V. STAFF COMMENTS:
Water Management:
The proposed system consists of one basin discharging into adjoining wetlands bordering
Turkey Bay. The system will provide water quality retention and peak flow attenuation
during storm events. The system is standard for projects of this type, and its proximity to
the final basin outfall means downstream properties will not be impacted.
Environmental:
The subject property is an undeveloped 88.5 acre parcel located on the north west corner
of Bluebill Ave. and Vanderbilt Drive. Habitats on site consist of scrub/scrubby flatwoods,
wetland forest, mangrove swamp and portions of Turkey bay. Most of the exotic
vegetation on site is located in the fresh water wetlands bordering the mangroves. Plant
diversity is fairly high due to the types of habitats found on. A plant list from
environmental staff's site visit to the subject property is included with this staff report.

Approximately 38.8 acres of Collier County jurisdictional wetlands occur on the subject
property. No wetland impacts are proposed at this time.
Three soil types were identified on the site. These include Urban Land Satellite Complex,
Bassinger fine sand and Durbin and Wulfert Mucks. The latter two are listed as hydric
soils per the revised Collier County soil legend (1/90, H. Yamataki). A soils map of the
project site is included in the environmental impact statement.
Gopher tortoises (Gopherus polyphemus) were the only listed wildlife species found on
the subject property. A total of 68 active and 70 inactive gopher tortoise burrows were
identified. The gopher tortoise is listed as a species of special concern by the Florida Game
and Fresh Water Fish Commission (FGFWFC). A gopher tortoise management plan has
not been proposed at this time.
Listed plant species observed on site by the petitioner include Curtiss' milkweed
(Asclepias curtissii), nodding pinweed (Lechea cernua), wild pines (Tillandsia setacea, T.
utriculata, T. balbisiana, T. fasciculata), wild coco (Eulophia alta), golden polypody
(Phlebodium aureum), brake fern (Pteris vittata), and sand spike moss (Salaginella
avenicola).
The project site contains a known archaeological site as identified in the
historical/archaeological probability maps for Collier County. The petitioner has submitted
an archaeological survey and assessment as required in section 2.2.25.3.3 of the Collier
County Land Development Code.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-96-15,
"Wiggins Pass Landings" with the following stipulations:

1. Applicant will need to obtain a Surface Water Management Permit from the
SFWMD prior to site development plan approval

Environmental impact statement for the Woodlands, dated December 5, 1983.
The Woodlands DRI U.S. Army Corps of Engineers Dredge and Fill Permit Application
prepared by Kevin L. Erwin, Consulting Ecologist, Inc., in conjunction with Hole,
Montes, and Associates, Inc., dated May, 1995.
V. STAFF COMMENTS:
Engineer's Comments - Water Management:
The Woodlands discharges into the lmmokalee Road canal (The Cocohatchee canal or the
CR-846 canal). It straddles the location of the proposed Cocohatchee three structure and
has two control elevations, 11.50 NGVD downstream and 13.0 F.G.V.D. upstream of the
proposed Coco three structure.
As was stated previously, the project has already received a SFWMD Permt.
Environmental:
The subject property is an undeveloped 500 acre parcel located on the north side of
Immokalee road approximately 1 1/2 mile east of 1-75 and one mile west of County Road
951. Habitats on site include Pine Flatwoods, Cypress Forest and Palmetto Prairie. The
quantity of exotic vegetation varies on site and is mapped out in the U.S. Army Corps of
Engineers (ACOE) Dredge and Fill Permit Application. The plant associations are

