due to lack of a quorum. Mr. Foley abstained from the vote.
Water Management:
1. A copy of SFWMD Permit or Early Work Permit with staff report is required
prior to construction plan approval.
2. An Excavation Permit will be required for the proposed lake(s) in accordance with
Division 3.5 of Collier County Ordinance No. 92-73 and SFWMD rules.
Environmental:
A. The following language shall be added to the PUD document under Section 6.9:

1 . All approved Agency (SFWMD, ACOE, FGFWFC) permits shall be
submitted prior to any final development order approval (Plat/Construction
Plan, SDP...).
2 . All conservation areas shall be designated as conservation/preservation
tracts or easements on all construction plans and shall be recorded on the
plat with protective covenants per or similar to Section 704.06 of the
Florida Statutes. Buffers shall be provided in accordance with 3.2.8.4.7.3
CCLDC.
3 . Buffers shall be provided around wetlands, extending at least fifteen (15)
feet landward from the edge of wetland preserves in all places and
averaging twenty-five(25) feet from the landward edge of wetlands. Where
natural buffers are not possible, structural buffers shall be provided in
accordance with the State of Florida Environmental Resources Permit Rules
and be subject to review and approval by Current Planning Environmental
Staff.
4 . An exotic vegetation removal, monitoring, and maintenance (exotic-free)
plan for the site,with emphasis on the conservation/preservation areas, shall
be submitted to Current Planning Environmental Review Staff for review
and approval prior to final site plan/construction plan approval. A schedule

for exotic removal within all preservation areas, shall be submitted with the
above mentioned plan.
5 . Environmental permitting shall be in accordance with the state of Florida
Environmental Resource Permit rules and be subject to review and approval

vegetation shall not be counted towards mitigation for impacts to Collier
County jurisdictional wetlands.
6 . A Gopher tortoise relocation/management plan shall be submitted for
review and approval at the time of SDP or construction plan submittal. The
approved language shall be added to the Site Development Plan or
Construction plan. Off-site relocation may be required if the applicant
cannot provide adequate habitat for on-site relocation.
B. The PUD Master Plan shall be amended to rename the tract on the eastern property
line, currently labeled as Enhanced Uplands. This area shall be designated as an
Upland Preserve. If this area was not included in the native vegetation category of
the Project summary,then the acreages in that chart shall be amended to include this
tract.

1. Amend section 2.3(A) of the PUD document as follows by adding the underlined
language.
Regulations for development of Lely Lakes Golf Resort shall be in accordance
with the contents of this PUD Ordinance and applicable sections of the LDC (to
the extent they are not inconsistent with this PUD Ordinance) and Growth
Management Plan which are in effect at the time of issuance of any development
order to which said regulations relate which authorizes the construction of
improvements such as but not limited to Final Subdivision Plat, Final Site
Development Plan, Excavation Permit and Preliminary Work Authorization.
Where this PUD Ordinance, or subsequently adopted Community Design
Guidelines and Standards, does not provide developmental standards, then the
provisions of the specific section of the LDC that is otherwise applicable shall
apply.
2. Amend section 2.18 of the PUD document as follows by deleting the stpuelE
Pursuant to Policy 6.4.6 of the Conservation and Coastal Management Element of
the Collier County Growth Management Plan, 25% of the viable naturally
functioning native vegetation on site shall be retained. The total aroa of viablo
approximately 700 acres, therefore, 175 acres are required to be retained in their
of the PUD.
3. Amend section 7.4 of the PUD document as follows by deleting the stfifsk
The developer will establish a non-exclusive easement over lands required to be
preserved under Section 3.2.8.4.7.3 of the Land Development Code. The
developer may also dedicate or sell all or some portion of this land to an entity
whose responsibility is for continued preservation and maintenance.
4. Add the following stipulations to the PUD document.
Environmental permitting shall be in accordance with Florida Statutes.
Wetland buffers shall be provided in accordance with Army Corps of Engineers
and South Florida Water Management District rules.

The subject property is located along the west side of
Vanderbilt Drive approximately % mile north of Wiggins

The surrounding land uses are a combination of
residential sub-divisions to the north, east and south
and preserved wetlands and the Bay to the west .

