DESCRIPTION OF SURROUNDING PROPERTIES: The surrounding land uses are a combination of residential sub- divisions and undeveloped property currently in a natural vegetated state . Developed residential property exists to the north and east . The property immediately to the west is Interstate 75 right-of-way. To the south is the unimproved Northbrooke PUD. S. 41/ Wiggins Pass Road PUD is a proposed Mixed commercial center made up of five tracts with uses ranging from fast food restaurants to a hotel . A conceptual water management plan uses to the greatest extent possible, natural features and systems within the site for the retention and storage of storm water as well as for preservation of existing native vegetation. STAFF COMMENTS: Water Management: The proposed water management system for the 9 . 08 acre parcel will consist of a 1 . 63 acre dry retention/detention area which will treat the first inch of runoff before discharging to the roadside swale on Wiggins Pass Road. A control structure will n be sized to limit the discharge to 0 . 04 cfs/ac. The system, as proposed, will meet the requirements of SFWMD and Collier County for water quality and water quantity. EAB Meeting July 2, 1997 PUD 97-6 Page 3 Environmental: The subject property consists entirely of upland habitats and Immokalee Fine Sand. The EIS described the upland vegetative communities as 0 . 7 acres of Pine Flatwoods, 0 . 6 acres of disturbed Pine Flatwoods, 6 .4 acres of Hardwood/ Conifer Mixed disturbed and 1 .4 acres of disturbed areas. The vegetative communities found on site are remnants of a much larger xeric scrub/ scrubby pine flatwoods which historically occurred along the dune ridge that is now U. S.41 . This parcel can now be described as a mostly Hardwood/ Conifer Mixed FLUCCS with a canopy of Slash Pine (Pinus elliottii) , live oak (Quercus virginiana) , myrtle oak ( Q. myrtifolia) and scrub live oak (Q. geminata) . Cabbage palm (Sabal Palmetto) , ear-leaf acacia (Acacia auriculiformis) and brazilian pepper (Schinus terebinthifolius) were observed occasionally on the property. Midstory species included live oak, myrtle oak and scrub live oak. Ground cover was predominantly saw palmetto (Serenoa repens) . Additional species included scrub rosemary (Ceratiola ericoides) , lichens and deer moss ( Cladonia spp. ) , running oak and prickly pear cactus. A wildlife species survey was conducted and the only protected species observed on site were Gopher Tortoise. It was estimated that one Gopher Tortoise lives on this parcel . VI. RECOMMENDATIONS: 1 Staff recommends approval of PUD 97-6 "U.S. 41/Wiggins Pass Road PUD" with the following stipulations : WATER MANAGEMENT: 1 . Section 9 .2 of the PUD document shall be revised by adding if fenced" to the end of the sentence. 2 . At the time of site development plan submittal, it shall be demonstrated that the Wiggins Pass Road swale has the capacity to handle the additional site discharge and that a positive outfall exists west of U.S. 41 . Amend Section VI of the PUD document to add the following: 6 . 6 "An exotic vegetation removal, monitoring and maintenance (exotic free) plan for the site, with emphasis on the conservation/ preservation areas, shall be submitted to Current Planning Environmental Review Staff for review and approval prior to Final Site Plan/ Construction Plan approval . " 6 . 7 "A Gopher Tortoise relocation/ management plan shall be submitted to Current Planning Environmental Staff for review and approval prior to final site plan/ construction plan approval . That plan shall contain, at a minimum, the area where the tortoise will be relocated, the type of fencing and its design, whether or not it will be necessary to provide additional plantings in that area for food or if food will be supplemented and the person responsible for the -- implementation of the plan. STAFF COMMENTS: Water Management: The water management system to serve the 10+ acre project will consist of two interconnected lakes. Catch basins and culvert systems will convey runoff from the residential areas and road to the lakes. Discharge off-site will be through a control structure into the existing swale running south to the Immokalee Road canal. Discharge will be limited to .04 cfs/acre. The proposed Sawgrass Court crosses the drainage easement at the high point of the swale. Environmental: The subject property is primarily a pine flatwoods with open areas of herbaceous vegetation. Portions of the site may have been farmed historically which explains the openness of the site. Disturbed areas containing bahia grass and other weedy species are found on the east and west sides of the property. The majority of site is vegetated with native species. Fifteen percent of the native vegetation on site will have to be retained and/or re- created pursuant to section 3.9.5.5.4 of the Collier County Land Development Code (CCLDC). The petitioner proposes retaining and/or re-creating 1.58 acres of native habitat on the single family lots and adjacent to the storm water management lake. - t EAB Meeting July 2, 1997 PSP-96-14 (Sawgrass Subdivision Page 3 No Collier County jurisdictional wetlands occur on the subject property as determined by the South Florida Water Management District (SFWMD). U.S. Army Corps of Engineers (ACOE) jurisdictional wetlands have not been determined at this time. The only soil type found on site is Immokalee Fine Sand. This soil type is typical of a pine flatwoods community. No U.S. Fish and Wildlife Service (USFWS) or Florida Game and Fresh Water Fish Commission (FGFWFC) plant or animal species were observed by the petitioner on the subject property. A review of the historical/archaeological probability maps for Collier County indicate no archaeological or historical sites to be located on the subject property. VI. RECOMMENDATIONS: Staff recommends approval of Preliminary Subdivision Plat No. PSP-96-14, "Sawgrass Subdivision"with the following stipulations: Water Management: 1. The top of lake bank shall be no closer than 50 feet from a property line. This requirement may be reduced if the lake is fenced or an equivalent is approved by staff i.e. berm or heavy landscaping. 