described in the Environmental Impact Statement and ACOE Dredge and Fill Permit
Application.
Approximately 333 acres of Collier County jurisdictional wetlands occur on the subject
property. One hundred seventy-four(174) acres of these wetlands will be impacted by the
proposed project (Craig Smith, Personal Communication).
Changes to the plan of development for the Woodlands are the result of permitting
requirements for the South Florida Water Management District (SFWMD) and the U.S.
Army Corps of Engineers (ACOE), both of which have issued permits for the project.
The preservation areas are now configured as a single unit on the eastern side of the
property. The preserve area is approximately 176 acres in size (35% of the total site). An
additional 6.5 acres of pine flatwoods will also be preserved adjacent to the golf course on
site.
Soil types found on the subject property include Immokalee Fine Sand, Cypress Swamp,
Arzell Fine Sand and Pampano Fine Sand. A soils map for the project site is included in
the Environmental Impact Statement.
Listed wildlife species on site include the Big Cypress fox squirrel (Sciurus niger
avicennia) and occasional wading birds which were observed along the Cocohatchee Canal
(Craig Smith, Personal Communication). Wildlife species surveyed for are listed in the
Environmental Impact Statement with more recent survey information included in the
ACOE Dredge and Fill Permit Application.
The petitioner has submitted an archaeological survey and assessment as required in
Section 2.2.25.3.2 of the Collier County Land Development Code. No cultural resources
are known to occur on the subject property. The Florida Department of State, Division of
Historical Resources stated that "While no cultural resources were identified within the
upland portions of the property, there is reasonable probability that significant cultural
resources, in the form of human burials or rare cultural artifacts manufactured from
perishable materials, may occur with the undisturbed cypress muck ponds." The soil
conditions indicated by the Division of Historical Resources are only found on the eastern
portion of the site within the preserved wetland slough. Cultural resource issues will be
coordinated by the Regional Planning Council.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No.
PUD-83-26(1)/DOA-96-3, "The Woodlands" with the following stipulations:

Environmental:
1. Add the following stipulation to the PUD document:
a) Regulations for development of the Woodlands shall be in accordance with the
contents of this document, PUD-Planned Unit Development District and other
applicable sections and parts of the Collier County Land Development Code
and Growth Management Plan in effect at the time of issuance of any
development order to which said regulations relate which authorizes the
construction of improvements, such as but not limited to Final Subdivision
Plat, Final Site Development Plan, Excavation Permit and Preliminary Work
Authorization. Where these regulations fail to provide developmental
standards then the provisions of the most similar district in the County Land
Development Code shall apply.
2. Delete Section 9.11(A), (B), (C), (D), (E), (F), (G), (H), (I), (.1), (M)) and (0) from
the PUD document.
3. Amend Section 9.11 (L) of the PUD document to read as follows by adding the
underlined language.
a) Prior to commencement of construction, the perimeter of the protected
wetlands and buffer zones shall be staked and roped to prevent encroachment
into the wetlands, subject to the approval of the South Florida Water
Management District (SFWMD) and Collier County Development Services
staff. The staking and roping shall remain in place until all adjacent
construction activities are complete.
4. Amend Section 9.11 (N) of the PUD document to read as follows by adding the
underlined language and deleting the strike through language:
a) Wetland preservation/mitigation areas, upland buffer zones, and/or upland
preservation areas shall be dedicated as conservation and common areas in
conservation easements as well as on the plat with protective covenants per or
similar to Section 704.06 of the Florida Statutes in compliance with the

5. Add the following stipulations to Section 9.11 of the PUD document.
a) Environmental permitting shall be in accordance with the state of Florida
Environmental Resource Permit rules and be subject to review and approval by
Current Planning Environmental Review Staff. Removal of exotic vegetation
shall not be counted towards mitigation for impacts to Collier County
jurisdictional wetlands.
b) Buffer zones pursuant to Section 3.2.8.4.7 (3) of the Collier County Land
Development Code shall be required.
c) An exotic vegetation removal, monitoring, and maintenance (exotic-free) plan
for the site, with emphasis on the conservation/preservation areas, shall be
submitted to Current Planning Environmental Review Staff for review and
approval prior to final site plan/construction plan approval.

The subject property is an undeveloped parcel, approximately 69
acres, located at the northeast corner of CR-951 and Rifle
Range Road in Collier County within Section 14 , Township 50 South,
Range 26 East.

The First Assembly of God Campus proposes a multitude of
different uses for the 69 acre parcel. Among them would be
residential dormitories, an assembly center, auditorium chapel,
youth cabins, child care, a school and both passive and active
recreational areas.

