ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 *** PETITION: PDA-88-12C FILED BY/FOR: Pete McDonough of Team/Plan Inc. , representing Forestlake Venture (A Michigan Partnership) REQUESTING: A PUD Amendment to Crown Pointe PUD by decreasing the number of single-family units , increasing the number of multi-family units , and changing floor area requirements from a "minimum" of 750 square feet to an "average" of 750 square feet. REPRESENTED BY: Mr . Pete McDonough COMMENTS: Mr . Pete McDonough of Team/Plan Inc. , stated that the petitioner is requesting that the 750 square feet minimum requirement be waived, and have that stated as an average. He noted that he proposes to control that for the Planning, Zoning, and Building Departments to have a record on file, that he will update those building permits as they come through, adding that the minimum square footage will be 500 square feet, and an average of 750 square feet. He indicated that the density is shifted from single-family to multi-family. He advised that all environmental stipula- tions set forth in 1987 will be adhered to, and there are no changes to those conditions . Environmental Specialsit Burch indicated that this petition is an amendment to a rezone that was heard by the EAC almost two years ago. He stated that the amendment proposes to rearrange some of the dwelling units and change the density. He noted that the amend- ment will enable the developer to save addi- tional native habitat than the original plan. He advised that the NRMD recommends approval of this Petition, subject to the stipulations as attached to the original PUD Agreement. Dr . Benedict stated that he can see benefit by reducing the number of units in Tract 1 , where the pines are located. Carried unanimously. *** PETITION NO: PU-88-22C FILED BY/FOR: Richard Baker of White Sands Construction Company of Naples, Inc. , representing Naples Building Company REQUESTING: A Provisional Use "x" of the "I" Zoning Classification for an asphalt batch plant REPRESENTED BY: Richard Baker COMMENTS: Mr . Richard Baker , of White Sands Construction Co. , Inc. , Agent for Naples Building Company, stated that it is his intent to establish an asphalt producing plant off of Old U. S. 41 and Livingston Road. He indicated that the materials to be produced will be for the construction of roads and parking lots. He stated that there is a demand for a venture of this nature, noting that there are presently two plants in Collier County: Better Roads, and APAC of Florida . He indicated that these plants supply 65% of the hot mix asphalt needed, and the remaining 35% is supplied by Lee County. Mr . Burch stated that the Petitioner is requesting approval for an asphalt plant within the present Industrial Zoning. He noted that the parcel is primarily a high pine/palmetto flatwood with a cypress wetland in the northwestern corner . He noted that State and Federal standards for this type of plant will be required, and inspections will be carried out by State regulatory agencies. Mr . Burch advised that proper containment for petroleum spills in the proposed project has been allowed for , and containment for the wash water has been provided. He stated that there Page 3 • v-� ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 is an environmental concern relating to an access road to this project which will be going through a xeric area to the south, which contains some protected species, gopher tor- toises, lizards, and other species. He noted that there is the possibility that an archaeological site may exist in the xeric area . He noted that there is the possibility that an archaeological site may exist in that area. He indicated that the NRMD would like to be involved with the site selection of the future access to the project. He noted that considering the project and the existing habitats, NRMD recommends approval of this Petition, subject to the following stipula- tions: STIPULATIONS: 1. Petitioner shall be subject to Ordinance 75-21 (or the tree/vegetation removal ordinance in existence at the time of permitting) , requiring the acquisition of a tree removal permit prior to any land clearing. A site clearing plan shall be submitted to the Natural Resources Management Department for their review and subject to approval prior to any work on the site. This plan may be sub- mitted in phases to coincide with the develop- ment schedule. The site clearing plan shall clearly depict how the final site layout incorporates retained native vegetation to the maximum extent possible and how roads, buildings, lakes, parking lots, and other facilities have been oriented to accommodate this goal. 2 . Native species shall be utilized, as described below, in the site landscaping plan. A landscape plan