1. The excavation shall be limited to a bottom depth of 12' below control. All
distributed areas proposed for lake excavation shall be excavated to a minimum
depth of 6'below control.
2. Off-site removal of material shall be subject to "Standard Conditions" imposed
by the Transportation Services Division in document dated 5/24/88 (copy
attached).
3. The lake littoral zone shall be created and planted as indicated on the Plan of
Record.
4. All provisions of Collier County Ordinance No. 91-102, Division 3.5 shall be
adhered to.
5. Groundwater shall not be pumped during the excavating operation.
6. No blasting will be permitted unless issued a separate permit by Collier County
Engineering Review Services.
7. Stockpile side slope shall be at a maximum of 4:1 unless fencing is installed
around the entire perimeter of the stockpile area.
8. No excavation permit shall be issued until all impact fees have been paid. These
fees will be determined by Transportation Services Division.

Environmental
Staff recommends approval of Commercial Excavation Permit No. 59.642 "Winchester
Lake Fill Pit" with the following stipulations:
1. The excavation shall be limited to a lowest possible bottom elevation of 25 feet
below existing grade unless a permit modification is applied for through the EAB
and the BCC and shall be no shallower than 10 feet below existing grade.
2. Offsite removal of material shall be subject to standard conditions imposed by the
Transportation Department(attached).
3. No blasting will be permitted unless a Collier County approved Blasting Permit is
obtained
4. A separate vegetation removal permit (per Collier County Land Development
/'•\ Code, Division 3.9) shall be obtained from Collier County Community
Development Environmental Services Division before commencing the proposed
clearing.
•
5. The site plan shall be revised to include the following note: "Exotic vegetation, as
defined by the CCLDC Section 3.9.6.4.1, shall be removed from the site.
Subsequent annual exotic removal (in perpetuity) shall be the responsibility of the
property owner."
6. Prior to any site improvement proposed in relation to this excavation or clearing,
the owner shall contact the USACOE and SFWMD to determine if wetland
permitting is needed. If so, all agency permits shall be obtained, prior to the
commencement of any site improvements.

IV. PROJECT DESCRIPTION:
The proposed project includes 442 residential units, lakes and 3.3 acres of preserve. The water
management system will collect the stormwater and convey it to the lakes for storage and final
treatment. Runoff will discharge to the Hardy Basin Canal. The water management system will
also convey runoff from the 60 acres to the east and south of the project. The South Florida Water
Management District will be responsible for plan review and permitting the stormwater
management system.

V. STAFF COMMENTS:
Water Management:
The site sits within the Harvey Drainage Basin and will have a discharge rate of 0.06 CFS/AC. A
system of lakes will provide water quality retention and peak flow attenuation. Projects within the
Harvey Basin must comply with the Harvey Basin Master Plan and the guidance of the Collier
County Water Management Department.Offsite flows must be accounted for and accommodated.
Environmental:
Most of the proposed project( 87 %)is disturbed old agricultural fields. Additionally it appears
the ground water table has been altered by the drainage canals. The wet season water table is
estimated to be 12.0 feet although the biological high water indicators are at approximately 13.6
feet. All but 4%of the project is proposed to be either excavated or filled.
The water management control elevation is proposed to be 12.0 feet although the biological
indicators place the seasonal high water elevation at about 13.6 feet.
Soils on the subject property include Holopaw fine sand, limestone substratum, Oldsmar fme
sand, limestone substratum, Bassinger fme sand, and Holopaw fme sand. Oldsmar fme sand,
limestone substratum is listed as non-hydric by the Natural Resources Conservation Service,
Collier County Soil Survey.All the remaining soils are listed as hydric.
On May 19, 1998, the project area was surveyed for wildlife species listed by the Florida Game
and Fresh Water Fish Commission(FGFWFC) and the U.S. Fish and Wildlife Service (USFWS)
as endangered, threatened, or species of special concern. Observations for plant species listed by
the Florida Department of Agriculture (FDA) and the USFWS as endangered, threatened, or
commercially exploited were also made during the survey.No listed wildlife or plant species were
identified on the project site during the survey.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-98-7 with the
following stipulations:

1. The project must obtain a SFWMD surface water management permit
Environmental:
Add the following stipulations to section 4.8 of the PUD document.
Environmental permitting shall be in accordance with the state of Florida Environmental Resource
Permit rules and be subject to review and approval by Current Planning Environmental Staff.
Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier
County jurisdictional wetlands.
All conservation areas shall be recorded on the plat with protective covenants per or similar to
section 704.06 of the Florida statues.Conservation areas shall be dedicated on the plat to the
project's homeowners' association or like entity for ownership and maintenance responsibilities
and to Collier County with no responsibility for maintenance.
Buffers shall be provided around wetlands,extending at least fifteen(15)feet landward from the
edge of wetland preserves in all places and averaging twenty-five(25)feet from the landward
edge of wetlands.Where natural buffers are not possible, structural buffers shall be provided in
accordance with the state of Florida Environmental Resource Permit rules and be subject to
review and approval by Current Planning Environmental Staff.
An exotic vegetation removal,monitoring,and maintenance(exotic free)plan for the site,with
emphasis on the conservation/preservation areas, shall be submitted to Current Planning
Environmental Staff for review and approval prior to final site plan/construction plan approval.

The Vincentian PUD includes a mixture of land uses for commercial and residential/group
housing. The master plan for the PUD identifies 8.5 acres of commercial, 11.7 acres of preserve,
4.5 acres of residential and 5.3 acres of residential/water management.Access for the PUD will be
from US 41 and Southwest Boulevard.

V. STAFF COMMENTS:
Water Management:
The plan incorporates a water management lake interconnected to dry detention facilities and an
outfall via a series of swales and reinforced pipe culverts to produce water quality retention and
peak flow attenuation.
The project will be reviewed for permitting by the SFWMD.
Environmental:
The subject property consists of pine flatwoods with a centrally located pine-cypress forested
wetland. Approximately 16.8 acres of South Florida Water Management District
(SFWMD)/Collier County jurisdictional wetlands have been identified on the property. Proposed
wetland impacts are summarized in Table 3 and shown in Figure 5 of the EIS.Approximately 6.8
acres of impacts to jurisdictional wetlands are proposed.Wetland impacts will be compensated for
by enhancing and preserving the remaining 10 acres of wetlands on-site. An additional 1.7 acres
of uplands will also be retained within the preserve area.
A listed plant and animal species survey was conducted on April 7, 1998 to determine whether the
site was being utilized by state or federally listed species. Additional observations for listed
species were conducted on April 20, 1998 and April 29, 1998 during vegetation mapping and
description, wetland flagging, and a wetland jurisdictional site inspection. No listed wildlife
species were observed on the property.The only listed plant species observed on site was butterfly
orchid (Encyclia tampensis). Butterfly orchid is listed as commercially exploited by the Florida
Department of Agriculture and Consumer Services.
Two soil types have been identified on the subject property. These include (7) Immokalee Fine
Sand and(27)Holopaw Fine Sand. The majority of the site consists of Holopaw Fine Sand with
Immokalee Fine Sand occurring the north portion of the site along Southwest Boulevard.
Holopaw Fine Sand is listed as hydric by the Natural Resource Conservation Service.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property. Correspondence from the
Florida Department of State, Division of Historical Resources, indicates no significant
archaeological or historical sites recorded for or likely to be present within the project area. The
letter further states that because of the project location and/or nature it is unlikely that any such
sites will be affected.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Amendment No. PUD-84-11(2) with
the following stipulations:

IV. PROJECT DESCRIPTION:
The Lely Lakes Golf Resort will be developed as a destination golf resort, featuring a hotel and
conference facility, 36 hole golf course, and a mixture of semi-private, single family, and multi-
family residences not to exceed 749 units. These residences will be designed around a
"resort/village center" which will provide residences and guests with opportunities for
convenience shopping,personal services, dining and active recreation within walking distance of
their residences or guest accommodations. There will be a maximum of 100,000 square feet of
commercial or office space,at the project's perimeter on US 41.