V. STAFF COMMENTS:
Water Management:
The site contains wetlands and is well over the 40 acre
threshold for South Florida Water Management District (SFWMD)
review and permitting. The project is contiguous to the CR-951
Canal (Henderson Creek) which qualifies it for an allowable
discharge rate of 0. 15 CFS/acre. Staff has seen a few
conceptual plans for this site, some of which are more intense
than others and therefore will result in higher storm stages
due to increased impervious areas and lower retention surface
area. The site is large enough to accommodate the water
management for the proposed uses.
Environmental:
The subject property is an undeveloped 69 acre parcel,
approximately 32 acres of which are SFWMD jurisdictional
wetlands. The site is made up of seven major community types
including Pine Flatwoods (with melaleuca) , Hydric Pine
Flatwoods (with melaleuca) , Melaleuca Forest, Hydric Melaleuca
Forest, Cypress, Pine-Cypress-Cabbage Palm and the FP&L
easement.
The amount and intensity of melaleuca throughout the property
creates a monoculture over more than 42 acres of the site. The
consultant determined that there are roughly 23 acres of
existing native vegetation on-site; therefore 5. 7 acres are
required for preservation. The PUD master plan calls for
preservation, enhancement and creation of 6. 06 acres as
depicted.

Two soil types are found on-site; they are Pineda Fine Sand and
Hallendale and Boca Fine Sand. Both are listed as hydric soil
types, typically found in sloughs or poorly defined drainage
areas.
No listed species were observed on-site by either Staff or the
consultant.
VI. RECOMMENDATIONS:
Staff recommends approval of PUD-96-10 with the following
stipulations:
Water Management:
No stipulations.
Environmental:
1. Petitioner shall delete The following sections from the
PUD document: 4 .9 (A) , 4 . 9 (B) and 4 . 9 (D) . Replace that
language with the following:
This PUD shall be in compliance with the Collier
County Land Development Code and the Growth
Management Plan Conservation and Coastal
Management Element at the time of final develop-
ment order approval.
2 . Petitioner shall replace section 4 .9 (C) with the following
language:
An exotic vegetation removal, monitoring and
maintenance (exotic free) plan for the site, with
emphasis in the conservation/preservation areas,
shall be submitted to Current Planning Environmental
Staff for review and approval prior to final site
plan/ construction plan approval.
3. Petitioner shall replace section 4 . 9 (E) with the following
language:
Environmental permitting shall be in accordance with
the State of Florida Environmental Resource Permit

rules and be subject to review and approval by
Current Planning Environmental Review Staff. Removal
of exotic vegetation shall not be counted towards

4 . Add the following language to the PUD document under

Buffers shall be provided around wetlands, extending
at least fifteen (15) feet landward from the edge of
wetland preserves in all places and averaging twenty-
five (25) feet from the landward edge of wetlands.

The proposed Planned Unit Development provides for adding Section 13 to the Fiddler's
Creek Master Plan. The uses on the property will be predominantly residential and golf
course, with associated open space, lakes, parks and infrastructure.

V. STAFF COMMENTS:
Water Management:
The proposed surface water management system to serve the 690 acre site will consist of
one drainage area which will utilize lakes and open space areas to provide the required
water quality and quantity storage volumes. Storm sewers, swales, and overland flow will
convey run-oil'to the storage areas.
The surface water management system will discharge via a control structure to the U.S. 41
Outfall Swale No. I . The ditch will be expanded to provide additional capacity and for
aesthetic purposes. Although no off-site flow currently enters the site, historic flow that at
one time entered the site will be routed through or around the project in accordance with

