1. A copy of SFWMD Permit or Early Work Permit with staff report is required prior to
construction plan approval.
2. An Excavation Permit will be required for the proposed lake(s) in accordance with
Division 3.5 of Collier County Ordinance No. 92-73 and SFWMD rules.
Environmental:
1 All approved Agency (SFWMD, ACOE) permits shall be submitted prior to final
Plat/Construction Plan approval.
2. All conservation areas shall be designated as conservation/preservation tracts or
easements on all construction plans and shall be recorded on the plat with protective
covenants per or similar to Section 704.06 of the Florida Statutes. Buffers shall be
provided in accordance with 3.2.8.4.7.3 CCLDC.
3. Buffers shall be provided around wetlands, extending at least fifteen (15) feet
landward from the edge of wetland preserves in all places and averaging twenty-five
(25) feet from the landward edge of wetlands. Where natural buffers are not possible,
structural buffers shall be provided in accordance with the State of Florida
Environmental Resources Permit Rules and be subject to review and approval by
Current Planning Environmental Staff.
4. An exotic vegetation removal, monitoring, and maintenance (exotic-free) plan for the
site, with emphasis on the conservation/preservation areas, shall be submitted to
Current Planning Environmental Review Staff for review and approval prior to final
site plan/construction plan approval.
5. Environmental permitting shall be in accordance with the state of Florida
Environmental Resource Permit rules and be subject to review and approval by
Current Planning Environmental Review Staff. Removal of exotic vegetation shall
not be counted towards mitigation for impacts to Collier County jurisdictional
wetlands.

STIPULATIONS:
Water Management:
1. A copy of the SFWMD Surface Water Permit application shall be sent to Collier
County Development Services with the SDP submittal.
2. A copy of the SFWMD Surface Water Permit will be submitted prior to Final SDP
approval.
3. Lake setbacks from the PUD perimeter can be reduced to 25 ft. where a 6 ft. high
fence or suitably substantial barrier is erected.
Environmental:
1. Setbacks from preserve areas shall be pursuant to section 3.2.8.4.7(3) of the Collier
County Land Development Code. Revise the setbacks in Table I (Residential
Development Standards) accordingly.
2. Add the following stipulation to section 4.10 of the PUD document:
Petitioner shall comply with the guidelines and recommendations of the U.S. Fish &
Wildlife Service (USFWS) and Florida Game and Fresh Water Fish Commission
(FGFWFC) regarding potential impacts to protected wildlife species. Where
protected species are observed on site, a Habitat Management Plan for those protected
species shall be submitted to Current Planning Environmental staff for review and
approval prior to Final Site Plan/Construction Plan approval.

STIPULATIONS:
Water Management:
A SFWMD permit modification must be obtained prior to final site development plan
approval.
Environmental:
1. Permits or letters of exemption from the U.S. Army Corps of Engineers (ACOE) and
the South Florida Water Management district(SFWMD) shall be presented prior to
final site development plan approval.
2. Petitioner shall submit the appropriate site clearing fee.
3. A preservation buffer/fence around every building site along the sides and the back of
not to exceed 10 ft. from the building must be erected around each building site prior
to commencement of construction. Further in all other areas a preservation fence is
required around all horizontal construction of not to exceed 10 ft. in width. The intent
is to preserve the most natural vegetation possible and if further remedies are
available during construction then they must be implemented.
NEW BUSINESS:
Mr. Lamoureux announced his resignation from the Environmental Advisory Board. He
may attend the next meeting if possible.

The subject property is located on the north and south sides of
Immokalee Road, approximately three miles east of SR 951, in

IV. PROJECT DESCRIPTION:
Twin Eagles straddles Immokalee Road and its parallel canal .
According to the Drainage Atlas for Collier County the northern
portion sits in the Corkscrew Canal Basin, just east of the flow
divide, so discharge for that portion would be to the east through
the Corkscrew Canal .
Southerly flows from Bird Rookery Swamp and Corkscrew Swamp to the
north appear to pass around the west side of Twin Eagles.
The portion of the project south of Immokalee Road drains into
preserves that straddle Rock Road, this entire area is within the
Cypress Canal Basin. The Curry Canal is the nearest positive
discharge, but water would have to flow toward the south or east
under Rock Road to get there.

