Lets have stats tell us what to do,not conjecture. I am sure you all are aware that at the Collier County website under "Transportation Planning Section" there is a part called"Traffic Calming". Here it states that a "problem" exists if in a residential area, there is "Daily traffic volumes greater than 2,000 vehicles per day." St. Andrews has almost 4 times that volume. And that count was taken in April when most seasonal visitors have left. Surely, this situation requires immediate and drastic action. We propose the gating of Warren Street at St. Andrews, allowing only emergency vehicular traffic. As a group we feel that much of the traffic volume generated on St. Andrews is due to vehicles exiting and entering Warren street. Warren Street was opened to St. Andrews because of the fire station. The building is no longer a fire station but is a storage unit. At one time, Warren Street was closed for months for repairs and there were no problems because St. Andrews does not supply the most efficient route for Warren Street area residents. From Warren Street, by using one of the 8 exits onto 41, residents can travel at 45 or 55 mph to their destinations, north or south respectively. Then by accessing Rattlesnake, they can travel 45mph east and pick up Santa Barbara. They should not be speeding on St. Andrews which has a speed limit of 30mph. Please execute this plan and stop the bloodshed. Foxfire community faced the same problem and gating the street solved it. We cannot wait for heavy-duty engineering in the future. It will be too late and stop signs are producing accidents not preventing them. The motorists who speed were not deterred by the speed limit signs and won't be deterred by lowering the speed limit. If we reduce the total numbers of motorists, we will also be reducing the numbers of reckless motorists on a street that, because of the proximity of the houses to the street, presents a situation that allows little room for driving errors. I saw the danger years ago and asked and trusted people who promised me they would end the speeding, the passing on the right in the bicycle lanes, the road-rage fueled tailgating, the endless stream of cars and huge trucks. But I failed to follow through; to make sure everything was being done to prevent what was so obviously an-accident-waiting-to-happen. And s, it did. And I am sorry. We are asking you to help disperse the huge v: ume of traffic that travels St. Andrews. Ours is residential street only two miles lon_ , 'th 200 homes, each situated less than three car-lengths, some only two car-lengths,,,.;om the onslaught of what it seems are many uncaring and reckless motorists. That number of houses does not include the people from the many complexes, such as Four Fountains. Our street provides homes for many souls. This is my mailbox which can only easily be accessed from standing in the rain gutter of the street. Reckless drivers passing cars on the right in the bike lanes could easily strike an innocent neighbor getting her/his mail. r Streets that flank us, Augusta Blvd. and Grand Lel do not have houses situated as close to the street nor do they have anywhere near the ount of traffic. As measured in April by the Collier Co • Transportation Department in a 24 hour period, St. Andrews had almost 7, 500 v- cies pass through, almost 2,000 of which were trucks. Trucks were not cars with trailer:. One-ton trucks are restricted by a s': on St. Andrews but 18-wheelers, cement mixers, car carriers, huge flat bed trucks • d other heavy commercial vehicles daily travel the Boulevard. Trucks require more feet of ro•d to stop and therefore present an even greater danger than cars. In comparison, on the same day, only about 2,800 vehicles drove Augusta Blvd. 340 being trucks. That means that St. Andrews handles almost 3 times the vehicles that Augusta does. I think some cars coming from Santa Barbara with drivers texting or otherwise distracted, hit the light and enter St. Andrews and think they are still on a six-lane major thoroughfare. They are lost and angry and react by speeding their way out. I amt trying to explain the truly life-threatening actions of motorists my neighbo and I have witnessed. On Halloween, our street is very popular. Hundreds of chili fill the Boulevard until midnight. It is truly a delight! But children can be unmins . of danger, especially on that night. I fear for them. Commissioner Fiala wisely recognized the probly in 2007. In this email to a resident dated February 5, 2007, she wrote, "We hav- always planned ahead to extend Santa Barbara, and then through a cement "pork c direct the traffic at Rattlesnake to the left or right and make it difficult for people to •ccess St. Andrews or Augusta Blvd." I have here plans drawn up by . engineering company in 2006 that illustrate how dispersal of Santa Barbara's traffic was to be accomplished. As can be seen in both plans, NO access is provided to Saint Andrews from Santa Barbara. All that was needed was cement barriers to prevent traffic from Santa Barbara going straight ahead to St. Andrews, instead traffic was to be directed left or right onto Rattlesnake, a six-laned road, widened for the purpose. This week I have observed police cruising up and down the street, on several occasions, stopping vehicles to write up violations. I reside at 432 and walk, usually in the mornings, between 5:30 and 7:00, and by doing so I believe I have a valuable assessment of the situation of road conditions between Forest Hills Blvd and Lely Palms Dr. Generally the CCSO patrols between 10 and 2, the least busy and not a good example of the issues, especially since many snow birds have departed. I will list the issues in no specific order and I have not observed any driver involved in all of these infractions. 