for a hunting camp

COMMENTS: Mr. Houghton explained this request is for a
16 ' x 20 ' ft . pre-constructed building on two
and one half acres he owns in the Big Cypress
National Preserve. He stated he is an exempt
property owner . He stated the building was
completed on July 15 , 1989, therefore, this is a
permanent request after the fact . He concluded
that he is in agreement with Staff ' s stipula-
tions, including the removal of plumbing facili-
ties in the bathroom if necessary.
Mr . Addison questioned if this has been approved
by the Parks Service, to which Mr . Houghton
replied in the affirmative.
MOTION: Made by Mr. Turrell, seconded by Mr. Addison and
carried 5/0, to recommend approval ofPU-90-22,
subject to Staff's Stipulations as follows:
STIPULATIONS:
1 . The petitioner shall plant twelve trees to
mitigate for the trees removed during
construction. The trees shall be native
species which will enhance the existing
habitat for protected species, such as the
liguus snails, observed during previous
site visits.
2 . If the hunting camp is found not to be an
accepted use as was stated in the letter
from Mr. Fagergren of August 8 , 1990 to Mr.
Houghton, the kitchen and bathroom shall be
removed, and the building shall be used for
storage or other acceptable use.
3 . Prior to issuance of Special Treatment (ST)
development permits and/or removal permits,
the petitioner shall obtain all applicable
State and federal permits or approvals
including the requirements of the Big
Cypress Preserve as noted in Ordinance No.
82-2 , Section 9 . 1 and Ordinance No. 75-21 as
amended.

COMMENTS: Ms. Boylan stated there is one small identified
. 43 acre wetland area on this 18-acre site. She
said a . 63 acre mitigation plan has been agreed
to in the northern area of the site which will
be adjacent to one of the retention lakes and
will be re-vegetated with appropriate aquatic
plantings. She adder: this mitigation will be
done in accordance with South Florida Water
Management District (SFWMD) requirements.
Ms. Boylan indicated a concern with Stipulation
#1 concerning 6 : 1 lake slopes, because the
greater the slope, the less room for mitigation
area. She suggested that standard 4 : 1 slopes be
required and stabilize the slopes in accordance
with SFWMD criteria.
It was the consensus to strike the last two sen-
tences in Stipulation #1 .
Dr . Martin commented that although there are
significant road improvements proposed along one
edge of the subject property, it is not
currently paved and is extremely dusty. He
suggested that, due to the few but existing
residences in the area, the petitioner enforce
his own proposal to keep the road watered down
during the dry season.
MOTION: Made by Mr. Neale, seconded by Mr. Turrell and
carried 5/0, to recommend approval of

protective covenants pursuant to Florida
Statutes, Chapter 704. 06 .
2 . Prior to final plat/construction plan appro-

cleared and filled, and the actual encroachment
on wetlands has been listed by Staff as . 72
acres. He stated it has since been surveyed per
the requirements of Stipulation #2 and is now
approximately . 4 acres. He concluded there are
no objections to Staff ' s stipulations.
MOTION: Made by Mr. Neale, seconded by Mr. Addison and
carried 5/0 to recommend approval of Petition
PU-90-33, subject to Staff's stipulations as

COMMENTS: Mr. Neale noted for the record that he has a
conflict of interest for this petition and has
filed Form 8B: Memorandum of Voting Conflict
for County, Municipal and Other Local Public
Officers.
Mr. Lee presented this request for a 5 . 6 acre
PUD located off Marco Lake Drive on Marco
Island. He said the subject property is bounded
on the north and west by property zoned C-4 and
on the east and south by RSF-4 zoning. He said
the site is currently a borrow pit which was
dredged several years ago for fill on Marco
Island. He stated the proposal is to fill
approximately three and one half acres of the
pit, maintain a two acre lake on site to treat
the water currently going through the site and
to accommodate the site ' s water management
needs. He mentioned that both the Department of
Environmental Regulation (DER) and SFWMD have
visited the site and determined it was not a
viable wetland. He added that Collier County is
claiming the site as a wetland and the peti-
tioner has no problem with mitigating off-site,
however, the main issue is the amount of mitiga-
tion. He asked that the mitigation being

