IV. PROJECT DESCRIPTION:
Falling Waters north preserve is a multi-family residential development located within the
eastern half of the Village Place PUD. The proposed project contains 90 multi-family
condominium units, pool and clubhouse, water management lakes and preserve area.

V. STAFF COMMENTS:
Water Management:
The improvements within the subject parcel drain into a wetland preserve along the south
side of the parcel. That preserve is connected hydraulically to the preserve at the NE
corner of Tarpon Cove PUD. There is a narrow sliver of RSF 4 zoned land between the
subject parcel and Tarpon Cove; and the Livingston Road E-W extension may eventually
be constructed along the southern boundary of this parcel. In either case, the hydraulic
continuity must be maintained.
The internal water management is standard for project of this type and employs a system
of non-interconnected lakes for water quality retention and water quantity peak flow
attenuation.
The subject parcel is the eastern half of the Old Village Place PUD which had a SFWMD
permit. This project will be required to modify that permit or obtain a new permit.
The district is aware of runoff quantity concerns in this area of this basin.
Environmental:
The subject property is an undeveloped 30.9 acre parcel located on the west side of U.S.
41 approximately one-half mile north of Wiggins Pass Road. Habitats on site include pine
and scrubby flatwoods, wet prairie, freshwater marsh and cypress forest. Hydrology on

the subject property is good with a minimal amount of exotic vegetation within the
wetland areas. Downy rosemyrtle has invaded portions of the pine flatwoods near the
road. See attached plant list for additional species found on site.
Approximately 18.0 acres of Collier County jurisdictional wetlands occur on the subject
property. These include wet prairie (10.2 acres), cypress forest (6.7 acres) and freshwater
marsh (1.1 acres). Development is mostly confined to the upland portions of the site.
Impacts to jurisdictional wetlands are shown on sheet 12/12 on the site development plan.
Approximately 0.9 acres of Collier County jurisdictional wetlands will be impacted by the
proposed project.
Soils on the site include Immokalee Fine Sand, Myakka Fine Sand, Rivera Fine Sand and
Rivera Find Sand, Limestone Substratum. Soils, FLUCCS and contour maps are found on
sheet 12/12 of the site development plan.
Gopher tortoises (Gopherus polyphemus) were the only listed wildlife species found on
the subject property. A total of six gopher tortoise burrows were identified. Gopher
tortoise burrows located within the development footprint will be excavated and the
gopher tortoises and commensals will be relocated to appropriate habitat within the
enhanced and preserved pine and scrubby flatwoods on site. No other U.S. Fish and
Wildlife Service (USFWS) or Florida Game and Fresh Water Fish Commission
(FGFWFC) listed plant or animal species were found by the petitioner.
The subject property is located within an area of historical/archaeological probability as
indicated on the historical/archaeological probability maps for Collier County, Florida.
The petitioner will need to submit an historical/archaeological survey and assessment as
required in section 2.2.25.3.7 of the Collier County Land Development Code
(CCLDC).Waiver requests are addressed in Section 2.2.25.3.10 CCLDC.
VI. RECOMMENDATIONS:
Staff recommends approval of Minor Site Development Plan No. SDP-96-151 "Falling
Waters North Preserve" with the following stipulations:
Water Management:
1. That a SFWMD permit or permit modification be secured prior to issuance of a
Final Site Development Plan Approval.

1. The Final Site Development Plan shall be submitted to the Environmental Advisory
Board for review and approval.
2. Permits or letters of exemption from the U.S. Army Corps of Engineers (ACOE)
and the South Florida Water Management District (SFWMD) shall be presented
prior to Final Site Development Plan approval.
3. All conservation areas shall be recorded as conservation/preservation tracts or
easements dedicated to an approved entity or to Collier County with no
responsibility for maintenance and subject to the uses and limitations similar to or as
per Florida Statutes Section 704.06.
4. Buffers shall be provided around wetlands, extending at least fifteen (15) feet
landward from the edge of wetland preserves in all places and averaging twenty-five
(25) feet from the landward edge of wetlands. Where natural buffers are not
possible, structural buffers shall be provided in accordance with the State of Florida
Environmental Resources Permit Rules and be subject to review and approval by
Current Planning Environmental Staff.
5. A Gopher Tortoise relocation/management plan shall be submitted to Current
Planning Environmental Staff for review and approval. A copy of the
relocation/management plan shall be included on the Final Site Development Plan.
6. Petitioner shall submit copies of approved gopher tortoise permits prior to or at the
pre-construction meeting.

