PETITION NO: Conditional Use Petition No. CU-96-1
"Naples New Haitian Church of the Nazarene"

REQUESTING: The petitioner proposes to develop the subject
property, impacting approximately 75% of the upland
area and less than 3/4 acre of the wetland area to
build a church and associated infrastructure.

COMMENTS: For a complete record of the proceedings reader is
directed to the tape recording of this meeting,
located in the Office of the Clerk to the Board, 5th
Floor, Building "F" , Collier County, Government
Complex.
The list of Water Management Submittal Requirements
was discussed. The list was to apply to all
petitions, but that Staff may use some discretion as
to whether all items on the list are applicable.
Heidi Ashton was asked to furnish a legal opinion as
to whether the EAB can request this information. She
felt that the EAB had that ability but would look into
it more. The EAB can adopt certain rules and
procedures to help them do their reviews.
MOTION: Made by Mr. Hermanson, seconded by Mr. Wilkison and
carried 6/0, to approve Petition CU-96-1 with amended
stipulations.
STIPULATIONS:
Environmental:
1. The Conditional Use shall be consistent with the
Environmental sections of the Collier County
Growth Management Plan Conservation and Coastal
Management Element and the Collier County Land
Development Code at the time of final development
order approval.
2. Environmental permitting shall be in accordance
with the State of Florida Environmental Resource
Permit rules and be subject to review and approval
by Current Planning Environmental Review Staff.
Removal of exotic vegetation shall be in
accordance with the Collier County Land
Development Code.

3. Prior to Final Site Development Plan approval the
Petitioner shall submit a management plan pursuant
to Collier County Land Development Code, Section
3.9.5.3.
4. All conservation areas shall be recorded on the
plat, or by separate instrument, with protective
covenants per or similar to Section 704.06 of the
Florida Statues. Conservation areas shall be
dedicated on the plat to the project's homeowners
association or like entity for ownership and
maintenance responsibilities and to Collier County
with no responsibility for maintenance.
5. Buffer zones will be placed around wetlands in
accordance with South Florida Water Management
District requirements.
6. Prior to final Site Development Plan approval the
petitioner shall supply a letter from U.S. Fish
and Wildlife Service (USFWS) , indicating that the
Bald Eagle nest which was located to the west of
the property is no longer being used.
Note: The motion for approval was made with the
understanding that Staff will bring back a
report later on the Water Management aspects.

OLD BUSINESS:
ITEM: CU-92-16, "Everglades Private Airboat Tours"
Wildlife Monitoring Reports
COMMENTS: County will correspond with petitioner to inform him
that future monitoring will be based on the five
Florida Game and Fresh Water Fish Commission (FGFWFC)
recommendations listed in Kimberly Polen's memorandum
dated February 7, 1996. Bird names on the surveys
need to correspond to the vernacular names adopted by
the American Birding Associations. Staff was also
directed to see if the petitioner is in compliance
with the other stipulations or their approved
conditional use petition.

COMMENTS: Staff was directed to put a workshop on the April
agenda to discuss the topic:
Staff's Authority on Wetlands Reviews, and exotics
credit, 1: 1 replacement with no net loss.
If Collier County adopts the State's ERP mitigation it
needs to consider amending the 1: 1 language.
Invite SFWMD, ACOE & FDEP staff to attend.

MEETING OF APRIL 3, 1996
I. NAME OF PETITIONER/PROJECT:

II. LOCATION:
The subject property is located on the south side of Rattlesnake
Hammock Road, approximately one mile west of County Road 951 in
Section 22 , Township 50 South, Range 26 East, Collier County,
Florida.
III. DESCRIPTION OF SURROUNDING PROPERTIES:
The project site is bordered by undeveloped agricultural zoned
land to the north and east and by the Lely PUD on the south and
west. Edison Community College lies immediately south of the
subject property.
ZONING DESCRIPTION
N - Agricultural undeveloped
S - Lely Resort PUD developed (Edison Community College)
E - Agricultural undeveloped
W - Lely Resort PUD undeveloped
IV. PROJECT DESCRIPTION:
The proposed project will consist of a maximum of two hundred and
ten (210) multi-family housing units with onsite recreational
facilities, water management lake and preserve areas.
The proposed water management system will consist of a 1. 08 acre
lake with enough retention capacity to treat the first k inch of
runoff before discharging into the 2 .42 acre wetland area onsite.
The wetland and lake will act in concert to provide peak flow
attenuation during major and minor storm events.

