1. Permits or letters of exemption from the U.S.Army Corps of Engineers(ACOE)and
the South Florida Water Management District(SFWMD) shall be presented prior to
final plat/construction plan approval.
2. Upland Recreational Open Space (UROS) areas shall be recorded on the plat as
conservation/preservation areas with uses and limitations similar to or as per section
704.06 of the Florida statues. Conservation areas shall be dedicated on the plat to the
project's homeowners association or like entity for ownership and maintenance
responsibilities and to Collier County with no responsibility for maintenance. UROS
areas must average at least 25 feet wide.
3. An exotic vegetation removal / maintenance plan for the site, with emphasis on the
conservation / preservation areas, shall be included on the final construction plan.
This plan shall include the methods of exotic vegetation removal to be used within
conservation/preservation areas.

Water Management:
1. SWFWMD Right-of-Way Permit and Discharge Permit for out-fall into the Golden
Gate Canal shall be submitted prior to Development Plan approval.
2. From I-75 North to the main Golden Gate Canal,the Developer shall be
responsible for clearing vegetation from the existing 25'drainage easement and
leveling the existing spoil piles to form a 15'wide maintenance travelway along the
west bank of the existing ditch. In addition,all vegetation shall be removed from
the top width of the existing ditch located on the adjacent 30'drainage easement.
All cut stumps shall be treated with an appropriate herbicide to prevent re-growth.

P'` 3. Petitioner must obtain permission from property owners abutting the north side of
the access road to place roadway fill(sideslopes)on their property.
4. Authorization from Collier County and FDOT must be obtained prior to
constructing culverts under the access road for conveying I-75 runoff and runoff
from south of I-75.
Environmental:
1. The following language shall be added the environmental section of the PUD
document Section 4.10:
A. "This PUD shall comply with the environmental sections of the Collier County
Land Development Code and Growth Management Plan conservation and
Coastal Management Element at the time of final development order approval."
B. A Gopher tortoise relocation/management plan shall be submitted to
Current Planning Environmental Staff for review and approval.
A copy of the approved plan language shall be included on the final Site
Development Plan."
C. Prior to final development order approval(FSDP)the petitioner shall
submit a copy of the Florida Game and Fresh Water Fish Commission
Gopher Tortoise Permit.

Environmental:
1. Reference section 5.3 of the PUD document next to the land use table on the PUD
master plan.
2. Petitioner proposes to retain five (5) acres of upland preserve and six (6) acres of
wetland preserve as illustrated on the PUD master plan.Revise the land use table on the
PUD master plan accordingly.
3. Add the following stipulation to section 6.8 of the PUD document:
In the event the project does not require platting, all conservation areas shall be
recorded as conservation/preservation tracts or easements dedicated to an
approved entity or to Collier County with no responsibility for maintenance and
subject to the uses and limitations similar to or as per Florida statutes
section 704.06.

1. The excavation shall be limited to a bottom elevation of 16 feet below existing grade and
shall be no shallower than 10 feet below existing grade.
2. Petitioner must create a 20' Easement around the lake bank so that Collier County can
continue to maintain the existing canal bank upstream and downstream of the project.
3. Offsite removal of material shall be subject to standard conditions imposed by the

work.

In an advisory capacity to the Board of County Commissioners
the Environmental Advisory Board is charged with:
"review and evaluation of specific zoning and development
petitions and their impact on the regulation, control ,
management, use or exploitation of any or all natural
resources of or within Collier County" .
In order to effectively discharge these responsibilities, it
is essential to:
1- carefully review all documents submitted by the petitioner,
2- carry out site visits when deemed necessary, and
3- consult with Staff when necessary for questions and
clarification.
Recognizing that I am new to the procedure, I still find it
difficult, at times, to fully and adequatelly prepare for the
meetings within the existing timechedule. This is neither
adequately serving the County or the petitioner.
In the interest of effective and efficient Board operation and
/'1 action, I present the following motion to the Board for action:
If it is possible, without adversely affecting the vital work
of the Staff, or presenting an additional burden on the efforts
of the staff, " it is moved that the Board request that