1. Failing to come to a complete stop at any of the stop signs, especially at Warren and Wildflower, one driver didn't even slow down. 2. Stop signs are being seen as Yield Right of Ways. 3. Speeding, some I would estimate to be at 50mph or higher. This has subsided some probably due to fewer cars using the road after season. 4. Truck over the weight limit, perhaps due to signs being hidden and no enforcement. 5. Drivers moving into the bike lane, at almost anywhere on the street, especially when speeding. 6. I cannot say most, darkened windows prevent it, many drivers are distracted by talking or texting on mobile devices. 7. The new stop sign has caused one new hazard, yesterday, there were 17 cars and trucks backed up towards Rattlesnake Rd, I estimate it took 2 minutes to clear. 8. The amount of traffic, especially in season causes unnecessary delays in residents from backing or pulling out onto St. Andrews. The amount of traffic also creates other undesirable situation, trash and glass items thrown from vehicles, tires screeching and loud music and exhausts disrupting the peace in the neighborhood, diesel engines making so much noise they can be heard through closed doors and windows, especially when they are floored. I know you are responsive to all citizens as you should be, but this community can no longer enjoy our properties or peace with this situation continuing. Whatever the solution(s) the commissioners come up with, they should not penalize the residents of this community. Thank you for your attention and action. After many tests my primary care physician sent me to pain management where I was given opioids as treatment.The side effects were many and unmanageable so I took it upon myself to find another solution. I obtained some cannabis legally on my own and started self medicating using it in tiny amounts.The CLINICAL effects were amazing.All my vital signs including A1C improved dramatically with none of the opioid side effects.My pain diminished considerably to a manageable amount and my weight even dropped by 30lbs. I now feel I'd like to work instead of retiring but many companies have drug testing.So instead of paying into the system for a few more years your actions are keeping me unemployed. When used responsibly I proved,in my case,that cannabis has a place in medicine.My physicians agreed. I feel my government is keeping me from helping myself and improving my physical condition for the sake of special interests that have no concern for my health but only for the enrichment of a few. of Collier County hold that licensed Medical Cannabis access is summary and background critical to the letter and spirit of Amendment 2. Florida voters made very clear our intent when we voiced our agreement to Legal Medical Marijuana by an overwhelming vote of 71.3% in favor of Florida's Amendment 2. This vote amended Article X, Section 29, to allow the"Use of Marijuana for Debilitating Medical Conditions,"with a physician's recommendation and stands aside from limited "Compassionate Use" law, 381.986, Florida Statutes, and chapter 2016- 123, Laws of Florida. We further hold that the moratorium proposed in Collier County places local patients' access to this legal medication at undue risk. On February 14, 2017 the Collier County Board of Commissioners convened their regular meeting. One of the last minute agenda items was to vote on a 6 month moratorium on safe patient access to cannabis within the county. During the meeting the Board of Commissioners upped their original intent and voted on a 12 MONTH moratorium instead; effectively blocking safe and local access to legal medical cannabis. This action is in blatant disregard to the 64.3% of Collier citizens who voted to have safe access to medical cannabis. In addition, the moratorium presents an unjust and unsafe proposition for all patients in Collier County and unilaterally removes our citizens' rights to safe local access to cannabis medication. This initiative comes up again on February 28th for a final vote. Please attend this meeting prepared to speak and to voice your opposition to this unnecessary prohibition of dispensaries. CONSERVATION AND COASTAL MANAGEMENT ELEMENT (CCME): The proposed amendment to the PUD will have no effect on the requirements of the CCME. FUTURE LAND USE ELEMENT (FLUE): The subject property is designated Urban, Urban Commercial District,Interchange Activity Center(IAC)Subdistrict#9,as depicted on the Future Land Use Map (FLUM) and in the Future Land Use Element (FLUE) of the Collier County Growth Management Tollgate Commercial Center PUD,PUDA-PL20150002280 Page 4 of 10 January 5,2017 CCPC Plan(GMP). The proposed PUDA may be deemed consistent with the FLUE of the Growth Management Plan. TRANSPORTATION ELEMENT: Transportation Planning staff has reviewed the