within an 18 hole golf course. The total project area is 485.02 acres, and
will also include 150,000 square feet of commercial/office space on 15±
acres.

Planned Unit Development Petition No. PUD 97-16 with amended stipulations:
Water Management:
1. The development project area shall be designed to consider regional stormwater
flows and include the passage of offsite flows from the north to the south through
the western portion of the property in a manner consistent with project
development plans.
2. The Developer shall grant the necessary drainage easements outside the Naples
r-• Forest Surface Water Management System and within western portions of the
project to Collier County to provide adequate regional stormwater management
flowways and facilities. The easement shall be granted after the Naples Forest has
received permits from the State and Federal agencies and within 90 days of
receipt of the drainage easement documents from Collier County. The easement
rights shall be subject to and consistent with Developer's development plans,
including Developer's wetland mitigation plans.
3. The Developer shall be responsible for providing, in a manner consistent with
Developer's project development plans, adequate facilities and/or flowways
necessary to pass through the project boundaries the offsite stormwater which
currently flows towards the Naples Forest property. Design of the improvements
shall be closely coordinated with the County Stormwater Management Department
to endeavor to maintain uniformly with the County's Lely Area Stormwater
Improvement project, currently under design.
A. The offsite flow rate will be calculated by the Developer's engineer and
accepted by the South Florida Water Management District (SFWMD) based
on existing permitted projects upstream. If Collier County disagrees with the
offsite flow estimate, the County shall provide supporting documentation to
the Developer's engineer and the SFWMD.

''*\ B. Such facilities may include,but are not limited to:
1. Regrading of the Naples Forest western easement area to reestablish
historic sheetflow along such portion of the property.
2. Excavation of small ponds in the flowway for additional storage area.
3. Construction of a control structure to detain a portion of the offsite flows.
Design of such a control structure shall be by the Developer's engineers.
The control structure will be maintained by Collier County and the
Developer shall not have liability for impacts to properties upstream due
to the County's control of the structure's control elevation. Collier
County agrees to maintain the control structure in a manner as described
in these stormwater conditions.
C. Collier County acknowledges that the Developer's commitment to construct
facilities to control offsite runoff may be precluded by the inability to timely
obtain the issuance of necessary permits. The Developer's failure to timely
obtain such permits that include the offsite stormwater runoff faculties will not
be considered a breach of these stipulations. In such an event, the Developer
agrees to provide the necessary drainage easements (subject to and consistent
with Developer's use of the easement areas as described above) at a later date,
if Collier County obtains construction permits for the facilities as part of the
regional drainage basin improvements.
4. In the event a water level control structure in the flowway and/or improvements to
the capacity of the .stormwater conveyance system along Rattlesnake Hammock
Road to regulate or improve off-site stormwater flows is required by SFWMD as
part of the Naples Forest project permitting, the County shall reimburse the
developer for the cost of such control structure and/or improvements to the
stormwater conveyance system along Rattlesnake Hammock Road (less the
developer's proportionate share of such cost) as soon as reasonably possible and not
later than the time an area wide funding mechanism is established for stormwater
improvements. Also, at the time of such reimbursement, the County shall reimburse
the developer for the cost of excavating a flowway(excluding any cost related solely
to aesthetics) along the western portion of the property. The developer's
proportionate share is calculated based upon the Naples Forest development
discharge divided by the total regional discharge.
5. If any of the regional stormwater improvements cause additional wetland
impacts which must be mitigated in the Naples Forest permit, the County
will pay the Developer for the cost of such mitigation.

6. A South Florida Water Management District Surface Water Management Permit
will be required for this project prior to the start of any construction.

The subject property is located approximately one half mile

V. STAFF COMMENTS:
Water Management:
Magnolia Pond is a proposed 42-acre Planned Unit Development
located within the Main Golden Gate Canal Drainage Basin. The
proposed outfall for the project is the Golden Gate Canal
located north of the project which ultimately discharges into
the Gordon River.
The water management system will be permitted by South Florida
Water Management District (SFWMD) through the Environmental
Resource Permit process. All rules and regulations of SFWMD
will be imposed upon this project including but not limited to:
storm attenuation with a peak discharge rate of 0 . 15 cfs/acre,
minimum roadway centerline elevation, perimeter berm and
finished floor elevations, water quality pre-treatment and
wetland hydrology maintenance. Water management will be
provided for Access Road No. 2 .
The engineering consultant has stated that water management
calculations are not necessary at this time and will be
provided at time of development plan submittal .
Environmental:
The subject property covers approximately forty-two (42) acres
/*N including fourteen (14) acres of jurisdictional wetlands and
twenty-eight (28) acres of uplands .

