Environmental:

approval the petitioner shall submit a plan
showing all areas of native vegetation to remain.
A note shall be put on the plan referencing these
areas as required native vegetation retention per
the Lely PUD. These areas of preservation shall
correspond with an accepted (by Collier County
Project Review Services) plan showing 111.3 acres
native vegetation to be retained for Lely A Resort
Community within the golf course district.

3. Prior to final plat approval jurisdictional

Statutes.
4. Prior to final plat approval the petitioner shall
provide evidence that Florida Game and Fresh Water
Fish Commission has reviewed the proposed

Cypress Basin and submitted prior to final

2 . Prior to construction plans approval, if any
additional maintenance easements along the west
side of Golden Gate Canal are needed, petitioner
shall provide any needed portion that might lie
within the project site.
Environmental:
1. A minimum separation distance between protected
wetlands and proposed lake(s) shall be two hundred
(200) feet unless adjacent lakes are controlled at
the lichen/water marks of the affected wetlands.
Any deviation from the two hundred (200) foot
separation distance shall require substantiation
data and South Florida Water Management District's
approval which shall be submitted to Project
Review Services prior to final approvals.
2 . Should the Florida Game and Fresh Water Fish
Commission (FGFWFC) have any comments or
recommendations regarding this proposed project,
the design of the golf course layout, buildings
and associated structures, and infrastructure may
have to be adjusted to comply with the
requirements of the FGFWFC.
3. Jurisdictional wetlands and mitigation areas shall
be designated as conservation/preserve tracts or
easements on all construction plans and shall be
recorded on the plat with protective covenants per
or similar to Chapter 704.06 of the Florida

ITEM: Old Business
COMMENTS: EAB members discussed that there has been no update as
to the status of Environmental Compliance Inspectors
review of environmental stipulations to development
orders. Previous concerns were that due to the new
Land Development Code, effective November 13 , 1991,
Environmental Inspectors were required to perform
landscape reviews for certificate of occupancy over
50% of their time. A suggestion had been made to
Development Services Director, David Pettrow to
recommend that other Code Inspectors be cross trained
to do landscape reviews to allow the Environmental
Inspectors time to perform the more specialized
reviews. EAB members asked Staff the status.
Staff related that to their knowledge, no cross
training has occurred and that there may be a
possibility that one of the two Compliance
Environmental Specialist II positions will be cut from
the County budget effective October 1992 .
Chairperson, Patrick Neale stated that he would call
David Pettrow to determine the status of the position
and the cross training. Should the Environmental
n Specialist II position be in question, the EAB agreed
that a letter should be forwarded to the Board of
County Commissioners supporting the need for retaining
the Environmental Specialist II position.

ITEM: Habitat Protection Ordinance Update
COMMENTS: EAB members were informed that Fran Stallings has been
hired as the new Director of Natural Resources. He is
the contact person for the Habitat Protection
Ordinance.

II. LOCATION:
Sections 9 & 10, Township 48 South, Range 25 East; bounded on the
west by U.S. 41 and on the north, south and east by the Cypress
Head (Sterling Oaks) PUD.
III. PROJECT DESCRIPTION:
The petitioner proposes to develop a twelve lot subdivision and
the associated infrastructure necessary to support it. The lots
are part of Phase I of the Cypress Head PUD (Ordinance No. 81-80) .
The Sterling Oaks project encompasses 30.54 acres of the total 198
acres. The site utilizes 0. 67 acres for buildings, 6. 6 acres for
pavement and tennis courts, 11. 1 acres impervious, 9 . 37 acres will
remain undisturbed and 2 .80 acres will be used as dry detention
areas.

IV. STAFF COMMENTS:
Water Management:
This project is part of the Cypress Head PUD which was last
revised by PDI Resolution No. 91-3 on October 17, 1991. The
petitioner has applied to the South Florida Water Management
District (SFWMD) for a Conceptual Permit for the entire PUD and
for a Construction and Operation Permit for Phase I.