H. LOCATION:
The subject property is an undeveloped twenty acre parcel situated between Rivers Road and
Moulder Drive approximately one half mile south of Immokalee Road in Section 30,Township 48
South,Range 27 East,Collier County,Florida.
III. DESCRIPTION OF SURROUNDING PROPERTIES:
Surrounding properties are mostly undeveloped with the following zoning classifications:

IV. PROJECT DESCRIPTION:
The petitioner is proposing to develop a social club for nude recreation.Proposed facilities include
a main residence, seven manufactured homes, approximately 400 square feet each in size, a pool
and spa and passive recreation trails around two natural wetlands and manmade two acre lake.

There is no water management plan of record for Stirn's Social Club.
Environmental:

Consultants,Inc.,received by Planning Services on January 30, 1998.

V. STAFF COMMENTS:
Water Management:
The subject property contains wetlands and will be required to obtain a SFWMD surface water
permit. The project sits within the Cypress Canal Basin. The site plan shows a structure, parking
lot and a 2-acre (±) lake. The design, when done, should utilize the lake for achieving water
quality retention and peak flow attenuation.
Environmental:
The subject property is an undeveloped twenty acre parcel situated between Rivers Road and
Moulder Drive approximately one half mile south of Immokalee Road. About seventy percent of
the site is covered with cabbage palm forest. The remaining areas include freshwater marsh,
cypress/cabbage palm, willow head and disturbed habitats. The proposed development plan will
impact about 9.26 acres of the site.
Approximately 5.14 acres of Collier County/South Florida Water Management District(SFWMD)
jurisdictional wetlands have been identified on the subject property. Wetland habitats on site
include freshwater marsh, cypress/cabbage palm and willow head. The historic wetlands in the
area have been altered by drainage works, fire and the introduction of Brazilian pepper. Historic
high water levels on site are approximately 12 to 16 inches higher than presently existing levels
judged by the height of old cypress knees adjacent to actively growing ones. All of the
approximately 9.26 acres of proposed development will occur within the uplands. No wetland
areas will be destroyed.
A listed species survey was conducted during the fall (November, 1997) and early dry season
(January, 1998).Wood storks(Mycteria americana)were the only listed wildlife species found on
the site. These were sighted perched in the tops of the large cypress fringing the fresh water
marsh. Local residents have reported that a Florida black bear (Ursus americanus floridanus)
roams the site.
Listed plant species identified on the subject property include golden polypody fern(Phlebodium
aureum) and shoestring fern(Vittaria lineata). Both plants are common epiphytes on the cabbage
palms on site.
Two soil types have been identified on the project site. These include (18) Riviera Fine Sand,
Limestone Substratum and(21)Boca Fine Sand. The former soil is considered hydric by the U.S.
Department of Agricultural - Natural Resources Conservation Service (Soil Conservation
Service).A soils unit map along with soils descriptions are included in the Environmental Impact
Statement.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No. CU-97-25 with the following
stipulations:
Water Management:
1. The project will obtain a SFWMD surface water permit.
Environmental:
1. Environmental permitting shall be in accordance with the state of Florida Environmental
Resource Permit rules and be subject to review and approval by Current Planning
Environmental Staff. Removal of exotic vegetation shall not be counted towards mitigation
for impacts to Collier County jurisdictional wetlands.

2. An appropriate portion of native vegetation shall be retained on site as required in section 1
3.9.5.5.4.CCLDC.
3. An exotic vegetation removal, monitoring, and maintenance (exotic free) plan for the site,
with emphasis on areas of retained native vegetation, shall be submitted to Current Planning
Environmental Staff for review and approval prior to final site plan /construction plan
approval.
4. Petitioner shall submit a topographic map for the site at the time of site development plan
review.

IV. PROJECT DESCRIPTION:
North Collier Industrial Center is a proposed industrial
subdivision with 36 lots, a wetland preserve and an upland/
Gopher tortoise preserve.