IV. PROJECT DESCRIPTION:
Glen Eden on the Bay proposes to construct a
multifamily subdivision within the eastern portion of
the property. The project proposes to create 94 single
family lots, a clubhouse area, three lakes for water
management and 12 acres of preserves .

V. STAFF COMMENTS:
Water Management:
The project will consist of 94 single family lots and a
clubhouse with a swimming pool and recreation building
with related parking. The water management system will
consist of a series of inlets and drainage pipes
connected to three interconnected lakes . Discharge
through a water control structure will be to onsite
wetlands on the western side of the project . Discharge
will be limited to 0 . 15 cfs/acre . Ultimate discharge is
to Wiggins Bay.
This project will be permitted by SFWMD.
Environmental:
The subject property is an undeveloped 41 acre site
located on the west side of Vanderbilt Drive
approximately % mile north of Wiggins Pass Road. A
little over seventy percent (29+ acres) of the site is
comprised of rare, high quality upland habitats . They
are, rosemary scrub, scrubby flatwoods, xeric oak scrub
and live oak hammock. A small fraction of the upland
habitats are proposed to be preserved. The remaining
11 .4 acres are jurisdictional wetlands, per the agency
reviews by South Florida Water Management District
(SFWMD) and the United States Army Corps of Engineers
(ACOE) . A little over ten acres of wetlands will be
preserved.
A listed plant and wildlife species survey was
conducted in the uplands with specific care to survey
for gopher tortoise (Gopherus polyphemus) . Within the
rosemary scrub, xeric oak scrub and the scrubby
flatwoods, 77 active and inactive burrows were
identified.
VI. RECOMMENDATIONS:
Staff recommends approval of PSP-97-2 Glen Eden Lakes,
with the following stipulations :
Water Management:

IV. PROJECT DESCRIPTION:
The proposed project includes a golf course,club house, commercial buildings,and reserve. The
PUD Master Plan depicts commercial development along the US 41 frontage, an 18 hole golf
course,with club house,lakes and reserves. Access is provided from US 41 through the

commercial area. The water management system includes several connected lakes which will
accommodate the existing Naples Park flow and one separate lake at the west side of the project.
All discharges are to wetlands adjacent to the Cocohatchee River and will be reviewed by the
South Florida Water Management District. These wetlands are in or contiguous with the
Cochatchee River Outstanding Florida Waters.

V. STAFF COMMENTS:
Water Management:
The proposed surface water management plan involves the use of a system of interconnected
manmade lakes to provide water quality retention and peak flow attenuation. The system will be
designed to accept discharge from the Naples Park Drainage Improvement Project (constructed
last year),the WalMart site,and Naples Memorial Gardens.The project will be required to obtain
a South Florida Water Management District surface water permit.