The engineer proposes to discharge into a twelve foot (12' )
drainage easement on the south side of the property, through a
control structure sized to limit the rate of discharge to 0. 06
cfs/acre in accordance with County Ordinance No. 90-10.

V. STAFF COMMENTS:
Water Management:
The internal drainage is standard for this type of project.
The twelve foot (12' ) offsite drainage easement shown on the water
management plan may not contain a conveyance swale. Staff did not
make a site visit. If there is no swale, then discharge will be
overland to the south, in random directions dependent on offsite
topography.
Environmental:
The subject parcel is mainly undeveloped with the exception of an
existing single-family home and driveway on the east side of the
property. The southeast corner of the property has been farmed in
the past.
Vegetatively the site contains pine flatwoods, cypress and mixed
forest wetlands, wet prairie, slash pine invaded farmland and
disturbed areas. Dominant vegetation includes slash pine,
melaleuca, cabbage palm, cypress, willow, saw palmetto, Brazilian
pepper, myrsine, pineland snowberry, Spartina, hatpins, blue
maidencane and saw grass. In total Staff observed 69 plant
species on the subject property (Excluding disturbed site plants
and ornamentals around the existing homesite. )

3 . 65 acres of native habitat (20. 8% of the site) are proposed for
preservation. This includes 2 . 42 acres of Collier county
jurisdictional wetlands and 1. 23 acres of upland preserve. 0. 59
acres of Collier County jurisdictional wetlands are proposed for
development.
No listed wildlife species were observed by the petiioner on the
subject property, although red-cockaded woodpeckers and fox
squirrels are known to exist in the project area. The petitioner
proposes preservation of a portion of the forested uplands nearest
the expected foraging habitat link between the known colonies to
the east and southwest of the property. The college immediately
to the south has previously set aside red-cockaded woodpecker
foraging habitat.
A review of the historical/archaeological probability maps of
Collier County indicate no archaeological or historic sites
occurring on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No.
PUD-96-7, "College Park PUD" with the following stipulations:
Water Management:
1. A copy of the South Florida Water Management District (SFWMD)
Permit or Early Work Authorization, with Staff Reports, is
required prior to final site development plan approval.
Environmental:
1. Amend section 4 . 14 of the PUD document to read as follows by
adding the underlined language.
4 . 14 NATIVE VEGETATION RETENTION REQUIREMENTS
Pursuant to Policy 6.4 . 7 of the Conservation and Coastal
Management Element of the Collier County Growth Management
Plan, an appropriate portion of the viably functioning native
habitat shall be retained in buffer areas, around the lake and
within open space areas and preserves as depicted on the PUD
master plan.
Add the following stipulations to Section IX of the PUD document.
2 . Environmental permitting shall be in accordance with the state
of Florida Environmental Resource Permit rules and be subject
to review and approval by Current Planning Environmental
Review Staff. Removal of exotic vegetation shall not be
counted towards mitigation for impacts to Collier County
jurisdictional wetlands.

3 . All jurisdictional wetlands and/or mitigation areas shall be
designated as conservation/preservation tracts or easements on
all construction plans and shall be recorded on the plat,or by
separate instrument, with protective covenants per or similar
to Section 704 . 06 of the Florida Statutes.
4 . At the time of site development plan submittal, petitioner
shall submit a letter from the U. S. Fish and Wildlife Service
(USFWS) regarding red-cockaded woodpecker issues on site.
