COMMENTS: Mr. Michael Fernandez advised that the proposed
plan amendment will lower the density and intensity
of the land use and will create a few more lakes.
He indicated that approximately nine acres of the
site will be preserved.

Mr . Fernandez called attention to the stipulations
as recommended by Staff . He reported that his
client has submitted the SMP and the work is
currently in progress. He offered alternative
language relating to Stipulation #1 as follows:
"The applicant shall supply all wildlife surveys
and information required by the Florida Game and
Fresh Water Fish Commission prior to submission of
the final construction plans and plat .
Mr . Fernandez offered the following language
relating to Stipulation #4 : "The applicant s
plant at least thirty-three percent (33%) of each
lakes littoral zone from one ( 1 ) foot elevation to
the control elevation of two ( 2) feet with native
emergent aquatic species, but exempting Lake #4
which will be utilized as a component of the
driving range to facilitate that use. "
Mr . Fernandez explained that Stipulation #3 states
that the project shall be controlled no lower than
the lichen line/water mark elevation of the pre-
serve areas as delineated by Collier County Project
Review Services. He remarked that the unique
characteristics of the site based on its past use
as a farm area results in a lichen line elevation
in the preserve areas which is dependent on mecha-
nical intervention. He reported that the pumps
shift from water overflow into those preserve
areas. He proposed the following: "Water Manage-
ment will be designed to discourage the lowering of
ground levels in accordance with the soils report
and in the anticipated wet season the water table
for the project should be around 11 ' -12 ' . The
southern wetland has a ground elevation of about
12 ' and the Dove Pointe water management system
shall be designed in accordance with the South
Florida Water Management District ' s standards at a
control elevation of 12 ' . The project will attempt
to route the overflow stormwater into the wetland
dependent upon the requirements of the Water
Management District . "
Ms. Polen stated that 96% of the site is being
farmed. She noted that four acres of the site are
cypress dome wetland and there are five acres of
hydric pine flatwoods. She advised that she and
-zhe applicant concur with the revised language as
offered by Mr . Fernandez regarding Stipulation #1 .

Ms. Polen suggested the following language for
Stipulation #3 : "The project shall be controlled
no lower than the lichen line/water mark elevation
of the preserve areas as delineated by Collier
County Project Review Services Environmental Staff .
If the lichen line elevations of the preserve areas
are determined to have been artificially produced
by agricultural activities the site shall not be
controlled lower than the ground elevation of the
preserve areas . "
Calling attention to Stipulation #4, Ms. Polen
expressed agreement with the applicant having the
opportunity to manage the lake littoral zones at
339 and allowing the option not to place any lit-
toral zones around Lake #4.
Mr . Fernandez remarked that staff ' s suggested
language for Stipulation #3 appears to be a little
confining. He requested that the language indi-
cate that the applicant will work with the require-
ments of the South Florida Water Management
District ' s standards and work toward that control
elevation. In addition, he noted that he is uncer-
tain what the criteria will be for proving that
there is an artificially produced elevation. He
reported that there is equipment which produces
this and questioned whether this would suffice.
Mr. Addison indicated that the language as
suggested by Ms. Polen allows flexibility and it
should be fairly easy to indicate that this area is
artificially maintained.
It was the concurrence of Ms. Polen and Mr.
Fernandez that Stipulation #3 state: "The project
shallbe controlled no lower than the lichen
line/water mark elevation of the preserve areas as
delineated by Collier County Project Review
Services Environmental Staff . If the lichen line
elevations of the preserve areas are determined by
the Collier County Review Services Environmental
Staff , South Florida Water Management District and
the applicant to have been artificially produced by
agricultural activities, the site shall not be
controlled lower than the ground elevation of the
preserve areas. "
MOTION: Made by Mr. Neale to recommend approval of Petition
PUD-86-91 (1)/SMP-91-9, subject to the stipulations

ADDENDA Memo re funding for the acquisition of environmen-
tally sensitive lands
COMMENTS: Mr. Addison advised that he has prepared a draft to
the Board of County Commissioners with respect to
funding for the acquisition of environmentally sen-
sitive lands . He presented the members with a copy
of the draft and requested that they provide
comments/input in this regard.
Mr. Addison explained that the Board of County
Commissioners have had recent discussions with
regard to the acquisition of lands for the
Corkscrew Regional Eco-system Watershed. He noted
that an attempt was made earlier in the year to
pass an additional one-cent sales tax, but this
failed. He revealed that he believes that the
reason the tax did not pass was that this was a
multiple issue tax. He expressed that in reviewing
information that has been provided for the five
counties within the State that have passed special
taxing referendums for the acquisition of lands, it
has always been on a single issue basis. He indi-
cated that the thrust of the memo is to encourage
the Commission to pursue this as a single issue
referendum. He requested that the Council submit
any comments or suggestions as soon as possible and
he will then forward a memo to the Board within the
next ten days.