South Florida Water Management District regulations and the Collier County stormwater
master plan for the area. The post-development runoff rate will be limited to the pre-
development rate.
The control elevation and discharge rate are set at 2.5 ft-NGVD and 0.12 cfs/ac,
respectively, which are the permitted values for Fiddler's Creek. Final control elevations,
peak discharge rates, and minimum finished elevations will be determined at the time of
SFWMD permitting in accordance with SF\\'MD and Collier County regulations.
Environmental:
The following is a site summary as written in the EIS and verified by a site visit on
September 20"' , 19%.
"The subject property (Section 13) can be characterized as an on-going agricultural
operation with associated support facilities including temporary housing, packing and
storage areas. The site has apparently been used lar agricultural activities since at least
1963. Current and historical farming practices consist of flooding the fields in the summer
to control weeds and nematodes, and pumping the water down in the fall to allow for
vegetable crop planting. As the dry season progresses, irrigation is supplied by pumping
from reservoirs and the surficial aquifer. Areas that are left fallow tend to become
colonized with a depauperate weedy plant community dominated by Brazilian pepper,
groundsel, wax myrtle, ragweed, medic, purple sedges, creeping Charlie, Spanish needle,
finger grass, broomsedge, beakrush, water hyssop, tick seed and natal grass. The
manmade ditches tend to contain cattail, arrowhead, water hyssop, mock bishop weed,
rushes and water panic grass. Some of the areas north and west of the temporary housing
are becoming established with some young slash pine The fields themselves are planted in
tomatoes and have an associated plant assemblat.;e of pig weed, ragweed, nightshades and
black medic.
No area of high quality, naturally occurring wetlands were observed on the site, nor are
expected to re-establish in the near future. Clearly, based upon the reported farming
practices, the quality of the remnant wetland communities have been severely degraded by
a variety of impacts. Forested areas within Section 13 are currently limited to slash pine
or Brazilian pepper dominated assemblages found in a few location. The only area of
natural wetlands (cypress wetlands) is located immediately adjacent to the Section, along
the northern property boundary next to U.S. 4I . Inspections confirm that the degree of
disturbance on the site from historical and on-going agricultural practices (e.g., laser
sloping and ditch and dike construction for irrigation) has so changed the soils and plant
communities that no Threatened and Endangered plants listed by the state or federal
agencies were found either on-site or on the project site. Inspections did show the

presence of American alligator in the reservoirs and ditches. In addition, although not
directly observed, it is possible that a few listed bird species, such as herons, white ibis,
egrets and possibly wood stork, may make limited use of the storage ponds and ditches for
feeding. The site, however does not represent critical habitat for any observed or
expected Threatened and Endangered species."
VI. RECOMMENDATIONS:
Staff recommends approval of PUD-84-7(5)/ DOA-96-4 with the following stipulations:
Water Management:
1. The perimeter berm for Section 13 shall meet LDC requirements as to setbacks from
the property line.
2. Provisions for Section 13 to accept or pass through existing flows from culverts SIS-
001-SO 150 and 180 under U.S. 41 shall be addressed by one or more of the following
methods:
a) Routing west along north line of Section 13 connecting to U.S. 41 outfall Swale
No. 1.
b) Routing south along east side of Section 13, and further south connecting to
Fiddler's Creek spreader facility.
c) Routing through project's internal water management system.
All of the above are subject to permitting by South Florida Water Management
District (SFWMD).
3. Within six (6) months of approval of the rezone of Section 13, Developer shall grant a
"temporary" easement to accommodate the construction of U.S. 41 outfall Swale No.
1 along the west and north sides of Section 13, the profile of which shall not exceed
that set forth in the construction plans therefor, as revised May 1992. Developer shall
grant permanent easements as part of the platting process for properties adjacent to
the temporary easement, and shall have the ability to change the boundaries of the
easement, and the profile of the drainage swale during said platting process, provided
minimum tows are maintained.

4. Any other drainage easements required in Section 13 for the conveyance of off-site
flows shall be dedicated and recorded within one (1) year of the approval of the
rezone of Section 13, pursuant to the process set forth in 3 above.
Environmental:
1. Make the following changes to PUD-84-7(5) Section 2.1 l :

3 . Amend the language in PUD-84-7(5) Section I I.19A and copy to Section 12.2A(1):

preservation areas have been deeded to the State of Florida in conjunction
with the Settlement Agreement referred elsewhere in this document. In
addition to these areas, approximately 243 acres of additional land is set aside
in Fiddler's Creek as depicted on exhibit "FC-A", and as regulated by Section
V hereof Other than incorporation into the approved drainage design or as
allowed by permits, these areas will be left untouched, with the exception of
the required removal of exotic vegetation, and deeded to the ptiblie
homeowners association or approved entity upon platting of these specific
areas."

