NAME OF PETITIONER/PROJECT: Petition No. : PUD-97-20 Petition Name: Golden Pond PUD Applicant/Developer: William L. LOCATION: The subject property is located on the west side of C.R. 951 approximately 700 feet north of the intersection of C.R. 951 and Vanderbilt Beach Road; in Section 34, Township 48 South, Range 26 East, in Collier County Florida. III. DESCRIPTION OF SURROUNDING PROPERTIES: The surrounding land uses are an approved, undeveloped health park, undeveloped agricultural property, the Golden Gate canal and I-75 road right-of-way. PROJECT DESCRIPTION: The proposed PUD would permit 1 to 2-story coach homes, attached villas/patio homes, townhouses, condominiums and single family homes for a requested maximum of 75 units . The Golden Pond PUD document dated December 23 , 1997 . V. STAFF COMMENTS: Water Management: The project site is located within the Harvey Canal Drainage Basin. The proposed interim outfall for the project is the CR- 951 roadside ditch located at the east property line of the project . Staff recommends that the interim outfall be into the wetland area to the south through a spreader swale. Upon completion of the future branch of the Harvey Canal to be located along the eastern boundary of the adjoining property to the west, the control structure will be relocated to direct site stormwater discharge into this branch. The Collier County Stormwater Management Department is requiring the dedication of a 15 ' drainage easement along the west property line for the use of a canal maintenance travelway. Additionally, a 10 ' drainage easement shall be provided along the entire north property line of the project for the construction of a conveyance swale to accept and route runoff from the north. The construction of the conveyance swale shall be the developer' s responsibility and all drainage easement dedications shall occur prior to issuance of a Certificate of Occupancy for the project . Natural ground elevation varies from 12 . 8 NGVD at the west edge n of the property to 14 .3 NGVD at the CR-951 right-of-way line. Average site elevation is 13 .4 NGVD. The entire site is located within FEMA Flood Zone "X" with no base flood elevation specified. EAB Meeting April 1,1998 PUD-97-20,Golden Pond Page 3 The water management system of the project proposes the construction of a perimeter berm with crest elevation set at or above the 25-year, 3-day peak flood stage. Water quality pretreatment is proposed in the on-site lake system prior to discharge to the wetland preserve areas. The water management system will be permitted by South Florida Water Management District (SFWMD) through the Environmental Resource Permit process . All rules and regulations of SFWMD will be imposed upon this project including but not limited to storm attenuation with peak discharge rate of 0 . 15 cfs/acre, minimum roadway centerline, perimeter berm and finished floor elevations, water quality pre-treatment, and wetland hydrology maintenance. Environmental: The subject property covers approximately nineteen acres including eleven (11) acres of jurisdictional wetlands and eight ( 8) acres of uplands . Eleven acres were identified as probable jurisdictional wetlands.The canopy of the Pine-Cypress-Cabbage Palm area was dominated by bald cypress (Taxodium distichum) , slash pine (Pinus elliottii) and cabbage palm (Sabal palmetto) with scattered melaleuca (Melaleuca quinquenervia) . The balance of the vegetation included wax myrtle (Myrica cerifera) , swamp fern (Blechnum serrulatum) , saw grass (Cladium jamaicense) , Brazilian pepper (Schinus terebinthifolius) , and salt bush (Baccharis halimifolia) and vines. The Cypress Area consisted of bald cypress, slash pine, swamp fern and wax myrtle. The project will attempt to improve the hydroperiod of the Wetland Preserve Areas on the east side of this development . Approximately fifty- eight (58) percent of the identified wetlands will be preserved for this project . The uplands on site are pine flatwoods which cover the remaining eight acres. Slash pine and cabbage palm made up the canopy of the flatwoods with an understory of palmetto (Serenoa repens) , gallberry (Ilex glabra) , bracken fern (Pteridium aquilinum) , downy rosemyrtle (Rhodomyrtus tomentosus) , melaleuca and Brazilian pepper Protected species surveys were conducted on site in accordance with the Florida Game and Fresh Water Fish Commission guidelines. RECOMMENDATIONS: Staff recommends approval of PUD 97-20 "Golden Pond" with the following stipulations : WATER MANAGEMENT: 1 . A copy of SFWMD Permit or Early Work Permit is required prior to final site plan approval . 2 . An Excavation Permit will be required for the proposed lake in accordance with Division 3 . 5 of Collier County Ordinance No. 92-73 and SFWMD rules. 