requested by Staff be reduced to something com-
parable to what is being impacted.
Dr. Martin indicated he has a problem with the
petitioner discounting the borrow pit as a
wetland, yet the proposal refers to it as a
lake. He asked what will change it from one to
the other?
Mr . Lee responded that it will be a lake typical
to developments throughout the County. He said
a specific program has not yet been set up
as to what the plantings will be, which is
something that is typically done in the site
development plan process.
In answer to Dr. Martin, Mr . Worsham stated the
petitioner will be required to retain or
recreate 25% of the native vegetation on site.
Attorney Patrick Neale, representing Lake Front
Commercial Condominium Association, stated his
client is a property owner directly across Marco
Lake Drive. He advised that his client has
filed a law suit against the owners of the pro-
perty this date, to enjoin them from any further
activity with Collier County and calling into
question their title to the property. He said
his client holds a 99-year lease on a strip of
this property which essentially landlocks it and
makes it impossible to develop. He stated,
therefore, it is inappropriate for this petition
to be considered while subject to litigation.
Mr. Lee indicated that in light of this new
development, he would like to continue this
petition indefinitely.
It was the consensus to table Petition R-90-8
indefinitely.

staff. The enclosed "Proposed EAB Petition Review Criteria"
list represents Development Services Department's
recommendations.
The intent of the aforementioned list is to stimulate
discussion in order that via additions and/or deletions, a
list of concise EAB review criteria will be established that
will ensure the implementation of the Goals, Objectives and
Policies of the Collier County Growth Management Plan -
Conservation and Coastal Management Element.

Trustee, requesting a zoning change from RSF-4 to PUD
"Sanders Shopping Center" for retail shopping
center/business offices.
Considerations:
Petition was previously heard by the EAC on 12/19/1990. At which
time the applicant applied for a rezone from RSF-4 to C-4 .
Planning Services has asked the petitioner to change their request
for a rezone from RSF-4 to PUD so that specific development
standards may be locked in. Staff requests the petition be
approved utilizing the same stipulations which have been
incorporated in this report.
The applicant is applying for a rezone from RSF-4 to PUD for con-
struction of a retail shopping center/business offices. The site
consists of a 4 . 2 +/- acre parcel with residential single-family
homes, bounded on the east and south by single-family homes and on
the west by commercial property. The petitioner proposes removal
of the single-family homes and construction of a commercial
center. Approximately twenty-five percent (25%) of the site will
remain as pervious area (buffer area and retention) with all
native vegetation within the designated buffer/open space areas to
be retained on-site.
A gopher tortoise burrow was observed on-site near the southwest
corner of the property. The petitioner has contacted Ms. Kimberly
Dryden, Florida Game and Fresh Water Fish Commission, for recom-
mendations and assistance in relocating any gopher tortoise found
on-site.
Sand pines are located along the south boundary and southeast
corner of the site. The petitioner will retain all sand pines on
site which are not under the proposed building envelope. Individ-
ual parking spaces may be relocated in order to retain sand pine
that may fall in a parking lot.
Recommendations:
In consideration of the above, staff recommends administrative
approval of Petition R-90-25 subject to the following stipula-
tions:
1. Prior to any future development order approvals, the peti-
tioner shall conduct a gopher tortoise survey in accordance
with the Florida Game and Fresh Water Fish Commission
protocols and obtain any necessary permits and/or approvals
for on-site preservation or off-site relocation.

2 . Prior to any future development order approvals, the peti-
tioner shall survey the locations of all sand pines greater
than or equal to 4 inches DBH and indicate on the site plan
the locations of all sand pines proposed for removal and

Petition: PDA-91-1: Ronald L. Hurt of Anchor/American

requesting a PUD Amendment to "Berkshire Lakes" .
Considerations:
The petitioner is requesting a PUD amendment to remove the
limits on single family and multi-family units and to allow
the distribution of single family and multi-family units to
be at the discretion of the developer while observing the
maximum allowable number of units of 4 ,200. Staff has
reviewed Berkshire Lakes' proposal and has no objection to
the change with some assurance that it will not cause
additional loss of native vegetation.
Recommendations:
Staff recommends administrative approval of PDA-91-1 with the
following stipulations:
1. All future development parcels, whether single family or
multi-family, shall be required to retain at least
twenty-five percent (25%) of the existing native
vegetation in existence at the time of this approval.
2 . Should the proposed re-assignment of development tract
uses require re-platting of any parcel, the applicant
shall provide an updated red cockaded woodpecker survey
and comply with the recommendations of the Florida Game
and Fresh Water Fish Commission should any birds or
cavity trees be discovered.

