stipulations.
STIPULATIONS:
n Water Management:
1. The excavation shall be limited to a bottom
elevation of 2.0 ft. NGVD. All disturbed areas
proposed for lake excavation shall be excavated to
a minimum elevation of 4 ft. NGVD.
2. Off-site removal of material shall be subject to
"Standard Conditions" imposed by the
Transportation Services Division in document dated
5/24/88 (copy attached) .
3. No blasting will be permitted unless issued a
separate permit by Collier County Project Review
Services.
4. An excavation permit for Lake 1-3, 1-4, 1-5 and
1-6 shall be issued prior to any excavation.
Submission of all information required by
Ordinance No. 91-102, Division 3.5 for commercial
excavations shall be submitted, however the
permit(s) shall be issued without submission to
the EAB or BCC.

5. The lake littoral zone shall be located and
planted as part of permit approval for Lake 1-3.
The plantings shall have an 80% survivability at
the end of three years.
6. A left turn and right deceleration lane on Oil
Well Road shall be constructed by the developer if
Transportation Services determines that one is
warranted. A right-of-way permit will be required
for all work.
7. All provisions of Collier County Ordinance No.
91-102, Division 3.5 shall be adhered to.
8. Copy of South Florida Water Management District
construction/operation permit or early work permit
shall be provided prior to excavation permit
approval.
9. No Excavation Permit shall be issued until all
impact fees have been paid.
10. Prior to excavation permit issuance for lakes in
the location of burrowing owl burrows, Florida
Game and Fresh Water Fish Commission shall be
consulted for habitat management guidelines and
preservation areas. All information and/or
permits shall be provided to Project Review
Services Environmental Staff for review and
approval prior to excavation permit issuance.
Project Review Services Environmental Staff shall
impose the Florida Game and Fresh Water Fish
Commission guidelines as minimum standards. If a
dispute arises between petitioner and staff the
petition shall return to EAB and Board of County
Commissioners for dispute resolution.

STIPULATIONS:
Water Management:
1. The excavation shall be limited to a bottom

downstream detention area shall have a minimum
bottom elevation of 3.0 ft. NGVD.
2. Where groundwater is proposed to be pumped during
the excavating operation, a Dewatering Permit
shall be obtained from the South Florida Water
Management District, and a copy provided to the
Collier County Project Review Services for
approval prior to the commencement of any
dewatering activity on the site.
3. No blasting will be permitted unless issued a
separate permit by Collier County Project Review
Services.
4. If trees are to be removed as a result of the
excavating operation, a Vegetation Removal Permit,
required by Ordinance No. 91-102, Division 3.9,
shall be obtained from Collier County Project
Review Services before work shall commence.
5. The lake littoral zone shall be created and
planted as indicated on the Plan of Record. An
annual report shall be submitted to Project Review
Services to ensure that the littoral zone
plantings have an 80% survivability at the end of
three years.

STIPULATIONS:
Water Management:
1. The petitioner shall provide water quality volume
to compensate for the loss of detention are caused
by the location of the proposed drainfield.
2. Detailed water management calculations, prepared
by a Florida Registered Professional Engineer
shall be submitted prior to final construction
plan approval.
Environmental:
1. Petitioner shall place environmental fencing
outside of the footprint of each building (and
around cypress trees to be retained within decks)
to protect native vegetation to be retained during
construction. The protective fencing shall remain
in place until all construction is completed and
the buildings have been inspected for certificate
of occupancy.

n 2. Approval of this conditional use constitutes
approval of the necessary ST permit for this
approved use only and does not remove the ST
zoning overlay from the property.
3. Replanting of wetland hardwoods and native shrubs
shall be complete prior to Certificate of
Occupancy of each building. The petitioner shall
replace removed native vegetation at the following
ratios: 1.5 to 1 for cypress removed; 1 to 1 for
other trees; 1 to 1 for shrubs.
4. Prior to final site development plan approval the
petitioner shall provide a narrative management
plan indicating the manner in which the owner will
preserve the native plant communities pursuant to
Section 3.9.5.3 of the Collier County Land
Development Code.
5. Prior to final site development plan approval the
petitioner shall provide a maintenance plan for
continued removal of exotic vegetation on the site
in perpetuity pursuant to Section 3.9.6.6 of the
Collier County Land Development Code. The
petitioner shall also propose a method of disposal
n of exotic vegetation (i.e. landfill for
mulching)prior to final site development plan
approval.

