LOCATION: Sections 24 & 25, Township 49 South, Range 25 East; generally bounded on the north by Grey Oaks - Phase 1A, on the east and south by undeveloped Grey Oaks PUD, and on the west by Airport- Pulling Road. III. DESCRIPTION OF SURROUNDING PROPERTIES: ZONING DESCRIPTION N - PUD Grey Oaks - Phase 1A S - PUD Grey Oaks E - PUD Grey Oaks W - C-3 , RMF-6 Airport- Pulling Road, Commercial, Multi-family IV. PROJECT DESCRIPTION: The petitioner proposes to excavate a 39 . 5 acre lake within Grey Oaks - Phase 1B, a future residential and golf course development. The lake will be excavated to a depth of only 12 feet, the depth of a Development Excavation. The petitioner proposes to remove approximately 500, 000 cubic yards of material from the site with a balance of 240, 000 cubic yards remaining on-site. The material remaining will be stockpiled as shown on the plan of record. All road impact fees will be paid prior to issuance of the excavation permit. Plan of Record: Water Management: The Plan of Record for this excavation is titled Grey Oaks- Phase 1B "Lake Excavation Site Plan" sheet 1 of 1 prepared by Wilson, Miller, Barton and Peek, Inc. , dated December 1995, no revisions. Environmental: Grey Oaks - Phase 1B "Aerial North & South" Sheet 2 and 3 of 10 prepared by Wilson, Miller, Barton & Peek, Inc. dated December 1995, no revisions. EAB Meeting 1/3/1996 EX59.558, "Grey Oaks - Phase 1B, Lake #22" Page 2 V. STAFF COMMENTS: Water Management: The proposed Lake #22 will be constructed in a fallow farm field. Presently the existing farm field run-off sheet flows into the Airport Road Canal . After Lake #22 is constructed the sheetflow will be directed to the lake which will discharge via a future control structure into the Airport Road Canal. No control structure is proposed at this time but will be a part of the future construction plans. Prior to issuance of this excavation permit a South Florida Water Management District (SFWMD) Surface Water Permit Modification will be submitted. Environmental: The site is a former farm field. Only clearing of exotics will be required. VI. RECOMMENDATIONS: Staff recommends approval of Commercial Excavation Permit No. 59 . 558, "Grey Oaks - Phase 1B, Lake #22" with the following stipulations: Water Management: 1. The excavation shall be limited to a bottom elevation of -5. 6 ft. NGVD. All disturbed areas proposed for lake excavation shall be excavated to a minimum elevation of -1. 1 ft. NGVD. 2 . Off-site removal of material shall be subject to "standard Conditions" imposed by the Transportation Services Division in document dated 5/24/88 (copy attached) . 3 . The lake littoral zone shall be created and planted as indicated on the Plan of Record. 4 . In order to ensure a minimum eighty percent (80%) coverage of littoral zone planting areas, a performance guarantee, based on a cost estimate to replace the original installed littoral zone plants, will be required upon completion and acceptance of the excavation (Land Development Code 3 . 5. 7 . 2 . 5) . 5. All provisions of Collier County Ordinance No. 91-102 , Division 3 . 5 shall be adhered to. 6. Where groundwater is proposed to be pumped during the excavating operation, a Dewatering Permit shall be obtained from the South Florida Water Management District, and a copy provided to Engineering Review Services for approval prior to the commencement of any dewatering activity on the site. 7 . If trees are to be removed as a result of the excavating operation, a Vegetation Removal Permit, required by Land Development Code, Division 3 . 9 shall be obtained from Collier County Current Planning Section before work shall commence. 9 . A 20 ft. maintenance easement shall be provided around the perimeter of the lake and a 20 ft. access easement to it shall be provided from a right-of-way. The easement shall be accessible to all maintenance vehicles. 10 . Lake setbacks from proposed rights-of-way will be reviewed at time of construction plan submittal. 11. All road impact fees shall be submitted prior to excavation permit issuance. 12 . A South Florida Water Management District (SFWMD) Surface Water Permit Modification shall be obtained prior to issuance of this excavation permit. Environmental: 1. An exotic vegetation removal, monitoring, and maintenance (exotic-free) plan for the site, with emphasis on the conservation/preservation areas, shall be submitted to Current Planning Environmental Review Staff for review and approval prior to construction plan approval. Mulhere, AICP Date Current Planning Manager f: • COLLIER COUNTY TRANSPORTATION SERVICES "STANDARD CONDITIONS" EXCAVATION PERMIT APPLICATIONS INVOLVING OFF-SITE REMOVAL OF MATERIAL The intent of these "Standard Conditions" are to provide excavation permit applicants a summary of conditions which may affect their projects and which should be taken into consideration during all stages of project development: 1 . Haul routes between an excavation site and an arterial road shall be private with property owner (s) approval or be a public collector road built to standards applicable to handle the resulting truck traffic. Where residential areas front collector roads, appropriate turn lanes-, buffer and bikepath shall be required as minimal site improvements and if recommended for approval, shall be so with the condition that the Transportation Services Administration reserves the right to suspend or prohibit off-site removal of excavated material should such removal create a hazardous road condition or substantially deteriorate a road condition; such action by the Transportation Services Administration shall be subject to appeal before the Board of County Commissioners . 2 . Haul routes utilizing public roads shall be subject to road maintenance and road repair or an appropriate fair share by the permittee in accordance with Excavation Ordinance No. 92-73 and Right-of-Way Ordinance No. 82-91. 3 . Off-site removal of excavated material shall be subject to Ordinance No. 92-22 (Road Impact Ordinance) . A traffic and road impact analysis shall be made by the County to determine the effects that off-site removal of excavated material will have on the road system within the excavation project's zone of influence. If appropriate, road impact fees in accordance with Ordinance No. 92-22 shall be paid prior to the issuance of an excavation permit. 4 . The Transportation Services Administration reserves the right to establish emergency weight limits on public roadways affected by the off-site removal of excavated material; the procedure for establishment of weight limits shall be the presentation of an applicable resolution before the Board of County Commissioners. Should weight limits be instituted, the permittee shall be responsible to implement measure to assure that all heavy truck loadings leaving the permit's property conform to the applicable weight restriction. 5 . The Excavation Performance Guarantee shall apply to excavation operations and also the maintenance/repair of public roads in accordance with current ordinances and applicable permit stipulations . • • 6 . Based on soil boring information per Ordinance No. 92-73 , a blasting permit may be appropriate. Should a blasting permit application be submitted and should residential areas exist within one mile of the excavation site, the County reserves the right to deny a blasting permit based on concerns for off-site impacts from blasting at an excavation site. Should a blasting permit be considered and approved, the minimum conditions of approval in addition to conditions per Ordinance No. 92-73 are as follows: A. Structure inventory/monitoring and applicable property owner release as required by the Development Services Director. B. Security bond applicable to private property damage acceptable to the County. C. Control of size/depth/number of charges per blast by the Development Services Director. • D. The right of the County to suspend and/or revoke blasting permit authority should be determined that blasting activities are creating unacceptable off-site conditions either in terms of private property damage and/or related physical effects of blasting operations. 7 . No excavation permit shall be issued until receipt of a release from the Transportation Services Administration applicable to proper mitigation of off-site impacts, meeting of applicable provisions of Ordinance No. 82-91, Ordinance No. 92-22, and Ordinance No. 92-73 . Quinby, Trustee Engineering Consultant: McAnly & Associates, Inc. II. LOCATION: Naples Heritage is an irregular shaped parcel near the southwest corner of Davis Blvd. and C. R. 951, in Sections 4 , 9, and 10 of Township 50 South, Range 26 East. It is generally bounded on the north by Davis Blvd. and property zoned Agriculture (A) and RSF-4 , on the east by C. R. 951 and Naples National Golf Course, on the south by Naples National Golf Course and Wing South Airpark, and on the west by a drive-in theater and property zoned A. III. The water management will use six water control structures to maintain a sitewide control elevation of 10 . 0, which is slightly above the average original site elevation of 9 . 8 NGVD. All lakes are interconnected and the control structures discharge into perimeter conservation areas that sheetflow offsite. The design allows for 66 cfs of inflow through the site from the north. STAFF COMMENTS: Water Management: The developer is applying for a commercial permit to dig the lakes deeper to generate enough fill to raise the residential areas and golf course out of the water. No fill will leave the site. Portions of the site have been previously cleared. Much of the proposed excavation will be done in these areas that were cleared based on a previous development excavation permit. Environmental: The commercial excavation permit will allow for minor relocation of the lake/water management system. Most of the proposed excavation will be done in areas that were previously cleared. The clearing plan calls for re-vegetation of previously cleared areas currently designated as preserve area on the new PUD Master Plan. VI. RECOMMENDATIONS: Staff recommends approval of Commercial Excavation Permit No. 59 . 