proposed amendment and has found it consistent with the Transportation Element. ANALYSIS: Staff has completed a comprehensive evaluation of this land use petition including the criteria upon which a recommendation must be based, specifically noted in LDC Subsection 10.02.13 B.5, Planning Commission Hearing and Recommendation (commonly referred to as the "PUD Findings"), and Subsection, 10.02.08 F.,Nature of Requirements of Planning Commission Report(referred to as"Rezone Findings"),which establish the legal basis to support the Collier County Planning Commission's(CCPC) recommendation. The CCPC uses these same criteria as the basis for their recommendation to the Board, who in turn use the criteria to support their action on the rezoning request.An evaluation relative to these subsections is discussed below. In addition,staff offers the following analyses. Environmental Review: Environmental Planning staff has reviewed the petition and the PUD Document for environmental sufficiency. This project does not require review by the Environmental Advisory Council (EAC) since the project did not meet the EAC scope of land development project reviews as identified in Section 2-1193 of the Collier County Code of Laws and Ordinances. Transportation Review: Transportation staff reviewed the PUDA and found the Level of Service continues to be acceptable. Zoning Review: The Applicant wishes to add institutional uses to the existing PUD. The subject site is within an Interstate Activity Center(Number 9). FINDINGS OF FACT: This PUD Amendment qualifies as a Substantial Change under LDC Section 10.02.13.E.1.b,"a proposed increase in the total number of dwelling units or intensity of land use or height of buildings within the development." PUD Findings: LDC Subsection 10.02.13.B.5 states that, "In support of its recommendation, the CCPC shall make findings as to the PUD Master Plan's compliance with the following criteria"(Staffs responses to these criteria are provided in bold font): 1. The suitability of the area for the type and pattern of development proposed in relation to physical characteristics of the land, surrounding areas, traffic and access, drainage, sewer, water, and other utilities. Staff has reviewed the proposed PUD Amendment and believes that the addition of certain institutional uses are compatible within an Interstate Activity Center. The addition will not have a major effect on traffic and other infrastructure. 2.Adequacy of evidence of unified control and suitability of any proposed agreements, contracts, or other instruments, or for amendments in those proposed, particularly as they may relate to arrangements or provisions to be made for the continuing operation and maintenance of such areas and facilities that are not to be provided or maintained at public expense. Conformity of the proposed Planned Unit Development with the goals, objectives, and policies of the Growth Management Plan (GMP). Staff has reviewed this petition and has determined that this amendment to add institutional uses does not affect the PUD's consistency with the GMP,therefore,staff is of the opinion that this petition may be found consistent with the overall GMP. 4. The internal and external compatibility of proposed uses, which conditions may include restrictions on location of improvements, restrictions on design, and buffering and screening requirements. The proposed change is the addition of uses.Staff believes that the approval of this amendment will not cause any compatibility issues. S. The adequacy of usable open space areas in existence and as proposed to serve the development. The Applicant proposes to add uses. Open space will not be affected. 6. The timing or sequence of development for the purpose of assuring the adequacy of available improvements and facilities, both public and private. It is staff's opinion that the addition of new permitted uses will not affect public or private facilities beyond what was approved in the existing PUD. 7. The ability of the subject property and of surrounding areas to accommodate expansion. The current PUD was found consistent with the GMP and compatible with the neighborhood. The addition of the proposed permitted uses is consistent with the uses in an Interstate Activity Center. 8. Conformity with PUD regulations, or as to desirable modifications of such regulations in the particular case, based on determination that such modifications are justified as meeting public purposes to a degree at least equivalent to literal application of such regulations. The proposed amendment is consistent with the uses in an Interstate Activity Center. Rezone Findings:LDC Subsection 10.02.08.F.states,"When pertaining to the rezoning of land,the report and recommendations from the Planning Commission to the Board of County Commissioners...shall show that the Planning Commission has studied and considered proposed change in relation to the following when applicable"(Staff's responses to these criteria are provided in bold font): 1. Whether the proposed change will be consistent with the goals, objectives, and policies of the Future Land Use Map and the elements of the Growth Management Plan. The proposed use is consistent with the uses in an Interstate Activity Center. Staff recommends that this petition be deemed consistent with the GMP. 2. The existing land use pattern. The existing land use pattern was reviewed and approved at the time of the original rezone. The proposed amendment will not substantially alter that pattern. No new districts will be created through this amendment. 