for all landscaping on the development shall be submitted to the County Landscape Architect and to a County Environmental Specialist for their review and shall be subject to their approval. The landscape design shall incorporate a minimum of 60% native plants, by number , including trees, shrubs, and ground cover . At least 60% of the trees, 60% of the shrubs, and 60% of Page 4 ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21 , 1988 the ground cover shall be native species . At the direction of the County Landscape Architect or County Environmental Specialist a higher percentage of trees or shrubs can off- set an equal percentage of ground cover . For example, the use of 70% native trees could allow the use of only 50% native ground cover . This plan shall depict the incorporation of native species and their mix with other spe- cies, if any. The goal of site landscaping shall be the re-creation of native vegetation and habitat characteristics lost on the site during construction or due to past activities . 3 . All exotic plants, as defined in the County Code, shall be removed during each phase of construction from development areas , open space areas, and preserve areas. Following site development, a maintenance program shall be implemented to prevent reinvasion of the site by such exotic species. This plan, which will describe control techniques and inspec- tion intervals, shall be filed with and sub- ject to approval by the Natural Resources Management Department and the Community Development Division. 4 . If, during the course of site clearing, exca- vation, or other constructional activities, an archaeological or historical site, artifact, or other indicator is discovered, all develop- ment at that location shall be immediately stopped and the Natural Resources Management Department notified. Development will be suspended for a sufficient length of time to enable the Natural Resources Management Department or a designated consultant to assess the find and determine the proper course of action in regard to its salvageabi- lity. The Natural Resources Management Department will respond to any such notifica- tion in a timely and efficient manner so as to provide only a minimal interruption to any constructional activities. 5 . Petitioner shall save at least 50% of the scrub oak trees in the access road easement when petitioner proposes to construct the Page 5 ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 access road. This shall become a condition of the tree removal permit in accordance with ordinance 75-21 . Mr . Baker stated that the property is pre- sently landlocked. He noted that he is a road contractor , and can build the road to the pro- posed plant, but will need the cooperation of the owners to the south to get gain access. He indicated that he has discussed with DOT the possibility of participation in the development of the easement of Livingston Road, but noted that his private investment will be that of the development of the road north to the south boundary of the property. Ms. Kurgis question how the disposal of the washwater is handled? Mr . Baker stated that there is a settlement pond, adding that it is a totally contained system, and the water evaporates. He indi- cated that the present owners of the plant have let their DER permit expire, as of August '"" 25 , 1988 . He indicated that the permits are transferable, but now he has to start from scratch and obtain a new permit. He stated that he will now be under more stringent regu- latory emission laws, than when this plant was first established. Ms. Kurgis questioned how long the plant is anticipated to operate? Mr . Baker noted that this will depend on the financial environment and the growth of the County, but indicated that if he gets 10 years use from this plant, he will be doing well . Dr . Benedict referred to Stipulation No. 5 , and noted that the EAC cannot stipulate that the Petitioner deal with something off-site, and questioned whether the language should state "access road easement on the site"? Mr . Burch stated that he believes the intent is to have language adopted relating to the tree removal off-site, but noted that it is Page 6 ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 probably more applicable for the area within the project itself. Dr . Snyder questioned what will happen to the southwest corner of the site between the cypress and the road? Mr . Baker indicated that he has not made a decision on that as yet. He stated that his main concern is that he will be able to use the land that he designed from the gate to the east. Dr . Benedict questioned how this plant com- pares with other asphalt plants relating to design stipulations, i .e. bag houses, and increased containment areas? Mr . Burch