and the Delnor
Wiggins Pass State Recreation Area OFW to the south; and
WHEREAS, protection of existing water quality is essential to ongoing and future
recreational use by residents and visitors and to protect the health of
such residents and visitors; and
WHEREAS, protection of existing water quality is essential to maintaining the
natural processes within the WPCR area which contribute to sustaining
the productive feeding and nursery grounds for fishes, shellfish, birds;
and
WHEREAS, maintaining existing water quality will contribute to the protection of
habitat for the endangered West Indian manatee, bald eagle, and least
tern; and
WHEREAS, the maintenance of water quality and its associated benefits to both
people and wildlife considerably the enhance economic value of the
WPCR area;
NOW THEREFORE, be it resolved on this date that the Environmental Advisory Board has
taken action to support the OFW designation of the WPCR area.

II. LOCATION:
The site is located north of State Road 41 at 50 mile bend within
Sections 13 , 14 and 15, Township 53 South, Range 34 East, Collier
County, Florida.
III. PROJECT DESCRIPTION:
The petitioner requests an exception to the Special Treatment
Development Permit to install new poles for a power line on
property in Sections 13 , 14 and 15, Township 53 South, Range 34
East, Collier County, Florida.
Plan of Record:
Florida Power and Light site plan dated 4/17/92 , two revisons.
IV. STAFF COMMENTS:
The proposal is to drill holes for new poles adjacent to existing
poles. The two poles will be tied together and the facilities
will be transferred to the new poles. The old poles are being
replaced due to extensive damage as a result of woodpecker
nesting. By leaving the old poles in place, less disruption of
the wetland habitat will occur and the woodpecker nests remain.
Access to the power line would be limited to the route of the
existing pole line, which is clear of trees but vegetated with
herbaceous wetland species. Caution would be taken when turning
the vehicles to avoid damaging any native hardwoods.
V. RECOMMENDATIONS:
Staff recommends approval of Special Treatment Development Permit
No. ST-92-21 with the following stipulations:
1. Access shall be limited to the existing cleared power pole
line route.

2 . Prior to the commencement of construction activities, the
petitioner shall obtain any necessary permits from Florida
Department of Environmental Regulation, South Florida Water

II. LOCATION:
Western terminus of Seagate Drive @ Collier County Clam Pass Beach
(See Attached Sketch prepared by Collier County Parks and
Recreation Staff of the Clam Pass Concession) . Section 9,
Township 49 South, Range 25 East, Collier County, Florida.
III. PROJECT DESCRIPTION:
The applicant proposes to leave forty (40) beach cabanas on the
beach twenty-four (24) hours per day, seven (7) days per week in
the approximate locations identified on the above referenced
sketch, during the non-nesting sea turtle season (November 1 thru
April 30) .
The proposed request complies with the requirements of Section
3 . 13 .7 . 3 of the Collier County Land Development Code (LDC) , since
the beach cabanas are (1) not fixed (2) each weighs less than one
hundred (100) pounds, and (3) they pose no actual or potential
threat to the beach and the dune system and adjacent properties.
According to Section 3 . 13 .7 .4 of the LDC, if a written request for
appeal regarding an exemption request is submitted within ten (10)
days after said Notice of the Exemption Certificate application is
advertised in a local newspaper (once per week for two consecutive
weeks) or after staff's decision is rendered the request is
reviewed by the Environmental Advisory Board (EAB) . In this
particular petition (EC-92-1) four (4) written request were
received; therefore, the EAB shall render a final decision to
affirm, overrule or modify staff's decision.
IV. STAFF COMMENTS:
The portions of the beach that the applicant proposes to leave the
cabanas on is a fairly undisturbed section of the Collier County
coastline characterized by a wide dune and back barrier area
stabilized by coastal vegetation.

Due to the tropical storm in June and the strong northeasterly
winds resulting from hurricane Andrew in August the open sandy
beach, estimated at low tide, has been significantly reduced in
width from approximately sixty-five (±65) feet to less than forty
(40) feet. Also, as a result of the changes in beach dynamics
over the past four (4) months, the coastal vegetation has
proliferated along the fore dune.
The proposed request does have alternative actions (i.e.
replacement of cabanas) ; therefore, the activity does not require
a permanent Exemption Certificate to the Coastal Construction
Setback Line. Staff recommends that a fair amount of time to
replace cabanas would be three (3) seasons. If a few of the
original cabanas are still remaining after the end of the third
season they can be moved manually from the beach.
V. RECOMMENDATIONS:
Staff recommends approval of petition EC-92-1 subject to the
following conditions:
1. This certificate must be kept on site, and be available for
inspection by County, State and Federal officials.
2 . This certificate does not obviate the need for other permits
of other County, State and Federal jurisdictional agencies.
NOTE: Prior to the issuance of this Certificate a Florida
Department of Natural Resources permit or documentation that a
permit is not required shall be submitted.
3 . In the event that the natural beach dynamics change
significantly over a short period of time, the Project Plan
Review Environmental Staff shall notify the applicant
immediately to discuss possible alternative actions verses the
original permitted action. If one or more of these
alternative actions appears to be more conducive to the
natural beach dynamics, the applicant shall be required to
revise his or her Exemption Certificate to reflect the most
appropriate action.
4 . The activity shall not be on any portion of a dune or impactt
on any native coastal vegetation.
5. If any changes of the conditions in the application or
certificate are anticipated, another application shall be
submitted to Collier County Project Plan Review, and a new
Exemption Certificate shall be obtained prior to further
activity.
6. A deviation from the Exemption Certificate conditions shall
cause to void said certificate.

