Water Management:
1. Prior to beginning final construction design, the developer's engineer should submit
conceptual drainage plans to the County Water Management Department for its
review and comment.

Environmental:
Revise the following stipulations to section 6.6 of the PUD document to read as follows:
6.6 ENVIRONMENTAL
A. Petitioner shall be subject to Division 3.9, Vegetation Removal, Protection and
Preservation of the Land Development Code. A site clearing plan shall be
submitted to Current Planning Environmental staff for their review and
approval prior to any substantial work on the site. This plan may be submitted
in phases to coincide with the development schedule. The site clearing plan
shall clearly depict how the final site layout incorporates retained native
vegetation to the maximum extent practical and how roads,buildings, lakes,
parking lots, and other facilities have been oriented to accommodate this goal.
B. Native species shall be utilized,where available, to the maximum extent
possible in the site landscaping design. A landscaping plan for the commercial
tract will be submitted to Current Planning Environmental staff for their
review and approval. This plan will depict the incorporation of native species
and their mix with other species, if any. The goal of site landscaping shall be
the re-creation of native vegetation and habitat characteristics lost on the site
during construction or due to past activities.

C. All exotic plants, as defined in the County Code, shall be removed during each
phase of construction from development areas, open space areas, and preserve
areas. Following site development, a maintenance program shall be
implemented to prevent re-invasion of the site by such exotic species. This
plan,which will describe control techniques and inspection intervals, shall be
filed with and approved by the Current Planning Environmental staff.
D. Pursuant to Section 2.2.25.8.1 of the Land Development Code, if, during the
course of site clearing, excavation or other construction activity an historic or
archaeological artifact is found, all development within the minimum area
necessary to protect the discovery shall be immediately stopped and the Collier
County Code Enforcement Department contacted.
E. Any future proposed dock construction shall comply with the Florida
Department of Environmental Protection(DEP)/Collier County Manatee
Protection Plan.
F. If turkey oaks are discovered during tree removal permitting,they shall be
transplanted to the upland preserve areas or utilized in project landscaping.
G. Environmental permitting shall be in accordance with the State of Florida
Environmental Resource Permit(ERP)rules and regulations, as well as the
U.S. Army Corps of Engineers §404 Permitting Program. Removal of exotic
vegetation shall not be the sole means of mitigation for impacts to Collier
County jurisdictional wetlands.
H. All conservation shall be recorded on any required plats with protective
covenants per or similar to § 704.06, Florida Statutes. In the event platting is
not required, conservation easements shall be recorded for such areas, subject
to uses and limitations similar to or per Florida Statute Section 704.06.
Conservation areas shall be maintained by the golf club, and these areas shall
be dedicated to Collier County on plats or easements, as applicable,with no
responsibility for maintenance.
I. Buffers around wetlands shall being accordance with the ERP issued for this
project. Current Planning Environmental Staff shall be provided with copies of
U.S. Army Corps of Engineers permits prior to any construction occurring in
jurisdictional areas addressed by such permits. Construction or early work
permits from the South Florida Water Management District shall be presented
prior to Final Site Plan/Construction Plan approval.
J. Petitioner shall coordinate protected wildlife species issues through the ERP
and CORPS §404 permit review process and comply with the guidelines and
recommendations of the U.S. Fish and Wildlife Service and Florida Game and
Environmental Advisory Board Minutes .November 4, 1998

Freshwater Fish Commission. Where a protected species occur on site, a
Habitat Management Plan for those protected species shall be submitted to
Current Planning and Environmental Staff for review and approval prior to
Final Site Plan/Construction Plan approval.

