2. The petitioner shall demonstrate that the outfall
route has the capacity to handle the discharge
from this project and others up and downstream for
the total distance to the Cocohatchee
River/Wiggins Bay estuary. The petitioner shall
also demonstrate that this project has legal means
to use this outfall route as well as the routes
ownership and maintenance responsibilities. Any
necessary improvements to the downstream outfall
route, to the U.S. 41 boxes, shall be constructed
by the applicant.
3. All sites within the industrial area shall conform
to the South Florida Water Management District
rules for pre-treatment of industrial projects.

1. As part of the initial final plat approval, a
conservation easement similar to or as per Florida
Statutes Chapter 704.06 shall be recorded on all

record (EIS dated 6/18/92) , prior to construction
plan/plat approval, a donation of at least
$53,370. 00 shall be accepted by the CREW Trust.
unless additional on-site or off-site mitigation
is approved by South Florida Water Management
District and Collier County to satisfy the
mitigation requirements.
3. PUD language is consistent with the Land
Development Code Section 3.2. and the PUD shall be
revised to require that the final plat illustrate
the preserve boundary line and setbacks as
established by the State and Federal agencies
having jurisdiction.

additional staff.

COMMENTS: Mr. Neale, Chairman was notified by Dr. Martin of his
resignation from the EAB due to relocation. A written
letter of resignation will follow.
A discussion followed concerning the expiration of Mr.
Vidzes' and Ms. Watts terms and the need to advertise
for the three vacancies as of October, 1992 .

III. PROJECT DESCRIPTION:
The subject property is a single mobile home lot located at 34
East Flamingo Drive in Plantation Island, Florida. The lot is
approximately one hundred (100) feet deep by forty-five (45) feet
wide and is adjacent to a man-made canal . An old mobile home
currently exists on the parcel and the petitioner wishes to
replace it. The cabbage palms, ficus and gumbo limbo on site will
not be disturbed during this process to replace the home, and no
additional fill will be used.
IV. STAFF COMMENTS:
This petition qualifies for an exception under Section 2 . 2 . 24 . 8 of
the Collier County Land Development Code. "Where land has an ' ST'
designation and the proposed alteration or development area
contains twenty (20) acres or less in gross area, and where no
transfer of development rights are involved, the Development
Services Director may approve a site alteration plan or a site
development plan. Prior to such approval the Development Services
Director shall make a finding that the following conditions exist:
1. The proposed site alteration or site development will not
require any modification of the topography, drainage, flora or
fauna or the site.
2 . No pollutants will be discharged from the area that will
degrade the air, water or soil below the levels existing at
the time of this application. "

III . PROJECT DESCRIPTION:
The petitioner requests an exception to the Special Treatment
Development Permit to allow the installation of two, 2 , 000 gallon
above ground fuel tanks and a drive slab. The subject site is a
±6. 7 acre parcel zoned A-ACSC/ST located within the Big Cypress
Area of Critical State Concern.

IV. STAFF COMMENTS:
The petitioner proposes to locate the above ground fuel tanks and

II. LOCATION:
North 100 feet of Government Lot 3 , Naples South in Section 14,
Township 51 South, Range 25 East, Collier County, Florida.
III. PROJECT DESCRIPTION:
The subject property is located on Key Island. The lot is
approximately 100 feet wide by 1000 feet long. The lot is zoned
A-ST.
The petitioner proposes to construct a boat dock that is
approximately sixty (60) feet in entire length and four (4) feet
width with a one hundred sixty (160) square foot access platform.