V. STAFF COMMENTS:
Water Management:
SFWMD Permit #11-01084-S for this site was issued on April 15,
1993 and allowed to expire on April 15, 1996. The SFWMD wants
to see the updated plan to determine whether it can be reviewed
locally or if a SFWMD permit is required.
The calculations indicate 4 . 12 acres of "wet detention. " This
is usually accomplished in a lake. The drawing shows a large
"water management area open space" in the north. The original
SFWMD permit drawing is attached for comparison.

The subject property consists of approximately forty-two acres
of land categorized as Pine Flatwoods, Cypress/ Pine
Flatwoods, inland ponds, wet prairie, and xeric oak uplands .
The Consultant identified 35 acres of uplands and 7 acres of
wetlands o site. The PSP commits to preservation of a minimum
of 2 . 5 acres of wetlands and 5 . 7 acres of uplands (a little
over 19%) on site.
The consultant provided the following site information:
"The dominant forest types of the project site are pine
flatwoods (411) , Pine/cypress (624) and Xeric oak scrub (421) .
The pine flatwoods consists of approximately 26. 5 acres . The
canopy consists of slash pine and melaleuca with a midstory and
ground cover of palmetto, winged sumac and gallberry. Several
saw palmetto island were scattered throughout the pine
flatwoods area. These palmetto islands were just grouped
together with pine flatwoods . Throughout the entire project
site exotic plants have established themselves . Melaleuca,
Brazilian pepper and Downy rosemyrtle are the majority of
n exotics encountered.
The pine/cypress area would be considered a jurisdictional
wetland to both the U. S. Army Corps of Engineers and South
Florida Water Management District. There are several other
areas that would be considered jurisdictional. These include a
wetland prairie area (643) and pine/wetland slough area (616) .
This Threatened and Endangered Species Survey done in June/July
1996, placed an emphasis in surveying in the xeric oak scrub
communities . Two separate scrub communities exist on this
project site. The largest scrub community is located in the
north-eastern corner of the project site. This area consists of
approximately 4 . 8 acres. Evidence of a recent fire has opened
some areas in the scrub. The second scrub community is located
in the southeastern corner. This area is much smaller,
consisting of approximately . 6 acres . "
The consultant surveyed for threatened and endangered species
on site and concluded that there were six active Gopher
tortoise burrows. The southernmost two will be excavated and
relocated into the northern preserve where the other four
/'� tortoise burrows were observed.

Staff conducted a site visit to verify the number of Gopher
n tortoise burrows. Approximately a dozen burrows were observed
in the larger northern scrub. The increase in numbers may be a
reflection of additional new burrows since summer of 1996. Due
to this discrepancy, a new Gopher tortoise survey will be
required prior to final plat/plans approval.
VI. RECOMMENDATIONS:
Staff recommends approval of PSP-97-6 "North Collier Industrial
Center" with the following stipulations:
WATER MANAGEMENT:
1 . That the petitioner or his engineer submit a set of plans
and calculations to the SFWMD for their assessment of his
need to obtain a SFWMD surface water management permit.
2 . That the petitioner' s engineer submit a more detailed
drainage plan during the subdivision review process .
ENVIRONMENTAL:
1. A new Gopher tortoise survey (recent within six months) and
relocation/management plan shall be submitted to Current
Planning Environmental Staff for review and approval . A copy
of the approved plan language shall be included on the final
Construction Plans .
2 . Prior to the pre-construction meeting for the Final
Plat/Construction Plans, the petitioner shall submit a copy
of the Florida Game and Fresh Water Fish Commission Gopher
tortoise Permit.
3 . Prior to final Plat/Construction Plans approval the
petitioner shall submit copies of all necessary environmental
permits (ERP, USACOE) .
4 . Prior to final plat approval a conservation Easement shall
be placed over the preserves and recorded on the plat with
protective covenants per or similar to Section 704 . 06 or the
Florida Statutes . Conservation areas shall be dedicated on
the plat to the project ' s homeowners association of like
entity for ownership and maintenance responsibility and to
Collier County with no responsibility for maintenance.
5. The final plat shall appropriately re-label "Tract C" as
/ "upland or wetland preserve" .