4. Amend the following language in PUD-84-7(5) Section 12.2C(1) :
12.2 C (1) " The EIS prepared ... with the condition that the stipulations

5. The petitioner shall place a general statement in the PUD document that says the
Fiddler's Creek Master Plan (Exhibit FC-A) supersedes the Marco Shores Master

WATER MANAGEMENT:
1. Applicant will need to obtain a Surface Water Management Permit from the
SFWNID prior to Site Development Plan approval.
ENVIRONMENTAL:
1. Petitioner shall prepare and submit for Environmental Advisory Board approval a
vegetation clearing/preservation plan optimizing the preservation of habitat with
curtiss' milkweed (Asclepias curtissii), nodding pinweed (Lechea cernua) and sand
spike moss (Salaginella avenicola) to the extent feasible for development of the
project. Such plan shall be submitted as part of the Preliminary Subdivision Plat
application or Site Development Plan application.

stipulations. Mr. Hermanson abstained from the vote.
ENVIRONMENTAL:
1. Add the following stipulation to the PUD document:

a) Regulations for development of the Woodlands shall be in accordance with
the contents of this PUD ordinance and applicable sections and parts of the
Collier County Land Development Code (to the extent they are not
inconsistent with this PUD ordinance) and Growth Management Plan in
effect at the time of issuance of any development order to which said
regulations relate which authorizes the construction of improvements, such
as but not limited to Final Subdivision Plat, Final Site Development Plan,
Excavation Permit and Preliminary Work Authorization. Where these
regulations fail to provide developmental standards then the provisions of
the most similar district in the County Land Development Code shall apply.
2. Delete Section 9.11(A), (B), (C), (D), (E), (F), (G), (H), (I), (J), (M)) and (0)
from the PUD document.
3. Amend Section 9.11 (L) of the PUD document to read as follows by adding
the underlined language and deleting the ' • • ..• • .. •-:
a) Prior to commencement of construction, the perimeter of the protected
wetlands and buffer zones shall be staked and roped to prevent
encroachment into the preserve areas identified in the South Florida Water
Management District Permit, wetlands, subject to the approval of the
South Florida Water Management District (SFWMD) and Collier County
Development Services staff. The staking and roping shall remain in place
until all adjacent construction activities are complete.
4. Amend Section 9.11 (N) of the PUD document to read as follows by adding
the underlined language and deleting the strike through language:
a) Wetland preservation/mitigation areas, upland buffer zones, and/or upland
preservation areas shall be dedicated as conservation and common areas in
conservation easements as well as on the plat with protective covenants per
or similar to Section 704.06 of the Florida Statutes, provided that said
covenants shall not conflict with South Florida Water Management District
Permit No. 11-01232S. in compliance with the requirements of the South
Florida Water Management District Permit No. 11 01232 S, as may be
amended
5. Add the following stipulations to Section 9.11 of the PUD document.
a) Development shall be pursuant to the existing South Florida Water
Management District Permit No. 11-01232S, and U.S. Army Corps of
Engineers Permit No. 198990960IPMN. Any amendments to these

Permits shall be subject to review and approval by Current Planning
Environmental Review Staff.
b) Buffer zones adjacent to the preserve areas shall be pursuant to South
Florida Water Management District Permit No. 11-01232S.
c) An exotic vegetation removal, monitoring, and maintenance (exotic-free)
plan for the site, with emphasis on the conservation/preservation areas,
shall be submitted to Current Planning Environmental Review Staff for
review and approval prior to final site plan/construction plan approval.
Such plan shall be consistent with the requirements of Division 3.9 of the
Collier County Land Development Code (CCLDC) and South Florida
Water Management District Permit No. 11-01232S.
d) Replacement and mitigation plantings shall be randomly spaced and/or
clumped at the densities quoted in the Woodlands Onsite Wetland
Mitigation and Monitoring Plan (SFWMD Phase I Construction), to
emulate a more natural environment.
PETITION NO: " First Assembly of God"
No. PUD-96-10

MOTION: Made by Ms. Straton, seconded by Mr. Hermanson, and carried 6/0, to approve
Petition No. PUD-96-10 "First Assembly of God" with amended stipulations.
1. Petitioner shall delete The following sections from the PUD document: .9(A),
4.9(B) and 4.9(D). Replace that language with the following:
This PUD shall be in compliance with the Collier County Land
Development Code and the Growth Management Plan Conservation and
Coastal Management Element at the time of final development order
approval.
2. Petitioner shall replace section 4.9(C) with the following language:
An exotic vegetation removal, monitoring and maintenance (exotic free)
plan for the site, with emphasis in the conservation/preservation areas, shall
be submitted to Current Planning Environmental Staff for review and
approval prior to final site plan/ construction plan approval.

