REQUESTING: An excavation of a 1.9 acre lake on 5.6 acres of"Estates" zoned property.

MOTION: Made by Mr. Espinar, seconded by Ms. Dejong and carried 5/0, to approve
Excavation Permit No. EX 59.636 with added stipulations:
1. The excavation shall be limited to a bottom elevation of 16 ft.below existing grade.
2. Off-site removal of material shall be subject to "Standard Conditions" imposed by the
Transportation Services Division in document dated 5/24/88 (copy attached).
3. No blasting will be permitted unless issued a separate permit by Collier County Project Plan
Review,however,blasting appears to be unnecessary.
4. If trees are to be removed as a result of the excavating operation, a Tree Removal Permit,
required by Ordinance No. 92-73, Division 3.9 shall be obtained from Collier County
Project Plan Review before work shall commence.
5. A lake littoral zone may be created and planted if desired by the SFWMD.
6. All provisions of Collier County Ordinance No. 93-73,Division 3.5 shall be adhered to.
7. A 20 ft. maintenance easement dedicated to the SFWMD shall be provided around the
perimeter of the lake.
8. Necessary SFWMD, ACOE &DEP permits must be obtained prior to commencing
construction.
VI. OLD BUSINESS: Staff were directed by the EAB to send an letter, on behalf of the
EAB, inviting the South Florida Water Management District to attend future EAB
meetings. This letter is to be sent out on a monthly basis.
VII. NEW BUSINESS: Discussion on proposed LDC Amendments. A motion was made
by Ms. Dejong, seconded by Mr. Espinar and carried 5/0 for the EAB not to support the
language changes proposed in Section 3.9.5.5.5 CCLDC and that the Code should remain
unchanged. The motion included having petitioners request variances from the board for
exceptions from the preservation requirements in Division 3.9 CCLDC.

CHANGE: Language changed in Section 3.9.5.5.5 to allow for Administrative exemptions to
the preservation requirements in 3.9.5.5.
REASON: To give exemptions to specifically identified property owners, so that they do not
have to protect any required percentage of existing native vegetation. This is done in cases of
extreme hardship such as the Naples Memorial Gardens Cemetery which is the only cemetery in
Naples and needs to expand to the maximum extent possible, to service the residents.
ENVIRONMENTAL ADVISORY BOARD RECOMMENDATION: The EAB at it's
regularly scheduled meeting on May 6, 1998, reviewed the proposed language change to Section
3.9.5.5.5 which would allow for administrative exemptions to the preservation requirements in
3.9.5.5. The Board made a motion not to support Staff's proposed language change and that any
requested exemptions to the preservation requirements of 3.9.5.5 should be brought in front of
the BCC as a variance, on a case by case basis.
COLLIER COUNTY PLANNING COUNCIL RECOMMENDATION: The CCPC , at it's
first LDC amendment hearing held on May 13, 1998, reviewed the proposed language change to
Section 3.9.5.5.5 which would allow for administrative exemptions to the preservation
requirements in 3.9.5.5. It was their consensus that a variance process would be the appropriate
method for requesting any exemptions to the preservation requirements of 3.9.5.5.
FISCAL & OPERATIONAL IMPACTS: None.
RELATED CODES OR REGULATIONS: None.
3.9.5.5.5. Bona fide Agriculture (as set forth in section 2.2.2.2.1.2) shall be exempt
from the above preservation requirements provided that any new clearing
of land for agriculture shall not be converted to nonagricultural
development for at least ten years. . . __ _ _. .. . _ .
�.y 2.6.21. For any such conversions in less than ten years,the converted land
will be restored with native vegetation to the degree required by this code
at the time the clearing occurred. The Community Development &
Environmental Services Administrator or his/her designee may grant
written exemptions to the above preservation requirements, on
agriculturally zoned property. for essential public services (as provided for
in Section 2.6.9) and cemeteries. where it is in the best interest of the
general public to allow expansion or development of the land in lieu of
preservation of existing native vegetation.

the road shoulder and shall be placed when directed.