Water Management:

2. An Excavation Permit will be required for the proposed lakes in accordance with
Division 3.5 of the Collier County LDC and SFWMD rules.
3. Section 2.11 of the PUD document shall be revised as follows:

1. All lake setbacks shall be measured from the lake top of bank.
2. The required setback to any internal property line or tract line internal to the
Cedar Hammock Development shall be zero (0) feet.
3. The minimum setback to any internal right-of-way, or roadway access
easement shall be twenty(20) feet.
4. The minimum setback to any external right-of-way, roadway access easement
or property line may be twenty(20) feet if the right-of-way,roadway access
easement or property line is fenced.
4. Section 6.5 subsection "J" of the PUD document shall be revised as follows:
a. In the second sentence "location of the contour of the control elevation of the Lake"
shall be struck through and replaced with"lake top of bank."
b. The third sentence shall be revised to read "The minimum setback to any right-of-
way, roadway access easement or external property line shall be twenty(20) feet if
the right-of-way,roadway access easement, or external property line is fenced.
5. Section 6.5 subsection"L" of the PUD document shall be deleted. See revisions in
Section 2.11 above.
6. Section 6.5 subsection"N" of the PUD document shall be deleted. The 20' lake
maintenance easement is required by SFWMD around the entire lake.

7. Section 6.5 subsection "T" of the PUD document shall be revised to state that 3:1 slopes
for berms will be permitted if height of slope is 2' or less or slope is landscaped or if
open channel is 2' or less in depth.
8. Section 6.8B of the PUD document shall be revised by striking through "pre-
development quantities by proposed weir structures" and replacing "the requirements of
Collier County Ordinance#90-10."
9. "Typical Water Management Berm at Property Line,Buffer and Lake Interfaces" and
"Typical Lake Bank Section" shall be revised to show 2:1 break point a minimum of 3
feet below low water level.
Environmental:
1. Amend section 6.11(B)(3) of the PUD document as follows by adding the underlined
language and deleting the str ck throug language
All exotic plants, as defined in the Collier County Land Development Code, shall be
removed from development areas and open space areas during each phase of
construction. Following site development, a continuing maintenance program shall be
implemented to prevent reinvasion of the site by such exotic species. The maintenance
plan, which describes control techniques shall be submitted to
Current Planning Environmental Staff for review and
approval prior to final site plan/construction plan approval.
2. Amend section 6.11(B)(8) of the PUD document as follows by deleting the staislk
If, during the course of clearing or course activities, plant or animal species identified in
the Florida Game and Fresh Water Fish Commission, July 1987 edition of "Official
Lists of Endangered and Potentially Endangered Fauna and Flora in Florida" are
identified, a survey for the presence and distribution of such protected species shall be
conducted by qualified personnel subject to and approved by the Development Services
Director. If warranted, project designs shall be adjusted and/or individuals and/or
populations of protected plants and/or animal relocated to preserve areas (ems-ether
. . - • . . = =- . to insure the survival of the species.
Retention/relocation efforts will include all species identified in the survey.
3. Delete sections 6.11(B)(2) and 6.11(B)(11) from the PUD document.
4. Add the following stipulations to the PUD document.
Environmental permitting shall be in accordance with the state of Florida Environmental
Resource Permit rules and be subject to review and approval by Current Planning

Environmental Staff. Removal of exotic vegetation shall not be counted towards
mitigation for impacts to Collier County jurisdictional wetlands.
Buffers shall be provided around wetlands, extending at least fifteen(15) feet landward
from the edge of wetland preserves in all places and averaging twenty-five(25) feet from
the landward edge of wetlands. Where natural buffers are not possible, structural buffers
shall be provided in accordance with the state of Florida Environmental Resource Permit
rules and be subject to review and approval by Current Planning Environmental Staff.
All conservation areas shall be recorded on the plat with protective covenants per or
similar to section 704.06 of the Florida statues. Conservation areas shall be dedicated on
the plat to the project's homeowners' association or like entity for ownership and
maintenance responsibilities and to Collier County with no responsibility for
maintenance.
Petitioner shall comply with the guidelines and recommendations of the U.S. Fish and
Wildlife Service(USFWS) and Florida Game and Fresh Water Fish Commission
(FGFWFC)regarding potential impacts to protected wildlife species. Where protected
species are observed on site, a Habitat Management Plan for those protected species shall
be submitted to Current Planning Environmental Staff for review and approval prior to
final site plan/construction plan approval.
In the event of a dispute concerning the application of the stipulations above, mutual
agreements must be reached between the Director and personnel of the Cedar Hammock
Golf and Country Club. If mutual agreements cannot be reached, the matter will be
brought before the EAB or whatever County environmental review board is in existence
at the time of any dispute. This governing entity will act as an arbitrator for any
disputes. If arbitration is futile, the matters will be brought before the Board of County
Commissioners (BCC)with the BCC to act as the final arbitrator.

