STIPULATIONS:
Water Management:
1. The excavation shall be limited to a bottom
elevation of -10. 0 ft. NGVD. All disturbed areas
proposed for lake excavation shall be excavated to
a minimum elevation of 2 ft. NGVD.
2. No excavated material shall be removed from the
project site.
3. Lake #4 shall be included on the plat when the
surrounding area is platted.
4. Lake #4 shall meet the minimum setbacks from the
roadway in accordance with Ordinance No. 91-102.
Construction plans for the roadway, when
submitted, shall document this.
5. Lake #6 may be filled, but the filling shall be
limited to the area of the future cul-de-sac that
is currently under water.
6. For three years, petitioner shall submit to
Collier County Compliance Services, an annual
report documenting 80% survivability of littoral
zone plantings.

7. An excavation permit for lake #5 and #6 shall be
issued prior to any excavation. Submission of all
information required by Ordinance No. 91-102,

shall be issued with a depth consistent with a
commercial excavation, however no fill may be
taken off-site.
8. All provisions of Collier County Ordinance No.
91-102, Division 3.5 shall be adhered to.
9. Developer shall provide aeration devices in lakes
#4 and #5 prior to any additional depth beyond a
development excavation.

separate permit by Collier County Project Review
Services.
5. If trees are to be removed as a result of the
excavating operation, a Vegetation Removal Permit,
required by Ordinance No. 91-102, Division 3.9
shall be obtained from Collier County Project
Review Services before work shall commence.
6. The earthmining activity must remain in
conjunction with and accessory to the agricultural
development of the land.
7. For three years, petitioner shall submit to
Collier County Compliance Services, an annual
report documenting 80% survivability of littoral
zone plantings.

II. LOCATION:
Section 14, Township 48 South, Range 27 East; bounded on the west
by Immokalee Road and the south by Oil Well Road (CR 858) .
III. PROJECT DESCRIPTION:
The petitioner requests approval of a commercial excavation
for six lakes. The petition includes an approval for all the
lakes but permits are to be issued only on the first two. Permits
on the remaining four lakes will not be issued until detailed
/'N plans are submitted in the future.

IV. STAFF COMMENTS:
Water Management:
The application consists of specific details for commercial
excavation permits for lake 1-1 and 1-2 . The petitioner also
requests the petition included commercial excavation approval for
the remaining four lakes although no permits are intended to be
issued at this time. This will save both Staff and Board time
since the permits could be issued administratively at the time the
petitioner submits specific details.
The two lakes intended for permits have been reviewed and meet the
requirements of the Excavation Ordinance and South Florida Water
Management District rules. The Orangetree PUD allows for
commercial excavation so a separate conditional use approval is
not required. The two lakes cover ±32 .75 acres and ±495,400 cubic
yards of material will be removed. Impact fees will be paid for
all material removed from Orangetree PUD.

All the littoral zones required on these lakes are proposed to be
located within lake 1-3. The littoral area will be placed around
the outfall which is consistent with the Excavation Ordinance
regulations.
The excavation of the site will not require removal of any
vegetation since the site is a former farm field. The only other
environmental concern is the presence of six burrowing owl
burrows. These are located in the northern and east portion of th
do not effect the two lakes specifically requested for an
excavation permit at this time. Prior to issuance of a permit for
lakes within the area of the burrows, the applicant shall
coordinate with the Florida Game and Fresh Water Fish Commission
for guidelines on protection, monitoring, etc.
V. RECOMMENDATIONS:
Staff recommends approval of Commercial Excavation Petition No.
59.436 Orangetree Phase C with the following stipulations:
Water Management:

shall be excavated to a minimum elevation of 4 ft. NGVD.
2. Off-site removal of material shall be subject to "Standard
Conditions" imposed by the Transportation Services Division in
document dated 5/24/88 (copy attached) .
3. No blasting will be permitted unless issued a separate permit
by Collier County Project Review Services.
4. An excavation permit for Lake 1-3 , 1-4 , 1-5 and 1-6 shall be
issued prior to any excavation. Submission of all information
required by Ordinance No. 91-102, Division 3 . 5 for commercial
excavations shall be submitted, however the permit(s) shall be
issued without submission to the EAB or BCC.
5. The lake littoral zone shall be located and planted as part of
permit approval for Lake 1-3 . The plantings shall have an
80% survivability at the end of three years.
6. A left turn and right deceleration lane on Oil Well Road shall
be constructed by the developer if Transportation Services
determines that one is warranted. A right-of-way permit will
be required for all work.
7. All provisions of Collier County Ordinance No. 91-102,
Division 3 . 5 shall be adhered to.