2. The south lake shall not encroach into the existing drainage easement unless approved by the Stormwater Management Director. 3. An Excavation Permit will be required for the proposed lake in accordance with Division 3.5 of Collier County Ordinance No. 92-73 and SFWMD rules. Environmental: 1. An appropriate portion of native vegetation shall be retained on site as required in section 3.9.5.5.4.CCLDC. These areas shall be designated on the final site plan/construction plan as native vegetation retention pursuant to section 3.9.5.5.4 CCLDC. LOCATION: The subject property is an undeveloped 35.19 acre industrial zoned parcel located at the eastern end of Sun Century road, approximately one half mile east of Old U.S.41, in Section 10, Township 48 South, Range 25 East, Collier County, Florida. III. DESCRIPTION OF SURROUNDING PROPERTIES: Surrounding properties are undeveloped with the following zoning classifications: ZONING DESCRIPTION N - Industrial Undeveloped S - PUD (Imperial Lakes) Undeveloped E - Agricultural Undeveloped W- Industrial Undeveloped IV. PROJECT DESCRIPTION: The following submission is a preliminary site plan for a proposed industrial park off Old U.S.41 in northern Collier County. The project will be submitted as an SDP following a review of the proposal by the Environmental Advisory Board. p . STAFF COMMENTS: Water Management: The water management system for the 35.2 acre industrial site will consist of a pond and/or retention area which will provide water quality and peak flow attenuation for the surface water runoff. Discharge from the site will be from a control structure located at the S.E. corner of the site and will be limited to .04 cfs/acre. Discharge will be into a slough east of the site and ultimately into the Cocohatchee River. This project will be permitted by SFWMD should wetland areas be determined jurisdictional. Environmental: Vegetation on the subject property includes xeric oak/rosemary scrub (20.37 acres), palmetto prairie (9.90 acres), pine flatwoods (3.94 acres), Melaleuca forest (0.50 acres) and a seasonal pond/marsh (0.48 acres). Upland habitats are of good ,.-• quality with few exotics present. EAB Meeting July 2, 1997 .-� Livingston Park Subdivision Page 3 Fifteen percent of the native vegetation .n site will have to be retained and/or re- created pursuant to section 3.9.5.5.4 o the Collier County Land Development Code (CCLDC). The petitioner propose. preservation/restoration of 2.68 acres of xeric oak/rosemary scrub, 0.83 acres of palmetto prairie, 1.34 acres of pine flatwoods and 0.50 acres of melaleuca forest in two separate preserve areas as shown on the future subdivision plan. e upland preservation area contains a high density of gopher tortoise burrows. Two wetland areas occur on the subject property, a seasonal pond and Melaleuca forest. Jurisdictional determinations wil be verified by the South Florida Water Management District (SFWMD) and the U.S. Army Corps of Engineers (ACOE) at the time of SDP submittal. Collier County jurisdictional wetlands will be equivalent to those wetlands claimed by e state of Florida. Gopher tortoises (Gopherus .ol is hem s were the only listed wildlife species found on the subject property. A tota of seventy active and inactive gopher tortoise burrows were identified. The :opher tortoise is listed as a species of special concern by the Florida Gam- and Fresh Water Fish Commission (FGFWFC). Gopher tortoise burrows li cated within the development impacted areas will be relocated to appropriate hali tat in the upland open space areas on site. Five soil types were identified on the s te. These include Immokalee Fine Sand, Basinger Fine Sand, Rivera Fine Sand ( imestone Substratum), Rivera Fine Sand (Depressional) and Satellite Fine Sand. •, soils map for the project site is included in the environmental impact statement. A review of the historical/archaeological probability maps for Collier County show the site to be located in an area of 'storical/archaeological probability. The petitioner will have to submit an histori al/archaeological survey and assessment with the SDP application. VI. RECOMMENDATIONS: Staff recommends approval of the "Livi gston Park Future Subdivision Plan" with the following stipulations: EAB Meeting July 2, 1997 Livingston Park Subdivision Page 4 Water Management: 1. Should wetland areas be determined jurisdictional, a copy of the SFWMD Surface Water Permit will be required prior to final SDP approval. 2. An Excavation Permit will be required for the proposed lake in accordance with Division 3.5 of Collier County Ordinance No. 92-73 and SFWMD rules. Environmental: 1. An appropriate portion of native vegetation shall be retained on site as required in section 3.9.5.5.4.CCLDC. These areas shall be designated on the final site plan/construction plan as native vegetation retention pursuant to section 3.9.5.5.4 CCLDC. 2. Environmental permitting shall be in accordance with the state of Florida Environmental Resource Permit rules and be subject to review and approval by Current Planning Environmental Review Staff. Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier County jurisdictional wetlands. 3. Buffers shall be provided around wetlands, extending at least fifteen(15) feet landward from the edge of wetland preserves in all places and averaging twenty-five(25) feet from the landward edge of wetlands. Where natural buffers are not possible, structural buffers shall be provided in accordance with the State of Florida Environmental Resource Permit Rules and be subject to review and approval by Current Planning Environmental Staff. 4. An exotic vegetation removal,monitoring, and maintenance(exotic free) plan for the site,with emphasis on areas of retained native vegetation, shall be submitted to Current Planning environmental staff for review and approval prior to final site plan/construction plan approval. 5. Petitioner shall comply with the guidelines and recommendations of the U.S. Fish and Wildlife Service (USFWS) and Florida Game and Fresh Water Fish Commission (FGFWFC) regarding potential impacts to protected wildlife species.
