Duane, AICP, of Hole, Montes & Associates, Inc. REQUESTING: A preliminary subdivision plat for a single family subdivision consisting of 35 acre lots with limited site clearing. REPRESENTED BY: Robert L. Duane, AICP of Hole, Montes & Associates, Inc. MOTION: Made by Mr. Saadeh, seconded by Dr. Gore and carried 5/1, to approve Preliminary Subdivision Plat Petition No. #PSP-96-7 STIPULATIONS: Water Management: 1. Petitioner shall obtain necessary South Florida Water Management District (SFWMID) permits prior to site development plan or subdivision master plan approval. Environmental: 1. Permits or letters of exemption of the U.S. Army Corps of Engineers (ACOE) and South Florida Water Management District (SFWMD) shall be presented prior to final plat/construction plan approval. 2. Environmental permitting shall be in accordance with the state of Florida Environmental Resource Permit rules and be subject to review and approval by Current Planning Environmental Review Staff. Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier County jurisdictional wetlands. 3. At the time of final plat/construction plan submittal, petitioner shall show areas of twenty-five percent (25%) retained native vegetation as required in Section 3.9.5.5.3 of the Collier County Land Development Code. 4. All conservation areas shall be recorded on the plat with protective convenants per or similar to Section 704.06 of the Florida Statutes. Conservation areas shall be dedicated on the plat to the project's homeowners association or like entity for ownership and maintenance responsibilities and to Collier County with no responsibility for maintenance. 2 5. An exotic vegetation removal, monitoring, and maintenance(exotic-free) plan for the site, with emphasis on the conservation/preservation areas, shall be submitted to Current Planning Environmental Review Staff for review and approval prior to final site plan/construction plan approval. 6. Petitioner shall comply with the guidelines and recommendations of the U.S. Fish & Wildlife Service (USFWS) and Florida Game and Fresh Water Fish Commission (FGFWFC) regarding potential impacts to protected wildlife species. 7. This petition is subject to a forty-five (45) day appeal period by the Florida Department of Community Affairs. There being no further business, the meeting was adjourned by order of the Chair. Foley, Chairman 3 HABITAT PROTECTION STANDARDS BRIEFING PAPER 5-20-96 Authorization CCME requirements: Inventory, define and prepare development standards and criteria for land clearing in various habitat areas. EAR Report: "Incentives should be created which would allow development to continue, but at the same time would also insure that some of the most ecologically sensitive habitat and vegetative communities are retained. " Current Requirements Section 3 .9.5. 5 requires that 25% of viable naturally functioning native vegetation be preserved. Allows for landscaping to substitute for preservation. Habitat Inventory and Preservation History The most current inventory of habitats is attached. The attached graph shows the amounts of various habitats retained for all PUDs permitted between 1989 and 1994 . Issues 1. Additional Regulatory Requirements vs. voluntary incentives. 2 . Focus on specific sensitive habitats (i.e. , Xeric Scrub, Dune and Strand, Hardwood Hammocks) vs. all habitats. General Approach 1. Concentrate on voluntary incentives rather than additional regulatory requirements. 2. Identify incentives for preserving selected habitat types greater than that required by the existing code. 3 . Propose types and percentages of habitat retention that would qualify for incentives. 4 . Propose other protection criteria that would qualitfy for incentives. 5. Survey the development community for incentives that will lead to additional habitat protection. LOCATION: The subject property is located on the west side of the Faka Union Canal , immediately north of U. S. 41, at Port-of-the-Islands. In general the site is located approximately twenty (20) miles southeast of Naples in Sections 4 and 9, township 52 South, Range 28 East, Collier County, Florida. II. DESCRIPTION OF SURROUNDING PROPERTIES: Lands around the proposed subdivision are generally undeveloped. Port-of-the-Islands lies immediately to the east and south of the subject property.