The Cypress Head PUD contains ±198 acres and is located
approximately 250 feet south of the Lee County line. The existing
master plan allows for the development of single and multi-family
homes, golf course and clubhouse, nature park, playground, roads
and wetland preservation areas. The PUD allows for a total of 740
units. This project is planned for 12 single family lots and will
eventually include a portion of the recreation facilities. Roads
and utilities will be stubbed to allow for future expansion of the
infrastructure.
This project is designed to stand on its own in regards to water
management, however, the dry detention areas are proposed to be
future residential areas when, and if, the Cypress Head PUD is
built. The entrance road has been relocated to the south to avoid
a conflict with a SFWMD jurisdictional line. If the
jurisdictional line is not mitigated for, the roadway will remain
as it is shown, with a reverse curve at the entrance to make it a
smooth transition.
The project is designed for the 25 year 3-day storm and will
utilize dry detention. The existing grades on the site range from
9. 0 feet to 14 . 0 feet NGVD. The proposed control elevation is
10. 5 feet. The two dry detention basins will flow into spreader
swales which will in turn discharge via sheet flow into the
on-site wetlands. A berm will be built around the site at the
25-year 3-day storm elevation.
The water management system meets the minimum requirements of the
South Florida Water Management District for water quality and
water quantity.
Environmental:
The subject parcel is a 30. 54± acres section of the Cypress Head
PUD. The vegetation on site consists primarily of pine flatwoods
along with a pond/marsh, oak hammocks, scrubby flatwoods, wetlands
devoid of vegetation, and wet prairies. No listed species were
observed on site, but the pond/marsh system is potential habitat
for species of special concern such as the little blue heron
(Egretta caerulea) and tricolored heron (Egretta tricolor) .
Proposed infrastructure, single family lots, and recreational
facilities will avoid wetlands except for an area of wet prairie
and non-vegetated wetland on the eastern boundary of the parcel.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
PSP-92-1 "Sterling Oaks" with the following stipulations:

1. If during the course of the South Florida Water Management
District permit review process, substantial changes are made
to the site plan and/or drainage facilities, the County
reserves the right to re-review the Preliminary Subdivision
Plat petition and have the petition heard again by the
Environmental Advisory Board.
Environmental:
1. Prior to construction plan/plat approval petitioner shall,
indicate the area of Collier County jurisdictional wetlands
proposed for impact, and the area and location of wetland
re-vegetation proposed as mitigation in the plan of record,
per Collier County Growth Management Plan - Conservation and
Coastal Management Element. Mitigation area(s) shall be
placed under a conservation easement similar to or as per
Florida Statutes Chapter 704 . 06.

III. PROJECT DESCRIPTION:
Sterling Oaks is located in northern Collier County with road
frontage on both U. S. 41 and Old U. S. 41 Road. The north
property line of Sterling Oaks is the Collier/Lee County line.
The project contains ±248 acres and is proposed for single and
multi-family development (799 units) and small commercial and
industrial areas.

IV. STAFF COMMENTS:
Water Management:
The project contains ±248 acres of which ±100 acres will be
preserve and ±7 acres which will be preserve buffers. The
impervious area will be ±122 acres of buildings and pavement. A
total of ±19 acres of lakes and marshes are also planned.
Water quality areas are planned to insure that runoff from
developed areas will not adversely impact wetlands. Culverts and
bubblers have been designed to provide protection from flooding
during storms of 100-year frequency. The majority of the runoff
will be directed to the lake system before discharging into the
wetlands. Some runoff will be directed to water quality areas
before being discharged into the wetlands.
The lake networks are individually hydraulically connected by
culverts. The water is directed into the lakes through swales and
catch basins and piped through the individual basin networks.
Each network overflows into the preserve area at elevation 10. 5
feet. Three of the lakes employ bubblers at the dry season water
table to insure that the natural hydroperiod is not altered.
Two projects (Spanish Wells and Springs Plaza) that abut the north
property line currently discharge through Sterling Oaks via
spreader swales parallel with the northern property line. Spanish
Wells is permitted to discharge into a spreader swale a total of
18.72 cfs. Springs Plaza is also permitted to discharge into a
spreader swale a total of 8 . 69 cfs. The discharge from these two
projects will be collected by a swale and conveyed via catch
basins and culverts into the Sterling Oaks water management
system.
Outfall from the project will occur from the large preserve area
along the eastern boundary. The control structure has been
designed to allow a peak discharge enough to handle the off-site
inflow while not exceeding the allowable discharge of this
project. The project outfall will be discharged into the western
swale within the Old U. S. 41 Road right-of-way. The swale will
be improved to allow free flow of the Sterling Oaks discharge as
well as any upstream or downstream contributories. The outfall
path continues south into a County drainage canal that flows into
the Cocohatchee River/Wiggins Bay estuary.