The subject property is located between Whippoorwill Lane and Interstate 75 approximately three
quarter mile south of Pine Ridge Road in Section 18, Township 49 South, Range 26 East, Collier
County,Florida.

IV. PROJECT DESCRIPTION:
Whippoorwill Woods is a proposed residential subdivision with 536 dwelling units, recreational
facilities, water management lakes and preserve areas. Residential units are projected to be
developed as villas,coach homes,carriage homes or condominiums.The project is proposed to be
completed in one or two phases.
The project site is located within the I-75 Gate Canal Drainage Basin according to the Collier
County Drainage Atlas. The proposed outfall for the project is the D-2 Canal, located along the
east side of I-75.

V. STAFF COMMENTS:
Water Management:
The site consists of four basins,A-1, A-2,B & C. Basin A-1 discharges into an existing lake that
discharges through existing box culverts under I-75. The lake was dug for the construction of I-
75.Basin A-2 is served by two connected lakes that discharge through existing box culverts under
I-75 toward the D-2 canal.
Basin"B" is served by a wetland preserve interconnected with three lakes. The eastern-most lake
discharges into an existing swale to the south which flows east to a box culvert under I-75.
Basin "C" is served by an interconnected lake and wetland. The wetland discharges west into a
swale flowing south that empties into the same westerly flowing swale as Basin"B".
Environmental:
The subject property is an undeveloped 83.9 acre parcel of land located between Whippoorwill
Lane and Interstate 75 approximately three quarter mile south of Pine Ridge Road.Native habitats
on site include pine flatwoods, pine-cypress-cabbage palm, palmetto prairie and cypress forest.
Also on the property is a large borrow pit, several dirt roads and evidence of two old homesites.
Approximately 24 acres(29 percent)of the site will be retained in preserve areas as shown on the
PUD master plan.
Approximately 43.32 acres of Collier County/South Florida Water Management (SFWMD)
jurisdictional wetlands occur on the subject property. Of these approximately 18.39 acres will be
impacted by development. To offset wetland losses the petitioner proposes on site preservation
and restoration of 16.9 acres of wetlands and 7.33 acres of uplands.Exotic vegetation removal and
supplemental plantings will be conducted in accordance with South Florida Water Management
District and U.S.Army Corps of Engineers permit criteria.
Four soil types have been identified on the subject property. These include (2) Holopaw Fine
Sand,Limestone Substratum,(3)Malabar Fine Sand,(21)Boca Fine Sand and(27)Holopaw Fine
Sand. All soil types encountered on site are listed as hydric by the Collier Soil and Water
Conservation District with the exception of(21)Boca Fine Sand.
The petitioner conducted a threatened and endangered species survey during the month of
December, 1997.Early morning(0730-1000),mid-day(1100- 1500)and late-day(1500- 1800)

time periods were chosen to conduct the survey. Two listed wildlife species were found during the
survey, Big Cypress fox squirrel (Sciurus niger avicennia) and gopher tortoise (Gopherus
polyphemus). A single fox squirrel was located at the southern property boundary, actively
foraging. Two active gopher tortoise burrows each approximately eight inches wide were
identified in the same vicinity as the fox squirrel. The area of the sightings will be incorporated
into a preserve area on site.
Several species of plants listed by governmental agencies were found on the property during
transect surveys. These include Tillandsia species, shoestring fern (Vittaria lineata) and golden
polypody(Phlebodium aureum).
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property. Correspondence from the
Florida Department of State, Division of Historical Resources, lists no archaeological sites,
historical standing structures or field surveys for Section 18, Township 49 South, Range 26 East,
Collier County,Florida.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-98-1 with the
following stipulations:
Water Management:
1. A SFWMD surface water management permit must be obtained prior to approval of
development plans
Environmental:
No additional stipulations.

IV. PROJECT DESCRIPTION:
The proposed PUD would permit 1 to 2-story coach homes,
attached villas/patio homes, townhouses, condominiums and
single family homes for a requested maximum of 75 units .