V. STAFF COMMENTS:
Water Management:
The water management system to serve the project will consist of an interconnected lake
system. Runoff from the developed areas will be conveyed to the lakes by sheetflow,
catch basins, and culvert systems. The lakes will then discharge through control structures
into the Vanderbilt Beach right-of-way. This discharge will be conveyed to the west by
the Vanderbilt Beach swale into the 1-75 canal and then south to the Golden Gate canal.
The proposed discharge from the site will be 38.6 cfs at a rate of 0.06 cfs/acre.
Offsite flows from the north will be accommodated pursuant to the recommendations of
the Harvey Basin Master Plan. This will be accomplished by passing runoff through or
around the perimeter of the project or a combination thereof. The details of the best
design are being developed at this time.
Pursuant to the Island Walk PUD document, removal of fill and rock from Island Walk
can be permitted up to 500,000 cubic yards subject to the receipt of a commercial
excavation permit. If a commercial excavation permit is required, the permit can be
administratively approved by the Collier County Development Services Director or his
designee.

This project will be permitted by the South Florida Water Management District
(SFWMD).
Environmental:
The project site consists mainly of active farm fields, drainage ditches and agricultural
facilities. A single two acre wetland is located in the northeast portion of the property and
will be preserved in its entirety. Vegetation within the wetland is composed mainly of
coastal plain willow (Salix caroliniana) and arrowroot (Thalia geniculata). The adjacent
preserved wetland within Dove Pointe is less disturbed and includes cypress (Taxodium
sp.), red maple (Acer rubrum), strangler fig (Ficus aurea), pond apple (Annona glabra) and
coastal plain willow. A Vegetation/FLUCCS map for the subject property is found on
map F of the Island Walk DRI Application for Development Approval.
Listed species found on the subject property include wood stork (Mycteria americana),
snowy egret (Egretta thula), little blue heron (Egretta caerulea) and white ibis (Eudocimus
albus). Map G of the Island Walk DRI Application for Development Approval includes
listed species survey information.
The soil types on the site generally include Holopaw fine sand, Malabar fine sand, Riviera
limestone substratum, Copeland fine sands, Pineda fine sand, and Boca limestone
substratum. Soil Conservation Service mapping of soil types is shown on Map E of the
Island Walk DRI Application for Development Approval.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition
No. PUD-96-14/DRI-96-I "Island Walk" with the following Stipulations:
Water Management:
1. A copy of the SFWMD Surface Water Permit with staff report is required prior to
construction plan approval.
2. An Excavation Permit will be required for the proposed lakes in accordance with
Division 3.5 of Collier County Ordinance No.91-102 as amended and SFWMD
rules.

1. Amend Section 2.3(A) of the PUD document to read as follows by adding the
underlined language:
2.3 GENERAL COMPLIANCE WITH COUNTY ORDINANCES
A. Regulations for development of Island Walk shall be in accordance with the
contents of this PUD Ordinance and applicable sections of the LDC (to the
extent they are not inconsistent with this PUD Ordinance) and Collier
County Growth Management Plan which are in effect at the time of
issuance of any development order to which said regulations relate which
authorizes the construction of improvements, such as but not limited to Final
Subdivision Plat, Final Site Development Plan, Excavation Permit and
Preliminary Work Authorization. Where this PUD Ordinance, or
subsequently adopted Community Design Guidelines and Standards, does not
provide developmental standards, then the provisions of the specific section
of the LDC that is otherwise applicable shall apply.