Considerations:
Petitioner requests a provisional use for a child care center
on a . 34 acre lot at the north corner of Henry Street and New
Market Road in Immokalee, FL. The parcel is a single family
lot with an existing home and an aluminum shed. Aerial
indicates sparse vegetation.
Concerns:
None.
Recommendations:
Staff recommends administrative approval of Petition PU-91-9 .

Considerations:
The ±3 . 75 acre parcel is located approximately six hundred
and thirty (630) feet west of the intersection of Airport
Road and Corporation Boulevard, within the J & C Industrial
Park.
The entire site has been previously cleared. At this time
approximately seventy percent (70%) of the site contains
transitional species, mostly Brazilian pepper (Schinus
terebinthifolius) and a herbaceous groundcover.
The petitioner is requesting a provisional use "b" of Section
8 . 10 within the Industrial District to collect and clean
construction materials and turn them into artificial reefs.
The artificial reefs will be constructed of the following
list of materials, which will be selected from materials
recovered from construction debris and stockpiled on the
site.
1. Wood and plywood.
2 . Concrete materials, spills, concrete pieces, mortar.
3 . Gypsum board materials, ground and mixed with sand and
portland cement.
4 . Reinforcing steel, metal studs wire lath, wire mesh.
5. P.V.C. pipes of various sizes.
Recommendations:
In consideration of the merits of this proposal, Staff
recommends administrative approval of Petition PU-91-8.

Considerations:
The subject property is a 2 . 39 acre site, currently zoned A-2
and located on the north side of Price Street. Surrounding
properties are also zoned A-2, except for the Victoria Falls
PUD on the northern border.
The site is vegetated primarily by slash pine and saw
palmetto. Downy rosemyrtle has invaded much of the property.
A gravel driveway and a well currently exist on site. The
petitioner proposes to utilize the existing driveway.
Recommendations:
In consideration of the limited environmental impacts which
shall be largely confined to the altered areas of the site,
Staff recommends administrative approval of Petition PU-91-6
with the following stipulations:
1. Petitioner is subject to Ordinance No. 75-21 or the
vegetation removal ordinance in effect at the time of
final land development order.
2 . Petitioner is subject to Ordinance No. 82-37 or the
exotics removal ordinance in effect at the time of final
land development order.

Considerations:
The subject property is a 4. 56 acre parcel adjacent to and
east of the Seaboard Coastline Railroad right-of-way. To the
south is the Krehling Plant and A-2 zoned property, to the
north is A-2 zoning and to the east is the Imperial Lakes
PUD.
The area of proposed impact is confined to the indicated
right-of-way along the east property line and the northeast
corner of the property. Reader is referred to the "Krehling
Tower Site" site plan. The vegetation in this area consists,
primarily of scattered slash pine, and wax myrtle, along with
wedelia, wire grass, dog fennel, coreopsis, and Brazilian
pepper. An existing path and dirt mounds are within the area
of proposed impact.
Recommendations:
In consideration of the above, Staff recommends
administrative approval of Petition PU-91-7 with the
following stipulations:
1. Petitioner is subject to Ordinance No. 75-21 or the
vegetation removal ordinance in effect at the time of
final land development order.
2 . Petitioner is subject to Ordinance No. 82-37 or the
exotics removal ordinance in effect at the time of final
land development order.

Petition: PUD-91-7: Kim P. Kobza of Treiser, Kobza, Leigh &
Hagaman, Chartered, representing Michael D. Kelly and
Barbara C. Kelly; requesting a zoning change from C-3
to PUD "Progressive Auto Washing" .
Considerations:
The subject parcel is a 0.41 acre site located within a designated
activity center in the southwest corner of the intersection of
South Barfield Drive and San Marco Road on Marco Island. The lot
is currently zoned C-3 , as is the surrounding property, except for
RSF-4 zoning across the alley to the west. The site is vegetated
by herbaceous species which have been subjected to mowing, and
several Australian pines (Casuarina spp. ) . No protected species
were observed on site.
Recommendations:
In consideration of the limited environmental impact, Staff
recommends administrative approval of petition PUD-91-7 subject to
the following stipulations:
1. Revisions to the PUD document shall include:
a) Page 12, Section 5. 7 : Revise to include provisions of
Ordinance No. 82-2, as amended by Ordinance No. 89-57 .
b) Page 13 , Add Section 5.8 stating that: The petitioner
shall be subject to Collier County Ordinance No. 82-37, as
amended, or the exotics removal ordinance in effect at the
time of Final Site Development Plan approval. Prior to
Final Site Development Plan approval, a maintenance plan
shall be submitted to Project Review Services -
Environmental Staff for review and approval. The plan
shall indicate schedules and methods for maintaining the
site exotics-free in perpetuity.