359 , "Naples Heritage Golf Course" with the following stipulations: Water Management: 1. If the excavation operation is discontinued for sixty (60) calendar days, the remaining stockpiles shall conform to the following criteria: a. The side slopes shall not be steeper than 4 : 1 . b. The stockpile shall be stabilized by seed and mulch. c. If the stockpile exceeds 4 feet in height, 4 foot high fencing shall be provided. 10. As per South Florida Water Management District (SFWMD) requirements, any excavation between -5 . 0 NGVD and -10. 0 NGVD will require water quality sampling to insure that chloride levels remain less than 250 PPM. Environmental: 1. Any areas cleared under pervious permits that are currently indicated as preserve areas on the PUD Master Plan, shall be restored prior to final plat/construction plan approval. A management plan pursuant to Section 3 . 9 . 5. 3 of the Collier County Land Development Code shall be submitted to Current Planning Environmental Staff for review and approval. LOCATION: The subject property is a 143 . 5 acre parcel with approximately 32 acres (not a part of this petition) to be used for a future County Park. It is located on the north side of East U. S. 41 immediately adjacent and west of the Lely Resort PUD property, in Section 33 , Township 50 South, Range 26 East, Collier County, Florida. III. DESCRIPTION OF SURROUNDING PROPERTIES: The property is surrounded by mostly vacant land and some land under development. The north and east property lines abut the Lely Resort PUD which is mostly undeveloped at this time. U. S. 41 is located to the south and the property to the west is mostly Agricultural and unused with a small portion to the northwest in residential use. PROJECT DESCRIPTION: The project consists of a 143 . 5± parcel with three (3) treated effluent storage ponds of approximately 67 . 1 acres. A 32 acre site will be used for excavated soil storage. The remaining 44 acres is made up of berms, wetlands, and forested uplands. The entire site will eventually become a County park/recreation area. EAB Meeting 1/3/1996 CU-95-15, Highland Properties of Lee and Collier, LTD. Page 2 Treated Effluent Storage Ponds set of plans (nine sheets) , prepared by Q. Grady Minor & Associates, P.A. (file name MSSWINDX) , revised 11/13/95 . V. STAFF COMMENTS: Water Management: The ponds are surrounded by berms to elevation 12 . 2 , which is about 7 feet above existing ground. Any rain falling on the ponds will raise the pond water level on a one to one basis. (e.g. a 12" rainfall will raise the water level 12") . Since the maximum anticipated effluent storage elevations is at 9 . 2 NGVD, the engineer put the emergency overflow pipe at elevation 10 . 25 . That allows 100% storage of a 12 . 37" storm, which is the 3 day 72 hour event. This is of course, dependent on Collier County insuring that the effluent storage elevation does not exceed 9 . 2 NGVD. It should be remembered that during extended periods of heavy precipitation, golf course irrigation is at a minimum, water tables are up, and various entities are looking for places to store water. At times like these, water falling on an undeveloped, inundated site, leaves as sheetflow with a runoff coefficient nearing 1. 0 (i . e. 100%) . Environmental: The acreage for the Conditional Use is approximately 143 . 5 acres less the 32 acres proposed for a County Park. Three treated effluent storage ponds will cover approximately 67 acres with the remaining acreage made up of berms around the ponds, preserved wetlands and forested uplands. The jurisdictional wetlands can be described as seventy (70) acres of hydric pine (Pinus elliottii) flatwoods heavily invaded by melaleuca (Melaleuca spp. ) . Other species present include scattered cypress (Taxodium distichum) , wax myrtle (Myrica cerifera) , Brazilian pepper (Schinus terebinthifolius) , wiregrass (Aristida strica) , beak-rush (Rhynchospora microcarpa) , muhly grass Muhlenbergia capillaris) , rush (Fuirena scirpoidea) , Coreopsis sp. , and juncus (Juncus megacephalus) . Approximately thirty-four acres (forty-nine percent) of the wetland area is proposed to be impacted by excavation or filling. Eight acres will be filled and twenty-six (26+) acres will be excavated. South Florida Water Management District (SFWMD) , through the Environmental Resource Permit (ERP) has reviewed the proposed impacts and has required that the wetlands be mitigated at a ratio of . 25 to 1 . That would require eight acres of mitigation for the impacts to 34 acres. The petitioner proposed wetland enhancement, wetland creation and upland enhancement and preservation for a total mitigation credit of 15. 