Petition: R-91-1: William R. Vines of Vines & Associates,
Inc. , representing Citizens & Southern Trust
Company (Florida) N. A. ; requesting a zoning
change from A-2 to PUD "Northbrook Plaza" .
Considerations:
The petitioner requests a zoning change from A-2 to PUD,
mixed commercial/residential, typical of interstate
interchange facilities. Subject property is an undeveloped,
irregularly shaped 39 . 9 acre parcel of land located in the
southeast quarter of Section 19, Township 48 South, Range 26
East, Collier County, Florida. It is situated in the
northeast quadrant of Interstate 75 (I-75) and Immokalee Road
(CR 846) . The Cocohatchee Canal is to the south of the
property.
Reader is referred to the enclosed Environmental Impact
Statement (EIS) page 6 and to the graphic representation of
vegetative cover located in the back of said report for a
vegetation description. Major habitats are: 1) pine
flatwoods; 2) pine flatwoods with exotic vegetation
(including Melaleuca (Melaleuca ctuinquenervia) and Brazilian
pepper, (Schinus terebinthifolius) ; 3) willow-cypress
wetlands; and 4) cleared, graminoid cover areas. The area of
willow-cypress wetlands is approximately .49 acres and is in
the southeast corner of the site. The wetland area has
clearly been impacted by the construction activities of I-75,
CR 846 and the Cocohatchee Canal system. Petitioner has
agreed to future determination by County, State and Federal
jurisdictions of the exact wetland boundary acreage. Given
that the wetland is adjacent to the planned site access road
from CR 846, alternative and/or mitigation measures will need
to be addressed in the site development review stage. The
plan is conceptual at this time.
A wildlife survey was conducted on October 9, 1990 by Kevin
L. Erwin Consulting Ecologists, Inc. (KLECE) . Staff agrees
that the pine flatwoods on site appear to be poor quality
gopher tortoise (Gopherus polvphemus) habitat. However, a
site visit on January 14 , 1991 by Barbara N. Prynoski,
Collier County Project Review Services Environmental Staff
and William Vines of Vines and Associates indicated recent
activity at one burrow (all eight burrows were not field

located) . Given the results of the 1/14/91 site visit and
the statement made by KLECE that "four potentially active
burrows had fresh dirt. . " [reference page 5, Threatened and
Endangered Species Survey (TESS) ] , an additional gopher
tortoise survey appears necessary. All TESS located gopher
tortoise burrows may not be inactive as stated.
Major environmental concerns:
- wetlands in southeast corner
- gopher tortoises
Recommendations:
Considering the above, Staff recommends approval of petition
R-91-1 with the following stipulations:
1. A protected species survey, specifically for gopher
tortoises (Gopherus polyphemus) , shall be conducted in
accordance with the requirements of the Florida Game and
Fresh Water Fish Commission within six (6) months or less
of Site Plan or Subdivison Master Plan (SMP) submittal.
2 . This project is recommended for rezoning only. Applicant
shall be subject to all environmental ordinances in
effect at the time of Site Plan/Subdivision Master Plan
approvals.
3 . Wetlands shall be flagged by the petitioner, to include
Collier County jurisdictional lines, and shall be field
verified by Collier County Project Review Services
Environmental Staff prior to and as part of the Site
Plan/Subdivision Master Plan approval. Said approved
wetland boundary shall be indicated on the SMP and final
site plan/construction plan.
4 . All proposed mitigation for impacts to Collier County
jurisdictional wetlands shall comply with the ratios and
requirements of Appendix 7 of the South Florida Water
Management District rules. Mitigation areas shall be
surveyed prior to final (site plan/construction plan)
approval and designated as a conservation easement and/or
tract with protective convenants pursuant to Florida
Statutes, Chapter 704 . 06.