IV. STAFF COMMENTS:
A site visit was conducted on August 6, 1992 by Kimberly J. Polen
of Collier County Project Review Services Environmental Staff and
Bob Reppening of Florida Department of Natural Resources Aquatic
State Preserves.
The site has an existing single family home within the western
half of the parcel, access is by boat from the west. Sea grass
beds consisting of shoal grass (Halodule wrightii) are present
within the intercoastal waterway. Vegetation on site is
characteristic of a xeric tropical hammock as one moves from the
west to east. Vegetation is as follows: sea oats (Uniola
paniculata) , seagrape (Coccoloba uvifera) , prickley pear cactus
(Optunia spp. ) , dune-elder (Iva imbricata) , marsh-elder (Iva
spp. ) , sea myrtle (Baccharis halimifolia) , Australian pine
(Casuarina spp. ) , Brazilian pepper (Schinus terebinthifolius) ,

cabbage palm (Sabal palmetto) , gumbo-limbo (Bursera simaruba) ,
Jamacian dogwood (Piscidia piscipula) , strangler fig (Ficus
aurea) , myrsine (Myrsine floridana) , wild coffee (Psychotria
spp. ) , coco plum (Chysobalanus icaco) , Virginia creeper,
(Parthenocissus quinquefolia) , coin vine (Dalberghia
ecastophyllum) , Christmas-berry (Lycium chrolinianum) , green
buttonwood (Conocarpus erectus) , white mangorve (Laguncularia
racemosa) and red mangrove (Rhizophora mangle) .
The petitioner proposes to construct a boat dock that extends east
and west along the central shoreline of the property. Vegetation
within the proposed location consists of one (1) large Brazilian
pepper at the water line, three (3) green buttonwood that are less
than four (4) inches in diameter at breast height, two (2)
Christmas-berry and one (1) myrsine.
Staff identified an area devoid of any woody vegetation located
approximately eighteen (18) feet north of the south property line.
This altered area was recognized as the best alternative.
Therefore, Staff requested that the petitioner provide additional
environmental impact statement information to substantiate his
proposed alternative verses Staff's recommendation (See Section
3 . 8 . 6 of the Environmental Impact Statement Information) .
V. CONCLUSION:
The petitioner is well aware of the environmental sensitivity of
the Key Island barrier system, and has proposed a structure which
reflects this concern. He is also in a position where he cannot
build a boat dock within less than twenty-five (25) feet from his
south property line unless he receives permission from the
adjacent property owner to the south which has a thicker mangrove
shoreline especially to the south.
VI. RECOMMENDATIONS:
Based on the above considerations Staff recommends approval of
Special Treatment Permit ST-92-16 "Troy Zinser - Boat Dock" with
the following stipulations:
1. Permits or letters of exemption from the U. S. Army Corps of
Engineers, Florida Department of Environmental Regulation, and
Florida Department of natural Resources shall be presented
prior to issuance of a building permit.

2 . All exotic vegetation as defined by the County Land
Development Code shall be removed from the eastern half of the
property and the eastern half of the property shall be
maintained exotics free (Collier County Land Development Code

The petitioner requests an exception to the Special Treatment
Development Permit to allow the replacement of present structures
with new structures of the same size. The petitioner proposes to
use the property for a gallery (exhibiting and selling Florida
art) , a studio and a home.

IV. STAFF COMMENTS:
The petitioner proposes to locate two new structures on previously
altered land that is devoid of vegetation. The environmental
quality of the site and the surrounding areas will not change.

Due to the above considerations Staff recommends administrative

II. LOCATION:
Section 15, Township 48 South, Range 25 East; bounded on the north
by Imperial Golf Course Boulevard, on the east by Park Place West
subdivision, on the south by undeveloped land zoned A-2 and on the
west by the development called Renaissance (previously known as
Veri-Care of Naples) . This tract is part of the Imperial West
PUD.
III. PROJECT DESCRIPTION:
The petitioner proposes to develop 14 . 33 acres of land into nine
buildings with a total of 68 units. There is an existing 4 . 75
acre lake which will be used for water management purposes. The
land will consist of 4 . 75 acre lake, 2 . 55 acres of building area,
2 . 16 acres of roads and parking, 3 . 97 acres of green area, a 0. 69
acre preserve (not to be included in the water management
calculations) and 0. 25 acres of a recreation center.