Pine Flatwoods Pine Flatwoods-Hydric
Most of the proposed project area is native habitat (94%). The project contains 200 acres of
native uplands and 50 acres of native wetlands. Most of the uplands are pine flatwoods (160
acres).
Impacts to the wetlands have been minimized as much as practical. The impacts include 2.1 acres
to low quality wetlands and 0.3 acres to high quality wetlands. The project proposes to preserve
and enhance 37.8 acres of wetlands(mostly mangrove) and 7.4 acres of bay and marsh wetlands
by eradicating exotics (Brazilian pepper). This area will be placed in a conservation easement.
Additionally 10.2 acres of low quality wetlands will be enhanced by eradicating Brazilian pepper,
melaleuca, and cattails. Exotic plants will be eradicated on 5.9 acres of wetlands and cordgrass
and needle rush will be planted. Monitoring of the wetlands will be performed.
The proposed water management system for the 267 acre project will consist of two lakes that
will convey Naples Park and most of the projects treated stormwater to wetlands that are
contiguous with the Cocohatchee River Outstanding Florida Waters. Although the EIS indicates
the mangrove forest is predominantly black mangroves there is insufficient topography within the
mangroves to evaluate possible impacts to the black mangroves. The project is subdivided into 3
basins which will treat the required volume of stormwater runoff for this project and the existing
Wallmart. The applicant is proposing to set lake control elevations at 2 ft below grade where
possible . (The elevation for the lakes that convey the Naples Park drainage is already set by the
existing system.) Applicant did not submit seasonal and historical high water tables for
comparison. This project will be permitted by South Florida Water Management District.
Gopher tortoise, little blue heron, tricolored heron, and snowy egret were the only listed species
observed onsite. The birds will be impacted minimally because of the wetland preservation.
There were 810 active and inactive burrows gopher tortoise burrows observed by the consultant.
The consultant indicates the burrows are densest(734 burrows and an estimated 61 tortoises)in 3
native habitats (pine flatwoods, scrubby flat woods, and xeric oak). The applicant indicates that
tortoises will be relocated to onsite preserves. The project is proposed to utilize 105 acres of
uplands and non jurisdictional wetlands. The remaining 112 acres will be in preserve, golf course
rough,or open space. There is also a commitment in the environmental impact statement(EIS)to
maximize habitat values for native species in the preserves and open space.
Areas of archaeological site potential within Section 21 have been identified on the County's
Historical/Archaeological Probability Map as consisting of mangrove swamp and upland margin
adjacent to the Cocohatchee River. Since no development is planned within the mangrove
wetland, no archaeological investigation was conducted in that area. The survey conducted by
Southeastern Archaeological Research, Inc., concentrated on the upland margin along the river
where development will occur. A total of 80 subsurface shovel tests were excavated. No
archaeological sites or historic structures were discovered during the survey.

VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development No. PUD-98-13 with the following
stipulations:
Water Management:
1. Prior to beginning fmal construction design, the developer's engineer should submit
conceptual drainage plans to the County Water Management Department for its review and
comment.
2. A SFWMD surface water management permit will be required.
Environmental:
Add the following stipulations to section 6.6 of the PUD document.
Environmental permitting shall be in accordance with the state of Florida Environmental Resource
Permit rules and be subject to review and approval by Current Planning Environmental Staff.
Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier
County jurisdictional wetlands.
All conservation areas shall be recorded on the plat with protective covenants per or similar to
section 704.06 of the Florida statues.Conservation areas shall be dedicated on the plat to the
project's association or like entity for ownership and maintenance responsibilities and to Collier
County with no responsibility for maintenance.
In the event the project does not require platting,all conservation areas shall be recorded as
conservation/preservation tracts or easements dedicated to an approved entity or to Collier County
with no responsibility for maintenance and subject to the uses and limitations similar to or as per
Florida statutes section 704.06.
Buffers shall be provided around wetlands,extending at least fifteen(15)feet landward from the
edge of wetland preserves in all places and averaging twenty-five(25)feet from the landward
edge of wetlands.Where natural buffers are not possible,structural buffers shall be provided in
accordance with the state of Florida Environmental Resource Permit rules and be subject to
review and approval by Current Planning Environmental Staff.
Petitioner shall comply with the guidelines and recommendations of the U.S.Fish and Wildlife
Service(USFWS)and Florida Game and Fresh Water Fish Commission(FGFWFC)regarding
potential impacts to protected wildlife species.Where protected species are observed on site,a
Habitat Management Plan for those protected species shall be submitted to Current Planning
Environmental Staff for review and approval prior to fmal site plan/construction plan approval.