Water Management&Environmental:
That the E.A.B. approve EX 59.664 with the following stipulations:
1. The excavation shall be limited to a bottom elevation of 16 ft. below existing grade,
which is approximately 14 ft below WSWT.
2. Off-site removal of material shall be subject to "Standard Conditions" imposed by
the Transportation Services Division in document dated 5/24/88 (copy attached).
3. No blasting will be permitted unless issued a separate permit by Collier County
Project Plan Review, however,blasting appears to be unnecessary.
4. The petitioner must apply for a Vegetation Removal Permit. Environmental Stall
shall perform a site visit to determine the need for a Vegetation Removal Permit and
to check for any listed species. No work shall be done prior to that site visit.
5. A lake littoral zone may be created and planted if desired by the SFWMD.
6. All provisions of Collier County Ordinance No. 93-73,Division 3.5 shall be adhered
to.
7. A 20 ft.maintenance easement dedicated to the SFWMD shall be provided around
the perimeter of the lake.
OLD BUSINESS
Discussion on EAB/EPTAB Consolidation-Proposed EAC Amendment to the current EAB
Code. September 16, 1998 preliminary draft for review and comment.

Hideout Golf Club is intended to be a private 18-hole golf course with a 5,000 square foot
clubhouse,driving range and maintenance facility.The applicant is proposing to improve Brantley
Blvd. (AKA Keane Ave.) to a 40 foot wide privately maintained right of way adjacent to the
property and connecting into the existing improved 23rd Street S.W.. The proposed roadway
improvements will provide access to the golf course and adjacent properties.

V. STAFF COMMENTS:
Water Management:
Conditional uses do not have a provision for water management review pursuant to the Land
Development Code.Water management will be reviewed at time of construction plan submittal.
Environmental:
The subject property contains a mix of pine flatwoods, palmetto prairie, cypress forest, pine-
cypress, citrus grove and disturbed land. An acreage breakdown of the habitat types found on site
are provided in Table 1 (page 2)of the environmental impact statement(EIS).
The project site contains one South Florida Water Management District(SFWMD)/Collier County
jurisdictional wetland area totaling approximately 17.3 acres. The golf course layout incorporates
the majority of this wetland area as a natural feature. Approximately 3.0 acres of impacts to
SFWMD/Collier County wetlands are proposed. The remaining wetlands (14.3 acres) will be
enhanced and preserved. Enhancement will include the removal of exotic vegetation and
hydroperiod improvements.
According to the Collier County Soils Map,the following six soil types are found on the property;
Malabar fine sand(Unit 3), Immokalee fine sand(Unit 7),Myakka fine sand(Unit 8),Pineda fine
sand, limestone substratum(Unit 14), Oldsmar fine sand(Unit 16), and Boca fine sand(Unit 21).
Soil Map Unit No. 3 and 14 are listed by the Natural Resource Conservation Service as hydric
soils.
The applicant has investigated several parcels of property within the vicinity of the project site.
Originally,property to the north of the current site was considered for development.As a result of
listed species surveys, an active red-cockaded woodpecker (RCW) cluster was identified on the
properties to the north. After discussions with U.S. Fish and Wildlife Service (USFWS) and
Florida Game and Fresh Water Fish Commission (FGFWFC) staff, it was determined best to
pursue property further to the south.
The subject property was surveyed for listed species over a period of seven consecutive days
beginning June 11, 1998 and ending June 17, 1998. Surveys were conducted around the times of
peek wildlife movement during the morning and evening hours. Morning observations began
approximately 15 minutes to 30 minutes prior to sunrise and ended by 10:00 a.m.. Evening
observations were conducted from approximately 5:00 p.m. to sunset. Surveys for listed species
were also conducted in association with vegetation mapping, wetland flagging, and RCW cavity
searches conducted during the afternoon hours of May 25, 1998, May 27, 1998, June 11, 1998,
and June 12, 1998.
Listed species that were either heard or observed on the project site included the Big Cypress fox
squirrel (Sciurus niger avicennia) and red-cockaded woodpecker (Picoides borealis). The Big
Cypress fox squirrel is listed as threatened by the FGFWFC. The red-cockaded woodpecker is
listed as threatened by the FGFWFC and endangered by the USFWS.