stated that this plant will be using a wet system, as opposed to a dry system. He indicated that the asphalt plant petition that was recently presented was to provide a vege- tated buffer around the plant, and there was a stipulation which required a bag house for emission control. He advised that this sti- pulation is not applicable in this case. He indicated that additional containment for che- micals has been addressed by the applicant. Dr . Benedict questioned whether a there will be a buffer requirement for this plant? Planner Nadeau advised that the same standards will be required for this plant: a setback of 50 ' minimum from all property lines. He indi- cated that the petitioner will have to comply with all EPA standards. He indicated that he will apply the same mitigated standards for this project, as those that applied to the plant for Harper Brothers. Dr . Benedict suggested rewording Stipulation No. 5 , and adding Stipulations No. 6 and 7 as noted below: 5 . Petitioner shall save at least 50% of the scrub oak trees in the southwest corner out- side of the gate. Page 7 ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 6 . The northwest quadrant isolated cypress dome shall be retained as a wetland preserve, and shall not be included in the site water management plan. 7. Unless otherwise directed by applicable per- mits, the rebuilt plant shall employ state-of- the-art pollution control systems, including at a minimum: a. Concrete lined settlement pond b. Venturi scrubbers or bag house c. Impermeable concrete containment area at least 20o greater than the fuel tanks d. Buffer vegetation will be retained and/or replanted native vegetation Mr . Baker stated that there are not that many scrub oaks that will be involved in the ease- ment nor the south easement. He stated that he will save as many of the oaks as he can. He advised that he agrees with all the stipu- lations, including those that have been added. MOTION: Made by Dr. Benedict to approve Petition PU-88-22C, subject to Stipulations No. 1 through 4 as presented, and Stipulations 5 through 7 as amended and added. Seconded by Dr. Snyer. Carried unanimously. *** PETITION NO: PU-88-25C FILED BY/FOR: Dr . Neno J. Spagna of Florida Urban Institute, Inc. , representing the Immokalee Haitian Free Methodist Church REQUESTING: A Provisional Use 7 . 12. 3 (a) of RMF-6 for a Church REPRESENTED BY: Dr . Neno J. Spagna COMMENTS: Dr . Neno J. Spagna advised that this petition is a request for a Provisional Use for a 270 seat church to be built in Immokalee. He noted that the site is located on the southeast corner of Eustis Avenue and Booker Boulevard. He noted that the site is Page 8 �-. ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 generously covered with oak trees, and the Petitioner intends on removing and relocating as many as he can. He indicated that the Petitioner concurs with all recommendations and Stipulations of the NRMD. Mr . Burch stated that the subject area is a disturbed high pineland area, with large oak trees. He noted that the surrounding area consists of residential development, adding that the NRMD has no major concerns relating to the habitat aspect of this parcel . However , he indicated there are concerns regarding the large old oak trees that are worth saving as landscape elements or habitat islands on the project within the Urban Area . He advised that Staff is recommending approval of this petition, subject to the following stipulations: STIPULATIONS: 1. This shall be accomplished primarily by leaving the trees in their existing locations . If this is not feasible, the trees may be transplanted for use as landscape components in the develop- ment . This stipulation will become a con- dition of the Tree Removal Permit which will be required for any clearing activity on site, by authority of Ordinance 75-21 . REQUESTING: A zoning change from RSF-4 to PUD for a multi- - residential development in Immoka.lee. Garden Lake apartments COMMENTS: Project Manager Weeks stated that he was notified by the petitioners that they would not be in attendance at today' s meeting. He noted that they are located in Jacksonville. He advised that he is familiar with the site, and will answer any questions the Council may have. Chairman Cardillo indicated that the Council does not entertain petitions unless there is representative present. He stated that he feels Mr. Weeks' role is one of an independent investigation. Mr. Weeks stated that he concurs with Mr. Cardillo. He noted that the petitioner requested a fast-tracking of the petition. before the Board of County Commissioners, and they directed Staff to speed up this petition, as it is a request for affordable housing. Page II ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 