V. STAFF COMMENTS:
Water Management:
Berkshire Lakes is currently permitted under a conceptual South Florida
Water Management District Permit No. 11-00364-S. A modification will be
made to the SFWMD conceptual permit for Parcel "E" development. Under
the conceptual approval, the proposed control elevation for Parcel "E"
is 9 . 0 ' N.G.V.D. with discharge to the Golden Gate Canal via the Santa
Barbara Boulevard roadside ditch.
The proposed 23 acre lake has been permitted under Collier County
Excavation Permit No. 59 . 192 and the lake will be complete prior to
final construction plans for this site. The 23 acre lake will provide
water quality treatment and surface water storage for the 150 acre site
(Parcel "E") . The proposed water control structure will be located at
the northwest corner of the site for direct discharge to the Santa
Barbara roadside swale. The water control structure will provide for
bleed-down via one rectangular notch weir (width = 1 . 66 feet, invert
elevation = 9 . 00 ' N.G.V. D. , crest elevation = 11. 50 ' N.G.V.D. ) . The 3-
day, 25-year storm peak discharge is 19 . 04 cfs at elevation 11. 27 '
N.G.V.D. The minimum road centerline elevation will be set at 11. 50 '
N.G.V.D. above the 3-day, 25-year peak elevation. The 3-day, 100-year
storm peak elevation at zero discharge is 12 . 05 ' N.G.V. D. The proposed
floor elevation will be a minimum 12 . 50 ' N.G.V. D.

Environmental:
The subject property is approximately 150 acres with an existing rock
mining/ excavation and cleared roadways onsite which cover about 40
acres. Native habitats and the boundaries were mapped and studied for
wetland and wildlife issues.
No wetlands were claimed on-site by South Florida Water Management
District through a permit process that has been under review through the
DRI . There were no wetlands claimed by the Army Corps of Engineers
during a recent site visit conducted with Wilson, Miller, Barton & Peek
Environmental Staff . Groundwater data was requested by the ACOE to
make a final determination.
The majority of the site is comprised of Pine Flatwoods with varying
understory dominated by of saw palmetto (Serenoa repens) , wax myrtle
(Myrica cerifera) , gallberry (Ilex glabra) and hog plum (Prunus sp. ) in
some areas and wax myrtle, dahoon holly (Ilex cassine) , cabbage palm
(Sabal palmetto) and wiregrass (Aristida stricta) in remaining areas.
Approximately twenty acres of Saw Palmetto Prairie exists on site
with a dominant canopy of slash pine (Pinus elliotti) giving less than
ten percent area cover, and a midstory of saw palmetto, gallberry, hog
plum and wax myrtle throughout. Active and inactive gopher tortoise
(Gopherus polyphemus) burrows were observed in this FLUCCS area. It was
estimated that the tortoise population is less than ten due to the
identified twelve active burrows and three inactive burrows.
A Gopher Tortoise Relocation Permit was issued on October 9 , 1996 by
Florida Game and Fresh Water Fish Commission for the excavation of five
burrows and relocation of one tortoise found in an area approved for
additional stockpiling. A wildlife survey for that area had been
conducted in December of 1995 and again in May 1996 in conjunction with
the clearing for additional stockpiling. The identified active and
inactive burrows and locations varied considerably from one survey to
the next possibly caused by unusually heavy rains over the past couple
of years causing the tortoise to abandon burrows and relocate to new
areas. Because of this known change on this small area of the property
Staff believes it is necessary to re-survey for tortoise immediately
prior to any approved activity or site improvement throughout Tract E.
A gopher tortoise preserve was designated at the northeast corner of the
property and currently houses the previously relocated tortoise.
Red-Cockaded woodpeckers have known cavity trees and foraging habitat
along the Radio Road corridor and on adjacent and nearby properties.
The pine flatwoods were subjected to an intense search for both cavity
trees and the species use of the property. No RCW active, inactive or
abandoned cavity trees or individuals were observed on site.

