REQUESTING: A rezone from "RMF-6 (ST) " to "PUD" , to be known as
David A. Gallman Estate PUD, for a multiple family
project consisting of 330 dwelling units including
those attributable to an affordable housing density
bonus for property.

COMMENTS: For a complete record of the proceedings reader is

Complex.
MOTION: Made by Mr. Hermanson, seconded by Mr. Saadeh and
carried 5/0, to approve Petition PUD-95-14 with
amended stipulations.
STIPULATIONS:
Water Management:
1. A copy of South Florida Water Management District
(SFWMD) Permit or Early Work Permit with staff
report is required prior to construction plan
approval.
2 . An Excavation Permit will be required for the
proposed lake in accordance with Division 3 .5 of
Collier County Ordinance NO. 92-73 and SFWMD
rules.
3 . Developer shall dedicate a thirty foot (30' ) wide
drainage easement along the north boundary of the
project to encompass the top width of the adjacent
ditch that lies within the property and provide
for a maintenance access travel way along the
south side of the ditch.
4 . Prior to final site development plan approval,
developer shall provide evidence that there is
sufficient capacity for the existing drainage
ditch to Haldeman Creek that serves as the
project's outfall at the southeast corner of the
project.

5. At site development plan submittal, PVC bleeders
shall be shown fitted with end structures.
Environmental:
The following stipulations shall be added to the
PUD document
1. All conservation areas shall be recorded on the
plat with protective covenants per or similar to
Section 704 . 06 of the Florida Statues.
Conservation areas shall be dedicated on the plat
to the project's homeowners association or like
entity for ownership and maintenance
responsibilities and to Collier County with no
responsibility for maintenance.
2 . Environmental permitting shall be in accordance
with the state of Florida Environmental Resource
Permit rules and be subject to review and approval
by Current Planning Environmental Review Staff.
Removal of exotic vegetation shall not be counted
towards mitigation for impacts to Collier County
jurisdictional wetlands.
3 . 5. 9 .0 of the PUD document shall be amended to read
" . . .Collier County Current Planning Environmental
Staff. . . " instead of "Project Plan Review" .
4 . 5. 9 .D of the PUD document shall be amended to read
" . . .A final site inspection by Collier County
Environmental Staff shall be required to verify
successful vegetation planting. . . "
5. During final site development plan review xeric
oak habitat shall be maintained to the maximum
extent possible.

STAFF REPORT
MEETING OF MARCH 6, 1996
I. NAME OF PETITIONER/PROJECT:

II. LOCATION:
The subject property is a ten (10) acre parcel located east off
Bayshore Drive, north of Republic Drive in East Naples. The
property is located in Section 23 , Township 50 South, Range 25
East, Collier County Florida.
II. DESCRIPTION OF SURROUNDING PROPERTIES:
The surrounding properties are mainly residential with the
exception of the land to the east which is a part of the East
Naples Community Park. To the north are single family homes and
mobile homes, to the south are single family homes and the west is
a residentially zoned but as of yet undeveloped area.
ZONING DESCRIPTION
N - VR Single family and mobile homes
S - RSF-4 Single family residential
E - PUD East Naples Community Park, County Park
W - RSF-5 Currently undeveloped
IV. PROJECT DESCRIPTION:
The petitioner proposes to develop the subject property, impacting
approximately 75% of the upland area and less than 3/4 acre of the
wetland area to build a church and associated infrastructure.

IV. STAFF COMMENTS:
Water Management:
Staff was not provided with sufficient information to review and
approve this project at this time. The project will be reviewed
for water management at the time of site development plan (SDP)
submittal.
Environmental:
The subject property is a ten (10) acre undeveloped parcel off
Bayshore Drive in East Naples. The site consists of 4 .2 acres of
jurisdictional wetlands. A remnant cypress dome (Taxodium
distichum) approximately acre in size is located near the
southeast corner. Other vegetation within this area include red
bay (Persea borbonia) , wax myrtle (Myrica cerifera) , Brazilian
pepper (Schinus terebinthifolius) and swamp fern (Blechnum
serrulatum) . The petitioner anticipates minimal impacts to the
wetlands and will mitigate in accordance with the reviewing agency
criteria of South Florida Water Management District (SFWMD) and U.
S. Army Corps of Engineers (ACOE) .
The remainder of the site is uplands and is categorized as 1) 3 .24
acre pine flatwoods, 2) . 24 acre xeric oak comprised mainly of
scrub oak (Quercus myrtifolia) , wax myrtle (Myrica cerifera) , saw
palmetto (Serenoa repens) , and chalky bluestem, and 3) a 2 .75 acre
mixed hardwood community which consists mostly of red bay (Persea
borbonia) , sweetbay magnolia (Magnolia virginiana) , and mango
trees (Mangifera indica) .
The consultant surveyed the property for listed species and stated
that none were observed. Since this property is within the
secondary zone of Collier County Bald Eagle Co-09, the petitioner
will be required to contact the appropriate agencies for technical
assistance. March 16, 1994 1 adult and 2 feathered chicks were
observed in this nest by Mr. Joe Bozzo of the Florida Game and
Fresh Water Fish Commission. This nest has since been blown down
but cannot yet be categorized as an inactive nest as the pair may
restart the nest in that tree or in the immediate area.
V. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No. CU-96-1,
Naples New Haitian Church of the Nazarene with the following
stipulations:
Environmental:
1. The PUD shall be consistent with the Environmental sections of
the Collier County Growth Management Plan Conservation and
Coastal Management Element and the Collier County Land
Development Code at the time of final development order
approval.

2 . Environmental permitting shall be in accordance with the State
of Florida Environmental Resource Permit rules and be subject
to review and approval by Current Planning Environmental
Review Staff. Removal of exotic vegetation shall not be
counted towards mitigation for impacts to Collier County
jurisdictional wetlands.
3 . Prior to Final Site Development Plan approval the Petitioner
shall submit a management plan pursuant to Collier County Land
Development Code, Section 3 . 9 . 5. 3 .
4 . All conservation areas shall be recorded on the plat with
protective covenants per or similar to Section 704 . 06 of the
Florida Statues. Conservation areas shall be dedicated on the
plat to the project's homeowners association or like entity
for ownership and maintenance responsibilities and to Collier
County with no responsibility for maintenance.
5. Buffer zones which extend at least fifteen (15) feet landward
from the edge of wetland preserves in all places and average
twenty-five (25) feet from the landward edge of wetland
preserves shall be required.
6. The petitioner shall supply an appropriate wildlife habitat
management plan as required by the U.S. Fish and Wildlife
Service (USFWS) and Florida Game and Fresh Water Fish
Commission (FGFWFC) in relation to the Bald Eagle nest located
to the west of the property, prior to an approval of any final
development order.