V. STAFF COMMENTS:
Water Management:
The project site is located within the Harvey Canal Drainage
Basin. The proposed interim outfall for the project is the CR-
951 roadside ditch located at the east property line of the
project . Staff recommends that the interim outfall be into the
wetland area to the south through a spreader swale. Upon
completion of the future branch of the Harvey Canal to be
located at the western boundary of the project , the control
structure will be relocated to direct site stormwater discharge
into this branch as shown on the plans . The Collier County
Water Management Department is requiring the dedication of a
35 ' drainage easement along the westerly property line to
accommodate this future canal . Additionally, a 10 ' drainage
easement shall be provided along the entire north property line
of the project for the construction of an offsite conveyance
swale to accept and route runoff from the north. The
construction of the offsite conveyance swale shall be the
developer' s responsibility and all drainage easement
dedications shall occur prior to issuance of a Certificate of
Occupancy for the project .
Natural ground elevation varies from 12 . 8 NGVD at the west edge
of the property to 14 . 3 NGVD at the CR-951 right-of-way line.
Average site elevation is 13 .4 NGVD. The entire site is located
within FEMA Flood Zone "X" with no base flood elevation
specified.

The water management system of the project proposes the
construction of a perimeter berm with crest elevation set at or
above the 25-year, 3-day peak flood stage. Water quality
pretreatment is proposed in the on-site lake system prior to
discharge to the wetland preserve areas .
The water management system will be permitted by South Florida
Water Management District (SFWMD) through the Environmental
Resource Permit process. All rules and regulations of SFWMD
will be imposed upon this project including but not limited to
storm attenuation with peak discharge rate of 0 . 15 cfs/acre,
minimum roadway centerline, perimeter berm and finished floor
elevations, water quality pre-treatment, and wetland hydrology
maintenance.
Environmental:
The subject property covers approximately nineteen acres
including eleven (11) acres of jurisdictional wetlands and
eight ( 8) acres of uplands .
Eleven acres were identified as probable jurisdictional
wetlands .The canopy of the Pine-Cypress-Cabbage Palm area was
dominated by bald cypress (Taxodium distichum) , slash pine
(Pinus elliottii) and cabbage palm (Sabal palmetto) with
scattered melaleuca (Melaleuca cruinctuenervia) . The balance of
the vegetation included wax myrtle (Myrica cerifera) , swamp
fern (Blechnum serrulatum) , saw grass (Cladium iamaicense) ,
Brazilian pepper (Schinus terebinthifolius) , and salt bush
(Baccharis halimifolia) and vines. The Cypress Area consisted
of bald cypress, slash pine, swamp fern and wax myrtle .
The project will attempt to improve the hydroperiod of the
Wetland Preserve Areas on the east side of this development .
Approximately fifty- eight (58) percent of the identified
wetlands will be preserved for this project .
The uplands on site are pine flatwoods which cover the
remaining eight acres . Slash pine and cabbage palm made up the
canopy of the flatwoods with an understory of palmetto (Serenoa
repens) , gallberry (Ilex glabra) , bracken fern (Pteridium
aquilinum) , downy rosemyrtle (Rhodomyrtus tomentosus) ,
melaleuca and Brazilian pepper
Protected species surveys were conducted on site in accordance
with the Florida Game and Fresh Water Fish Commission
guidelines . No protected species, or evidence of their
foraging, were observed on site.

VI. RECOMMENDATIONS:
Staff recommends approval of PUD 97-20 "Golden Pond" with the
following stipulations :
WATER MANAGEMENT:
1 . A copy of SFWMD Permit or Early Work Permit is required
prior to final site plan approval .
2 . An Excavation Permit will be required for the proposed lake
in accordance with Division 3 . 5 of Collier County Ordinance
No. 92-73 and SFWMD rules .
3 . It is recommended that the interim discharge from the
project be directed into the wetland area to the south
through a spreader swale.
ENVIRONMENTAL:
No environmental stipulation. The PUD shall be approved
as submitted.