No other listed species were observed on site.
Thirty three acres of existing native vegetation shall be preserved on
site; identified at the appropriate phase of development and platted
with protective covenants. The gopher tortoise preserve will also be
protected with the appropriate platting and covenants.
I. RECOMMENDATIONS:
Staff recommends approval of PSP-96-15 with the following stipulations:
Environmental:
1. Prior to final approval of PSP-96-15 the petitioner shall either: 1)
show retention of 25% of the existing native vegetation on Phase One
and 25% on each subsequent Phase as it is submitted for development
order approval or 2) shall show the 33 acres of required native
vegetation for all of Parcel E on PSP-96-15 . These areas shall be
defined as preservation or conservation tracts and shall be platted
with protective covenants similar to or per Florida Statute 704 . 06.
2 . Submit an updated aerial for the EIS with current land conditions
shown. (i . e. cleared stockpile area and cleared roads) .
3 . Amend the Parcel E Master Plan, submitted with the EIS, to show the
Gopher Tortoise preserve. This tract shall be platted with
protective covenants similar to or per Florida Statute 704 . 06.
4 . Prior to approval of the final Plat and Construction Plans for Phase
One, the petitioner shall submit an updated Gopher Tortoise Survey,
relocation plan and necessary agency permits.
5. At the time of subsequent Development Order submittals the petitioner
shall submit updated Gopher tortoise Surveys, relocation Plans and
necessary agency permits.
6 . Amend the Parcel E Master Plan Land Use Summary for the
EIS. The Green Space/ Park designation shall be renamed as
Preservation or Conservation.
7 . Revise sheet three of four and sheet four of four of the PSP Site
Plan to correctly name all retained native vegetation tracts as
Preservation or Conservation. In Phase One, the Common Area/ Buffer
shall be renamed accordingly.
8 . Amend sheet three of four of the PSP Site Plan to show the Gopher
Tortoise Preserve.

Whistler's Cove is a multi-family affordable housing project with 240 rental apartments,
recreational clubhouse, water management lake and preserve areas.

V. STAFF COMMENTS:
Water Management:
The water management system is typical for projects of this type. It employs a 1.9 acre
lake for water quality retention and peak flow attenuation. A perimeter berm with a top
elevation set to the 25 yr. 3 day storm elevation will be constructed around the site. The
discharge is into a 1.0 acre enhanced preserve which discharges into the U.S. 41 (FDOT)
drainage canal. The project is within the C-4 canal basin (0.15 CFS/AC.) but adjacent to
the Lely Manor Canal Basin.
Environmental:
The subject property is an undeveloped 24 acre parcel located on the north side of U.S.
41, immediately south of the Naples Manor subdivision. The site contains both hydric and
non-hydric flatwoods. Most of the plant diversity on site is concentrated in the two saw
palmetto islands and along the drainage ditch which bisects the property. Melaleuca has
invaded the hydric pine flatwoods. See attached plant list for plant species found on the
subject property.
Approximately 22 acres of Collier County jurisdictional wetlands occur on the subject
property. Seventy-five per cent (16.5 acres) of these wetlands will be impacted by the
proposed project.

Four soil types were identified on the site. These include Immokalee Fine Sand, Holopaw
Fine Sand, Urban Land Immokalee Oldsmar Limestone Substratum Complex and Pineda
Fine Sand, Limestone Substratum. A soils map for the project site is included in the
environmental impact statement.
No U.S. Fish and Wildlife Service (USFWS) or Florida Game and Fresh Water Fish
Commission (FGFWFC) listed plant or animal species were observed on the subject
property by the petitioner. Fox Squirrels have been observed on the property immediately
to the east.
The project site contains a known archaeological site as identified in the
historical/archaeological probability maps for Collier County. The petitioner has submitted
an archaeological survey and assessment as required in section 2.2.25.3.3 of the Collier
County Land Development Code.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-96-13
"Whistler's Cove" with the following stipulations:
Water Management:
1. An FDOT drainage connection permit must be obtained prior to the preconstruction
conference.
Environmental:
1. Replace Section 2.2.(A) of the PUD with the following stipulation:
Regulations for development of Whistler's Cove PUD shall be in accordance with
the contents of this document, PUD-Planned Unit Development District and other
applicable sections and parts of the Collier County Land Development Code and
Growth Management Plan in effect at the time of issuance of any development order
to which said regulations relate which authorizes the construction of improvements,
such as but not limited to Final Subdivision Plat, Final Site Development Plan,
Excavation Permit and Preliminary Work Authorization. Where these regulations
fail to provide developmental standards then the provisions of the most similar
district in the County Land Development Code shall apply.