8 . Copy of South Florida Water Management District
construction/operation permit or early work permit shall be
provided prior to excavation permit approval.
9 . No Excavation Permit shall be issued until all impact fees
have been paid.
10. Prior to excavation permit issuance for lakes in the location
of burrowing owl burrows, Florida Game and Fresh Water Fish
Commission shall be consulted for habitat management
guidelines and preservation areas. All information and/or
permits shall be provided to Project Review Services
Environmental Staff for review and approval prior to
excavation permit issuance.

"STANDARD CONDITIONS"
EXCAVATION PERMIT APPLICATIONS INVOLVING
OFF-SITE REMOVAL OF MATERIAL
The intent of these "Standard Conditions" are to provide excavation
permit applicants a summary of conditions which may affect their
. projects and which should be taken into consideration during all
stages of project development:
1. Haul routes between an excavation site and an arterial road
shall be private with property owner(s) approval or be a public
collector road built to standards applicable to handle the
resulting truck traffic. Where residential areas front
collector roads, appropriate turn lanes, buffer and bikepath
shall be required as minimal site improvements and if
recommended for approval, shall be so with the condition that
the Transportation Services Administration reserves the right
to suspend or prohibit off-site removal of excavated material
should such removal create a hazardous road condition or
substantially deteriorate a road condition; such action by the
Transportation Services Administration shall be subject to
appeal before the Board of County Commissioners.
2 . Haul routes utilizing public roads shall be subject to road
maintenance and road repair or an appropriate fair share by the
permittee in accordance with Excavation Ordinance No. 91-102
and -Right-of-Way Ordinance No. 82-91.
3 . Off-site removal of excavated material shall be subject to
Ordinance No. 85-55 (Road Impact Ordinance) . A traffic and
road impact analysis shall be made by the County to determine
the effects that off-site removal of excavated material will
have on the road system within the excavation project's zone of
influence. If appropriate, road impact fees in accordance with
Ordinance No. 85-55 shall be paid prior to the issuance of an
excavation permit.
4 . The Transportation Services Administration reserves the right
to establish emergency weight limits on public roadways
affected by the off-site removal of excavated material; the
procedure for establishment of weight limits shall be the
presentation of an applicable resolution before the Board of
County Commissioners. Should weight limits be instituted, the
permittee shall be responsible to implement measure to assure
that all heavy truck loadings leaving the permit's property
conform to the applicable weight restriction.
5. The Excavation Performance Guarantee shall apply to excavation
operations and also the maintenance/repair of public roads in
accordance with current ordinances and applicable permit
stipulations.
6. Based on soil boring information per Ordinance No. 91-102, a
blasting permit may be appropriate. Should a blasting permit
application be submitted and should residential areas exist
within one mile of the excavation site, the County reserves the
right to deny a blasting permit based on concerns for off-site
impacts from blasting at an excavation site. Should a blasting
permit be considered and approved, the minimum conditions of
approval in addition to conditions per Ordinance 88-12 are as
•follows:
A. Structure inventory/monitoring and applicable
property owner release as required by the County
Engineer.
B. Security bond applicable to private property damage
acceptable to the County.
C. Control of size/depth/number of charges per blast by
the County Engineer.
D. The right of the County to suspend and/or revoke
blasting permit authority should be determined that
blasting activities are creating unacceptable
off-site conditions either in terms of private
property damage and/or related physical effects of
blasting operations.
7 . No -excavation permit shall be issued until receipt of a
release from the Transportation Services Administration
applicable to proper mitigation of off-site impacts,
meeting of applicable provisions of Ordinance No. 82-91,
Ordinance No. 85-55, and Ordinance No. 88-12.