STIPULATIONS:
Water Management:
1. On August 27, 1990, the Collier County Board of
County Commissioners approved the "Stormwater
Management Program Master Plan". The Master Plan
incorporated the earlier recommendations of the
1985 "Master Plan Update for Water Management
District No. 6". The District No. 6 Plan
specifically detailed the need for the
construction of an open ditch along the north side
of the F.D.O.T. SR-84 (Davis Blvd. ) right-of-way.
The Developer shall be responsible for the
following:
a. Dedicating an 80 foot wide drainage easement
along the entire south side of the project
immediately north of the F.D.O.T.
right-of-way.
b. Excavating an open ditch commencing 5 feet
north of the northerly F.D.O.T. right-of-way
line down to elevation 2.5 feet N.G.V.D. with
n a 14 foot bottom width and 3H:1V side slopes
(approximate top width = 47 feet) .
c. Constructing a 16 foot wide maintenance
travelway along the northern portion of the 80
foot drainage easement to a minimum elevation
of 9.5 feet N.G.V.D.
d. Construction the development access roadway
from Davis Blvd. to include a culvert
configuration with a minimum end area opening
of 80 square feet below elevation 8.0 feet
N.G.V.D. and set to bottom grade of 2.5 feet
N.G.V.D. (District No. 6 Crossing D6-C-3) .
e. Providing additional drainage easements as
necessary at the culvert crossing location to
allow unrestricted maintenance travel around
any headwall/landscaping features at the
entrance road.

f. Providing sufficient easements at the northern
end of the existing triple box culverts
recently installed under Davis Blvd. to allow
for the construction and maintenance of a
proposed water level control structure to be
connected to the headwall of said box
culverts.
2. Lake one shall be revised to meet the minimum one
hundred foot (100' ) setback requirement from
right-of-way, unless exceptions to these setbacks
are approved by the Development Services Director.
Said exceptions shall be based upon recognized
standards for traffic engineering and road design
(AASHTO) and shall incorporate such factors as
road alignment, travel speed, bank slopes, road
cross-section and need for barriers.
3. Provisions shall be made for any off-site flow by
constructing a swale around project and conveying
it to Davis Boulevard.
4. Developer shall demonstrate that outfall capacity
as presently constructed is adequate and project
be designed per guidelines of South Florida Water
Management District # 6.
Environmental:
1. Prior to final site development plan approval the
petitioner shall provide a narrative management
plan indicating the manner in which the owner will
protect the preserves (upland, wetland and
littoral) communities pursuant to Section 3.9.5.3
of the Collier County Land Development Code.
2 . Prior to final plat approval or final site
development plan approval if platting is not
required, the preserves as mentioned in #1 shall
be platted or recorded with protective covenants
of a conservation easement pursuant to Florida
Statutes 704. 06.
3. Prior to final site development plan approval the
petitioner shall provide a maintenance plan for
continued removal of exotic vegetation on the site
in perpetuity pursuant to Section 3.9. 6. 6 of the
Collier County Land Development Code. The
petitioner shall also propose an acceptable method
of disposal of exotic vegetation (i.e. landfill
for mulching) prior to final site development plan
approval.

MEETING OF JULY 1, 1992
I. NAME OF PETITIONER/PROJECT:
Petition No. : PSP-91-25
Petition Name: "Mustang Plantation"
Applicant/Developer: Lely Development Corporation

II. LOCATION:
Section 21, 27, 28 & 33 Township 50 South, Range 26 East; bounded
on the north by the Lely Classic Golf Course, on the east by Lely
Resort Blvd. , on the south by U. S. 41 and on the west by Lely
High School.
III. PROJECT DESCRIPTION:
The petitioner proposes to develop a 553 .86 acre tract into 261
units for single family residences, 2611 units of multi-family
residences, an 18 hole golf course and 18 lakes.
This project lies within the Lely Resort PUD. The project will be
reviewed in accordance with the PUD document as amended and it
will need to be platted in accordance with the Land Development
Code.

Water Management and Environmental:
"Mustang Plantation, Master Plan Drainage System" , prepared by
Wilson, Miller, Barton & Peek, Inc. , dated October 1991, no
revisions.
IV. STAFF COMMENTS:
Water Management:
The water management system for the entire Lely Resort PUD has
received a conceptual surface water permit from South Florida
Water Management District (SFWMD) . This permit approved the
proposed control elevations and different locations of the
discharge structures. The southeast quadrant of the project area
has received a construction permit from SFWMD and all the
stormwater systems for that area are in place. The northeast and