It was the consensus of the Council to con- tinue Petition PU-88-25C, until a represen- tative is present. ITEM: EAC Nominations COMMENTS: The following applicants were ranked by mem- bers of the Council as follows: Mr. Below: David Addison, Patrick Neale, Todd Turrell, Monte Lazarus Dr. Snyder: David Addison, Todd Turrell, Patrick Neale Ms. Kurgis: David Addison, Patrick Neale, Todd Turrell Dr. Benedict: David Addison, Robert Diffenderfer, Patrick Neale, Todd Turrell Dr. Cardillo: David Addison, Todd Turrell, Robert Diffenderfer, Patrick Neale Mr. Below suggested that a letter be forwarded to the Board of County Commissioners, with the following recommendations: that Mr. Cardillo remain on the Council for another term; that David Addison be appointed to fill one vacan- cy; and that Patrick Neale, Todd Turrell, and Robert Diffenderfer are equally acceptable to be considered for the remaining vacancy. It was the consensus of the Council that Dr. Benedict will forward a letter to the Board o County Commissioners, articulating the recom- mendations of the EAC. ITEM: Expiration of Mr. Below' s Term on the EAC COMMENTS: Mr . Cardillo stated that he believes a resolu- tion should be provided, acknowledging Mr . Below for the outstanding service he rendered to the County, State, and the Region while Page 12 • ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 serving on the EAC. He noted that he is a founding member of the Council . He indicated that it has been a pleasure for all members to have served on the Council with Mr . Below. MOTION: Made by Dr. Benedict that a resolution be provided to Mr. Below for his outstanding service to the EAC. Seconded by Dr. Snyder. Carried unanimously. *** ITEM: Expiration of Dr. Benedict' s Term on the EAC COMMENTS: Mr . Cardillo noted that this is Dr. Benedict ' s last meeting. He stated that in his mind, Dr . Benedict has been the "Rock of Gibraltor" to the EAC. He noted that he does not let anything of significance pass him by, adding that he is very thorough, comprehensive, and truly an environmental man. He indicated that it has been a delight to have had Dr . Benedict serving on the EAC. Dr . Benedict stated that his reason for resigning from the EAC is that he is serving on many other committees, and there has been a timing conflict. He indicated that he feels he will be better able to serve on other County committees by resigning from the EAC. MOTION: Made by Mr. Cardillo that a resolution be provided to Dr. Benedict for his outstanding service to the EAC. Seconded by Dr. Snyder. Carried unanimously. *** ITEM: Everglades Coalition COMMENTS: Mr . Burch stated that there will be a meeting of the Everglades Coalition on January 13 , 14 , and 15, 1989 at Port of the Islands. He indicated that he feels it is important to try to attend, and keep abreast of what is taking place. Page 13 ENVIRONMENTAL ADVISORY COUNCIL DECEMBER 21, 1988 Dr . Benedict stated that the Everglades Coalition was formed 5 or 6 years ago in response to Senator Graham' s effort to have a major environmental issue to protect the Everglades. He noted that this will be a very interesting meeting to attend. He advised that there will be a field trip on Friday, and a number of panel presentations regarding issues relating to Everglades protection, and field trips again on Sunday. He indicated that if any of the members have a free day to attend, he encourages them to participate in Saturday' s discussion. He noted that he has agenda information regarding this meeting, if anyone is interested. Mr . Cardillo indicated that he believes it will be worthwhile to attend this meeting. *** ITEM: Status of Comprehensive Plan COMMENTS: Mr . Burch stated that the most recent draft of the Comp Plan has been put together and a brief workshop was held with the Planning Commission last Thursday. He noted that the CCPC will have their public hearing on the Plan tomorrow. He indicated that he feels the Plan addresses the comments made by Tallahassee, and he believes it is progressing quite well. Dr . Benedict advised that there will be a Board of County Commissioners workshop on December 28th and the public hearing will be conducted on January 4 , 1989 . He indicated that the Ad Hoc Committee has made many good improvements to the Plan, noting that there are a lot of deadlines regarding habitat stan- dards being created, ordinances being put together , and identifying natural resources protection areas. *** There being no further business, the meeting was adjourned by Order of the Chair. Cardillo, Chairman Page 15 ---�.,,• ENVIRONMENTAL RESOURCES STAFF REPORT FOR EAC MEETING 1-4-89 Continued from 12-21-88 % f".