V. STAFF COMMENTS:
Water Management:
The project site is primarily located within the 951 Canal North Drainage Basin. The
eastern portion of the site is located within the Cypress Canal Drainage Basin. The
proposed outfall for the project is the CR-951 roadside ditch located at the west property
line of the project.
The water management system for the project proposes the construction of a perimeter
berm with crest elevation set at or above the 25-year, 3-day peak flood stage which is
estimated to be elevation 13.8 NGVD. The finished floor elevations shall be set above
the 100-year, 3-day, zero discharge peak stage which is estimated to be elevation 15.0
NGVD. Water quality pretreatment is proposed in the on-site lake system prior to
discharge to the wetland preserve areas.
The water management system will be permitted by South Florida Water Management
District (SFWMD) through the Environmental Resource Permit process. All rules and
regulations of SFWMD will be imposed upon this project including but not limited to:
storm attenuation with a peak discharge rate of 0.04 cfs/acre; minimum roadway
centerline,perimeter berm and finished floor elevations; water quality pre-treatment, and
wetland hydrology maintenance.
Environmental:
The project site is 98 %jurisdictional wetlands which the applicant indicates have been
adversely impacted by surrounding development. The project proposes to fill or excavate
21.1 acres of wetlands. Eighteen acres of the property will be preserved and enhanced
by removal of nuisance exotic plants and 5.8 acres of the wetland will receive the storm
water runoff prior to discharge from the site. The control elevation will prevent
discharge of the stormwater unless it reaches a depth of 1.2 feet in the wetlands. Most of
the preserve area(12.2 acres)will be east of the filled land and not part of the water

V. STAFF COMMENTS:
Water Management:
A large flow way preserve runs through the center of the project and will provide a drainage
/'\ outfall for the 150 acres of the property located north of the project and south of Davis Boulevard.
A large interceptor ditch is also provided along the north property line to collect offsite flow and
route it to the flow way. Drainage from this offsite area will help hydrate the onsite preserves.
Stormwater discharge from the developed Cedar Hammock project will also be directed to the
wetland flow way.
The Cedar Hammock project is designed as three separate water management basins. Two basins
are located west of the flow way. One basin is east of the flow way. The control elevation (wet
season water table)for all basins is elevation 10'.
Approximately 80 acres of lake will be constructed and will be the primary element of the water
management system. Runoff from all developed areas of the project will be directed to the
interconnected lake system for treatment. Both water quality and quantity treatment will occur in
the lakes. Storage will also occur in the golf course during the 25-year storm event.
Approximately 10 to 30 percent of the golf course is flooded at elevation 12.5', which is the
approximate 25-year zero discharge peak stage.The flooding of the golf course will only occur in
areas that are not critical for play and will not affect the operation of the course. Tees and greens
will be above the 100-year flood stage.
Each water management basin discharges to a different wetland. These different discharge points
are necessary to maintain wetland hydrology. Discharge will be limited to 0.04 cfs/acre which is
allowable discharge rate for the Lely Basin.
To account for tailwater effects and the lack of a developed outfall ditch, the project is designed
based on zero discharge storm events.The roadways and water management system are designed
at or above the elevation of the 25-year,zero discharge storm event.Buildings will be place above
the 100-year storm event.

Environmental:
The subject property is an undeveloped parcel composed of approximately 100.4 acres of pine
flatwood uplands and 318.4 acres of pine-cypress wetlands.Habitat types for this site are listed in
the "Cedar Hammock Vegetation Description Table" on page six of the environmental impact
statement.Most of the wetlands(202 acres)have been effected by melaleuca.
The wetland impacts proposed for this development consist of impacting 244.2 acres of the
poorest quality wetlands while preserving and enhancing 74 acres of wetlands and 37.2 acres of
pine flatwood uplands. The preserve will be enhanced by removing exotic plants and restoring
hydrology. Monitoring will be performed for 5 years. Additionally, 320 acres of off site
mitigation will be provided which consists of 294 acres of cypress and slash pine wetlands and 26
acres of slash pine uplands located approximately one and a half mile east of the Cedar Hammock
project,within the Belle Meade acquisition area(Picayune Strand State Forest).
A protected species assessment was conducted during May and June of 1998 to review the site for
the presence of listed species. An additional red-cockaded woodpecker (RCW) survey was
conducted in July of 1998. The Protected species survey and subsequent RCW survey did not
reveal the presence of any listed species of plants or animals on the subject property. A total of
eight old and inactive RCW cavity trees were located on site. No actual sightings or evidence of
recent use by RCW's was documented.The only species of special status determined to utilize the
site, at least in the past, was the fox squirrel (Sciurus niger avicennia) and red-cockaded
woodpecker(Picoides borealis).
The primary consideration in the site planning of the project was the preservation and
enhancement of RCW habitat and forage area. The site plan and preserve configuration were
based on input and discussions with the USACOE,SFWMD,USFWS and the FGFWFC.Preserve
areas have been designed to provide a drainage flow way and wildlife corridor that connects with
the preserves in Naples Heritage and other projects to the south to provide a regional preservation
area large enough to sustain a diversity of flora and fauna. The preserved uplands on site contain
several inactive RCW cavity trees.
Two soils have been identified on the subject property. These include (14) Pineda Fine Sand,
Limestone Substratum and(21) Boca Fine Sand. Soil map unit number 14 is listed as hydric by
the Natural Resource Conservation Service.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-98-16 with the
following stipulations:
Water Management:
1. A copy of the SFWMD Surface Water Permit shall be submitted prior to fmal construction
plan approval
2. An Excavation Permit will be required for the proposed lakes in accordance with Division
3.5 of the Collier County LDC and SFWMD rules.