northwest quadrants have received a construction permit from
SFWMD, however the water management system has not been completely
built. Some of the lakes still need excavation permits.
The water management system for "Mustang Plantation" consists of a
series of interconnected lakes including four new control
structures and the modification of an existing control structure.
Two control structures will be used for limiting discharge and
water quality treatment from the previously permitted west half of
Classics golf course. The third control structure will limit
discharge and perform water quality treatment for a portion of the
"Mustang Plantation". The fourth control structure (in
conjunction with another future control structure) splits the
historic Rattlesnake Hammock Road slough flow such that
approximately 50% is routed through Lely Resort and the remainder
through Naples Manor Canal. The outfall for the whole Lely
Resort PUD is into the Collier County-4 Canal which runs through
the Eagle Creek Subdivision and ends finally in Henderson Creek.
The EAB has previously approved the water management for the
entire Lely Resort PUD, however the lakes as shown and depicted on
"Mustang Plantation"were never discussed or reviewed. As a
requirement of Division 3.5 of the Land Development Code, these
lakes need to be reviewed and approved by the EAB.
The water management system meets all the requirements for water
quality and water quantity in accordance with SFWMD rules.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
Number PSP-91-25 "Mustang Plantation" with the following
stipulations:
Water Management:
1. Those lakes that are less than 100 feet to a right-of-way line
shall be revised to meet the minimum setback requirements,
unless an exception is requested and supported with adequate
documentation at the time of construction plans review.
Environmental:
1. Prior to individual final subdivision plat approval the
petitioner shall submit a plan showing all areas of native
vegetation to remain. A note shall be put on the plan
referencing these areas as required native vegetation
retention per the Lely PUD. These areas of preservation shall
correspond with an accepted (by Collier County Project Review
Services) plan showing 111.3 acres native vegetation to be
retained for Lely A Resort Community within the golf course
district.

2 . Prior to final plat approval, the petitioner shall provide
dredge and fill permits from the Army Corps of Engineers,
Florida Department of Environmental Regulation and South
Florida Water Management District permit allowing the proposed
development within jurisdictional wetlands, and accepted
mitigation plan for impacts to wetlands, for review and
approval by Collier County Project Review Services
Environmental Staff.
3 . Prior to final plat approval jurisdictional wetlands to be
preserved shall be platted as conservation easements with
restricted covenants pursuant to or similar to Chapter 704 . 06
Florida Statutes.
4 . Prior to final plat approval the petitioner shall provide
evidence that Florida Game and Fresh Water Fish Commission has
reviewed the proposed development and has no unaddressed
wildlife concerns.

IV. STAFF COMMENTS:
Water Management:
This project is part of 2,797.83 acre PUD for Orangetree. The
South Florida Water Management District (SFWMD) has granted a
Conceptual Surface Water Management Permit as well as construction
permits for several basins within the entire PUD area. This
project falls within one of the approved basins for construction.
The subject petition must receive a modification permit from
SFWMD.
The proposed water management system will consist of a series of
lakes and wetlands which will receive the runoff generated by the
project. This runoff will be conveyed to the lakes and wetlands
via catch basins, pipes and swales. After the runoff is collected
for water quality and water quantity it is discharged through two
control structures, one to the Golden Gate Canal and the other to
Randall Blvd. right-of-way which eventually discharges into the
Golden Gate Canal.
The water management system has been designed in accordance with
the SFWMD criteria for water quality and water quantity.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
No. PSP-91-24, "Valencia at Orangetree" with the following
stipulations:
Water Management:
1. A right-of-way permit allowing discharge into the Golden Gate
Canal shall be obtained from the Big Cypress Basin and
submitted prior to final construction plans approval.
2. Prior to construction plans approval, if any additional
maintenance easements along the west side of Golden Gate Canal
are needed, petitioner shall provide any needed portion that
might lie within the project site.
Environmental:
1. A minimum separation distance between protected wetlands and
proposed lake(s) shall be two hundred (200) feet unless
adjacent lakes are controlled at the lichen/water marks of the
affected wetlands. Any deviation from the two hundred (200)
foot separation distance shall require substantiation data and
South Florida Water Management District's approval which shall
be submitted to Project Review Services prior to final
approvals.

2 . Should the Florida Game and Fresh Water Fish Commission
(FGFWFC) have any comments or recommendations regarding this
proposed project, the design of the golf course layout,
buildings and associated structures, and infrastructure may
have to be adjusted to comply with the requirements of the
FGFWFC.
3 . Jurisdictional wetlands and mitigation areas shall be
designated as conservation/preserve tracts or easements on all
construction plans and shall be recorded on the plat with
protective covenants per or similar to Chapter 704. 06 of the
Florida Statutes.

III. PROJECT DESCRIPTION:
The petitioner proposes to develop a 61.4 acre tract into 388
multi-family residential units, with three lakes and a clubhouse
site. The area breakdown will consist of 8. 6 acres of buildings,
13 . 6 acres of pavement, 13 .0 acres of lakes and 26. 2 acres of open
area (pervious surface) .