V. STAFF COMMENTS:
Water Management:
The project uses a standard water management system consisting of a series of interconnected
lakes to achieve peak flow attenuation and water quality retention.
The site sits on a major drainage flowway that accepts drainage runoff from the subdivision
known as Naples Manor.This flow must be accounted for and maintained.
Environmental:
There are approximately 573 acres of Collier County/State of Florida jurisdictional wetlands on
the property. This amount equals 36 percent of the 1,559 acre site. The jurisdictional wetlands
have been described in the EIS using eleven(11) different community types. These communities
include canals, hardwood swamps, freshwater marshes, cypress, borrow areas, spoil areas, pine
flatwoods,saltwater marsh,hardwood hammock,Brazilian pepper and mangrove swamp.
Table 2 in the EIS indicates the proposed acreages and percentages of impacts to Collier County
jurisdictional wetlands by community type. Approximately 90.46 acres (5.80 percent) of County
jurisdictional wetlands will be impacted by development.Mitigation will consist of a combination
of preservation, enhancement and restoration of wetlands on site. A Qualitative and Quantitative
mitigation plan will be submitted during the permitting process with the U.S. Army Corps of

V. STAFF COMMENTS:
Water Management:
The proposed surface water management plan involves the use of a system of interconnected
manmade lakes to provide water quality retention and peak flow attenuation. The system will be
designed to accept discharge from the Naples Park Drainage Improvement Project (constructed
last year),the WalMart site, and Naples Memorial Gardens. The project will be required to obtain
a South Florida Water Management District surface water permit.

Most of the proposed project area is native habitat (94%). The project contains 200 acres of
native uplands and 50 acres of native wetlands. Most of the uplands are pine flatwoods (160
acres).
Impacts to the wetlands have been minimized as much as practical. The impacts include 2.1 acres
to low quality wetlands and 0.3 acres to high quality wetlands. The project proposes to preserve
and enhance 37.8 acres of wetlands(mostly mangrove) and 7.4 acres of bay and marsh wetlands
by eradicating exotics (Brazilian pepper). This area will be placed in a conservation easement.
Additionally 10.2 acres of low quality wetlands will be enhanced by eradicating Brazilian pepper,
melaleuca, and cattails. Exotic plants will be eradicated on 5.9 acres of wetlands and cordgrass
and needle rush will be planted. Monitoring of the wetlands will be performed.
The proposed water management system for the 267 acre project will consist of two lakes that
will convey Naples Park and most of the projects treated stormwater to wetlands that are
contiguous with the Cocohatchee River Outstanding Florida Waters. Although the EIS indicates
the mangrove forest is predominantly black mangroves there is insufficient topography within the
mangroves to evaluate possible impacts to the black mangroves. The project is subdivided into 3
basins which will treat the required volume of stormwater runoff for this project and the existing
Wallman. The applicant is proposing to set lake control elevations at 2 ft below grade where
possible . (The elevation for the lakes that convey the Naples Park drainage is already set by the
existing system.) Applicant did not submit seasonal and historical high water tables for
comparison. This project will be permitted by South Florida Water Management District.
Gopher tortoise, little blue heron, tricolored heron, and snowy egret were the only listed species
observed onsite. The birds will be impacted minimally because bf the wetland preservation.
There were 810 active and inactive burrows gopher tortoise burrows observed by the consultant.
The consultant indicates the burrows are densest(734 burrows and an estimated 61 tortoises) in 3
native habitats (pine flatwoods, scrubby flat woods, and xeric oak). The applicant indicates that
tortoises will be relocated to onsite preserves. The project is proposed to utilize 105 acres of
uplands and non jurisdictional wetlands. The remaining 112 acres will be in preserve, golf course
rough,or open space. There is also a commitment in the environmental impact statement(EIS)to
maximize habitat values for native species in the preserves and open space.
Areas of archaeological site potential within Section 21 have been identified on the County's
Historical/Archaeological Probability Map as consisting of mangrove swamp and upland margin
adjacent to the Cocohatchee River. Since no development is planned within the mangrove
wetland, no archaeological investigation was conducted in that area. The survey conducted by
Southeastern Archaeological Research, Inc., concentrated on the upland margin along the river
where development will occur. A total of 80 subsurface shovel tests were excavated. No
archaeological sites or historic structures were discovered during the survey.

VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development No. PUD-98-13 with the following
stipulations:
Water Management:
1. Prior to beginning fmal construction design, the developer's engineer should submit
conceptual drainage plans to the County Water Management Department for its review and
comment.
2. A SFWMD surface water management permit will be required.
Environmental:
Add the following stipulations to section 6.6 of the PUD document.
Environmental permitting shall be in accordance with the state of Florida Environmental Resource
Permit rules and be subject to review and approval by Current Planning Environmental Staff.
Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier
County jurisdictional wetlands.
All conservation areas shall be recorded on the plat with protective covenants per or similar to
section 704.06 of the Florida statues.Conservation areas shall be dedicated on the plat to the
project's association or like entity for ownership and maintenance responsibilities and to Collier
County with no responsibility for maintenance.
In the event the project does not require platting,all conservation areas shall be recorded as
conservation/preservation tracts or easements dedicated to an approved entity or to Collier County
with no responsibility for maintenance and subject to the uses and limitations similar to or as per
Florida statutes section 704.06.
Buffers shall be provided around wetlands,extending at least fifteen(15)feet landward from the
edge of wetland preserves in all places and averaging twenty-five(25)feet from the landward
edge of wetlands.Where natural buffers are not possible, structural buffers shall be provided in
accordance with the state of Florida Environmental Resource Permit rules and be subject to
review and approval by Current Planning Environmental Staff.

IV. PROJECT DESCRIPTION:
The proposed project includes a public golf course, club house, ACOE Wetland Preserve, and
Lakes. The Conditional Use Site Plan depicts an 18 hole golf course extending north from the
east end of Vanderbilt beach Road Extension. The hydrology and ground water table of the area
has been altered by the existing drainage canals. The Water Management System consists of
several interconnected lakes and excludes the wetland preserve area. The discharge will be to the
south under Vanderbilt Beach Road Extension into the Cypress Canal below the existing weir.
Water will flow west then south to the Main Golden Gate Canal and Naples Bay.
Wetlands onsite are jurisdictional for only the US Army Corps of Engineers because during the
monitoring period the ground water table remained greater than 22" below land surface.
Approximately 86%of the designated wetlands have been preserved.

V. STAFF COMMENTS:
Water Management:
Conditional uses do not have a provision for water management review pursuant to the Land
Development Code. Water management issues will be reveiwed at time of construction plan
submittal.
Environmental:

Most of the proposed project is undeveloped native habitat(83%). Pine flatwoods and pine mixed
forests account for most of the native habitat. The ACOE is the only agency exerting jurisdiction
over the wetland habitat due to altered hydrology. The canal systems have lowered the ground
water table such that in the project wetland habitats ground water is greater than 22"below ground
surface even at the end of the wet season in a normal year. The applicant states that withdrawal of
potable and non-potable groundwater for the project will be in accordance with the SFWMD
Water Use Permit which will dictate no adverse effect on groundwater drawdown. Fire has also
impacted the area. Approximately 42%of the project area has been impacted by fire(including
the two areas in the above pictures).
Impacts to the wetland habitat has been limited to 14%of the existing ACOE wetlands.
Six soil types occur on the subject property. These include (2) Holopaw fme sand, limestone
substratum, (10) Oldsmar fine sand, limestone substratum, (11)Hallandale fine sand, (14)Pineda
fme sand, limestone substratum, (16) Oldsmar fme sand, and (18) Riviera fine sand, limestone
substratum. Soils map units number 2,14 and 18 are considered hydric by the Natural Resource
Conservation Service.
The subject property was surveyed on several occasions between July and October of 1997 for the
presence of listed species. In order to review the site for the presence of listed species per Florida
Game and Fresh Water Fish Commission(FGFWFC)guidelines,the site was surveyed during the

morning and evening hours on at least five separate occasions. The survey revealed the presence
of no listed species on the subject parcel.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No. CU-98-17 with the following
stipulations:
Environmental:
Permits or letters of exemption from the U.S.Army Corps of Engineers(ACOE)and the South
Florida Water Management District(SFWMD)shall be presented prior to final site
plan/construction plan approval.
An appropriate portion of native vegetation shall be retained on site as required in section
3.9.5.5.4.CCLDC.
An exotic vegetation removal,monitoring,and maintenance(exotic free)plan for the site,with
emphasis on areas of retained native vegetation, shall be submitted to Current Planning
Environmental Staff for review and approval prior to final site plan/construction plan approval.A
schedule for exotic vegetation removal within all areas of retained native vegetation shall be
submitted with the above mentioned plan.
Petitioner shall comply with the guidelines and recommendations of the U.S.Fish and Wildlife
Service(USFWS)and Florida Game and Fresh Water Fish Commission(FGFWFC)regarding