Big Cypress fox squirrels were observed in pine-cypress habitat on the south and west sides of the
citrus grove.A red-cockaded woodpecker vocalization was heard on the morning of June 12, 1998
in the pine-cypress habitat on the west side of the citrus grove near the northwest corner of the
site. The vocalization moved off-site to the north. No red-cockaded woodpecker was observed.
One additional red-cockaded woodpecker vocalization was heard on June 16, 1998 from a pine
flatwoods area located on off-site lands east of the citrus grove. No direction of travel could be
ascertained from the June 16 vocalization.An active red-cockaded woodpecker colony is reported
to exist approximately one-quarter mile north of the project site.
The applicant considered several alternative golf course layouts to minimize impacts to higher
quality upland habitat. These alternatives have been discussed with USFWS staff. As a result,the
current layout minimizes impacts to the higher quality upland habitats and preserves the majority
of the better quality potential foraging areas for red-cockaded woodpeckers.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No. CU-98-22 with the following
stipulations:
Environmental:
Permits or letters of exemption from the U.S.Army Corps of Engineers(ACOE)and the South
/'� Florida Water Management District(SFWMD)shall be presented prior to fmal site
plan/construction plan approval.
An appropriate portion of native vegetation shall be retained on site as required in section
3.9.5.5.4.CCLDC.
An exotic vegetation removal,monitoring,and maintenance(exotic free)plan for the site,with
emphasis on areas of retained native vegetation,shall be submitted to Current Planning
Environmental Staff for review and approval prior to fmal site plan/construction plan approval.
This plan shall include methods of exotic vegetation removal to be used within areas of retained
native vegetation.
Petitioner shall comply with the guidelines and recommendations of the U.S.Fish and Wildlife
Service(USFWS)and Florida Game and Fresh Water Fish Commission(FGFWFC)regarding
impacts to protected wildlife species.Where protected species occur on site,a Habitat
Management Plan for those protected species shall be submitted to Current Planning
Environmental Staff for review and approval prior to fmal site plan/construction plan approval.

The subject property is a developed 105.32(±) acre agricultural parcel in Section 25, Township
47 South, Range 27 East, Collier County, Florida. The parcel sits on the south side of
Immokalee Road about a mile east of Sanctuary Road.

IV. PROJECT DESCRIPTION:
The petitioner proposes to excavate an 81.72 acre lake on 105.32 acres of agriculturally zoned
property. An estimated 4.5 million C.Y of material will be removed from the 36-foot deep
excavation and hauled off-site to be used as fill..
V. STAFF COMMENTS:
The site is an active citrus orchard surrounded by old farm fields visible on the aerial
photograph. An area titled"Environmental Research Area" was created by the property owner
in an effort to determine more efficient and environmentally beneficial means of routing and
cleaning farm field runoff. That area was planted with species in two zones,one above and one
below the control elevation. The existing wetland species plant list for this area is on sheet 2 of
3,of the submitted site plans. This petition proposes no impact to this area; no environmental
concerns are evident from this excavation.