-\ : etition: R-68-250: Sanford L. Seligman or Shelly O ' Steen of Landcom. Inc . , representing Garden Lake of immokaloe, Ltd. ; requesting a zoning change from RSF-4 to PUD for a multi-family residential development in Immokalee. GARDEN LAKE APARTMENTS. Considerations: The property under consideration for rezoning is a . .29 acre rectangular parcel located between Warden Lane and Palm Drive on the south side of Lake Trafford Road in Immok:aleee (S32. T465. RE9E) . Residential and mobile home subdivisions border the property to the west and to the east , and undeveloped land is found to the south of the parcel . The site was inspected by Andrea Stevens (Environmental Resources Staff) on December 5, 1938. The petitioner is requesting a rezoning of the property to allow for an apartment complex with oo rental units ( "affordable housing" ) . The density of the residential development will be 9 units per acre, and the PUD will be known as Garden Lake Apartments. The site is an open grassy pasture with 3 or 4 isolated exotic fruit trees. Small berms run along the length of the field pir1 suggesting some past agricultural use of the site. The only remaining native vegetation on the parcel includes dog Fennel (Eupatorium caoillifo1ium) and various annuals and grasses. Clearly, intact native habitats have been obliterated from this site, and the environmental integrity of the parcel has been lost because of past disturbances. Recommendations: The petitioner is encouraged to re-create as much of the lost habitat as possible in green areas of the development , as specified in Standard Stipulation *2. This condition is • of particular importance for this site because of the extensive habitat disturbance which has occurred across the entire parcel . The Environmental Resources Staff recommends approval of petition R-88-250 subject to Standard Stipulation 2 as adopted by the EAC on 12/7/S3, and Standard Stipulations 3 and 4 as adopted by the EAC on 4/1/87. Standard Stipulation 1 is not applicable to this site because of the absence of native trees. PIPER St. Petersburg, FL ;:: i _ . . , ENVIRONMENTAL RESOURCES STAFF REPORT �-N, FOR EAC MEETING 12/21/88 Petition: PDA-88-12C: Pete McDonough of Team/Plan Inc . , representing Forestlake Venture (a Michigan Partnership ) ; requesting a PUD Amendment to Crown Pointe PUD by decreasing the number of single family units, increasing the number of multi-family units, and changing floor area requirements from a "minimum" of 750 square feet to an "average" of 750 square feet. Considerations: The petitioner is requesting an amendment to the Crown Pointe PUD to allow for the following changes: 1 ' In Tract 1 : a decrease in the maximum number of single family units from 235 to 204 units, with a gross density change in this tract from 3.5 to 3'0 units per acre. 2. In Tract 2: an increase in the maximum number of multi-family units from 96 to 127 units, with a gross density change in this tract from 8 to 10.6 units per acre. 3. For other than detached single family units, the requirement /=N for a "minimum" area of 750 square feet per unit will be changed to an "average" area of 750 square feet per unit ' The Crown Pointe PUD (R-86-27C, see Attachments 1 and 2) is divided into 3 tracts. Tract 1 will include single family units and water management facilities, Tract 2 will have multi-family units, and Tract 3 will be a recreational area. The proposed changes to the PUD involve Tracts 1 and 2. Tract 2 is located in the northern portion of the parcel " and is made up of fallow farm fields. Since this area has already been impacted, the increase in multi-family units here will not further degrade the environmental integrity of the tract . Tract 1 , located to the south of Tract 2, is mostly a pine flatwoods with a small isolated cypress wetland. The proposed decrease in the number of single family units will allow for the preservation of a larger portion of the existing native vegetation in the tract - Recommendation* : The Environmental Resources Staff recommends approval of petition PDA-88-12C subject to all environmental stipulations attached to the original PUD agreement. -- Prepared 8�� Date: /Z' /5- 5 Reviewed By : kODate : V,0P ENVIRONMENTAL RESOURCES MANAGEMENT STAFF REPORT FOR EAC MEETING 12/21/88 Petition: PU-88-22C; Richard Baker , of White Sands Construction Company of Naples, Inc . , representing Naples Building Company; requesting a provisional use "x" of the " I " zoning classification for an asphalt batch plant . Considerations : The area in question is a rectangular 5.0 acre tract located half- of-a-mile east of old U.S. 41 (State Road 887) , two-thirds of a mile south of the Lee-Collier County line, and about one- quarter of a mile northeast of the east end of Sun Century Road (R25E T48S, S10) . The parcel is surrounded by " I "-zoned land . A site visit was