IV. STAFF COMMENTS:
Water Management:
The proposed project lies within the Vineyards PUD which has a
conceptual water management permit from South Florida Water
Management District (SFWMD) and incorporates 1925.4 acres of land.
This project lies within the wester portion of Basin IV of this
PUD. Basin IV is located between Airport road and I-75.
The proposed water management system consists of a series of lakes
which collect the runoff generated by the project through valley
gutters and catch basins which convey the runoff to the lakes via
pipes.
The 25-year, 3-day duration event has been used to design the
water quantity requirements which also provide for water quality
requirements. A 1.26 foot wide, 21° V-notch weir is being
n designed to control the discharge at 0. 06 cfs/acre in accordance
with Collier County Ordinance No. 90-10. The discharge is being
directed to the Airport Canal which runs adjacent to the property,
and flows south to the Golden Gate Canal.

Off-site flows from the remainder of Basin IV (approximately 131. 3
acres) will be accommodated through the lake system within Pipers
Grove and discharged through the proposed control structure. The
petitioner will obtain a modification surface water permit from
SFWMD prior to any construction plans approval.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
No. PSP-92-6, "Pipers Grove" with the following stipulations:
Water Management:
1. Prior to final construction plan approval a copy of the Big
Cypress Basin (SFWMD) right-of-way permit allowing this
project to discharge to their right-of-way, shall be obtained.
2 . This project shall make provisions for all off-site runoff
discharging to the property.
3 . The discharge rate shall be limited to 0. 06 cfs/acre in
accordance with Collier County Ordinance No. 90-10, unless the
South Florida Water Management District allows a different
discharge.

II. LOCATION:
Sections 18 & 19, Township 48 South, Range 25 East; lands
contiguous to the road right-of-way are vacant, 39.9 acres zoned
Northbrooke Plaza PUD (mixed commercial and residential) and 320
acres zoned agriculture.
III. PROJECT DESCRIPTION:
Northbrooke Drive is located approximately ±1500 feet east of I-75
in Collier County. Northbrooke Drive is proposed to extend
northerly from it's southern terminus at Immokalee Road (SR 846)
for a distance of two miles, terminating at the southwest corner
of Quail West. The proposed Northbrooke Drive is a two mile long
by 100 foot right-of-way. The project will accommodate access to
Northbrooke Plaza, undeveloped lands in Sections 18 and 19 and the
Quail West project.

IV. STAFF COMMENTS:
Environmental:
Seven vegetation communities have been identified (reference EIS
addendum, pages 4-6) in addition to Collier County jurisdictional
wetlands. The proposed alignment will impact 1. 0 acre of the 1.8
acres of Collier County jurisdictional wetlands (Cypress) . The
Army Corp of Engineers (ACOE) , South Florida Water Management
District (SFWMD) and Florida Department of Environmental
Regulation (FDER) have also exercised wetland jurisdiction. Two
protected wildlife species surveys were conducted by Kevin L.
Erwin Environmental Consultants (KLECE) , in late 1988 and in
September 1991. No protected species were observed.

The road alignment attempts to cross the cypress wetland at the
narrowest point and, where possible, in existing cleared areas.
Mitigation for impacts to Collier County jurisdictional wetlands
will be required. The applicant does not own the adjacent lands
and therefore "on-site" mitigation does not appear feasible.
Donations to the CREW Trust have been proposed as off-site
mitigation.
Petitioner has proposed CREW Trust donations as mitigation to the
ACOE and FDER and will be negotiating with SFWMD (reference Plan
of Record Northbrooke Drive Dredge and Fill Permit Application) .
V. RECOMMENDATIONS:
Staff recommends approval of the "Northbrooke Drive Environmental
Impact Statement" with the following stipulations:
Environmental:
1. Collier County jurisdictional wetlands shall be indicated on
the final construction plan.
— 2 . All proposed mitigation for impacts to Collier County
jurisdictional wetlands shall comply with Appendix 7 of the
South Florida Water Management District rules.
3 . Wetland mitigation plans for any required State and Federal
wetland mitigation shall be submitted to Project Review
Services Environmental Staff for review and incorporation
into the final construction plan.
4 . Army Corp of Engineers, Florida Department of Environmental
Regulation dredge and fill permits and South Florida Water
Management District permits shall be submitted to Project
Review Services prior to final construction plan approval.
5. An exotic removal, monitoring and maintenance (exotic free)
plan for the proposed right-of-way shall be submitted to
Project Review Services Environmental Staff for review and
approval prior to final construction plan approval.