3. Section 2.11 of the PUD document shall be revised as follows:
a. The last part of the first sentence "as part of the construction phase" shall be struck
through and replaced with"as allowed in Section 3.2.8.3.6 of the LDC."

maintenance easement is required by SFWMD around the entire lake.
7. Section 6.5 subsection"T"of the PUD document shall be revised to state that 3:1 slopes for

channel is 2'or less in depth.
8. Section 6.8B of the PUD document shall be revised by striking through "pre-development
quantities by proposed weir structures" and replacing "the requirements of Collier County
Ordinance#90-10."
9. "Typical Water Management Berm at Property Line, Buffer and Lake Interfaces" and
"Typical Lake Bank Section"shall be revised to show 2:1 break point a minimum of 3 feet
below low water level.
Environmental:
1. Amend section 6.11(B)(3) of the PUD document as follows by adding the underlined
language and deleting the .
All exotic plants, as defined in the Collier County Land Development Code, shall be
removed from development areas and open space areas during each phase of construction.
Following site development, a continuing maintenance program shall be implemented to
prevent reinvasion of the site by such exotic species. The maintenance plan, which
describes control techniques shall be submitted to and-approved-by
the-SF Current Planning Environmental Staff for review and approval prior to fmal
site plan/construction plan approval.

of Endangered and Potentially Endangered Fauna and Flora in Florida" are identified, a
survey for the presence and distribution of such protected species shall be conducted by
qualified personnel subject to and approved by the Development Services Director. If
warranted, project designs shall be adjusted and/or individuals and/or populations of
protected plants and/or animal relocated to preserve areas

Digging a 1.9 acre lake on 5.0 acres of Estates zoned property raises no substantial engineering
issues at all.
The old soils map of Collier County showed the area as Pompano fine sand, a designation that
has been phased out. The new map shows the area as Immokalee fine sand. Both sands are
described as"deep". Pompano f.s. was described as"poorly drained,but rapid internal
drainage when freed from high water table."Immokalee f.s. still is described as having rapid
internal drainage.
The excavation of the Golden Gate canal system is most likely responsible for lowering the
water table in the area. The relative proximity of the canal to this property means that the water
table closely conforms to the canal elevation.
Environmental:
The site is an old farm field. A site visit will be performed prior to granting a vegetation
removal permit.
VI. RECOMMENDATIONS:
Water Management& Environmental:
That the E.A.B. approve EX 59.664 with the following stipulations:
1. The excavation shall be limited to a bottom elevation of 16 ft.below existing grade,which
is approximately 14 ft below WSWT.
2. Off-site removal of material shall be subject to "Standard Conditions" imposed by the
Transportation Services Division in document dated 5/24/88 (copy attached).
3. No blasting will be permitted unless issued a separate permit by Collier County Project
Plan Review,however,blasting appears to be unnecessary.