conducted on 16 November 1988 by Keith Edwards (ERM) and Richard Baker . There are several biological habitats within the tract , ranging from scrub oak to an isolated cypress dome. Most of the site is dominated by a pine/ palmetto flatwood . The canopy in the flatwood is composed entirely of slash pine (Pinus elliottii var . densa) with an understory of palmetto ( Serenoa repens ) , wax myrtle (Myrica cerifera) , and Brazilian pepper ( Schinus terebinthifolius) . The groundcover is dominated by graminoids with scattered individuals of yellow-tops (Flaveria linearis ) and shiny blueberry (Vaccinium myrsinites) . An isolated cypress dome is present in the northwest quarter of the parcel . The wetland consists of a central dome, dominated by cypress ( Taxodium Staff Report EAC Meeting 12/21/88 Page 3 pond lined with concrete to keep the settled material contained . Another habitat within the limits of the project is a xeric oak community in the southwest corner of the lot . The xeric oak area is dominated by scrub oak (Quercus spp . ) with associated groundcover , including palmettos and rosemary (Ceratiola ericoides) . This xeric oak area is the northern-most tip of a more extensive xeric system that extends to the south of the property. The majority of the xeric system is vegetatively diverse, containing lichens and tar flower (Befaria racemosa ) along with the oaks and rosemary. Also , active gopher tortoise (Gopherus polyphemus) burrows are present in the majority of the xeric system, though no burrows were found in the parcel under review. According to Mr . John Beriault , president of the Southwest Florida Archaeological Society a possible archaeological site may exist in the xeric area south of the subject property. In order to have access to the site, petitioner is planning to construct an access road through the property to the south of the project , from the proposed east-west Livingston Road extension. Appendix A describes petitioner ' s interim and long-term traffic plans. Recommendations : The site contains several different habitats. Petitioner has agreed to leave the wetland as is and to adjust the site plan to Staff Report EAC Meeting 12/21/88 Page 2 distichum) , surrounded by a concentric St . John ' s wort marsh (Hypericum spp . ) with some melaleuca ( Melaleuca quinquenervia ) infestation. The U.S. Army Corps of Engineers (USCOE ) claims jurisdiction over this area and has, subsequently, flagged the boundaries of the wetland . Petitioner agrees with the wetland boundary and proposes to berm around the wetland , leaving the area in its natural condition. Petitioner plans to use an already existing asphalt plant that is presently owned by Harper Brothers and located in Lee County. In order for the petitioner to move the plant from Lee County to the proposed site, pollution control devices must be installed onto the plant and the plant must pass a Department of Environmental Regulation (DER) stack test . Petitioner plans to employ a Venturi scrubber system as the pollution control device. Mr . David Noles ( DER) , during a phone conversation, explained that Venturi scrubbers are wet scrubber systems, as compared to baghouses that use a dry technology. Mr . Noles stated that plants with Venturi systems can still meet state standards for particulate emissions. The fuel storage containment area will be constructed of concrete and have a greater volume than the total volume of the oil tanks. This would prevent soil contamination in the event of n an oil tank leak . Petitioner also plans to have the settlement . . rm.. Staff Report EAC Meeting 12/21/88 Page 4 accomodate the isolated wetland . Before petitioner can begin asphalt production, the asphalt plant will have to meet DER and federal particulate emission standards. The problem of access to the site is more of a planning problem. However , ERM wishes to be involved in discussions and the final decision of access road placement , since there are several environmentally sensitive habitats and a possible archaeological site in proximity to where petitioner wishes to construct the access road . ERM recommends that petitioner construct the fuel storage containment area so that the volume of the impermeable concrete is at least 20% greater than the total volume of the fuel tanks. �--, Considering the above statements, ERM recommends approval of PU-88-22C with the following stipulations: 1-4. Standard stipulations 1 , 3, and 4 as adopted by EAC on 4/1 /87, and standard stipulation 2 as adopted on 12/7/88. 5. Petitioner shall save at least 50% of the scrub oak trees in the access road easement when petitioner proposes to construct the access road . This shall become a condition of the tree removal permit in accordance with ordinance 75-21 . .
