REQUESTING: The proposed project will consist of a maximum of
two hundred and ten (210) multi-family housing units
with on-site recreational facilities, water
management lake and preserve areas.

MOTION: Made by Mr. Saadeh, seconded by Ms. Straton and
carried 5/0, to approve Petition PUD-96-7 with amended
stipulations.
STIPULATIONS:
Water Management:
1. A copy of the South Florida Water Management
District (SFWMD) Permit or Early Work
Authorization, with Staff Reports, is required
prior to final site development plan approval.
2 . An offsite swale shall be constructed within the
existing drainage easement from the south side of
the property to the existing lake shown on the
"Offsite Conveyance Swale Plan" for College Park.
Environmental:
1. Amend section 4. 14 of the PUD document to read as
follows by adding the underlined language.
4 . 14 NATIVE VEGETATION RETENTION REQUIREMENTS
Pursuant to Policy 6.4.7 of the Conservation and
Coastal Management Element of the Collier County
Growth Management Plan, an appropriate portion of
the viably functioning native habitat shall be
retained in buffer areas, around the lake and
within open space areas and preserves as depicted
on the PUD master plan.
Add the following stipulations to Section IX of
the PUD document.
2 . Environmental permitting shall be in accordance
with the state of Florida Environmental Resource
Permit rules and be subject to review and approval

by Current Planning Environmental Review Staff.
Removal of exotic vegetation shall not be counted
towards mitigation for impacts to Collier County
jurisdictional wetlands.
3. All jurisdictional wetlands and/or mitigation
areas shall be designated as
conservation/preservation tracts or easements on
all construction plans and shall be recorded on
the plat,or by separate instrument, with
protective covenants per or similar to Section
704. 06 of the Florida Statutes.
4. At the time of site development plan submittal,
petitioner shall submit a letter from the U. S.
Fish and Wildlife Service (USFWS) regarding
red-cockaded woodpecker issues on site.

OLD BUSINESS:
ITEM: EAB Authority
COMMENTS: Heidi Ashton gave a legal opinion for concerning the
EAB's authority in requiring or requesting additional
information for water management.
A memo was distributed.

WORKSHOP:
ITEM Wetland Mitigation
COMMENTS: Karen Johnson was present from South Florida Water
Management District (SFWMD) to answer questions and
discuss policies and procedures, both of SFWMD and
other counties.
The EAB and Staff discussed the concept of no net loss
of wetlands, with a consensus or recommendation to Mr.
Mulhere, that Staff prepare standard language
regarding mitigation and consider several different
alternatives including a Mitigation Fund, upland
compensation around wetlands, and offsite mitigation
when the proposed mitigation for the Environmental
Resource Permit (ERP) causes a net loss of wetlands.
Staff was also asked to clearly define what
constitutes a net loss.

STAFF REPORT
MEETING OF May 1, 1996
I. NAME OF PETITIONER/PROJECT:

Petition Name: "The Preserve"

II. LOCATION:
The subject property is a fifty-eight acre parcel located at the
southwest corner of Davis Boulevard and County Barn Road in
Collier County, within Section 8, Township 50 South, Range 26
East.
III. DESCRIPTION OF SURROUNDING PROPERTIES:
The proposed rezone is located adjacent to the south side of Davis
Boulevard and is on the west side of County Barn Road. The
surrounding land uses are almost entirely single family with the
exception of the church across County Barn road to the east of the
property.

N - PUD Embassy Woods PUD
S - C-3 and A Vacant land in the commercial zoning and
single family homes on the A zoned land
E - E single family homes
W - E single family homes
IV. PROJECT DESCRIPTION:
The total site area of The Preserve is 58 acres and is proposed to
be developed with multi-family dwelling units. It is anticipated
that the project will contain 232 units housed in 20 buildings, a
clubhouse, pool house and pool.
The surface water management system serving The Preserve will be
designed to provide water quality treatment for the 36. 90 ± acres
of developed area. The water management system will consist of
two (2) lakes totaling 5. 10 acres providing water detention for
runoff from the impervious areas. Surface water runoff will be
collected from the roads, parking lots and landscaped areas by
catch basins and pipe systems for conveyance to the proposed
lakes. Water quality treatment will be accomplished by grassed

swales and landscaped islands which will receive most of the
surface water runoff prior to entering the stormwater system. The
balance of the property's preserve area will be isolated from the
project's water management system through berming, and will be
unaltered to act as a natural flow way to carry historic surface
waters from the east through the property.
A water control structure will be installed at the property line
along County Barn road to provide detention of the surface water
runoff. The control structure will be designed for the 25-year,
3-day storm event. This structure will be a modified Type "C"
catch basin with orifice set at the control elevation, 9 . 5 feet
NGVD. The allowable discharge of 0. 06 cfs/acres (2 . 21 cfs) will
not be exceeded. Preliminary water management calculations will
result in a minimum road center line elevation set at
approximately 12 . 5 ft. NGVD. , and the finished floor elevation at
approximately 14 ft. NGVD.

Engineering & Design, Inc. , dated February 29, 1996, no revisions.
Environmental:
Collier County Environmental Impact Statement for Wallace R.
Devlin, 58 acres located in S8 , T 50S, R 26E, Collier County
Florida, dated February 1996.
IV. STAFF COMMENTS:
Water Management:
Water management concerns will be reviewed at time of site
development plan submittal. This project will be permitted for
surface water management by the South Florida Water Management
District (SFWMD) .
Environmental:
The subject property is a mix of pine flatwoods, saw palmetto
islands and hydric pine to cypress wetlands. It is expected that
approximately one half of the property will be determined to be
jurisdictional to one or more of the agencies. Although some
small areas on site have a great abundance of exotic vegetation,
the vast majority of the site is nearly exotic free.

Strong evidence of wetland hydrology was seen on the parcel
through such indicators as algal matting, water marks and drift
lines (materials that has been transported and deposited by
waterflows) . The recent heavy flooding of this property (starting
with the 16+ inches of rain that the Naples area received in the
'95 rainy season) may have contributed to some of these more
obvious indicators.
The upland areas are divided between pine flatwoods and diversly
vegetated palmetto habitats. There was no evidence of gopher
tortoise on site, nor were there any sitings on the property of
any other protected wildlife with the exception of airplants
(Tillandsia spp) and golden polypody ferns (Phlebodium aureum) .
V. RECOMMENDATIONS:
Staff recommends approval of Rezone Petition No. R-96-4, "The
Preserve" with the following stipulations:
Water Management:
1. An Excavation Permit will be required for the proposed lakes
in accordance with division 3 . 5 of Collier County Ordinance
No. 92-73 and South Florida Water Management District (SFWMD) .
2 . A copy of South Florida Water Management District (SFWMD) with
staff report is required prior to site development plan
approval.
3 . Developer shall coordinate the design of the project with
Collier County Office of Capital Projects Management staff to
ensure the interface with the 4-lane design of county Barn
road which is in progress.
Environmental:
1. All conservation areas shall be recorded on the plat or by
separate instrument at the time of site development review
with protective covenants per or similar to Section 704 . 06 of
the Florida Statues. Conservation areas shall be dedicated on
the plat to the project's homeowners association or like
entity for ownership and maintenance responsibilities and to
Collier County with no responsibility for maintenance.

2 . At the time of submittal of the first Site Development Plan
the petitioner shall provide a management plan (per CCLDC
Section 3 . 9 . 5. 3) for the entire preserve area on site and
shall indicate a schedule for that plan to go into effect.