4. If trees are to be removed as a result of the excavating operation, a Tree Removal Permit,
required by Ordinance No. 92-73, Division 3.9 shall be obtained from Collier County

6. All provisions of Collier County Ordinance No. 93-73, Division 3.5 shall be adhered to.

In accordance with the provisions of Section 3.5.5.3 of Ordinance No. 91-102, which
regulates excavations within Collier County, we are required to serve notice to all adjacent
property owners that the Environmental Advisory Board will consider a request to perform an
excavation described at the location on the attached Staff Report.
The Public Hearing to consider this item and other matters will begin at 9:00 a.m. on
November 4, 1998, at the Collier County Government Complex, Building "F", Third Floor,
Commissioners Board Room.
While your presence is not required at this meeting, all interested parties are invited to attend
and be heard. In addition to those parties wishing to speak at the meeting, any written
comments may be submitted to this office prior to the meeting for consideration by the
Environmental Advisory Board.

A RESOLUTION TO EXTEND THE TERM OF MARCO A.
ESPINAR TO SERVE ON THE ENVIRONMENTAL
ADVISORY BOARD FOR A PERIOD OF TWO MONTHS OR
UNTIL A SUCCESSOR BOARD IS CREATED.
WHEREAS, Ordinance No. 92-102, as amended, the Collier County
Land Development Code, established the Environmental Advisory Board,
and provides that the Advisory Board shall consist of seven (7)
members; and
WHEREAS, the terms of two members expired on September 30, 1998,
and there was one (1) resignation thereby causing a total of three
(3) vacancies on this Board; and
WHEREAS, one of the two members whose term expired has not
exceeded the term limit established by Ordinance No. 86-41, as
amended; and
WHEREAS, on August 4, 1998, the Board of County Commissioners
approved staff' s recommendation to consolidate the Environmental
Advisory Board and the Environmental Policy Technical Advisory Board
into a single board; and
WHEREAS, the Environmental Advisory Board will continue to meet
until the successor board is created; and
WHEREAS, there may arise scheduling and/or other conflicts which
could prevent some of the remaining four (4) members, whose terms
have not expired, from attending the scheduled meetings, thereby
causing a lack of quorum; and
WHEREAS, the term of one member will need to be extended for a
period of two months in order to ensure that there will be a quorum
for the Environmental Advisory Board meetings scheduled during the
months of November and December, 1998, or until a successor board is
created.
NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF County
COMMISSIONERS OF COLLIER County, FLORIDA, that:
1. The extension of the term of one member is necessary to
ensure a quorum for the meetings of the Environmental Advisory Board
during said period.

2 . The term of Marco A. Espinar is hereby extended for a period
of two months; said term to expire on December 31, 1998, or until a
new board is established.

EXECUTIVE SUMMARY
REQUEST TO EXTEND THE TERM OF GEORGE H. HERMANSON TO SERVE ON THE
ENVIRONMENTAL ADVISORY BOARD UNTIL THE SUCCESSOR ENVIRONMENTAL
BOARD IS CREATED.
OBJECTIVE:
To extend the term of George H. Hermanson to serve on the Environmental Advisory Board until the
successor environmental board is created to ensure a quorum for meeting of the Environmental
Advisory Board during said period.
CONSIDERATIONS:
The Environmental Advisory Board (EAB) consists of seven members whose function is to act in an
advisory capacity to the Board of County Commissioners in matters dealing with the review and
evaluation of specific zoning and development petitions.
On August 4, 1998, the Board of County Commissioners approved staff's recommendation to
n consolidate the Environmental Advisory Board and the Environmental Policy Technical Advisory
Board into a single board. The consolidation of these environmental advisory boards is planned with
the current Land Development Code amendment cycle which should be completed in December, 1998.
Positions for the new advisory board will most likely be filled in February or March, after the positions
are advertised.
The term of George H. Hermanson expired on September 30, 1998, and there has been two
resignations thereby creating a total of three vacancies on the Environmental Advisory Board. With
only four members remaining, quorum problems have occurred.

28 Board until a successor board is created.
29 2. The extension of the term of 1 members is necessary to ensure a quorum for the meetings
30 of the Environment Advisory Board during said period.
31 3. The term of the George H. Hermanson is hereby extended until the successor board is
32 created.
33 4. The Board of County Commissioners of Collier County, by unanimous vote, hereby
34 waives the provisions of Section Seven(b)(1)of Ordinance No. 86-41,as amended,relating to a
35 limitation of two consecutive terms of office, for the purpose of reappointment of George H.
36 Hermanson to this Committee.