2. Amend Section 3.4(G) of the PUD document to read as follows by adding the
underlined language and deleting the strike through language:
As required within Division 2.4 of the Collier County Land Development Code.;
except that required landse-aping a+PUD perimeter buffers located within Natural
Habitat Preserve Areas may be relocated within other areas of the Natural Habitat
Preserve Areas, with approval of the County Landscape Architect at the time of Site
Development Plan approval. If landscape buffers are determined to be necessary
adjacent to preserve areas, they shall be separate from preserve areas.
3. Add the following stipulations to Section IV of the PUD document:
a) Environmental permitting shall be in accordance with the state of Florida
Environmental Resource Permit rules and be subject to review and approval by
Current Planning Environmental Review Staff. Removal of exotic vegetation
shall not be counted towards mitigation for impacts to Collier County
jurisdictional wetlands. Any additional mitigation, that may be recommended by
the Environmental Advisory Board (EAB) and approved by the Board of County
Commissioners, above that proposed with this petition shall be submitted with
the Site Development Plan/Construction Plan Package for review and approval.
b) All conservation areas shall be designated as conservation/preservation tracts or
easements on all construction plans and shall be recorded on the plat with
protective covenants per or similar to Section 704.06 of the Florida Statutes.
Buffers shall be provided in accordance with 3.2.8.4.7.3 CCLDC.
In the event the project does not require platting, all conservation areas shall be
recorded as conservation/preservation tracts or easements dedicated to an
approved entity or to Collier County with no responsibility for maintenance and
subject to the uses and limitations similar to or as per Florida Statutes Section
704.06.
c) Buffers shall be provided around wetlands, extending at least fifteen (15) feet
landward from the edge of wetland preserves in all places and averaging twenty-
five (25) feet from the landward edge of wetlands. Where natural buffers are not
possible, structural buffers shall be provided in accordance with the State of
Florida Environmental Resources Permit Rules and be subject to review and
approval by Current Planning Environmental Staff.
d) An exotic vegetation removal, monitoring, and maintenance (exotic-free) plan
for the site, with emphasis on the conservation/preservation areas, shall be

submitted to Current Planning Environmental Review Staff for review and
approval prior to final site plan/construction plan approval.
4. Amend the PUD Master Plan by removing the 40 ft. Florida Power and Light
easement from the natural habitat preserve areas.

order to allow a large group from Columbia hospital to
use the room. Instead of moving to a different location
that morning, which we had done once before and it was a
poorly run meeting, we decided to move the meeting to
Friday December 6, the same time and the same location.
Steve will let all the members know at the November
meeting and we will include a reminder with the December
package when we mail it out.

The Environmental Advisory Board approved No. PUD-96-14/DRI-961 with the following
stipulations:
Environmental:
1 . Prior to final approval of PSP-96-15 the petitioner shall either: 1) show retention of
25% of the existing native vegetation on Phase One and 25% on each subsequent
• Phase as it is submitted for development order approval or 2) shall show the 33
acres of required native vegetation for all of Parcel E on PSP-96-15. These areas
shall be defined as preservation or conservation tracts and shall be platted with
protective covenants similar to or per Florida Statute 704.06.
2 . Submit an updated aerial for the EIS with current land conditions shown. (i.e.
cleared stockpile area and cleared roads).
3 . Amend the Parcel E Master Plan. submitted with the EIS, to show the Gopher
Tortoise preserve. This tract shall be platted with protective covenants similar to or
per Florida Statute 704.06.