IV. STAFF COMMENTS:
Water Management:
The proposed project lies within Imperial West Stormwater Master
Plan which has a South Florida Water Management District (SFWMD)
permit for the entire system. The existing 4 . 75 acre lake will be
modified to meet the minimum requirements for an excavation in
accordance with Section 3 . 5 of the Land Development Code and it
will provide capacity to handle the runoff generated by the
proposed project plus any off-site drainage coming onto site.
The project water management system will take off site discharges
from the Veri-Care site to the west and a portion of Imperial Golf
Course Boulevard and route them through the system.
There is an existing control structure located on the south side
of the lake and discharging into Horse Creek which heads south
into the Cocohatchee River. The discharge is being controlled at
7 . 69 cfs. The petitioner will obtain a modification surface
water permit from SFWMD. The water management system has been
designed for water quality and water quantity in accordance with
SFWMD rules and regulations.
Environmental:
The project lies within the watershed of the Cocohatchee River.
Prior to the creation of the existing lake, a tributary identified
as FLUCCS code 626 bisected the property. After the creation of
the lake, over the past decade, the drainage has been flowing
around the western end of the lake which has created a stagnant
low area. Ground elevations within the project site range from
3 . 0 to 7 . 0 NGVD. The historical seasonal high water elevation
appears to have been much higher, maybe as much as a foot, than
the present control elevation of 5. 3 NGVD.
According to Exhibit #5 the Soil Survey of Collier County Area,
Florida - Sheet Number 20 revised 1/90 , the soil types of the site
include mostly Immokalee fine sand with a small area of Satellite
fine sand in the southeast corner. Soils in the designated
wetland areas are all hydric.
There are approximately 5 . 01 acres of jurisdictional wetlands on
site (35% of the site) , of which 0 . 61 acres consists of forested
wetland, 1 . 34 acres consists of freshwater marsh and 3 . 06 acres
consists of borrow areas.

Fifty percent (50%) of the site consists of the following upland
habitats: palmetto prairie (0 . 62 acres) ; pine flatwoods (5. 66
acres) ; and pine-mesic oak (0. 85 acres) .
The remaining fifteen percent (15%) consists of spoil area around
the main-made lake.
In order to compensate for the twenty percent (20%) of the Collier
County jurisdictional wetlands proposed to be impacted, the
applicant is proposing to create, restore, and enhance the entire
west end of the lake into a gradually sloped, diverse wetland
system that will connect into the stream. Also the applicant is
proposing to preserve approximately one (1) acre of upland and
to creat additional littoral shelves within the lake perimeter.
Due to the fact that the property is located close to the
secondary zone of Bald Eagle Nest 2001, Staff recommends that
slash pines and snags be retained within the development
landscaping to serve as a visual buffer for the eagles and as
potential future roosting sites.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
PSP-92-8 , "Manors at Regal Lake" with the following stipulations:
Water Management:
1. The lake as shown shall meet all the construction requirements
for a development excavation in accordance with Division 3 . 5.7
of the Land Development Code.
Environmental:
1. Prior to final construction plan/plat approvals the applicant
shall submit all Federal, State and Local determinations and
permits, waivers/exemption determinations that may relate to
or effect the design and layout of said final construction
plans/plats.
2 . Jurisdictional wetlands and/or mitigation areas shall be
designated as conservation/preservation tracts or easements on
the final construction plans and shall be recorded on the plat
with protective covenants as per or similar to Chapter 704 . 06
of the Florida Statutes.

III. PROJECT DESCRIPTION:
The developer proposes to subdivide a 31. 81 acre parcel of land
into 42 single family residential lots with an internal road and
two (2) lakes. Arbor Boulevard, which will provide access to the
development, will be built in conjunction with the project. The
area breakdown will consist of 5 . 31 acres of right-of-way, two (2)
9 . 29 acre lakes, 1 . 06 acres of buffers and easements and 15 . 15
acres of lot area.