V. STAFF COMMENTS:
Water Management:
This project will be reviewed and permitted by the SFWMD.
Environmental:
The subject property consists of a total of 1374 acres of land
divided into a northern half and a southern half by Immokalee

Road. The majority of the impacts will be to the northern 1114
acres with two proposed 18 hole golf courses and 275 residential
units. Proposed impacts to the southern 260 acres will be by
development of horse pastures, stables, riding arenas, on site
caretakers home and other recreational facilities .
A formal Environmental Impact Statement as required by Collier
County Land Development Code Section 3 . 8 was not submitted. Staff
feels that the Assessment Report submitted, the consultants guided
tour of the site, very thorough descriptions and answers to the
impacts not addressed in the Report and subsequent conversations
with the environmental consultant should allow this submittal to
be considered complete. The Environmental Advisory Board (EAB)
may however wish to have the consultant submit additional
information as an attachment to the Environmental Assessment
Report submitted. This should not require additional review by
the EAB, but should be filed with the official PUD file and the
Environmental file at Community Development & Environmental
Services Division.
The environmental consultants Report excellently and thoroughly
describes the site by FLUCCS code and gives detailed descriptions
of the individual tracts of land broken down by North Tract and
South Tract . Site development proposes approximately 19 acres of
impacts to the 240 acres of wetlands on the north tract and about
3 acres of impacts to the 178 acres of wetland in the southern
portion of the property. Special protection will be afforded the
unique 2 . 7 acre Tropical Hammock with Simpson' s stopper located on
the southern tract .
Endangered species surveys were conducted by the consultant in the
months of April and May, 1996 and January and February, 1997 .
Eight (8) listed species were observed on the north tract and two
(2) listed species were observed on the south tract . Those
species seen on the north tract were the American alligator, Big
Cypress fox squirrels, great egrets, tri-color herons, wood
storks, white ibis, sand hill cranes and little blue herons . The
species found on the south tract were gopher tortoise and
Simpson' s stopper. Also of interest was the presence of wild
turkey on site. Both the vegetation inventory and protected
species locations are identified on the aerials provided with the
report . All areas where these species were observed will be
protected in preserves or conservation easements except for the
small cattle pond where little blue heron and great egret were
observed in the southern central portion of the northern tract .

VI. RECOMMENDATIONS:
Staff recommends approval of PUD-97-3 Twin Eagles Golf & Country
Club, with the following stipulations :
Water Management:
1 . Amend section 6 . 8 of the PUD document as follows :
"The development of this PUD Master Development Plan shall be
3ubjcct to and govcrncd by the following conditions : comply with
the CCLDC, as amended. "
2 . The petitioner shall submit a copy of the SFWMD permit
application to Collier County Development Services Engineering
Staff for review and comment .
3 . The petitioner shall show the route of the off-site discharge
from the parcel south of Immokalee Road (from the project
boundary to the receiving canal) on the conceptual water
management plan.
4 . Amend Section 2 . 11 of the PUD document as follows :
A. End the second sentence after 1 in accordance with Section

The subject property is located adjacent to and east of
Interstate 75 extending from % mile north of Immokalee Road to
2 miles north of Immokalee Road in northern Collier County;

III . DESCRIPTION OF SURROUNDING PROPERTIES:
The surrounding land uses are a combination of residential sub-
divisions and undeveloped property currently in a natural
vegetated state . Developed residential property exists to the
north and east . The property immediately to the west is
Interstate 75 right-of-way. To the south is the unimproved
Northbrooke PUD.