4 . Prior to approval of the final Plat and Construction Plans for Phase One, the
petitioner shall submit an updated Gopher Tortoise Survey, relocation plan and
necessary agency permits.
5. At the time of subsequent Development Order submittals the petitioner shall submit
updated Gopher tortoise Surveys, relocation Plans and necessary agency permits.
6. Amend the Parcel E Master Plan Land Use Summary for the
EIS. The Green Space/Park designation shall be renamed as Preservation or
Conservation.
7 . Revise sheet three of four and sheet four of four of the PSP Site Plan to correctly
name all retained native vegetation tracts as Preservation or Conservation. In Phase
One, the Common Area/Buffer shall be renamed accordingly.
8 . Amend sheet three of four of the PSP Site Plan to show the Gopher Tortoise
Preserve.

such as but not limited to Final Subdivision Plat, Final Site Development Plan,
Excavation Permit and Preliminary Work Authorization. Where these regulations
fail to provide developmental standards then the provisions of the most similar
district in the County Land Development Code shall apply.
2. Amend Section 3.4(G) of the PUD document to read as follows by adding the
underlined language and deleting the strike through language:
As required within Division 2.'1 of the Collier County Land Development Code.,
except that required landscaping for PUD perimeter buffers located within Natural
Habitat Preserve Areas may be relocated within other areas of the Natural Habitat
Development Plan approval. If landscape buffers are determined to be necessary
adjacent to preserve areas. they shall be separate from preserve areas.
3. Add the following stipulations to Section IV of the PUD document:
a) Environmental permitting shall be in accordance with the state of Florida
Environmental Resource Permit rules and be subject to review and approval by
Current Planning Environmental Review Staff Removal of exotic vegetation
shall not be counted towards mitigation for impacts to Collier County
jurisdictional wetlands. Any additional mitigation, that may be recommended
by the Environmental Advisory Board (EAB) and approved by the Board of
County Commissioners, above that proposed with this petition shall be
submitted with the Site Development Plan/Construction Plan Package for
review and approval.
b) All conservation areas shall be designated as conservation/preservation tracts or
easements on all construction plans and shall be recorded on the plat with
protective covenants per or similar to Section 704.06 of the Florida Statutes.
Buffers shall be provided in accordance with 3.2.8A.7.3 CCLDC.
In the event the project does not require platting, all conservation areas shall be
recorded as conservation/preservation tracts or easements dedicated to an
approved entity or to Collier County with no responsibility for maintenance and
subject to the uses and limitations similar to or as per Florida Statutes Section
704.06.
c) Buffers shall be provided around wetlands, extending at least fifteen (15) feet
landward from the edge of wetland preserves in all places and averaging twenty-

five (25) feet from the landward edge of wetlands. Where natural buffers are

4. Amend the PUD Master Plan by removing the 40 ft. Florida Power and Light
easement from the natural habitat preserve areas.

now occurring (the drainage easement) and those proposed (ag
lands adjacent to the east, "DeVosta" proposal) relative to
wildlife usage.
Dear Cathy and Gary,
Per our discussions on the phone, our on site meeting with you November
26, 1996 and my review of relevant Tropical Environmental Consultants
office file documents please find my environmental evaluation.
I will first address the 30 foot wide drainage easement (Right-of-way)
recently cleared along your eastern property boundary.
My review of the 1990 Collier County Soil Survey indicates that hydric
soils are present within a majority of the entire length of the drainage R.
0. W. for at least two miles.
As we discussed in the field this condition in and of itself does not mean
that regulatory agencies would assert wetland jurisdiction. Two other
characteristics must also occur, i. e., wetland vegetation and sufficient
hydroperiod before the three tests are met.
I would, however, recommend you inquire at the county if a wetland
determination was undertaken and what the agency (South Florida Water
Management District-SFWMD and U. S. Army Corps of Engineers-USACOE)
determined.
What is evident to me was the lack of installation of a siltation curtain, a

