PETITION NO: Planned Unit Development Petition No. PUD-98-5 "Walgreens PUD" Environmental Advisory Board Minutes July 1 , 1998 Page 2 REQUESTING: Proposed commercial shopping center. MOTION: Made by Mr. Espinar, seconded by Mr. Foley, and carried 6/0, to approve Planned Unit Development Petition No. PUD-98-5 "Walgreens PUD" with Staffs stipulations: Water Management: Big Cypress R/W Permit and Discharge Permit shall be submitted prior to final SDP approval. Environmental: 1. Amend section 2.2 (A) of the PUD document by adding the underlined language. Regulations for development of Walgreens PUD shall be in accordance with the contents of this document, PUD-Planned Unit Development District and other applicable sections and parts of the Collier County Land Development Code and Growth Management Plan in effect at the time of building permit application. Where these regulations fail to provide development standards then the provisions of the most similar district in the Collier County Land Development Code shall apply. 2. Add the following stipulations to section 4.9 of the PUD document. Petitioner shall retain 1.27 acres of native vegetation on site or mitigate as required in section 3.9.5.5.4 CCLDC. An exotic vegetation removal, monitoring, and maintenance (exotic free)plan for the site, with emphasis on areas of retained native vegetation, shall be submitted to Current Planning Environmental Staff for review and approval prior to final site plan/construction plan approval. This project is located within a Collier County Groundwater Protection Zone and shall comply with the appropriate sections of the Groundwater Protection Ordinance No. 91-103 at the time of final development order approval. PETITION NO: Planned Unit Development Petition No. PUD-87-33(2) "Windsong PUD" Environmental Advisory Board Minutes July 1 , 1998 Page 3 REQUESTING: Proposed single family subdivision. REPRESENTED BY: Ian Butler of Turrell &Associates, Inc. Jim Can of Agnoli,Barber&Brundage, Inc. MOTION: Made by Mr. Saadeh, seconded by Mr. Foley, and carried 6/0, to approve Planned Unit Development Petition No. PUD-87-33(2) "Windsong PUD" with Staffs stipulations: Water Management: Petitioner shall provide evidence of the adequacy of the outfall ditch along the west side of the development and provide, if necessary, before any development orders are issued, the required drainage easements for the ditch cross-section and adjacent maintenance access travelway. Environmental: 1. Amend section 4.2 of the PUD document by adding the underlined language. n Regulations for development shall be in accordance with the contents of this document, PUD - Planned Unit Development District and other applicable sections and parts of the Collier County Land Development Code and Growth Management Plan. Residential areas designated on the Master Plan are to accommodate single family housing, essential services and customary accessory uses. 2. Delete stipulations 5.7(e) and 5.7(f) from the PUD document. 3. Add the following stipulations to the PUD document: Environmental permitting shall be in accordance with the state of Florida Environmental Resource Permit rules and be subject to review and approval by Current Planning Environmental Staff. Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier County jurisdictional wetlands. All conservation areas shall be recorded on the plat with protective covenants per or similar to section 704.06 of the Florida statues. Conservation areas shall be dedicated on the plat to the project's homeowners association or like entity for ownership and maintenance responsibilities and to Collier County with no responsibility for maintenance. Environmental Advisory Board Minutes July 1 , 1998 Page 4 Buffers shall be provided around wetlands, extending at least fifteen(15) feet landward from the edge of wetland preserves in all places and averaging twenty- five(25) feet from the landward edge of wetlands. LOCATION: The subject property is an undeveloped 5 acre Golden Gate Estates parcel (Tract 42 Unit 62) on the North side of 41st Avenue N.E. one/third mile east of Everglades Blvd. On the border of Sections 8 & 17, Township 48 South, Range 28 East, Collier County, Florida III. DESCRIPTION OF SURROUNDING PROPERTIES: ZONING DESCRIPTION N - "E" Estates Vacant Lot S - "E" Estates 41st Avenue NE R/W E - "E" Estates Vacant Lot W - "E" Estates Vacant Lot IV. PROJECT DESCRIPTION: The petitioner proposes to excavate a 2 . 0 (+/-) acre lake on a 5 acre tract in Golden Gate Estates . An estimated total of 28, 000 C.Y. of material is to be excavated, sold and hauled off-site . The lake will be excavated to a depth of 12 feet . The home appears on the 1986 aerial photographs and the lot looks cleared on that same photo. The owner would like to excavate a pond for fish and has no room on the site for the excavated material The off-site hauling will be permitted for a period of 2 years . Road impact fee will be submitted prior to issuance of the excavation permit . STAFF COMMENTS: Water Management: The excavation on the parcel of land will add to that parcel ' s ability to retain water during storm events . The minor site improvements required to serve the excavation operation will not substantially impact stormwater quality or quantity Post - development runoff will be less than pre-development runoff . Environmental: None . VI. The excavation shall be limited to a bottom depth of 12 ' below control . All distributed areas proposed for lake excavation shall be excavated to a minimum depth of 6 ' below control . 2 . The lake littoral zone shall be created and planted as indicated on the Plan of Record. 4 . All provisions of Collier County Ordinance No. 91-102 , Division 3 . 