II. LOCATION:
Section 12, Township 50 South, Range 25 East; bounded on the north
and west by the Collier County Government Center, on the South by
U.S. 41, and by vacant land to the west.
III. PROJECT DESCRIPTION:
The project consists of one lake and one marsh area that were
previously permitted as a private excavation. The lakes are being
dug to provide water management and fill for the new parking area
at the Collier County Government Center.

IV. STAFF COMMENTS:
Water Management:
This project was permitted as a private excavation in March 1992
and now the applicant wishes to revise the permit to a commercial
excavation. A South Florida Water Management District Permit
Modification was granted for the original permit to provide water
quality volume for the parking area expansion.
The project outfalls to an existing 40 foot Drainage Easement (OR
Book 385, PG 740) which then drains into the Haldeman Creek and
eventaully to Naples Bay.

The project is being revised to a commercial excavation to allow
material (approximately 6000 cubic yards) to be taken off site to
be used for median beautification projects within the County.
This activity is permitted in Zoning District "P" (Public Use) , as
a long as the material is used for government projects.
V. RECOMMENDATIONS:
Staff recommends approval of Commercial Excavation Permit No.
59.450, "Government Center Parking Lake" with the following
stipulations:
Water Management:
1. The excavation shall be limited to a bottom elevation of -4. 0
ft. NGVD. All disturbed areas proposed for lake excavation
shall be excavated to a minimum elevation of -4 . 0 ft. NGVD.
The downstream detention area shall have a minimum bottom
elevation of 3 . 0 ft. NGVD.
2. Where groundwater is proposed to be pumped during the
excavating operation, a Dewatering Permit shall be obtained
from the South Florida Water Management District, and a copy
provided to the Collier County Project Review Services for
approval prior to the commencement of any dewatering activity
on the site.
3 . No blasting will be permitted unless issued a separate permit
by Collier County Project Review Services.
4. If trees are to be removed as a result of the excavating

III. PROJECT DESCRIPTION:
The applicant proposes to erect 8 camping cabins, International
coachs' dormitory, and owner's residence for gymnastic site on the
western margin of a senescent slough in A-ST wetlands. The total
area is 3 .0 acres.

Water Management:
The water management impacts to the subject site caused by the
proposed cabins are negligible. West of the subject parcel is
Naples Progressive Gymnastics Center, a previously permitted 2 .89
acre facility, which provided under South Florida Water Management
District (SFWMD) rules, water quality volume. This was in the
form of a dry detention area located at the rear of the gymnasium.
The proposed drainfield for the septic system, necessary with the

addition of the cabins, is to be located within the existing dry
detention area. The petitioner proposes to provide additional
area, elsewhere on site, to provide the necessary water quality
volume required under SFWMD rules.
Environmental:
The subject property is approximately three acres in size and is
zoned A-ST. It is located adjacent to the eastern edge of the
Naples Progressive Gymnastics Center which is at 3275 Pine Ridge
Road, Naples. The parcel is a seasonally wet cypress slough with
up to twelve inches of standing water during the wet season, as
indicated by watermarks on the cypress. The slough, once
connected hydrologically to an adjacent system to the south, has
been severed by Pine Ridge Road.
The dominant canopy tree is bald cypress (Taxodium distichum) with
secondary growth of Brazilian pepper (Schinus terebinthifolius) ,
melaleuca (Melaleuca quinguenervia) and scattered dahoon holly
(Ilex cassine) . A nearly monoculture area of melaleuca occurs
along the western boundary where the proposed coaches residence
would be located.
The understory consists of wax myrtle (Myrica cerifera) saltbush
(Baccharis halimifolia) and Brazilian pepper. The understory
(including epiphytes) consists of swamp fern (Blechnum
serrulatum) , boston fern (Nephrolepis exaltata) , resurrection fern
(Polypodium polypodioides) , wire-leaf wild pine (Tillandsia
setacea) , reflexed wild pine (T. balbisiana) and Spanish moss (T.
usneoides) .
No mammal or bird life was observed by the environmental
consultant during any transects. Reptiles and amphibians observed
on-site include Cuban Anoles (Anolis cubenis) and Florida black
racer (Coluber constictor) .
The petitioner proposes constructing one directors ' residence, one
international coachs ' residence and eight cabins. All structures
have been located along the western edge (first 75 feet) of the
slough and are elevated stilt buildings to reduce the impacts to
the special treatment (ST) area. The construction should have
little or no impact to existing hyroperiods. The total area
proposed for clearing of the buildings is less than 0.2 acres or
6% of the entire three acre slough.