IV. STAFF COMMENTS:
Water Management:
The proposed project lies within the Vineyards PUD which has a
Master Water Management System. Within the proposed project site,
the runoff generated by the development will be collected via

swales, valley gutters, catch basins and pipes and it will be
conveyed to the two proposed lakes. The lakes will store the
water quality and water quantity requirements as per South Florida
Water Management District (SFWMD) rules and regulations. These
lakes will be connected through pipes to the existing lakes which
form the stormwater system for the Vineyards.
The petitioner will obtain a SFWMD surface water modification
permit prior to any construction plans approval. This project is
required to be reviewed and approved by the Environmental Advisory
Board (EAB) since the proposed lakes were never part of the
Vineyards PUD Master Plan. Also, the petitioner is required to
obtain an excavation permit for the proposed lakes, in accordance
with Division 3 . 5 of the Land Development Code.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
PSP-92-10 , "Arbor Estates" with the following stipulations:
Water Management:
1. The lakes as shown do not appear to meet the minimum setbacks
from the right-of-way. Exceptions to these setbacks may be
developed and shall be subject to final approval by the
Development Services Director. Said exceptions shall be based
on recognized standards for traffic engineering and road
design (AASHTO) and shall incorporate such factors as road
alignment, travel speed, bank slope, road cross-section, and
need for barriers. This shall be done at the time of
excavation permitting.
2 . Landscape buffer and lake areas shall be kept separate unless
approved by Project Review Services.
3 . A SFWMD permit for the development of that portion of Arbor
Boulevard which will serve the proposed project shall be
obtained prior to final construction plans approval.
Environmental:
1. All previous environmental standards of the Vineyards PUD
Ordinance No. 85-15 shall continue to apply.

III . PROJECT DESCRIPTION:
The petitioner is requesting a planned unit development amendment
to the "Cypress Glen PUD" , to reduce density for 9 . 4 to 7 units
per acre to comply with the comprehensive plan. The PUD consists
of 29 . 67 acres of land; 2 . 7 acres consist of lakes, 0 . 52 acres are
for an oak hammock, 9 . 88 acres of cypress slough, 0 . 28 acres will
be reserved for recreation area, 5 . 3 acres will be used for
buildings, 6 . 4 acres will consist of pavement and 4 . 59 acres will
be for pervious areas .

IV. STAFF COMMENTS:
Water Management:
The water management system for this project is being divided into
three (3) sub-basins . Sub-basin 1 consists of the upland area
just east of the cypress slough. Sub-basin 2 is the upland area
west of the cypress slough and sub-basin 3 is the cypress slough.

Sub-basin 1 is proposed to have a water management system
consisting of two lakes which have been sized to handle the runoff
generated by a 25-year, 3-day duration storm event. The runoff
will be conveyed to the lakes through swales and/or pipes. The
lake located on the north side of property will discharge via a
spreader swale into the slough. The lake on the south side will
have a three (3) inch bleed-down mechanism which will be directed
into the Pine Ridge Road swale.
Sub-basin 2 contains approximately 2 . 5 acres of area, and due to
the small amount of impervious surface (±1. 70 acres) and the
separation from Basin 1 by the cypress slough the drainage will be
designed for water quality only and it will discharge into the
cypress slough through a spreader swale.
Sub-basin 3 which encompasses the 9 . 88 acres of cypress slough
will remain in its natural state and it will continue flowing in a
southerly direction into the Pine Ridge Road swale.
There will be a road built across the cypress slough which will
incorporate properly sized culverts in order to maintain
historical flow of the area. The discharge from Basin 1, will be
limited to 0 . 06 cfs/acres or to the minimum size bleeder in
accordance with Ordinance No. 90-10 and South Florida Water
Management District rules.
The water management system meets all the requirements for water
quality and water quantity in accordance with South Florida Water
Management District rules .
Environmental:
The petitioner proposes a density reduction and associated
configuration changes to the PUD and Master Plan. The areas
proposed for environmental preservation have either remained
unchanged (Oak Hammock) or increased slightly in size (Cypress
Slough) .
The only major impact to the slough is a single access roadway,
along the northern boundary of the property, which cuts across the
slough. Best engineering principles, including use of culverts
shall be utilized to ensure continued sheet flow within the
wetland system.
An updated cursory wildlife survey was conducted between March 24 ,
1992 and April 2 , 1992 to determine the status of listed species
on the site. No listed species were observed on the upland
portion of the project. No listed animal species were observed in
the wetland area; listed plant species (butterfly orchids, twisted
air plants) shall be retained within the preserved slough.