The water management system meets the minimum requirements of the
South Florida Water Management District for water quality and
water quantity.
Environmental:
The site contains ±145. 7 acres of Collier County jurisdictional
wetlands. The petitioner proposes to preserve ±101. 6 of those
acres and to encroach into ±44 . 1 acres. As detailed in the
Environmental Impact Statement, the petitioner proposes
restoration and creation of wetlands along with preservation of a
3 .4 acre oak hammock as compensation for wetland encroachment. As
further compensation, the petitioner proposes a donation of
$53, 370. 00 to the CREW Trust for wetland acquisition and
preservation.
Three species of special concern were observed on site, little
blue heron (Egretta caerulea) , reddish egret (Egretta rufescens)
and snowy egret (Egretta thula) . No other listed species were
observed on site.
V. RECOMMENDATIONS:
Staff recommends approval of rezone petition PUD-92-5, "Sterling
Oaks PUD" with the following stipulations:
Water Management:
1. Should the South Florida Water Management District, or any
other agency, during its review process, require changes to be
made to the site plan or drainage facilities, Collier County
reserves the right to re-review this petition and if
necessary, have the petition heard again by the Environmental
Advisory Board.
2 . The petitioner shall demonstrate that the swale in the Old
U.S. 41 Road right-of-way has the capacity to handle the
discharge from this project along with others up and
downstream.
3. All sites within the industrial area shall conform to the
South Florida Water Management District rules for
pre-treatment of industrial projects.

easement similar to or as per Florida Statutes Chapter 704 . 06

Staff recommends the addition of the following stipulation
for the approval of the referenced petition.
3 . PUD language {PUD, July, 1992 revision, 4 . 5 (A) } is
consistent with the Land Development Code Section
3 . 2 . 8 . 4 . 7 (3) . However, the PUD, 4 . 5 (A) must be revised
to require that the final plat illustrate the wetland
jurisdictional line and the preserve boundary line in
order to verify the twenty-five (25) foot buffer. Based
on this approach, no encroachment past the preserve

Section 36, Township 49 South, Range 25 East; bounded on the east
by the future Livingston Road, on the south by Radio Road, on the
west by Commercial Boulevard and unplatted part of Collier County
Production Park and on the north by an unplatted part of Collier
County Production Park.
III. PROJECT DESCRIPTION:
n The petitioner proposes to subdivide 33 acres of Collier County
Production Park (total area is 82 .75 acres) into 19 lots and 2
tracts zoned industrial. Collier County Production Park is part
of the Naples Production MSTBU which contains 335.20 acres. Tract
A has already been developed for the United Parcel Service. The
project is proposed to provide 3 . 00 acres of right-of-way, 21.0
acres of building and parking, and 9 . 0 acres of open space

Water Management:
n Naples Production Park (335. 20 acres) formed a Municipal Service
Taxing Benefit Unit (MSTBU) in 1985 to serve as a funding source
to provide uniform improvements to the roadway, drainage, water

and sewer systems. The Naples Production Park is an unrecorded
subdivision initially developed in 1968. There are existing
unpaved roadways and drainage swales.
The MSTBU has obtained a modification SFWMD Surface Water Permit
for the entire industrial park which originally was permitted for
82 .75 acres. The Collier County Production Park, Phase III falls
in Basin 7 of the water management system and it consists of a
series of swales which run north-south and east-west. The swales
act as a dry detention system with the bottom elevation one foot
above the control elevation. There is an existing control
structure which is located on the west side of Tract B and
discharges into Radio Road swale. This runoff from Radio Road
flows into Rock Creek.
In accordance with the SFWMD permit, the undeveloped parcels as
they are developed will provide on-site detention/retention
systems that treat the greater of 1" or 2. 5" X impervious area,
for the stormwater quality volume. The stormwater system has been
designed for a 25-year storm 3-day duration event in accordance
with SFWMD criteria
Environmental:
The subject property is approximately thirty-three (33) acres,
zoned industrial, to be subdivided into nineteen (19) lots. An
Environmental Impact Statement was performed by Mr. Geza Wass de
Czege of Southern Biomes. The consultant has determined that
there are no jurisdictional wetlands or rare upland habitats on
site.
An endangered species survey was conducted with particular
attention paid to red-cockaded woodpeckers and gopher tortoise
habitats. One tortoise burrow was located along the northern
boundary of the southern parcel.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
No. PSP-91-21 "Collier County Production Park, Phase III" with the
following stipulations:
Water Management:
1. An analysis on the capacity of Radio Road swale to handle the
discharge from this project shall be submitted at the time of
construction plans review. Any improvements deemed necessary
n shall be provided.