8. Permittee shall be responsible to maintain all areas of right-of-way disturbed, including any
route used to the site during spoil material removal.
9. Permittee shall remove spoil material only; any material disturbed below natural ground may
be in violation of Collier County Ordinance 91-102, Division 3.5, and/or Collier County
Ordinance 89-16.
10. Prior to the expiration of the permit, the right-of-way used shall be totally restored to the
satisfaction of the Engineering Inspections Section, and the Permittee shall call for final
inspection(403-2417).
11. During spoil removal operations the County reserves the right to void said permit should it be
determined that damage has occurred or may occur to the road right-of-way or that safety of
the public is in question.
12. Additional requirements may be imposed by this office if conditions warrant.

II. LOCATION:
Raccoon Point Field and adjacent lands in the northern half of the Corn Dance Management Unit
of the Big Cypress National Preserve. See Figure 1: General Location Map and Figure 2: BCNP

County (preserve boundary) are planned for lands bounded by Township 52 South, Range 34
East, Sections 1,2,3,4,10,11,12,13,14,15 and Township 51 South, Range 34 East, Sections 23,24,

III. DESCRIPTION OF SURROUNDING PROPERTIES:

IV. PROJECT DESCRIPTION:
Calumet Florida, Inc. (CFI)plans to conduct a 3-D seismic evaluation of its Raccoon Point Field
consisting of 29 lines configured to provide 3-D seismic data sufficient to evaluate approximately
12 square miles of oil and gas minerals.Planned operations will require the temporary occupancy
(approximately 66 days) of surface lands owned or managed by the Department of the Interior-
National Park Service (DOI-NPS), State Board of Education, and eight surface in-holders in the
vicinity of Raccoon Point.

CFI's 3-D program consists of approximately 116 miles of source and receiver lines. There are 10
source lines comprised of approximately 1800 shot points at intervals of 110 feet, oriented
northeast to southwest, totaling approximately 40 miles and 19 receiver lines (location of
geophones), oriented northwest to southeast totaling approximately 76 miles. The geophone
receiver arrays will be in a 12-line swath perpendicular to the source lines. Each receiver line will
consist of 192 geophone groups spaced 110 feet apart. Individual geophone groups will consist of
nine geophone groups in a 20-foot diameter circle. See Attachment B: CFI Program Map in
attached plan for a graphic overview of planned operations.

V. STAFF COMMENTS:
Water Management:
The seismic testing program has no readily discernible impacts on the area's surface water.
Staging areas may be prone to increased runoff rates and should be designed for water quality
retention.
Environmental:
The attached plan is a current copy of CFI's Big Cypress National Preserve plan of operations
(plan) for the proposed seismic project. The plan was prepared for the U.S. Department of the
Interior -National Park Service (DOI-NPS) federal permitting process pursuant to the Minerals
Management Plan (MMP) of the Big Cypress National Preserve General Management Plan and
Environmental Impact Statement(BCNP GMP/EIS).The plan is presently in the DOI-NPS review
and approval process at this time. Plans approved pursuant to the MMP meet the review and
approval requirements of the National Environmental Policy Act (NEPA) as part of the BCNP
GMP/EIS development process. Other agency permits required for this project are listed on page
18 of the attached plan. Planning Services staff have accepted the plan as meeting the County's
EIS requirement.
A vegetative analysis conducted by CFI utilizing a current digitized vegetative cover map
provided by preserve staff indicates that the proposed 3-D program area includes cypress,prairie,
cypress strand, high density dome complex with scattered pines, scattered pine and cypress in
herbaceous prairie,pine forest with cypress associate,hardwood scrub,low density pine forest and
old-growth pine land. CFI's analysis indicated that the temporary vegetative impact will be
approximately 43 acres. Refer to Attachment G: BCNP Vegetative Cover Map (Local View) and
Attachment H: Vegetative Analysis for detailed fmdings of CFI's vegetative impact analysis.
Temporary impacts associated with this proposal are discussed in sections 2 and 3 of the attached