V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Amendment
PUD-87-18 (1) "Cypress Glen PUD" subject to the following
stipulations:
Water Management:
1. Prior to construction plans approval, verification on the
capacity of Pine Ridge Road swale to handle the project
discharge shall be submitted. If improvements are deemed
necessary, then the improvements shall be provided by the
petitioner.
2 . A South Florida Water Management District permit shall be
obtained and a copy of the permit provided prior to final
construction plans approval. Even though the size of the
project is less than forty (40) acres, due to the impact to
the wetlands, the County will not issue the water management
permit.
Environmental:
The following changes shall be made to the proposed PUD document:
1. Section 4 . 04 (a) through (d) shall be deleted and replaced
with "The petitioner shall comply with all applicable
environmental sections of the Collier County Land Development
Code, its amendments and the Collier County Growth Management

IV. STAFF COMMENTS:
Engineering/Water Management/Environmental:
Southwoods PUD is a proposed 400 site TTRV project which may
include a clubhouse, recreational facilities, accessory uses, a
cypress preserve and a lake.
Of the 101. 3 acres, 92 . 3± acres constitute the water management
basin. Excluded are 4 . 8 acres of cypress preserve and 4 . 2
acres of road/utility easements which are located outside of
the water management isolation berm. The entire water
management basin drains to a 34 . 9 acre lake which discharges to
the south via a control structure that is set at 2 . 5 NGVD. The
stormwater will be directed to the lake through a system of
rear yard swales, roadside swales, and catch basin and piping
networks .
The 34 . 9 acre lake is designed in accordance with the
Settlement Agreement. The maximum depth of 20 ft. is allowed
under Section 3 . 5 of the Land Development Code for Commercial
Excavations. A littoral shelf equal to 10% of the shoreline
shall be provided. The Collier County Transportation
Department will perform a road impact analysis for this project
and calculate the appropriate road impact fees.
The control elevation equals the permitted control elevation of
the Marriott golf course development immediately south of
Southwoods. The peak 25 year stage is 4 . 92 NGVD and the peak
25-year discharge rate is 11. 23 cfs. The 100-year stage is
5 . 40 NGVD.
Natural drainage of the site is in a northeast to southwest
direction. Sheetflow from the north flows across the property
and is collected by a ditch located in the Championship Drive
right-of-way. This interceptor ditch discharges south and west
via the S.R. 951 right-of-way ditch and a drainage pipe under
Championship Drive discharging in Marco Shores PUD. Elevations
at the site range from 2 . 3 ft. to 3 . 8 ft. above mean sea level.
Most of the site averages 3 . 0 .
A berm along the north property line will divert around the
site the off-site flow that presently enters the site from the
north. An on-site swale will be constructed along the east
property line that diverts run-off around the east side of the
site to the inceptor ditch located along the south property
line. The diverted run-off will ultimately discharge through
cross-drains underneath Championship Drive and flow
southwesterly as it did prior to development.

The subject property is entirely within the boundaries of lands
deemed "Development Areas" by the Stipulation for Dismissal and
Settlement Agreement, dated July 20, 1982 , between Deltona
Corporation, various agencies of the State of Florida,
conservation intervenors and Collier County.
To conform with the Settlement Agreement, post-development
discharge shall not exceed pre-development rates for the
25-year/3-day storm and off-site drainage entering a
development area must be collected and conveyed via systems
that are independent or isolated from the internal drainage
systems. Off-site drainage systems and internal drainage
systems may share spreader waterway outfalls.
This project meets South Florida Water Management District
rules for water quality and water quantity.
V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition
No. PUD-92-06 "Southwoods" and Commercial Excavation Permit No.
59 . 228 with the following stipulations:
Water Management:
The following stipulations apply to Petition PUD-92-5.
1. The petitioner shall adhere to the requirements of Exhibit
E - "Conceptual Drainage Design Criteria" of the
Stipulations for Dismissal and Settlement Agreement dated
July 20 , 1982 .
2 . Should the South Florida Water Management District, or any
other agency, during its review process require significant
changes be made to the site plan and/or the water
management facilities, Collier County reserves the right to
re-review the project and have it heard by the
Environmental Advisory Board.
3 . A twenty (20) foot access easement shall be provided to
allow access to the lake.
4 . A littoral shelf shall be provided on the lake equal to 10%
of the shoreline. The type, quantity and spacing of plants
shall be submitted to Project Review Services for approval.
5 . The commercial excavation permit cannot be issued until the
Planned Unit Development Petition No. PUD-92-6 is approved
by the Board of County Commissioners.