4. Whether existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change. This amendment will not affect existing district boundaries. S. Whether changed or changing conditions make the passage of the proposed rezoning necessary. Staff believes that this location is appropriate for institutional uses in addition to the approved commercial and light industrial uses. 6. Whether the proposed change will adversely influence living conditions in the neighborhood. Religious institutions and other institutional uses are generally compatible with both residential and non-residential uses. 7. Whether the proposed change will create or excessively increase traffic congestion or create types of traffic deemed incompatible with surrounding land uses, because of peak volumes or projected types of vehicular traffic, including activity during construction phases of the development, or otherwise affect public safety. Transportation staff reviewed the PUD and found the Level of Service acceptable. 8. Whether the proposed change will create u drainage problem. The PUD is required to meet South Florida Water Management District standards and therefore, will not create a drainage issue. 9. Whether the proposed change will seriously reduce light and air to adjacent areas. The site planning process,PUD dimensional standards,and LDC requirements will ensure that light and air circulation are not seriously affected. 10. Whether the proposed change will adversely affect property values in the adjacent area. This is a subjective determination based upon anticipated results,which may be internal or external to the subject property. Property valuation is affected by many factors including zoning; however, zoning by itself may or may not affect values, since value determination is driven by market conditions. 11. Whether the proposed change will be a deterrent to the improvement or development of adjacent property in accordance with existing regulations. Since the Tollgate Commercial Center PUD is existing, the proposed amendment should not be a deterrent to the improvement of adjacent properties. 12. Whether the proposed change will constitute a grant of special privilege to an individual owner as contrasting with the public welfare. In light of this fact, the proposed change does not constitute a grant of special privilege. Consistency with the FLUE is further determined to be a public welfare relationship because actions consistent with plans are in the public interest. 13. Whether there are substantial reasons why the property cannot be used in accordance with existing zoning. The subject property has been developed within the parameters of the existing land-uses; however, the addition of institutional uses to the current permitted uses will be consistent with the uses in an Interstate Activity Center. 14. Whether the change suggested is out of scale with the needs of the neighborhood or the County. The subject PUD was evaluated at the rezoning stage and was deemed consistent with the GMP. The GMP is a policy statement which has evaluated the scale,density,and intensity of land uses deemed to be acceptable throughout the urban-designated areas of Collier County. Staff is of the opinion that the development standards and the developer commitments will ensure that the project is not out of scale with the needs of the community. 15. Whether is it impossible to find other adequate sites in the County for the proposed use in districts already permitting such use. There are other parcels in the County suitable for institutional uses.However,an Interstate Activity Center is deemed to be a place for diverse uses. 16. The physical characteristics of the property and the degree of site alteration, which would be required to make the property usable for any of the range of potential uses under the proposed zoning classification. This project will undergo evaluation relative to all federal,state,and local development regulations during the site development plan approval process and again as part of the building permit process. However,since the site is partially developed,this process will be minimal. 17. The impact of development on the availability of adequate public facilities and services consistent with the levels of service adopted in the Collier County Growth Management Plan and as defined and implemented through the Collier CountyAdequate Public Facilities Ordinance, as amended This petition has been reviewed by County staff who is responsible for jurisdictional elements of the GMP as part of the PUD process and staff has concluded that no Level of Service will be adversely impacted with the commitments contained in the PUD Document. 18. Such other factors, standards, or criteria that the Board of County Commissioners (Board)shall deem important in the protection of the public health, safety, and welfare. To be determined by the Board during its advertised public hearing. Deviation Discussion: The petitioner is not seeking approval of any deviations from the requirements of the LDC.