9 EAB Meeting 1/3/1996 CU-95-15, Highland Properties of Lee and Collier, LTD. Page 3 acres (approximately . 5 to 1 ratio) . Exotic removal (which is required by the County) was accepted by SFWMD as part of the enhancement proposal and therefore the mitigation credit acreages that the County would accept might be less than 15 . The Collier County Growth Management Plan Objective 6. 2 states that there shall be no net loss of wetlands and it has been the policy of the Environmental Staff since 1989 to recommend not less than one to one ratios for wetland mitigation. Having spoken to former Staff regarding past projects and minimum accepted mitigation ratios there are no projects that we could recall that were permitted with less than . 5 to 1 ratios and only one or two that were permitted with between . 5 to 1 and 1 to 1 ratios, both of which were reviewed prior to the Growth Management Plan (in 1989) . Approximately sixteen aces of uplands exist on site in the form of small upland islands throughout the hydric pine flatwoods. These islands are made up primarily of slash pine, saw palmetto (Serenoa repens) , rusty lyonia (Lyonia feruginea) , gallberry (Ilex vomitoria) , and tarflower (Befaria racemosa) . A preliminary gopher tortoise survey was conducted by the environmental consultant on December 16 , 1995 and no evidence of use or occupation by gopher tortoise was observed. No evidence of fox squirrels was observed by the consultant but it had been noted in her staff report that a fox squirrel was recently sighted on an upland portion of the property . The remaining fifty seven acres of the property consists of a farm field which will be excavated to create pond C. This upland area was recently disced and poses no environmental concerns. VI. RECOMMENDATIONS: Staff recommends approval of Conditional Use Petition No. CU-95-15, Highland Properties of Lee and Collier, LTD. with the following stipulations: Water Management: 1. An excavation permit will be required in accordance with Division 3 . 5 of Collier County Ordinance No. 92-73 and South Florida Water Management District (SFWMD) Volume IV. Environmental: 1. All conservation areas shall be recorded on the plat or by separate instrument with protective covenants per or similar to Section 704 . 06 of the Florida Statues, prior to Final Site Development Plan approval or issuance of an Excavation permit. Environmental permitting shall be in accordance with the state of Florida Environmental Resource Permit rules and be subject to review and approval by Current Planning Environmental Review Staff . Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier County jurisdictional wetlands. Any additional mitigation, that may be recommended by the Environmental Advisory Board (EAB) and approved by the Board of County Commissioners, above that proposed with this petition shall be submitted with the Site Development Plan package/Excavation permit for review and approval . 3 . An exotic vegetation removal , monitoring, and maintenance (exotic-free) plan for the site, with emphasis on the conservation/preservation areas, shall be submitted to Current Planning Environmental Review Staff for review and approval prior to final site plan/construction plan approval. LOCATION: The subject property is an undeveloped 17± acre parcel located on the south side of S. R. 29 approximately 22 miles southeast of the intersection of Immokalee Road (C. R. 846) and S. R. 29 in Section 11, Township 47 South, Range 29 East, Collier County, Florida. III. PROJECT DESCRIPTION: The proposed project includes 204 affordable housing units, a leasing facility, laundry, maintenance building, accessory recreation facilities, water management lake and open space areas. The proposed surface water management system to serve the project will consist of on-site wet retention/detention to provide for water quality and peak flow attenuation. Discharge will be from a proposed 3 . 5 acre lake through a control structure (elevation 24 . 5 NGVD) into the S. R. 29 roadside swale along the northeast property line. The flow then goes northwest approximately 250 feet to a twin 36" RCP flowing northeast under S. R. 29 to the main canal flowing south along the east side of S. R. 29 . STAFF COMMENTS: Water Management: The lake, as designed, could generate approximately 50, 000 cubic yards of fill , which would raise the 6 . 