5 shall be adhered to. 5 . Groundwater shall not be pumped during the excavating operation. 6 . No blasting will be permitted unless issued a separate permit by Collier County Engineering Review Services . 7 . Stockpile side slope shall be at a maximum of 4 : 1 unless fencing is installed around the entire perimeter of the stockpile area. 8 . Haul routes between an excavation site and an arterial road shall be private with property owner(s) approval or be a public collector road built to standards applicable to handle the resulting truck traffic. Where residential areas front collector roads, appropriate turn lanes, buffer and bikepath shall be required as minimal site improvements and if recommended for approval, shall be so with the condition that the Transportation Services Administration reserves the right to suspend or prohibit off-site removal of excavated material should such removal create a hazardous road condition or substantially deteriorate a road condition; such action by the Transportation Services Administration shall be subject to appeal before the Board of County Commissioners. 2. Haul routes utilizing public roads shall be subject to road maintenance and road repair or an appropriate fair share by the permittee in accordance with Excavation Ordinance No. 91-102 as amended Div. 3.5 and Right-of-Way Ordinance No. 93-64. 3. Off-site removal of excavated material shall be subject to Ordinance No. 92-22 (Road Impact Ordinance). A traffic and road impact analysis shall be made by the County to determine the effects that off-site removal of excavated material will have on the road system within the excavation project's zone of influence. If appropriate, road impact fees in accordance with Ordinance No. 92-22 shall be paid prior to the issuance of an excavation permit. 4. The Transportation Services Administration reserves the right to establish emergency weight limits on public roadways affected by the off-site removal of excavated material; the procedure for establishment of weight limits shall be the presentation of an applicable resolution before the Board of County Commissioners. Should weight limits be instituted, the permittee shall be responsible to implement measures to assure that all heavy truck loadings leaving the permit's property conform to the applicable weight restriction. 5. The Excavation Performance Guarantee shall apply to excavation operations and also the maintenance/repair of public roads in accordance with current ordinances and applicable permit stipulations. EXHIBIT "B" Page One of Two a L 6. Based on soil boring information per Ordinance No. 91-102 as amended, a blasting permit may be appropriate. Should a blasting permit application be submitted and should residential areas exist within one mile of the excavation site, the County reserves the right to deny a blasting permit based on concerns for off-site impacts from blasting at an excavation site. Should a blasting permit be considered and approved, the minimum conditions of approval in addition to conditions per Ordinance No. 91-102 as amended are as follows: A. Structure inventory/monitoring and applicable property owner release as required by the Development Services Director. B. Security bond applicable to private property damage acceptable to the County. C. Control of size/depth/number of charges per blast by the Development Services Director. D. The right of the County to suspend and/or revoke blasting permit authority should it be determined that blasting activities are creating unacceptable off-site conditions either in terms of private property damage and/or related physical effects of blasting operations. 7. No excavation permit shall be issued until receipt of a release from the Transportation Services Administration applicable to proper mitigation of off-site impacts, meeting of applicable provisions of Ordinance No. 93-64, Ordinance No. 92-22, and Ordinance No. 91-102 as amended. An estimated 19,000,000 C.Y of material will be removed from the 20-foot deep excavation and hauled off-site to be sold commercially. V. STAFF COMMENTS: Soil borings show a fine sand down to about 20 feet deep.The petitioner intends excavating to about 20 feet deep.The petitioner has not submitted a clearing plan. Under criteria in Section 3.5 of the Land Development Code the maximum allowable depth for this excavation would be 80 feet below the control elevation. EAB Meeting August 5, 1998 EX 59.648 Page 2 VI. RECOMMENDATIONS: Staff recommends approval of Commercial Excavation Permit No. 59.642 "Winchester Lake Fill Pit"with the following stipulations: 1. The excavation shall be limited to a lowest possible bottom elevation of 25 feet below existing grade unless a permit modification is applied for through the EAB and the BCC and shall be no shallower than 10 feet below existing grade. 2. Offsite removal of material shall be subject to standard conditions imposed by the Transportation Depailment(attached). 3. No blasting will be permitted unless a Collier County approved Blasting Permit is obtained 4. A separate vegetation removal permit (per Collier County Land Development Code, Division 3.9) shall be obtained from Collier County Community Development Environmental Services Division before commencing the proposed clearing. 5. The site plan shall be revised to include the following note: "Exotic vegetation, as defined by the CCLDC Section 3.9.6.4.1, shall be removed from the site. Subsequent annual exotic removal(in perpetuity)shall be the responsibility of the property owner." 6. Prior to any site improvement proposed in relation to this excavation or clearing,the owner shall contact the USACOE and SFWMD to determine if wetland permitting is needed.