plan. Section 6 of the plan contains NPS operational stipulations for exploratory and operational
phases of oil and gas development.
According to the GMP the Corn Dance Unit has a documented resident panther population. Old
growth pinelands in the northern half of the unit provide red-cockaded woodpecker (RCW)
habitat, and many hardwood hammocks have indigenous tree snail populations. Cypress stands,
prairies and dwarf-cypress prairies dominate the southern portion of the unit. Archeological sites
are scattered throughout the unit and Miccosukee Indians formally used the Corn Dance
ceremonial grounds.
The Important Resource Areas Protection Stipulation in the MMP prohibits surface occupation in
or on vegetative communities or cultural sites identified as Important Resource Areas.Discussions
with preserve staff responsible for performing environmental research and regulating oil and gas
activities in the Corn Dance Unit indicate that primary important resource protection concerns
include Florida panther, RCW colonies and cypress domes. Preserve staff also indicated that
dwarf cypress, although not listed as part of the preserve's important resource area, are a
vegetative species of concern to the NPS.NPS,with input from the U.S.Fish and Wildlife Service
(USFWS), have satisfied these concerns through the imposition of a 500 foot setback zone for
RCW colony sites, a 600 foot setback for cypress domes, and total avoidance of dwarf cypress.
Correspondence from the USFWS is included as attachment I in the proposed plan.
To date, a total of 395 archeological sites have been found within the preserve. These sites have
been designed Important Resource Areas by the NPS and are protected under the National
Historic Preservation Act of 1966, as amended,and the Archeological Resource Protection Act of
n 1979.These sites are not shown on the attached Important Resource Areas map in order to prevent
vandalism. Preserve staff and the Florida Department of State Division of Historical Resources
have indicated that known archeological sites are present in the proposed area of operations and
data from environmentally similar adjacent areas indicate that additional sites are likely to be
present in the area.
Arrangements have been made with The Archeological and Historical Conservancy, Inc. for
qualified archeologists to accompany each survey crew during program layout operations. The
monitoring program will be implemented to meet the guidelines for an archeological and
historical assessment as required by State and Federal reviewing agencies. The scope of
monitoring services will include pre-operational literature and archival review, state permit
application, field monitoring, and post-operational report preparation to be provided to the State
of Florida within 30 days of completion of operations.
VI. RECOMMENDATIONS:
Staff recommends approval of Special Treatment Permit No. ST-98-4 with the following
stipulations:
Environmental/Water Management:
1. The proposed project shall be in accordance with the approved plan and Collier County
land development code.
2. The ST permit is subject to a forty-five(45) day appeal period by the Florida Department
of Community Affairs.

IV. PROJECT DESCRIPTION:
Calumet Florida, Inc. (CFI)plans to conduct a 2-D seismic evaluation of the Sunniland Trend in
the vicinity of its Cow Bone Island exploration prospect.The seismic survey will be comprised of
3 lines of roughly equal length, designated A-A', B-B' and C-C' and will be oriented N-S, NE-
SW and E-W, respectively. The seismic lines will be configured in a triangular fashion designed
to verify regional data indicating the presence of a geologic structure capable of producing
commercial quantities of crude oil. The local geologic structure to be examined is an unexplored
area of the Sunniland formation. The 2-D seismic data will be utilized to enhance the local
subsurface geologic picture suggested by the regional data and more accurately assess the extent
of the potentially productive structure.

Approximately sixty-five (65) percent of CFI's proposed seismic operations will require the
temporary occupancy(approximately 40 days)of surface lands within the Addition Area and Bear
Island management units of the Big Cypress National Preserve. Proposed operations within the
preserve, which are the subject of this plan, will total approximately 22.6 linear miles of seismic
line. 1084 shot points and 1086 receiver locations will be required to complete seismic operations
within the preserve. See Figure la: General Location Map (local View) and Attachment B: CFI
Program Map for location and orientation of lines and a detailed depiction of proposed area of
operations and its relationship with the preserve boundary.