3. Environmental permitting shall be in accordance with the State of Florida
Environmental Resource Permit rules and be subject to review and approval by
Current Planning Environmental Review Staff. Removal of exotic vegetation
alone, shall not be the sole component of mitigation for impacts to Collier
County jurisdictional wetlands.
4. Buffers shall be provided around wetlands, where possible extending at least
fifteen (15) feet landward from the edge of wetland preserves in all places and
averaging twenty-five (25) feet from the landward edge of wetlands. Where
natural buffers are not possible, structural buffers shall be provided in
accordance with the State of Florida Environmental Permit rules and be subject
to review and approval by Current Planning Environmental Review Staff.
PETITION NO: "Fiddlers Creek"

MOTION: Made by Ms. Straton, seconded by Mr. Foley, and carried 5/0, to approve Petition
No. PUD-84-7(5)/DOA-96-4 "Fiddlers Creek" with amended stipulations. Mr.
Hermanson abstained from the vote.
WATER MANAGEMENT:
1. The perimeter berm for Section 13 shall meet LDC requirements as to setbacks
from the property line.
2. Provisions for Section 13 to accept or pass through existing flows from
culverts SIS-00l-S0 150 and 180 under U.S. 41 shall be addressed by one or
more of the following methods:
a) Routing west along north line of Section 13 connecting to U.S. 41 outfall
Swale No. 1.
b) Routing south along east side of Section 13, and further south connecting
to Fiddler's Creek spreader facility.
c) Routing through project's internal water management system.
All of the above are subject to permitting by South Florida Water Management
District (SFWMD).

3. Within six (6) months of approval of the rezone of Section 13, Developer shall
grant a "temporary" easement to accommodate the construction of U.S. 41
outfall Swale No. 1 along the west and north sides of Section 13, the profile of
which shall not exceed that set forth in the construction plans therefor, as
revised May 1992. Developer shall grant permanent easements as part of the
platting process for properties adjacent to the temporary easement, and shall
have the ability to change the boundaries of the easement, and the profile of the
drainage swale during said platting process, provided minimum flows are
maintained.
4. Any other drainage easements required in Section 13 for the conveyance of
off-site flows shall be dedicated and recorded within one (1) year of the
approval of the rezone of Section 13, pursuant to the process set forth in 3
above.
ENVIRONMENTAL:
1. Make the following changes to PUD-84-7(5) Section 2.11:
2.11A "Landscape berm over two (2) feet in height shall have the following
maximum side slopes:
(1) Grassed berms 3:1
(2) Ground covered berms 2:1
(3) Rip-Rap..."
Native shade trees shall be planted 25 ft. on center, along the exterior side of
the berm, equal in height or greater than the completed height of the berm.
2.11E "Pedestrian sidewalks and/or bike paths, water management systems
and drainage may be allowed in landscape buffers in accordance with Collier
County Land Development Code Division 2.4 Landscaping and Buffering."
Subject to review and approval by the Fiddler's Creek Design Review
Committee."
2. Replace PUD-84-7(5) Section 5.4A with the following language:
5.4A "Buffers shall be provided around wetlands in Section 13, extending at
least fifteen (15) feet landward from the edge of wetland preserves in all places
and averaging twenty-five (25) feet from the landward edge of wetlands."
3. Amend the language in PUD-84-7(5) Section 11.19A and copy to Section
12.2A (1):

12.1 A (1)(d) " Approximately 15,000 acres of valuable wetlands and other
preservation areas have been deeded to the State of Florida in conjunction
with the Settlement Agreement referred elsewhere in this document. In
addition to these areas, approximately 243 acres of additional land is set aside
in Fiddler's Creek as depicted on exhibit "FC-A", and as regulated by Section
V hereof Other than incorporation into the approved drainage design or as
allowed by permits, these areas will be left untouched, with the exception of
the required removal of exotic vegetation, and deeded to the tic
homeowners association or approved entity upon platting of these specific
areas."
4. Amend the following language in PUD-84-7(5) Section 12.2C(1) :
12.2 C (1) " The EIS prepared ... with the condition that the stipulations
contained herein in the County Environmentalist's May 15, 1984 Memorandum
are followed."
5. The petitioner shall place a general statement in the PUD document that says
the Fiddler's Creek Master Plan (Exhibit FC-A) supersedes the Marco Shores
Master Plan (Exhibit A).