Petition: PU-91-4: Gary Young of Collier County Sheriff's
Office; requesting a provisional use of Section
8.10 of Estates zoning for Essential Services.
Considerations:
The petitioner proposes to construct a multipurpose training
facility, to include a firearms range, physical training
field, special field operations training course and other
outdoor oriented training programs. The 6.77± acre site is
located in the northwest corner of the intersection of 70th
Avenue and Oil Well Grade road, approximately seven (7) miles
east of the County Fair Grounds, in Section 28, Township 47
South, Range 28 East. Past land use was agricultural.
Several old irrigation ditches are located on and off the
site.
A small wetland, less than 0.5 acres, exists in the southeast
portion of the site. No standing water was evident on
6/10/91. Vegetation within this area is a mixture of wetland
and upland species such as willow (Salix caroliniana) , wax
myrtle (Mvrica cerifera) , swamp fern (Blechnum serratum) ,
saltbush (Baccharis halimifolia) , ragweed (Ambrosia
artemisiifolia) and dog fennel (Eupatorium capillifolium) .
The ditches on site, one being in the southeast area, did
contain standing water on 6/10/91. Plant species in and
along sides and banks of the ditches consists of narrow leaf
sagittaria (Sagittaria lancifolia) , swamp fern, wax myrtle,
camphor weed (Pluchea odorata) and dog fennel.
Upland portions of the site consist of scattered slash pines
(Pinus elliottii var. densa) , small clusters of saw palmetto
(Serenoa repens) and wax myrtle, with dog fennel and tickseed
(Coreopsis leavenworthii) being dominant.
Concerns:
1. Utilization of southeast portion of site for water
management.
2 . Lead bullets and possible effects on surface and ground
water.
Recommendations:
Staff recommends approval of Petition PU-91-4 with the
following stipulations:

1. Petitioner shall utilize the southeast wetland as a
naturally vegetated retention area to meet stormwater
retention requirements unless otherwise required by South
Florida Water Management District.
2 . Should the State or County require groundwater monitoring
for lead contamination at the time of development order
approvals, the petitioner shall provide a copy of the
monitoring plan to Project Review Services prior to the
issuance of said development order.

considerations:
The subject parcel is a disturbed 0.72 acre site located in
the northwest corner of the intersection of D Street and
Church Street in Copeland, Florida. The property is within
the boundaries of the Big Cypress Area of Critical State
Concern (ACSC) and is in close proximity to the Fakahatchee
Strand State Preserve. The subject lot and surrounding lots
are zoned as Village Residential - ACSC-ST. The lot was the
site of mobile homes and has been subject to the impacts of
clearing and filling.
Recommendations:
In consideration of previous impacts to the site, Staff
recommends approval of Petition PU-91-10 subject to the
following stipulations:
1. Prior to Final Site Development Plan approval, petitioner
shall:
a) Provide proof that the property is more than six
hundred sixty (660) feet from the boundary of the
Fakahatchee Strand State Preserve, or provide proof
that the DNR, division of Recreation & Parks, has
been notified of the project, as specified by the
Department of Natural Resources (DNR) "Greenline"
designation, surrounding state parks.
b) Submit an Exotics Maintenance Plan to Project Review
Services - Environmental Staff for review and
approval. The plan shall indicate schedules and
methods for maintaining the site exotics free in
perpetuity.

c) Submit a Special Treatment (ST) Development Permit
application to Project Review Services -