project are listed on page 19 of the plan. Planning Services staff have accepted the attached plan
as meeting the County's EIS requirement.
Elevations vary by approximately 7 to 8 feet over the entire 12 mile north-south axis of the
program area. Within the program area elevations range from approximately 13 feet at the
southern end to slightly over 20 feet NGVD at the northern end with isolated depressional areas
approximately 1-2 ft. lower than the surrounding topography. See Figure 12: Hydro-Station
Location Map in section 5 of the attached plan for topographic contours.
Soil-types mapping activities and map products are incomplete for most of eastern Collier County.
The current soil surveys produced by the National Resource Conservation Service (NRCS),
formerly the Soil Conservation Service,do not delineate soil types east of State Road 29.The only
available soils data for areas east of SR 29 was completed by the U.S. Department of Agriculture
(USDA)in 1942 and published in 1954.The 1954 survey represents the best available data and

was used for this report. Descriptions of the prevalent soil types within the program area are
provided as Appendix A in section 5 of the plan. Refer to Attachment H(a): Soils Map - Collier
County for a photocopy of the 1954 soil map.
Program area hydrology information was obtained by analysis of South Florida Water
Management District (SFWMD) hydro-station data. The main wetland system in the vicinity of
the program area is the Kissimmee Billy Strand. Data collected by SFWMD between September
1995 and July 1997 was converted to a hydrograph and compared with the recorded ground
elevation of approximately+14.0 NGVD at the recorder location. Seasonal highs were around 15
feet in the strand during the monitoring period. Refer to Figure 12: Hydro-Station Location Map
in section 5 of the attached plan for location details.
Vegetation in the project area is dominated by prairies, cypress swamps and pine flatwoods.
Hardwood hammocks and saw palmetto thickets represent a minor but significant habitat type.
Within the Addition Area management unit boundary and in contiguous areas outside the northern
boundary of the preserve,wetland vegetative cover types continue to dominate the landscape,but
are intermixed with pastures and agricultural fields. Refer to Figure 4: Vegetative Cover Map in
section 3 of the attached plan and Attachment D: Vegetative Cover Map - local view for graphic
depictions of the program area and its relationship to the various vegetative communities
prevalent in the preserve.
Potential vegetative impacts associated with this project were calculated by applying a ten foot
wide corridor to each shot line, identifying the vegetative cover types crossed and obtaining the
total potential temporary impact by vegetative type. Table 2 in section 5 of the plan shows the
n results of this analysis. In summary,potential temporary vegetative impacts for all cover types in
the entire program area total approximately 42.2 acres. Within the preserve, total potential
temporary vegetative impacts total approximately 27.3 acres. Refer to section 3 and 4 of the
attached plan for descriptions of temporary impacts associated with this project. Section 7 of the
plan contains NPS operational stipulations for exploratory and operational phases of oil and gas
development.
Five listed wildlife species which may occur in or near the program area include the American
alligator,eastern indigo snake,wood stork,Florida black bear and Florida panther.No records of
red-cockaded woodpeckers or bald eagles occurring in the area were included in the databases
received from either the Florida Game and Fresh Water Fish Commission (FGFWFC) or the
Florida Natural Areas Inventory (FNAI). The five listed species are discussed in section 5 of the
attached plan.
Research was conducted by the consultant through written and verbal coordination with the
National Park Service-Southeast Archeological Center (SEAC) and the State of Florida,
Department of State,Historic Preservation Office(SHPO).Records from SEAC were provided for
the preserve with approximate site locations detailed on the appropriate USGS quad maps. SHPO
documentation is not location specific and there is likely to be redundancy between the federal
and state listings. Most of the nearby archeological sites are found in the southwest part of the
program area.
A total of four known archeological sites are known to exist in close proximity to the program
area. See Figure 11: NPS-SEAC Archeological Sites in section 4 of the plan and Table 4 in
section 5 of the plan for approximate site locations. SHPO sites are designated as yellow boxes
around the designated sections in Figure 11 a: SHPO Archeological Sites in section 4 of the plan.

Arrangements will be made with qualified archeologists, approved by the State and NPS, to
accompany survey crew(s)during program layout operations.The archeologists will identify areas
of archeological interest and take steps to avoid known sites and provide any new archeological
and historical assessment as required by State and Federal reviewing agencies. The scope of
monitoring services will include pre-operational literature and archival review, state permit
application, field monitoring,and post-operational report preparation to be provided to the SEAC
and SHPO within 30 days of completion of operations.
VI. RECOMMENDATIONS:
Staff recommends approval of Special Treatment Permit No. ST-98-3 with the following
stipulations:
Environmental/Water Management:
1. The proposed project shall be in accordance with the approved plan and Collier County
land development code.
2. The ST permit is subject to a forty-five (45) day appeal period by the Florida Department
of Community Affairs.