containment fence, along the western edge of the R. 0. W. This is required
by the county itself for two reasons: 1) to prevent soil/silt/fines from
entering wetlands and open water such as canals, 2) to clearly delineate
the limits of clearing and thus protect native vegetation outside of the
county drainage easement from damage Installation of this device is a
standard proceedure and considered a Best Management Practice (BMP's)
for land alterations during construction. Surprised the county does not
follow its own requirements.
Your observations that the Big Cypress Fox squirrel commonly forages and
dwells in your yard and general vicinity was verified as we saw several
behind your residence and up on the roof. Obviously necessary life history
requirements of this species are being provided in Unit 97 and most
shuridly along the entire ag land forested edge.
A detailed survey must be conducted to evaluate wheredening/nesting
sites exist as the Florida Game and Fish Commission legally can only
protect the nest sites. This is required before land alterations can begin.
Of special concern to me was did the county conduct such a survey before
the clearing of the R. 0. W. was begun? The stand of melaleuca trees
present behind your office and residence would be prime habitat for
squirrel nests. The Big Cypress Fox squirrel seems to prefer constructing
nests within the dense canopy of melaleuca found within altered wetlands.
Destruction of these without proper review and permitting by the FL. G. &
F C would be a clear violation of Florida law. A portion of the cypress,
melaleuca and slash pine stand clearly was present within the R. 0. W.
along your property.
I would recommend that you confer with county staff to determine if this
survey was conducted and what were the findings.

Edges between differing landscape vegetational feature (ecotones) are
very rich and diverse when considering the variety and numbers of plant
and animal species. This biodiversity is possible because the habitat
provides essential needs of a variety of species such as the Big Cypress
Fox squirrel and the Bob cat. Note, scat was noted within the cleared R. 0.
W.
This edge, along the Estates lots from Vanderbilt Road to lmmockalee,
also provides a forested corridor which facilitates movement of wildlife
over larger distances.
Some comments relative to the proposed land alterations within the ag
fields adjacent and to the east of you.
My first concern, now that the 30' drainage R. 0. W. has been cleared, is
the potential loss of additional forested edge which presently exists on or
along the ag perimeter spoil berm.
Prior to the clearing of the R. 0. W. the edge of the farm fields, just at the
perimeter spoil mound, functioned as the ecotonal edge community.
If the ag property also has a 30' drainage easement, one contiguous with
your 30' easement, then it too might be cleared. The entire berm and
associated ag ditch would be eliminated and in it place would be a 60'
drainage easement, completely devoid of mature native trees.
This would further degrade the functional aspects of the occupied range .of
the bob cat and the B. C. fox squirrel as well as other wildlife.
One requirement of larger developments, such as the one being proposed by
Mr. DeVosta, is that a perimeter berm be installed to insure storm water
runoff is held within the development. This new berm would be
constructed interior to the 60' drainage R. 0. W. further eliminating
forested corridors for wildlife movement.

County planning staff, as recently as two weeks ago, expressed concern by
the new type of development being designed which offer little native
vegetated buffers but instead consist of a repeating finger lake and fill
complex, one which "double loads" housing along access roads.
Environmentally, functionally, these designs preserve little to no forested
areas especially if slated for already cleared active ag areas such as that
to the east of you.
As you know the county Land Development Code Regulations require
preservation of a percentage of native habitat when present. Development
in previous active ag areas do not have to preserve native habitat if none
existed.
The Collier staff professional planners believe that these types of
development designs could be more environmentally and esthetically
pleasing, if required to recreate masses of native vegetation. such as
adequate and functional perimeter buffers, i concur with that evaluation.
Specific efforts are being proposed through the South Florida Water
Management District's Environmental Advisory Committee to request tht
the District evaluate the effectiveness of buffer requirements on water
quality and wildlife values. The scientific literature clearly suggests
that buffers of 100+ feet are necessary to preserve wildlife values and
maintian biodiversity.
No one in the field of ecology/wildlife management would disagree that
the fragmentation of the landscape by agricultural practices and urban
development is a threat to wildlife and biodiversity. They also agree that
there are designs which if incorporated into both land uses would enhance
the value to wildlife, especially if the more intense landscape altering
land use is adjacent to larger intact habitat systems, i. e., rural estates
type mosaic where the majority of the native vegetation is retained.