2 . At such time as the petitioner has prepared final
construction plans (site development plans, construction
plans/plat) for any phase of the proposed development, the
petitioner shall submit such plans to the Florida
Department of Environmental Regulation, South Florida Water
Management District, and the Conservancy Inc. in accordance
with the provisions of the "Stipulation for Dismissal and
Settlement Agreement" dated July 20, 1982 .
The following stipulations apply to the Commercial Excavation
Permit EXC. 59 . 228 .
1. The excavation shall be limited to a bottom elevation of
-17 . 5 ft. NGVD. All disturbed areas proposed for lake
excavation shall be excavated to a minimum elevation of
-4 . 0 ft. NGVD.
2 . Off-site removal of material shall be subject to "Standard
Conditions" imposed by the Transportation Services Division
in document dated 5/24/88 (copy attached) .
3 . Where groundwater is proposed to be pumped during the
excavating operation, a Dewatering Permit shall be obtained
from the South Florida Water Management District, and a
copy provided to Project Review Services for approval prior
to the commencement of any dewatering activity on the site.
4 . No blasting will be permitted unless issued a separate
permit by Collier County Project Review Services.
5 . If trees are to be removed as a result of the excavating
operation, a Tree Removal Permit, required by Ordinance No.
91-102 , Division 3 . 9 shall be obtained from Collier County
Project Review Services before work shall commence.
6. Revise the side slopes within the littoral zone to 6: 1
unless approved otherwise by the South Florida Water
Management District. The lake littoral zone shall be
created and planted as indicated on the Plan of Record with
the above revision.
7 . Copy of South Florida Water Management District
construction/operation permit or early work permit shall be
provided prior to excavation permit approval.

8 . This approval is subject to the approval of the Board of
County Commissioners of Land Use Petition No. PUD-92-6.
9 . No Excavation Permit shall be issued until all impact fees
have been paid.
10. The water quality monitoring program shall be amended as
follows and shall be submitted to and approved by Project
Review Services prior to this petition being heard by the
Collier County Board of County Commissioners:
a. Samples at MW-1 shall be taken from a depth of 16 ' -19 ' .
Samples at MW-2 shall be taken at a depth of 11 ' -14 ' .
Samples at MW-3 shall be at a depth of 6 ' -9 ' .
b. The tests shall be conducted weekly for the first 2
weeks of excavation and then biweekly until the
excavation is complete.
c. Based upon the petitioner ' s claim that no pumping will
occur at this excavation, a tolerance limit of 20%
shall be used. If the tests show results outside the
20% tolerance, another test shall be performed to
verify the previous test ' s results. The results from
the second test shall be made available to Project
Review Services within three (3 ) working days and if
they are still outside the 20% tolerance, all
excavation activity shall cease until tests show the
samples are within the 20% tolerance.
If pumping does occur, the tolerance limit shall be
reduced to 10% . If the test results show results
outside the 10% tolerance, another test shall be
performed to verify the previous test ' s results. The
second test shall be made available to Project Review
Services within three (3) working days and if they are
still outside the 10% tolerance, all pumping shall
cease until the results are within the 10% tolerance.
The water quality monitoring program shall be
implemented, as submitted.
11. Work within and improvements to S.R. 951 shall be
coordinated with and permitted by the Florida Department of
Transportation.