7 acres of buildings and parking as much as six feet, so offsite hauling of excess fill is a possibility. A commercial excavation permit with appurtenant traffic impact analysis should be considered. The PUD allows offsite hauling of 10% of the material up to maximum of 20 , 000 cubic yards . The 10% maximum would be in the order of 5 , 000 cubic yards, so offsite hauling is also a possibility. The surface water management aspects of the project are common to projects of this character. Environmental: The seventeen acre site consists primarily of pine flatwoods with small areas of unimproved pasture. The dominant species include slash pine (Pinus elliottii) in the canopy, and saw palmetto (Serenoa repens) in the understory. Other species present were live oak (Quercus virginiana) , myrtle oak (Quercus myrtifolia) , cabbage palms (Sabal palmetto) , pawpaw (Asimina reticulata) , rusty lyonia (Lyonia ferruginea) , hog plum (Ximenia americana) , and mulberry (Morus rubra) . A complete list of plant species observed is included in the consultants Environmental Impact Statement. There are no jurisdictional wetlands on site. There are several old agricultural ditches on the property which during the rainy season may hold water and show evidence of limited wetland vegetation. A review of the historical/archaeological probability maps for Collier County indicate no archaeological or historical sites located on the subject property . During the Staff site visit with the environmental consultant and during their site visits, no species of special status were observed. Special care was taken to look for gopher tortoise and scrub jays as they are known to be in the area or were suspected to be on-site. No evidence of any protected species was seen. RECOMMENDATIONS: Staff recommends approval of Planned Unit Development Petition No. PUD-95-13 , Garden Walk Village PUD with the following stipulations: Water Management: 1. The excavation shall be limited to a bottom elevation of +12 . 5 ft. NGVD. All disturbed areas proposed for lake excavation shall be excavated to a minimum elevation of +16 . 5 ft. NGVD. 2 . No excavated material shall be removed from the project site. 3 . The lake littoral zone shall be created and planted and indicated on the Plan of Record. 4 . In order to ensure a minimum eighty percent (80%) coverage of littoral zone planting areas, a performance guarantee, based on a cost estimate to replace the original installed littoral zone plants, will be required upon completion and acceptance of the excavation (Land Development Code Section 3 . 5. 7 . 2 . 5) . No Certificates of Occupancy will be issued until this performance guarantee is submitted. 5. All provisions of Collier County Ordinance No. 91-102 , Division 3 . 5 shall be adhered to. 6. Where groundwater is proposed to be pumped during the excavating operation, a Dewatering Permit shall be obtained from the South Florida Water Management District, and a copy provided to Engineering Review Services for approval prior to the commencement of any dewatering activity on the site. 7 . No blasting will be permitted unless issued a separate permit by Collier County Engineering Review Services. 8 . If trees are to be removed as a result of the excavating operation, a Vegetation Removal Permit, required by Land Development Code, Division 3 . 9 shall be obtained from Collier County Current Planning Section before work shall commence. 9 . A 20 foot maintenance easement shall be provided around the perimeter of the lakes and a 20 foot access easement shall be provided from a right-of-way . The easement shall be provided to Collier County, however, maintenance will be provided by the applicable homeowner' s associations . The following stipulations shall be incorporated into the PUD: A. The PUD shall be consistent with the Environmental sections of the Collier County Growth Management Plan Conservation and Coastal Management Element and the Collier County Land Development Code at the time of final development order approval . B. Petitioner shall show areas of retained native vegetation, as required in Section 3 . 9 . 5 . 5 of the Collier County Land Development Code, on the PUD Master plan or separate plan. Retained areas of native vegetation shall be preserved in their entirety with all trees, understory and ground covers left intact and undisturbed, except for prohibited exotic species removal . The EIS states that 4 . 4 acres will remain in buffer, passive recreation and natural vegetation areas. C. If it is determined that the size of the proposed lake is in excess of what is required for water management and that by reducing the size of the lake the petitioner will be able to preserve additional native vegetation, this shall be done at the time of Site Development Plan review. The stockpile shall be stabilized by seed and mulch. c. If the stockpile exceeds 4 feet in height, 4 foot high fencing shall be provided. 10. As per South Florida Water Management District (SFWMD) requirements, any excavation between -5.0 NGVD and -10. 0 NGVD will require water quality sampling to insure that chloride levels remain less than 250 PPM. Environmental: 1. Any areas cleared under previous permits that are currently indicated as preserve areas on the PUD Master Plan, shall be restored prior to final plat/construction plan approval.