Cypress Woods Golf and Country Club is a proposed 18-hole
private golf course community to contain a maximum of 799
residential units both single family and condominium.

V. STAFF COMMENTS:
Water Management:
The water management system to serve this project will consist
of three drainage basins . The northern two basins will
discharge through separate control structures into the third
basin which will ultimately discharge from the site through a
third control structure to the Immokalee Road Canal .

Each basin will contain a series of interconnected lakes .
Runoff from the developed areas will be conveyed to the lakes
by sheet flow, catch basins and culvert systems .
Offsite flow from the Northbrooke Plaza PUD, to the south, will
be routed through the project .
Discharge from the site is limited to . 04 cfs/acre .
This project will be permitted by the South Florida Water
Management District .
Environmental :
The subject property consists of approximately 285 acres of
land categorized by FLUCCS code as Pasture, Pine Flatwoods,
Hydric Pine Flatwoods, Cypress, Wet Prairie, Canal and Borrow
Pit . The Consultant identified 163 acres of wetlands (57 of
which are borrow areas) and 122 acres of uplands on site . The
Environmental Impact Statement (EIS) commits to preservation of
a minimum of 46 . 25 acres (25%) of native vegetation on site . A
great majority of this will be accomplished by preserving the
cypress wetlands and creating a smaller wetland marsh system.
About 5 acres of uplands will be set aside in a preserve.
The consultant did a thorough Threatened and Endangered Species
(T&E) Survey concentrating on Red-Cockaded Woodpeckers and Big
Cypress Fox Squirrels . None were observed on site or evidenced
to be using the area for forage . A cumulative list of major
flora and wildlife species observed on site is attached as Item
#3 and Item #4 in the T&E Survey.
The EIS attachment describes the property by FLUCCS code and
expands on that with acreage and a vegetation inventory for
each area. It also identifies the 6 soil types found on site by
providing a copy of the soil survey map and the Collier County
Soil Legend, revised 1/90 by Howard Yamataki .
In a letter from William Stanton, Archeological Data Analyst
for the Florida Master Site File, he stated that there were no
recorded archaeological sites or historical structures on the
subject property.

VI. RECOMMENDATIONS:
Staff recommends approval of PUD 97-8 "Cypress Woods Golf and
Country Club" with the following stipulations :
WATER MANAGEMENT:
(No Stipulations. This project will be reviewed through the
South Florida Water Management District offices . )
ENVIRONMENTAL:
1 . As stated in 2 . 8B, a minimum of 25% of the existing native
vegetation shall be retained on site. That would require
46 .25 acres of native vegetation retention. The PUD master
plan shows 40 . 9 acres . Amended the PUD Master Plan to show a
minimum of 46 .25 acres and identify the tracts as preserves .
2 . Amend Table I under 3 .4 of the PUD document, Residential
Development Standards, under the entry of Natural Habitat
Preserve area setback. The 15 ft . may remain as an accessory
setback but the setback for principle structures is 25 ft .
in accordance with CCLDC 3 .2 . 8 .4 . 7 . 3 .
3 . Amend Table II under 4 .3 of the PUD document, Golf Course/
Recreational Development Standards, under Natural Habitat
Preservation Area Setback. For principle structures the
setback shall be 25 ft as stated in CCLDC 3 .2 . 8 .4 . 7 . 3 .
4 . Amend Section V of the PUD document to add 5 .2 .A. 8 to read
as follows :
"The Permitted Principal Uses and Structures described in
5 .2 .A. 1 through 5 .2 .A. 7 shall not cause vegetation to be
removed where the remaining native vegetation acreage
falls below the required minimum of 46 .25 . "
5 . Add the following language to the PUD document under Section
6 . 9 .E. :
"A minimum of twenty-five (25) percent of the existing
native vegetation on site shall be retained as required in
Section 3 . 9 . 5 . 5 . 3 of the Collier Land Development Code .
(That requires a minimum of 46 .25 acres of native
vegetation, in all three strata) . "