12 . Work within Collier County right-of-way shall meet the
requirements of Collier County Right-of-Way Ordinance No.
82-91. The access drive detail shall be revised to show
the apron as being paved. The right-of-way permit shall be

COLLIER COUNTY TRANSPORTATION SERVICES
"STANDARD CONDITIONS"
EXCAVATION PERMIT APPLICATIONS INVOLVING
OFF-SITE REMOVAL OF MATERIAL
The intent of these "Standard Conditions" are to provide excavation
permit applicants a summary of conditions which may affect their
projects and which should be taken into consideration during all
stages of project development:
1. Haul routes between an excavation site and an arterial road
shall be private with property owner(s) approval or be a public
collector road built to standards applicable to handle the
resulting truck traffic. Where residential areas front
collector roads, appropriate turn lanes, buffer and bikepath
shall be required as minimal site improvements and if
recommended for approval, shall be so with the condition that
the Transportation Services Administration reserves the right
to suspend or prohibit off-site removal of excavated material
should such removal create a hazardous road condition or
substantially deteriorate a road condition; such action by the
Transportation Services Administration shall be subject to
appeal before the Board of County Commissioners.
2 . Haul routes utilizing public roads shall be subject to road
maintenance and road repair or an appropriate fair share by the
permittee in accordance with Excavation Ordinance No. 91-102
and Right-of-Way Ordinance No. 82-91.
3 . Off-site removal of excavated material shall be subject to
Ordinance No. 85-55 (Road Impact Ordinance) . A traffic and
road impact analysis shall be made by the County to determine
the effects that off-site removal of excavated material will
have on the road system within the excavation project' s zone of
influence. If appropriate, road impact fees in accordance with
Ordinance No. 85-55 shall be paid prior to the issuance of an
excavation permit.
4 . The Transportation Services Administration reserves the right
to establish emergency weight limits on public roadways
affected by the off-site removal of excavated material; the
procedure for establishment of weight limits shall be the
presentation of an applicable resolution before the Board of
County Commissioners. Should weight limits be instituted, the
permittee shall be responsible to implement measure to assure
that all heavy truck loadings leaving the permit' s property
conform to the applicable weight restriction.
5. The Excavation Performance Guarantee shall apply to excavation
operations and also the maintenance/repair of public roads in
accordance with current ordinances and applicable permit
stipulations.
6. Based on soil boring information per Ordinance No. 91-102 , a
blasting permit may be appropriate. Should a blasting permit
application be submitted and should residential areas exist
within one mile of the excavation site, the County reserves the
right to deny a blasting permit based on concerns for off-site
impacts from blasting at an excavation site. Should a blasting
permit be considered and approved, the minimum conditions of
approval in addition to conditions per Ordinance 88-12 are as
follows:
A. Structure inventory/monitoring and applicable
property owner release as required by the County
Engineer.
B. Security bond applicable to private property damage
acceptable to the County.
C. Control of size/depth/number of charges per blast by
the County Engineer.
D. The right of the County to suspend and/or revoke
blasting permit authority should be determined that
blasting activities are creating unacceptable
off-site conditions either in terms of private
property damage and/or related physical effects of
blasting operations.

II. LOCATION:
Section 34 , Township 49 South, Range 26 East; bounded on the north
by the Golden Gate Canal and Golden Gate Unit 8 , on the east by
CR 951, and by vacant lands to the south and west.
III. PROJECT DESCRIPTION:
The petitioner proposes to develop a 74 . 23 acre hospital/medical
center with associated office, retail and group housing areas.
Other uses will include residential areas, roadways, lakes and
open space/buffer areas. Approximately 12 . 00 acres will be used
for medical related office/group housing, 6 . 00 acres for medical
related office/retail , 11 . 00 acres for the hospital/medical
center, 22 . 15 acres for residential, 5 . 33 for major rights-of-way,
7 . 75 acres for lakes and 10 . 00 acres for open space/buffers.

