Plan to show a minimum of 45. 02 acres and identify the
tracts as preserves.
2 . Amend Table I under 3. 4 of the PUD document, Residential
Development Standards, under the entry of Natural

4 . Amend Section V of the PUD document to add 5. 2 .A. 8 to
read as follows:
"The Permitted Principal Uses and Structures described
in 5. 2 .A. 1 through 5. 2 .A. 7 shall not cause vegetation
to be removed where the remaining native vegetation
acreage falls below the required minimum of 45 . 02 . "
5. Add the following language to the PUD document under
Section 6. 9.E. :
"A minimum of twenty-five (25) percent of the existing
native vegetation on site shall be retained as required
in Section 3. 9. 5 . 5. 3 of the Collier Land Development
Code. That requires a minimum of 45 . 02 acres of native
vegetation, in all three strata) . "

2 . The excavation shall be limited to a bottom elevation
of 16 feet below existing grade and shall be no
shallower than 10 feet below existing grade.
3. Offsite removal of material shall be subject to
standard conditions imposed by the Transportation
Department (attached) .
4 . No blasting will be permitted unless issued a separate
permit by Collier County Engineering Review Services .
5 . If vegetation is to be removed as a result of the
excavation, a separate Vegetation Removal Permit (per
Collier County Land Development Code, Division 9) shall
be obtained from Collier County Development Services
Department before commencing work.

Water Management:
1. Prior to issuance of the Excavation Permit, applicant shall submit Geological
Report with borings :showing depth of confining layer, if layer exists.
Conclusions in the report will be verified by County staff. Lake depth will be
limited to 50' or confining layer,whichever is shallower.
2. Petitioner will obtain necessary permits from the Army Corps of Engineers and
the South Florida Water Management District and the Florida Department of
Environmental Protection.
3. Prior to issuance of Excavation permit, or by September 1, 1997, whichever
comes first, applicant shall submit water quality monitoring plan for salinity.
Plan shall be in effect until it has been decided by County staff that no adverse
impacts are occurring.
Environmental:
1. The petitioner shall retain fifteen percent of the existing native vegetation on site
pursuant to section 3.9.5.5.4.CCLDC. The proposed site plan exceeds this
requirement by preserving 45 percent of the existing native vegetation on site.

Environmental Resource Permit rules and be subject to review and approval by
Current Planning Environmental Review Staff. Removal of exotic vegetation

3. Buffers shall be provided around wetlands, extending at least fifteen(15) feet
landward from the edge of wetland preserves in all places and averaging twenty-
five (25) feet from the landward edge of wetlands. Where natural buffers are not
possible, structural buffers shall be provided in accordance with the State of
Florida Environmental Resource Permit Rules and be subject to review and
approval by Current Planning Environmental Staff.
4. An exotic vegetation removal,monitoring, and maintenance(exotic free)plan
for the site,with emphasis on the areas of preservation, shall be submitted to
Current Planning environmental staff for review and approval prior to issuance
of an agricultural clearing permit.

1. The top of lake bank shall be no closer than 50 feet from a property line. This
requirement may be reduced if the lake is fenced or an equivalent is approved by
staff i.e. berm or heavy landscaping.
2. The south lake shall not encroach into the existing drainage easement unless
approved by the Stormwater Management Director.
3. An Excavation Permit will be required for the proposed lake in accordance with
Division 3.5 of Collier County Ordinance No. 92-73 and SFWMD rules.
Environmental:

V. STAFF COMMENTS:
Water Management:
Stormwater runoff for the site generally sheetflows to the south. A large slough covering the
western portion of the site conveys onsite as well as offsite flows southerly to the CR 864 roadside
swale. Offsite flows originate from the Naples Heritage Golf and Country Club to the west and
the Naples National Golf Course and undeveloped areas to the north. The site is located within
the Collier County C-4 Canal Basin and has an allowable discharge of 0.06 cfs per acre as
defined by Collier County Ordinance 90-10.
The project will consist of a 28 unit single-family residential subdivision and a tennis recreation
center. Each lot in the subdivision will have a permanent concrete block retaining wall
surrounding the lot and driveway. The retaining wall will limit impacts to the wetlands in the
center of development, prevent untreated runoff from entering preserved wetlands, and provide
flood protection for the residences resulting from high water levels in the wetlands. Stormwater
runoff from the lots will be conveyed directly to the road right-of-way. Catch basins in the
roadside swales will convey the runoff to Lakes 1 and 2 for water quality treatment. Berms
around each lake will hydraulically separate the lakes from the interior wetlands. A control
structure in Lake 2 will discharge to the onsite slough by a spreader swale.
The tennis center will be constructed outside of the residential development surrounded by the
onsite slough. Water quality treatment for the 0.41 acre facility will be provided by retention
swales which overflow to the adjacent slough.

Environmental:
Native habitats on site include 16.23 acres of pine flatwoods, 7.36 acres of cypress wetland and
132.14 acres of pine/cypress/melaleuca wetlands. Plant community descriptions and FLUCCS
map(Exhibit A)are included in the environmental impact statement. Over twenty five percent of
the native habitat on site will be retained per the PUD master plan.
A total of 139.5 acres of Collier County / South Florida Water Management District
jurisdictional wetlands have been identified on the subject property. Approximately 40.0 acres of
these wetlands will be impacted by the proposed project. To offset wetland losses the petitioner
proposes on site preservation and restoration of 4.87 acres of pine flatwoods and 100.4 acres of
cypress and pine/cypress wetland. A mitigation and monitoring plan is included in the
environmental impact statement.
No U.S. Fish and Wildlife Service(USFWS) or Florida Game and Fresh Water Fish Commission
(FGFWFC) listed flora or fauna were observed on site by the petitioner. Red-cockaded
woodpeckers (RCW) are known to use the pine and pine/cypress habitat types for nesting and
feeding in the project area. All mature pine trees in the pine flatwoods were checked for cavities
by the petitioner. No sign or calling by RCWs were observed during the survey.
Three soil types were identified on the site as shown in Figure 3 in the environmental impact
statement. These include Chobee,Limestone Substratum and Dania Mucks,Depressional,Pineda
Fine Sand, Limestone Substratum and Boca Fine Sand. Two of the three soils are considered
hydric by the Soil Conservation Service.
The project site is located in an area of historical/archaeological probability as identified in the
historical/probability maps for Collier County. The petitioner will need to submit an
archaeological survey and assessment as required in section 2.2.25.3.3 of the Collier County
Land Development Code(CCLDC). Waiver requests are covered in section 2.2.25.3.10 CCLDC.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-97-9, "The Club
Estates"with the following stipulations:
Water Management:
1. An excavation permit will be required for the proposed lakes in accordance with
Division 3.5 of the Collier County Land Development Code and SFWMD rules.
Environmental:
1. Amend section 5.2.A.2 of the PUD document to read as follows:
Lakes as shown on the PUD master plan.

2. Add the following stipulations to section 6.10 of the PUD document:
a. Permits or letters of exemption from the U.S. Army Corps of Engineers
(ACOE)and the South Florida Water Management District(SFWMD) shall be
presented prior to final plat/construction plan approval.
b. Environmental permitting shall be in accordance with the State of Florida
Environmental Resource Permit rules and be subject to review and approval by
Current Planning Environmental Review Staff. Removal of exotic vegetation
shall not be counted towards mitigation for impacts to Collier County
jurisdictional wetlands.
c. All conservation areas shall be designated as conservation/preservation tracts or
easements on all construction plans and shall be recorded on the plat with
protective covenants per or similar to section 704.06 of the Florida Statutes.
In the event the project does not require platting, all conservation areas shall be
recorded as conservation/preservation tracts or easements dedicated to an
approved entity or to Collier County with no responsibility for maintenance and
subject to the uses and limitations similar to or as per Florida Statutes Section
704.06.