5. An exotic removal, monitoring, and maintenance

Considerations:
Lely Development Corporation is requesting a PUD amendment to
allow a welcome center on site. Staff has reviewed the PUD
document and has no objections to the new language. Staff does
recommend the following additional environmental stipulations.
Stipulation #2 is a requirement of Lelys' Red Cockaded Woodpecker
management plan, reviewed and approved by Florida Game and Fresh
Water Fish Commission.
Recommendations:
Staff recommends approval of PDA-90-11 with the following
stipulations:
1. Amend PUD document: (Pg. 12-1) under 12 . 02 Permitted
Uses & Structures
#4 "Water Management Facilities and essential services. "
Add the following language " . . . subject to further review
by Collier County Project Review Environmental Staff to
insure that water management facilities do not degrade or
alter the vegetation or hydroperiod of the cypress
preserve areas. "
2 . Amend PUD document: (Page 14-8)
#8 Add: Red Cockaded Woodpecker (RCW) Habitat - Habitat
preservation (RCW) effected as a result of the RCW
Management Plan shall be in perpetuity unless otherwise
mitigated on a regional basis and approved by the Florida
Game and Fresh Water Fish Commission. No jurisdictional
wetlands can be included within the Red Cockaded
Woodpecker habitat preserve areas. "

Petition: R-90-8: Robert L. Duane, AICP of Hole, Montes &
Associates, Inc. , representing Elhanon and Sandra
Combs; requesting a zoning change from RSF-4 to
PUD "Island Oasis".
Considerations:
Petitioner requests a zoning change for the development of
single-family and multi-family residential units with a
recreation area that includes a pool, clubhouse, and tennis
facilities on the 5.6 acre site. The subject property is
located off Marco Lake Drive on Marco Island and is bounded
on the north and west by property zoned C-4, and on the east
and south by RSF-4 zoning.
Most of the site is a submerged wetland created by borrow pit
activities. The dominant vegetation is cattails (Typha
spp. ) . Many birds were observed on site, and American
alligators (Alligator mississippiensis) have been reported.
Recommendations:
Since human activity has had a great impact on the site,
staff recommends approval of petition R-90-8 subject to the
following stipulations:
1. Habitats and their boundaries (consistent with FLUCCS)
shall be identified on an aerial photo of the site
(Ordinance No. 82-2 as amended by Ordinance No. 89-49)
prior to approval of subdivision master plan.
2 . The master plan shall reflect the fact that twenty five
percent (25%) of native vegetation (as determined from
data supplied in stipulation one) shall be retained or
recreated (Ordinance No. 82-2 as amended by Ordinance No.
89-49) prior to approval of subdivision master plan.
3. A proposed mitigation plan for wetland impacts (a minimum
ratio of 1.5: 1 onsite and/or 3:1 offsite) shall be
submitted (Collier County Growth Management Plan -
Conservation and Coastal Management Element Policies •
6.2 .5; 6.2.8; 6.2. 10; 6.2 . 12; and 6.3.2) prior to
approval of subdivision master plan.

4. The applicant shall modify the proposed lake cross
section to raise bottom elevation to -4.0 NGVD (Ordinance
No. 70-2) , or, if a deeper excavation is desired, test
borings and periodic water quality monitoring shall be
required to prove that no salt water intrusion will
occur, prior to approval of the plat and construction
plans.
5. An appropriate protected species survey, using current
methodology of the Florida Game and Fresh Water Fish
Commission (FGFWFC) shall be performed (Collier County
Growth Management Plan - Conservation and Coastal
Management Element Policies 7.3 .4 and 7.3.8) prior to
approval of subdivision master plan. FGFWFC permits or
letters of exemption shall be presented prior to plat
approval.
6. Section 7.1B of the PUD document shall be revised to
incorporate the provisions of Ordinance No. 82-2, Section
8.30 as amended b Ordinance No. 89-57.