Soil borings show a fine sand down to about 36 feet deep. The petitioner intends excavating to
the 36 foot depth.. The petitioner has not submitted a clearing plan yet. The clearing plan
usually accompanies the excavation permit application.
VI. RECOMMENDATIONS:
That the Environmental Advisory Board approve Commercial Excavation Permit No. EX
59.667 with the following stipulations:
1. The petitioner must apply for a Vegetation Removal Permit.Environmental Staff shall
perform a site visit to determine the need for a Vegetation Removal Permit and to check for
any listed species.No work shall be doe prior to that site visit.
2. The excavation will be limited to a bottom elevation of-11.0 NGVD(36 feet deep).
3. No blasting will be permitted.
4. A lake littoral zone equivalent to 10%of the lake perimeter will be planted prior to fmal
acceptance.
5. A 20-foot maintenance easement dedicated to Collier County shall be provided around the
perimeter of the lake.
6. Off-site removal of material shall be subject to "standard conditions"imposed by the
Transportation Services Division in the attached document dated May 24, 1988.

II. LOCATION:
The subject property is an undeveloped five acre Golden Gate Estates parcel (Tract 71, Unit 46)
located on the north side of 66th Avenue NE, one-half mile east of Everglades Boulevard in
Section 29,Township 47 South,Range 28 East,Collier County,Florida.

IV. PROJECT DESCRIPTION:
The petitioner proposes to excavate a 1.7 acre lake on a 5 acre tract in Golden Gate Estates. An
estimated total of 23,025 C.Y.will be removed from the site.
Because there was no building permit issued for the property,the project was required to be heard
by the EAB.
The depth of the lake will be limited to 12 feet,since the excavation is less than 2 acres in area.
The offsite hauling will be permitted for a period of 2 years. Road impact fees will be submitted
prior to issuance of the excavation permit.

V. STAFF COMMENTS:
Water Management:
The excavation on the parcel of land will add to that parcel's ability to retain water during storm
events. The minor site improvements required to serve the excavation operation will not
substantially impact stormwater quality or quantity.Post development runoff will be less than pre-
development runoff.
Environmental:
A site visit was conducted by the Environmental Staff and no protected species were observed on
or using the parcel. The petitioner shall be responsible for determining if the USACOE or FDEP
will claim wetland jurisdiction over the property. If so, those permits shall be obtained prior to
any site improvements.
VI. RECOMMENDATIONS:
Staff recommends approval of Commercial Excavation EX 59.671 with the following stipulations:
Water Management:
1. The excavation shall be limited to a bottom elevation of 12 feet below the wet season water
table.
2. Off-site removal of material shall be limited to 23,000 C.Y. and shall be subject to
"Standard Conditions"imposed by the Transportation Services Division in document dated
5.24.88(copy attached).
3. The lake littoral zone shall be created and planted as indicated on the Plan of Record.
4. In order to ensure a minimum eighty percent (80%) coverage of littoral zone planting
areas, a performance guarantee, based on a cost estimate to replace the original installed
littoral zone plants, will be required upon completion and acceptance of the excavation
(Land Development Code 3.5.7.2.5).No Certificates of Occupancy will be issued until this
performance guarantee is submitted.
5. All provisions of Collier County Ordinance No. 91-102,Division 3.5 shall be adhered to.
6. Where groundwater is proposed to be pumped during the excavating operation, a
Dewatering Permit shall be obtained from the South Florida Water Management District,
and a copy provided to Engineering Review Services for approval prior to the
commencement of any dewatering activity on the site.

II. LOCATION:
The subject property is a 34 acre tract at the northwest corner of U.S. 41 and Wiggins Pass Road
within Section 16,Township 48 South,Range 25 East,Collier County,Florida.
III. DESCRIPTION OF SURROUNDING PROPERTIES:
The property is surrounded to the north and west by Tarpon Cove, a residential PUD. To the
south is Wiggins Pass Road and the Germain auto dealerships;to the east is U.S.41.