Proposed locations for all structures have been field surveyed to
minimize removal or impact to the cypress trees on-site. A total
of 28± cypress trees between one and six inches dbh would be
removed. The petitioner proposes replacement with wetland
hardwoods at a ration of 1.5 to 1 for cypress removed and 1 to 1
for other trees. Replacement of native shrubs is proposed on a 1
to 1 basis with similar species and size.
Approval of this petition would require that the property be
cleared of exotic vegetation and that it be maintained exotic free
in perpetuity. This would be a great benefit to the slough.
V. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No. CU-92-2
"Naples Gymnastics Center" with the following stipulations:
Water Management:
1. The petitoner shall provide water quality volume to compensate
for the loss of detention are caused by the location of the
proposed drainfield.
2 . Detailed water management calculations, prepared by a Florida
Registered Professional Engineer shall be submitted prior to
final construction plan approval.
Environmental:
1. Petitioner shall place environmental fencing outside of the
footprint of each building (and around cypress trees to be
retained within decks) to protect native vegetation to be
retained during construction. The protective fencing shall
remain in place until all construction is completed and the
buildings have been inspected for certificate of occupancy.
2. Approval of this conditional use constitutes approval of the
necessary ST permit for this approved use only and does not
remove the ST zoning overlay from the property.
3. Replanting of wetland hardwoods and native shrubs shall be
complete prior to Certificate of Occupancy of each building.
4. Prior to final site development plan approval the petitioner
shall provide a narrative management plan indicating the
manner in which the owner will preserve the native plant
communities pursuant to Section 3 .9 .5.3 of the Collier County
Land Development Code.

5. Prior to final site development plan approval the petitioner
shall provide a maintenance plan for continued removal of
exotic vegetation on the site in perpetuity pursuant to
Section 3 .9 . 6. 6 of the Collier County Land Development Code.

exotic vegetation (i.e. landfill for mulching)prior to final
site development plan approval.

II. LOCATION:
Section 6, Township 50 South, Range 26 East; bounded on the east
by agricultural land, on the north by a mobile home recreational
park, on the west by Moon Lake subdivision and on the south by
Davis Blvd.
III. PROJECT DESCRIPTION:
The petitioner proposes to develop a 41. 00 acre site into a 128
unit condominium with two (2) lakes and some preserve areas. The
development is proposed to be constructed in two (2) phases.
The land use consists of 18.76 acres of building area, 7. 63 acres
of lakes, 13 . 10 acres of natural preserve, 0.83 acres of
recreation area and 0. 68 acres for buffer purposes.

IV. STAFF COMMENTS:
Water Management:
The water management system consists of two lakes and wetlands
which collect the runoff generated by the development through
swales. The two lakes are interconnected by equalizer pipes.