Petition: PUD-89-1(1) : Bill Hoover of Butler Engineering,
Inc. , representing Rockwell Gust. J. R.
Properties; requesting a PUD Amendment to Pelican
Lake (Name Changed to Ospreys Landing) .
considerations:
The petitioner proposes an amendment to the Pelican Lake PUD
to request an Affordable Housing Density Bonus. The PUD will
be known as the "Ospreys Landing", and will include open
space and preserve areas, recreational uses, and a lake in
addition to the multi-family dwelling units. The project
density will be approximately nine (9) units per acre.
The property under consideration is a ±20 acre site located
approximately one and half miles east of Airport Road and one
half mile west of County Barn Road on the north side of Davis
Boulevard. The site is bordered to the west and north by
Moon Lake (PUD) , to the east by undeveloped A-2 land, and to
the south by Davis Boulevard.
The project site lies within the watershed of Rookery Bay
Aquatic Preserve. The natural drainage of the site flows
south into the Crown Pointe lake system then through the Lely
canal system. Ground elevations within the project site
range from 7.0 to 9. 6 feet above mean sea level.
The soil types on the site include Oldsmar fine sand
(approximately 30%) and Pineda fine sand limestone substratum
(approximately 70%) .
The southern one third of the site and three additional
smaller areas on the property consist of mostly saw palmetto
(Serenoa repens) with widely scattered slash pines (Pinus
elliottii) , with diameters up to nine inches. Groundcover
vegetation noted among the palmetto include rusty lyonia
(Lvonia ferruginea) , wax myrtle (Myrica cerifera) , gallberry
(Ilex glabra) , pennyroyal (Piloblephis rigida) and various
grass species. The open nature of the habitat (a few canopy
trees) and a thick shrub layer are site characteristics
beneficial to the protected red cockaded woodpecker.
Although woodpeckers were not observed during the site
inspection, they have been seen in this area.

There are approximately 4.5 acres of Collier County
jurisdictional wetland on the property (Reference Conceptual
Master Plan Dated 5/21/91) . The largest area is located in
the northeast corner, which is contiguous with an off-site
system. The canopy is comprised of scattered cypress
(Taxodium distichum) and occasional slash pine and cabbage
palm (Sabal palmetto) . The cypress are often significantly
buttressed and provide support for a diversity of epiphytes.
Corkwood (Stillingia aquatica) in this habitat indicate water
levels up to four inches. Additional wetland
vegetation among the cypress include wax myrtle, sawgrass
(Cladium iamaicense) , and swamp fern (Blechnum serrulatum) .
Various wetland grasses were also noted throughout this area.
The remaining areas on the property area characterized by an
open pine canopy (pines with four to nine inches in diameter)
with scattered cypress, melaleuca (Melaleuca spp. ) and a
graminoid groundcover.
The only listed species observed in the area were butterfly
orchids (Epidendrum spp. ) and a big cypress fox squirrel
(Scirus nigar ayicennia) .
Recommendations:
Staff recommends approval of Petition PUD-89-1 (1) with the
following stipulations:
1. A minimum of twenty-five percent (25%) of the entire
site's native vegetation shall be retained as required by
Collier County Ordinance No. 75-21 as amended by
Ordinance No. 89-58. Contiguous area(s) of retention
(preservation) shall be designated on the preliminary
site development plan (SDP) submittal.
2. The applicant shall submit a red cockaded woodpecker
survey conducted in accordance with the requirements of
the Florida Game and Fresh Water Fish Commission (FGFWFC)
prior to the preliminary SDP submittal. Survey results
shall determine if the design of the buildings,
associated structures and infrastructure shall be
adjusted to comply with the requirements of the FGFWFC.
3 . Design of the buildings, associated structures and
infrastructure shall not impact the Collier County
jurisdictional wetlands located in the northeastern
corner of the site as indicated on the Conceptual Master
Plan dated 5/21/91, unless all other non-impacting
designs would prohibit development of the minimum
allowable use of the zoning district or render the
project unpermitable by Local, State or Federal agencies.

4 . Proposed wetland impacts to Collier County jurisdictional
wetlands located in the central western portion of the
site as indicated on the Conceptual Master Plan dated
5/21/91, shall be subject to Project Review Services -
Environmental Staff approval. All proposed mitigation
for impacts to Collier County jurisdictional wetlands
shall comply with Appendix 7 of the South Florida Water
Management District rules. Proposed wetland mitigation
shall first be considered on site and contiguous to the
wetlands located in the northeastern corner of the site.
5. Wetlands proposed as mitigation and preserve areas shall
be field verified and approved by Project Review Services
- Environmental Staff, prior to preliminary SDP approval.
Prior to Final SDP approval the approved mitigation and
preserve areas must be surveyed and recorded as
conservation easement(s) as per the uses and limitations
of Chapter 704. 06 of the Florida Statutes. Said
conservation easement(s) must be recorded in the public
records of Collier County.
6. The water management system shall be controlled at the
lichen line/water mark elevation or other biological
indicator(s) of the adjacent wetland to ensure reasonable
successful restoration/preservation and/or enhancement of
the wetlands.
7 . An exotic removal, monitoring and maintenance
(exotic-free) plan for the site shall be submitted to the
Project Review Services - Environmental Staff for review
and approval prior to Final SDP approval.