There are Best Management Practices (BMP's) which, if applied to the
DeVosta and Carleton Lakes style design format, would enhance, augment,
already existing habitat functions provided along the estates units-ag
fields interface. The creation of a forested buffer along the edges,
especially when a more intense land use is proposed on one side, e. g., the
farm fields multifamily units adjacent to the single family estates
zoning, would assist both developments to bridge the transition between
them as well as provide corridor edge habitat for wildlife.
In conclusion your statement that the creation of finger lakes would
involve blasting to fracture the subsurface rock and facilitate the
excavation process has the potential to alter ground water hydrology and
recharge characteristics, especially in adjacent wetlands due to the
potential of Karst conditions in southwest Florida. Fractures could alter
near surface marl/clay layers allowing summer rains to more quickly
penetrate downward reducing the hydroperiod of affected wetlands. This
and formation of sink holes were a serious problem when the Lee County
Regional (now International) airport was constructed.
My report is general in coverage, however additional field investigation
and review of county records and permit applications would allow a more
accurate evaluation of environmental issues raised.

what that means.
4. Has any consideration been given to the impact on our environmentally
sensitive area? Numerous nests and plant species have already been
destroyed in the process of the drainage easement clearing. Further nearby
devastation cannot help but affect the species hanging on in our area. A 20 ft.
"buffer" is not nearly enough to ensure a corridor for wildlife in the area.

As a R EAI,TOR within Collier County,I can attest to the fact that there is a need for the
type of Community that is being proposed in the Island Walk PUD. Many of my Clients
have an interest in being a part of a planned community,but are not golfers.Unfortunately,
the design of these types of communities often provide or preserve very little in the way of
functional native habitat.
I am also an adjoining property owner to this Development and I am extremely concerned
about the environmental impact to Units 96 and 97 of Golden Gate Estates. My husband
and I have hired the services of Mr.Gary L.Beardsley of Tropical Environmental
Consultants,Inc to analyse the damage that has already occurred on my property in Collier
Counties efforts to install a drainage swale He has also been requested to assist us with
input on the Island Walk PUD so that we do not suffer the loss of additional Habitat. Mr.
Beardsley is working to complete this report so that it will he available for you at the
hearing.
In your brief Staff Report that I received in the mail just yesterday,comments were made in
regards to species found on the Subject property. I would like to call your attention to the
fact that adjoining property to the West of the proposed Island Walk PUD is Habitat for
Deer,Bobcat,Fox and The Rig Cypress Fox Squirrel.
If the proposed road location is accepted,you will be literally pouring a future concrete
harrier around this sensitive area. This Development,as proposed,is going to eliminate the
meandering corridor idor for Wildlife. Wildlife wanders through our area because of the natural
protective cover and food that is provided by native vegetation. I am concerned that we are
closing the corridor which would allow wildlife to reach Units 95 which is the forested area
to the south of the proposed PUD.

There is a definite need here for a transitional buffer,whether it be planned green space or by
means of a planted forest of native vegetation. We are forcing wildlife on humans and
setting the stage for confrontations.
Ismes of drainage must also be addressed carefully to avoid the loss of any additional
forested areas and habitat. Your Staff Comments regarding the passing of runoff through or
around the perimeter of the project or a combination thereof is also a concern.
In 1974 Collier County restricted further divisions of75 X 660 lots within the Estates area,
thus lowering the density to 1 unit per 2.25 acres. A 3 Unit per acre Development without
proper packaging is not compatible with the sensitive habitat of Units 96 and 97 of Golden
Gates Estates which adjoins the proposed island Walk PIJD to the Fast.
As an adjoining property owner I have additional concerns of blasting for lakes and the
removal of fill in a Carst Region. Concerns regarding damage to windows,pools and decks
to the adjoining homes are warranted.
I will speak at the scheduled hearing for standing,hut sincerely request that you give serious
consideration to the items that are addressed herein. In addition,we have requested input
from Kim Dryden of Game and Fish and from the Conservancy of SW Florida on ideas for a
transitional buffer which will be presented during the Planning Review Board hearing on
December 19th.