7 . The forty (40) cabanas shall gradually be replaced by
lightweight, portable cabanas by April 30, 1995. This
Exemption Certificate to the Coastal Construction Setback Line
shall expire on April 30, 1995, 7 : 00 p.m.
8. A Certificate of Exemption for the Operation of Vehicles on
Collier County Beaches must be obtained annually in order for
this Exemption Certificate to be applicable. The Certificate
of Exemption for the Operations of Vehicles on Collier County
Beaches shall be renewed, providing conditions remain
unchanged, at no fee.

by U.S. 41, on the south by the Micelli PUD and on the north by
the Naples R & D Park PUD.
III. PROJECT DESCRIPTION:
The petitioner requests to rezone the subject 3 . 02 acre parcel
from "A" to "C-4" . The petitioner is asking for a full range of
uses allowed by the C-4 zoning district.

IV. STAFF COMMENTS:
Water Management:
The on-site water management system will consist of a ±0. 31 dry
detention area that will discharge via a control structure into a
drainage canal that runs along the northwest property line. There
currently exists a twenty (20) foot easement on the subject
property.

The drainage canal accepts runoff from a portion of Naples Manor
which is then conveyed under U. S. 41 by a fifty-four (54) inch
pipe. The Water Management Department is proposing an easement
with a total width of eighty (80) feet. The exact width will be
determined during the design phase of this project along with the
Naples R & D Park PUD to the north and the proposed Lely Lakes PUD
which will accept the discharge from this project.
This project will meet South Florida Water Management District
rules for water quality.
Environmental:
The project lies within the watershed of the Rookery Bay System.
There is an existing drainage canal approximately twenty (±20)
feet in width along the northwest property line. The stormwater
flows across the site in a northeast to southwest direction.
Ground elevations within the project range from 5. 0 to 5.8 NGVD.
The soil type on the project consists entirely of Holopaw fine
sand, limestone substratum which has been classified as hydric.
Most of the site may be characterized as upland except where the
drainage canal is located. As part of this rezone request the
drainage canal is not going to be impacted.
Vegetation within the upland consists of slash pine (Pinus
elliottii) , cabbage palm (Sabal palmetto) , java plum (syzygium
cumini) , acacia (Acacia auriculiformis) , live oak (Quercus
virginiana) , melaleuca (Melaleuca spp. ) , wax myrtle (Myrica
cerifera) , Brazilian pepper (Schinus terebinthifolius) , saw
palmetto (Serenoa repens) and herbaceous groundcover.
Approximately two-thirds of the upland consists of all three
vegetation strata (canopy, midstory and groundcover) . Staff
recommends that 0. 5 acres should be an appropriate amount of
retained native habitat to be preserved on site.
V. RECOMMENDATIONS:
Based on Section 3 . 9 . 5. 5 of the Collier County Land Development
Code, Staff recommends approval of rezone petition East Trail,
R-92-8 with the following stipulations:
Water Management:
1. The ultimate width of the drainage easement along the
northwest property line, as indicated by the Collier County
Water Management Department, is eighty (80) feet. There
currently exists a twenty (20) foot easement on the property.

This easement width will have to be increased with the final
width to be determined with the final design of this project
and the proposed Lely Lakes. The petitioner is therefore put
on notice that additional lands will be required to be
dedicated as a drainage/access easement during the site
development phase of this project. The petitioner should
coordinate their design with Project Plan Review and the
Collier County Water Management Department.
Environmental:
1. Petitioner shall retain a minimum of 0. 5 acres of existing
native habitat on site. The retained natural canopy
understory and groundcover shall be maintained in perpetuity.
Flexibility in the retainment/preserve areas may be allowed if
during the site development plan/construction plan reviews
such flexibiltiy is necessary to accommodate both preservation
of habitat and project design.
2 . Protected species surveys shall be required for all subsequent
final construction plans and or site development plans
submitted to the County for approval.