IV. PROJECT DESCRIPTION:
The project consists of 34 acres of retail, office, hotel/motel mixed use including 8.5 acres of
preservation and water management area.
The conceptual water management plan shows discharge of surface water runoff to the west into
wetlands that discharge into a state DOT drainage conveyance that flows south under Wiggins
Pass Road and then overland into the waters of Wiggins Pass.

V. STAFF COMMENTS:
Water Management:
Because of the presence of wetlands on site, this project will be reviewed by the SFWMD. The
site is bordered on the south and east by raised roads(Wiggins Pass Road and U.S.41)and on the
north and west by Tarpon Cove and also on the north side by a state DOT drainage swale which
will receive the runoff by way of a contiguous wetland.
Environmental:
The subject property is an undeveloped 34 acre site located on the northwest side of U.S. 41 and
Wiggins Pass Road. Approximately 8.7 acres of South Florida Water Management District/
Collier County jurisdictional wetlands were mapped on site, with 4.3 acres identified for
preservation. Approximately 4 acres of uplands have been designated for preservation, out of the
25 acres of uplands that were mapped by the consultant. The petitioner's Environmental
Consultants are in the process of permitting the wetland impacts through the ERP process. Their
proposal is to use the 8.5 acre tract D as a native vegetation preservation tract which may
accommodate runoff for the property without the necessity of removing any vegetation. The
uplands which may be the receiving area for some overflow from time to time shall be managed
so as not to cause adverse affects on the uplands vegetation or the protected Gopher tortoise which
/'••\ will need to be relocated into this area.
A listed plant and wildlife species survey was conducted in the uplands with specific care to
survey for gopher tortoise (Gopherus polyphemus). Within the pine flatwoods, scrubby pine
flatwoods and wet prairie, 12 total burrows were identified. It was estimated that approximately
two individuals occupied these burrows and the remaining were either inactive or abandoned. The
tortoises will be relocated to the upland preserve prior to any site improvements.
VI. RECOMMENDATIONS:
Staff recommends approval of PUD-89-23(1)with the following stipulations:
Water Management:
Add the following language to Section X of the PUD document: "One half(1/2)inch of dry
pretreatment shall precede the discharge of any water into the preservation area."
Environmental:
1. Amend 7.1 under Section VII of the PUD document to include the following language, "All
preservation areas shall be designated as conservation/preservation tracts or easements on all
construction plans and shall be recorded on the plat with protective covenants per or similar
to Section 704.06 of the Florida Statutes. Buffers shall be provided in accordance with
3.2.8.4.7.3 CCLDC."
2. Replace 7.4 under Section VII of the PUD document with the following language,
"Environmental permitting shall be in accordance with the state of Florida Environmental
Resource Permit rules and be subject to review and approval by Current Planning
Environmental Review Staff. Removal of exotic vegetation shall not be counted towards
mitigation for impacts to Collier County jurisdictional wetlands. Buffers shall be provided
around wetlands, extending at least fifteen (15) feet landward from the edge of wetland
preserves in all places and averaging twenty-five (25) feet from the landward edge of
wetlands. Where natural buffers are not possible, structural buffers shall be provided in
accordance with the State of Florida Environmental Resources Permit Rules and be subject to
review and approval by Current Planning Environmental Staff."
3. Add the following language to 7.7 of Section VII of the PUD document the, "A schedule for
exotic removal within all preservation areas, shall be submitted with the above mentioned
plan."
4. Add the following language to 7.2 of Section VII of the PUD document, "The approved
language shall be added to the Site Development Plan or Construction plan. Off-site
relocation may be required if the applicant cannot provide adequate habitat for on-site
relocation."
5. The PUD Master Plan shall be amended to rename the tract on the western property line,
currently labeled as Preservation/Water Management.An asterisk shall be placed after Water
Management and a note added which states that no vegetation shall be removed to facilitate
water management in Tract D.