IV. STAFF COMMENTS:
Water Management:
This project lies within the Main Golden Gate System and is part
of the Main Golden Gate Canal Sub-basin. The proposed surface
water management system will consist of lakes and detention areas
to provide the required storage volume. The surface waters will
be directed to the storage areas by storm sewer networks, swales
and overland flow.

The project is divided into two inter-connected basins. Basin 2 ,
the southern basin, will cascade into Basin 1, the northern basin.
The control elevations for Basin 1 and 2 are 7 . 0 ft. NGVD and 7 . 5
ft. NGVD, respectively. The project ' s control structure is
located in Basin 1 and consists of a circular bleed-down orifice
at control elevation 7 . 0 ft. NGVD and a rectangular overflow
orifice at crest elevation 8 . 6 ft. NGVD. The project will outfall
to the Golden Gate Canal.
Currently the northern quarter of the site sheetflows directly
into the canal. The remainder of the site first sheetflows into
the undeveloped property to the south then flows westerly to the
drainage easement that lies along this projects western boundary,
then flows into the canal . The average grade on-site is
approximately 11 . 4 ft. NGVD. The post-development discharge rate
for this project will equal the pre-development discharge rate of
0. 15 cfs/acre.
This project meets the South Florida Water Management District
rules for water quality and water quantity.
Environmental:
The property has been classified as 7 . 2 acres herbaceous range
land, 28 . 6 acres palmetto prairie, 37 acres pine flatwoods (xeric)
and 1. 4 acres melaleuca. A population of gopher tortoises
(Gopherus polyphemus) exists within the palmetto prairie. A total
of 32 burrows were observed including active, inactive and
abandoned. The burrows were found in two groups on the western
three-fourths of the site. They were monitored for two weeks
during which time it was determined that eleven burrows showed
evidence of activity. The petitioner proposes retaining the
gopher tortoises on site.
Florida Game and Fresh Water Fish Commission has notified Staff
and the petitioner of a red-cockaded woodpecker (Picoides
borealis) colony on property to the south, and recommends
retention of foraging habitat on site.
To meet the preservation requirements in the Collier County Land
Development Code the petitioner has proposed retention of
twenty-five percent (25%) of each site as it applies for an
individual site development plan.
A portion of the site lies within ground water protection zone W-4
of the Florida Cities Wellfield. There are no jurisdictional
wetlands on site.

V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition
PUD-92-4 "Golden Gate Health Park" with the following
stipulations :
Water Management:
1. Should the South Florida Water Management District, or any
other agency, during it ' s review process cause changes to be
made to the site plan or drainage facilities, Project Review
Services shall reserve the right to re-review the project and
have it brought before the Environmental Advisory Board.
2 . A 20 ft. maintenance easement shall be provided to Collier
County along the southern side of the Golden Gate Canal, the
entire length of this projects northern property line. This
easement shall be continuous, non-obstructed and accessible to
the County ' s maintenance equipment. All buffers shall be
located outside of the canal maintenance easement.
3 . A 20 ft. maintenance easement shall be provided around the
perimeter of each lake along with an access easement to each
lake.
Environmental:
1. Prior to preliminary subdivision plat (PSP) approval:
a. A gopher tortoise management plan shall be submitted to
Florida Game and Fresh Water Fish Commission and Collier
County Project Review Services for review and approval.
The plan shall emphasize the retention of burrows within
appropriate on-site habitat.
b. A management plan for retention of red-cockaded woodpecker
forage habitat protection shall be submitted to Florida
Game and Fresh Water Fish Commission and Collier County
Project Review Services for review and approval. This
area may encompass all or part of the gopher tortoise
habitat area, if appropriate to both species.
c. The native habitat retention requirement shall be
delineated on the preliminary subdivision plat. This area
shall encompass preserve areas for listed species.
d. The approximate limits of ground water protection zone W-4
shall be delineated on the preliminary subdivision plat.

2 . Prior to final site development plan approvals a management
plan for all individual areas of preserved plant communities
larger than one half ( Z) acre in area, as required by Collier
County Land Development Code Section 3 . 9 . 5 . 3 , shall be
provided to Project Review Services Environmental Staff for
review and approval .