This site is located within the District Six Water Management
Master Plan. The discharge will be directed to Davis Blvd. with a
control discharge of 2.01 cfs. The petitioner will construct some
improvements on Davis Blvd. right-of-way in accordance with
District Six Water Management Master Plan.
The engineer preparing the water management system has stated that
no off-site flow is coming onto the site. Since this project is
larger than 40 acres in size, the petitioner needs to obtain a
Surface Water South Florida Water Management District permit prior
to any construction plans approval. Also an excavation permit
will be needed for the two (2) proposed lakes.
The water management system meets the minimum requirements of
South Florida Water Management District for water quality and
water quantity.
Environmental:
The subject property is a 41± acre parcel located east of Moon
Lake and Pelican Lake PUD. The petitioner proposes construction
of 128 multi-family units, 2 lakes and retention of large tracts
of preserve.
Approximately 16.4 acres of the property is upland habitat; 11.9
acres of pine-saw palmetto flatwoods and 4. 5 acres of melaleuca.
The remainder of the property is jurisdictional wetlands,
approximately 11 acres of which will be impacted. The petitioner
proposes mitigation for impacted wetlands with lake littoral
marsh, wetland enhancement, upland preservation and wetland
creation totaling 15.94 acres or 39% of the site, an additional
5.8 acres will be excavated for lakes. The total area designated
to preservation and lake excavation is greater than 53% of the
site. Additional preservation is likely within the residential
tracts.
No endangered species were sighted during the five day survey
conducted by the consultant. The proposed preservation and
creation of habitat should enhance the site and provide a better
environment for local wildlife, particularly wading birds. The
designation of large contiguous tracts for habitat preservation
creates an available north-south and east-west corridor for
wildlife.
V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition
No. PUD-92-2 "Victoria Landing" with the following stipulations:

Water Management:
1. On August 27, 1990, the Collier County Board of County
Commissioners approved the "Stormwater Management Program
Master Plan" . The Master Plan incorporated the earlier
recommendations of the 1985 "Master Plan Update for Water
Management District No. 6". The District No. 6 Plan
specifically detailed the need for the construction of an open
ditch along the north side of the F.D.O.T. SR-84 (Davis Blvd. )
right-of-way.
The Developer shall be responsible for the following:
a. Dedicating an 80 foot wide drainage easement along the
entire south side of the project immediately north of the
F.D.O.T. right-of-way.
b. Excavating an open ditch commencing 5 feet north of the
northerly F.D.O.T. right-of-way line down to elevation 2 .5
feet N.G.V.D. with a 14 foot bottom width and 3H: 1V side
slopes (approximate top width = 47 feet) .
c. Constructing a 16 foot wide maintenance travelway along
the northern portion of the 80 foot drainage easement to a
minimum elevation of 9. 5 feet N.G.V.D.
d. Construction the development access roadway from Davis
Blvd. to include a culvert configuration with a minimum
end area opening of 80 square feet below elevation 8. 0
feet N.G.V.D. and set to bottom grade of 2 . 5 feet N.G.V.D.
(District No. 6 Crossing D6-C-3) .
e. Providing additional drainage easements as necessary at
the culvert crossing location to allow unrestricted
maintenance travel around any headwall/landscaping
features at the entrance road.
f. Providing sufficient easements at the northern end of the
existing triple box culverts recently installed under
Davis Blvd. to allow for the construction and maintenance
of a proposed water level control structure to be
connected to the headwall of said box culverts.
2. Lake one shall be revised to meet the minimum one hundred foot
(100 ' ) setback requirement from right-of-way, unless
exceptions to these setbacks are approved by the Development
Services Director. Said exceptions shall be based upon
recognized standards for traffic engineering and road design
(AASHTO) and shall incorporate such factors as road alignment,
travel speed, bank slopes, road cross-section and need for
barriers.

Environmental:
1. Prior to final site development plan approval the petitioner
shall provide a narrative management plan indicating the
manner in which the owner will protect the preserves (upland,
wetland and littoral) communities pursuant to Section 3 . 9 . 5. 3
of the Collier County Land Development Code.
2 . Prior to final plat approval, the preserves as mentioned in #1
shall be platted by protective covenants of a conservation
easement.
3 . Prior to final site development plan approval the petitioner
shall provide a maintenance plan for continued removal of
exotic vegetation on the site in perpetuity pursuant to
Section 3 . 9 . 6. 6 of the Collier County Land Development Code.
The petitioner shall also propose an acceptable method of
disposal of exotic vegetation (i. e. landfill for mulching)
prior to final site development plan approval.