3 . It is recommended that the interim discharge from the project be directed into the wetland area to the south through a spreader swale. 4 . A 15 ' Drainage Easement along the entire west property line shall be dedicated as a canal maintenance travelway prior to issuance of a Certificate of Occupancy. LOCATION: The subject property is an undeveloped 9.81 acre parcel of land located on the north east corner of Vanderbilt Beach Road Extension and future Livingston Road,just north of Vineyards PUD, in Section 31,Township 48 South,Range 26 East,Collier County,Florida. III. DESCRIPTION OF SURROUNDING PROPERTIES: Surrounding properties are partially developed with the following zoning classifications: ZONING DESCRIPTION N- Agricultural Actively Farmed S- Vineyards PUD Partially Developed E- Agricultural Developed W- Agricultural Undeveloped IV. PROJECT DESCRIPTION: Crossroads Community Church is a proposed church and child care facility.The project will have a 1,200 seat church and a maximum of 200 students. V. STAFF COMMENTS: Water Management: The water management system for the project will consist of a series of collector swales, catch basins and pipes to direct the runoff into the retention areas. There are currently two planned retention basins that will have the bottom at existing ground elevation to preserve the existing native vegetation. The basins will be constructed by creating a berm around and tied into the proposed parking areas, disturbing a minimal amount of the vegetation. The two retention areas will be connected by either open swales or pipes to allow equalization of the system. An outfall structure will be installed along Vanderbilt Beach Road. This site is at the top of the drainage basin for the Airport Road canal north and the I-75 canal.At this time the drainage from Vanderbilt Beach Road drains to the I-75 canal, therefore the outfall will be to the I-75 canal system. The on-site system will be restricted to 0.15 cfs/acre discharge rate and the system will be designed for a 25-year, three day storm event. Final design will be completed upon fmalization of the site plan along with environmental permitting with SFWMD and the Army Corps of Engineers. Environmental: The subject property is an undeveloped 9.81 acre parcel of land located on the north east corner of Vanderbilt Beach Road Extension and future Livingston Road. Native habitats on site include 3.16 acres of pine flatwoods and 6.50 acres of pine-cypress-cabbage palm. Approximately .93 acres(9.6 Percent) of the native vegetation on site will be retained as shown on the proposed site plan. Approximately 6.64 acres of Collier County/South Florida Water Management (SFWMD) jurisdictional wetlands occur on the subject property. These include 6.50 acres of pine-cypress- cabbage palm and .14 acres of Melaleuca. The proposed development will impact approximately 5.71 acres of the wetlands on site. Remaining wetlands will be preserved in the stormwater retention areas on the east and west sides of the property. The proposed control elevation will be approximately 11 NGVD,equal to the assumed average wet season water table elevation. Two soil types have been identified on the subject property.These include(14)Pineda Fine Sand, Limestone Substratum and (27) Holopaw Fine Sand. Both soil types are listed as hydric by the Collier Soil and Water Conservation District. The petitioner conducted a threatened and endangered species survey during the month of December, 1997.Early morning(0730-1000),mid-day(1100- 1500)and late-day(1500- 1800) time periods were chosen to conduct the survey. No listed wildlife species were identified inhabiting or utilizing the subject property. Several species of plants listed by governmental agencies were found on the property during transect surveys. These include stiff-leaved wild pine Tillandsia fasiculata, recurved wild pine Tillandsia balbisiana, wired-leaved wild pine Tillandsia setacea, shoestring fern(Vittaria lineata) /'\ and golden polypody(Phlebodium aureum). EAB Meeting April 1, 1998 Conditional Use Petition No. CU-98-4 Page 3 A review of the official Historical/Archaeological Probability Maps for Collier County indicate no archaeological or historical sites to be located on the subject property. Correspondence from the Florida Department of State, Division of Historical Resources, lists no archaeological sites, historical standing structures or field surveys for Section 31, Township 48 South, Range 26 East, Collier County,Florida. VI. RECOMMENDATIONS: Staff recommends approval of Conditional Use Petition No. CU-98-4 "Crossroads Community Church"with the following stipulations: Water Management: 1. A copy of SFWMD Permit or Early Work Permit is required prior to fmal site plan approval. 2.