II. LOCATION:
Section 24 , Township 49 South, Range 25 East; bounded on the north
by World Tennis Center PUD, on the south by Golden Gate Parkway,
on the east by Livingston Road and on the west by Airport Road.
III. PROJECT DESCRIPTION:
The phase I portion of the Grey Oaks PUD/DRI consists of 517
acres. The proposed development consists of an 18 hole golf
course and 224 single family and multi-family units. Access to
the project is provided from Airport road and Livingston Road.
The subdivision master plan is being amended, to add another lake
(Lake #19) to the project.
Plan of Record:
Water Management:
"Grey Oaks - Phase One, Master Water Management Plan" , prepared by
Wilson, Miller, Barton & Peek, Inc. , dated October 17 , 1992 , five
(5) revisions.
IV. STAFF COMMENTS:
Water Management:
The original subdivision master plan SMP-90-16, was reviewed and
approved by the Water Management Advisory Board on the meeting of
August 8 , 1990 . The proposed amendment is for an addition of a
lake (Lake #19) in Phase One. The developer is proposing this
addition to provide an aesthetics backdrop/buffer to the proposed
golf course putting course, as a future water management detention
area, and also as a means to obtain needed fill. Since this lake
was not approved before as part of any master plan, it is
necessary to be reviewed and approved by the EAB.

V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat
Amendment Petition No. PSP-90-16, Grey Oaks - Phase One with the
same stipulations as approved under SMP-90-16. The stipulations
are as follows:
Water Management:
1. Detailed paving, grading and site drainage plans shall be
submitted to Project Plan Review for review. No construction
permits shall be issued unless and until approval of the
proposed construction in accordance with the submitted plans
is granted by Project Plan Review.
2 . In accordance with the Rules of the South Florida Water
Management District, (SFWMD) Chapters 40E4 and 40E-40, this
project shall be designed for a storm event of 3-day duration
and 25-year return frequency.
3 . Design and construction of all improvements shall be subject
to compliance with the appropriate provisions of the Collier
County Land Development Code Division 3 . 2 .
4 . An Excavation Permit will be required for the proposed lake(s)
in accordance with Collier County Ordinance 92-102 , Division
3 . 5 and SFWMD rules. The lake setbacks, side slopes and depth
shall be in full compliance with Division 3 . 5, of the Land
Development Code.
5. A copy of SFWMD Permit of Early Work Permit is required prior
to construction plan approval.
6. Landscaping shall not be placed within the water management
areas unless specifically approved by Project Plan Review.
7 . Pursuant to the PUD document, provide an executed agreement
between the applicant and the Big Cypress Basin regarding the
maintenance regarding the maintenance responsibilities for
Airport Road Canal.
8 . The master water management plan identifies a "landscape"
island in the middle of the Airport Road Canal. Provide
documentation from the Big Cypress Basin stating they have no
objection to this.
9 . Prior to final construction plan approval provide a copy of
the South Florida Water Management District right-of-way
permit for water management facilities being constructed
within their right-of-way.

10. Prior to submission of the construction plans, provide a copy
of the South Florida Water Management District Conceptual
Permit.
Environmental:
1. Water management features (lakes) shall be controlled at or
above the historic mean high-water elevation of any wetland
within two hundred (200) feet. This elevation shall be
determined from a professional survey utilizing lichen lines
or other biological indicators as field verified and agreed
upon by the applicant's representative and Collier County
Project Plan Review Manager.
2 . Criteria for establishing wetland rations shall be determined
by Collier County as outlined in thee Districts "Basis of
Review For Surface Water Management Permit Applications" ,
Chapter 40E-4 , Appendix 7 , Isolated Wetlands.
3 . Mitigation plans proposed in wetlands to be preserved,
restored, enhanced shall include a description of the area
(location and size) , vegetation proposed to be planted, source
of vegetation (transplantation from impacted areas preferred) ,
hydrologic regime, exotic vegetation removal, monitoring and
maintenance program. Mitigation proposed in upland areas
shall emphasize the retention of existing vegetation and shall
focus on establishment of native vegetative "communities" .
Lakes mitigation in the lakes designated on construction plans
shall include littoral zone plantings of native, aquatic
vegetation.
4 . Protective wetland covenants pursuant to Florida statute,
Chapter 704 must occur on the cover of the plat.
5. All final wetland areas as a result of Collier County
permitting and mitigation and/or as required to be platted by
Army Corps of Engineers, Department of Environmental
Regulation, South Florida Water Management District, must be
indicated on the plat as a conservation easement that is
dedicated to the property owners association to be maintained
and monitored per the appropriate agency permit criteria and
to Collier County with no responsibilities for maintenance.
6. All jurisdictional wetlands may be used for stormwater
retention and all buffers around protected wetlands must meet
SFWMD specifications.
7. Documentation of dredge and fill permits shall be required for
any impacts to jurisdictional wetlands prior to the
pre-construction meeting.

8 . Petitioners must depict on the construction plans, site
clearing plan, the twenty-five (25) percent of viable,
naturally functioning vegetation to be retained within the
entire Grey Oaks PUD prior to construction plan approval for
Phase I .
9 . Petitioner shall be subject to collier County Growth
Management Plan, Conservation and Coastal Element Policies
7 . 3 . 4 , 7 . 3 . 6 and 7 . 3 . 8 .