Fourteen acres were identified as jurisdictional wetlands .
The canopy of the Pine-Cypress area was dominated by bald
cypress (Taxodium distichum) , slash pine (Pinus elliottii) and
cabbage palm (Sabal palmetto) with occasional melaleuca
(Melaleuca guinciuenervia) . The balance of the vegetation
included wax myrtle (Myrica cerifera) , swamp fern (Blechnum
serrulatum) , saw grass (Cladium jamaicensis) , Brazilian
pepper (Schinus terebinthifolius) , myrsine (Myrsine floridana)
and salt bush (Baccharis halimifolia) .
The hydroperiod for the wetland has been altered due to the
construction of the Golden gate canal to the north and I-75 to
the south. The project will attempt to improve the hydroperiod
of the remaining portions of the isolated wetlands on the south
side of this development . Forty-three percent of the
identified wetlands will be impacted for this project
The uplands on site are divided between three major vegetative
n communities . Pine flatwoods cover eighteen acres with the
remainder of the uplands being a one acre cabbage palm hammock
and sight and a half acres of palmetto islands. Slash pine and
cabbage palm made up the canopy of the flatwoods with an
understory of palmetto (Serenoa repens) , gallberry (Ilex
glabra) , myrsine, bracken fern (Pteridium aciuilinum) melaleuca
and Brazilian pepper. Grape vine and poison ivy covered a fair
amount of this area. The cabbage palm hammock included Sabal
palms, palmetto, Sweet bay (Magnolia virginiana) , and Balsum
apple (Momordica charanita) . The palmetto islands included saw
palmetto, winged sumac (Rhus copallina) , gallberry and
occasional slash pine.
Protected species surveys were conducted on site in accordance
with the Florida Game and Fresh Water Fish Commission
guidelines . The only protected species observed on site were
Gopher tortoise (Gopherus polyphemus) . Seven active and one
inactive burrows were identified and mapped. The burrows were
found in the pine flatwoods and palmetto areas. All tortoises
will be relocated into the upland preserve.
VI. RECOMMENDATIONS:
Staff recommends approval of PUD 97-19 "Magnolia Pond" with
the following stipulations :

WATER MANAGEMENT:
1 . SWFWMD Right-of-Way Permit and Discharge Permit for out-fall
into the Golden Gate Canal shall be submitted prior to
Development Plan approval .
2 . From I-75 North to the main Golden Gate Canal, the Developer
shall be responsible for clearing vegetation from the
existing 25 ' drainage easement and leveling the existing
spoil piles to form a 15 ' wide maintenance travelway along
the West bank of the existing ditch. In addition, all
vegetation shall be removed from the top width of the
existing ditch located on the adjacent 30 ' drainage easement .
All cut stumps shall be treated with an appropriate herbicide
to prevent re-growth.
ENVIRONMENTAL:
1 . The following language shall be added the environmental
section of the PUD document Section 4 . 10 :
A. "This PUD shall comply with the environmental sections
of the Collier County Land Development Code and Growth
Management Plan conservation and Coastal Management
Element at the time of final development order
approval . "
B. A Gopher tortoise relocation/management plan shall be
submitted to Current Planning Environmental Staff for
review and approval . A copy of the approved plan
language shall be included on the final Site Development
Plan. "
C. Prior to final development order approval (FSDP) the
petitioner shall submit a copy of the Florida Game and
Fresh Water Fish Commission Gopher Tortoise Permit .

intersection of Radio Road and Davis Boulevard, lying south of Interstate 75, in Section 34,

IV. PROJECT DESCRIPTION:
Saddlebrook Village is a 33.79 acre rental apartment project with 438 residential dwelling units,
recreational facilities, storm water retention lakes and preserve areas. The first phase is proposed
to be known as The Palms,which will include 140"affordable"rental units. The second phase of
the development is proposed to be known as Pelican Pointe, which include the remaining 298
rental apartments being a mix of both"affordable"and"market rate"units.

The entire 33.79 acre property is planned as a single storm water management basin.
Approximately 3 acres of lakes and 11 acres of preserve area are included in this area.
Flood protection will be provided to the project by raising buildings, roads, etc. in conformance
with South Florida Water Management District criteria. The South Florida Water Management
District criteria for building pad elevation is the 100-year, 3-day/zero discharge storm elevation,
and the minimum road elevation is based on the 25-year, 3-day/zero discharge storm event.After
heavy rainfall events,runoff from impervious areas will be routed to the lakes connected by pipe,
which will run to the wetland preserve with discharge to the east.

V. STAFF COMMENTS:
Water Management:
The original SFWMD permit application was withdrawn on October 25, 1996.A new permit must
be applied for.
Environmental:
The subject property is an undeveloped 33.79 acre parcel located on the north side of the
intersection of Radio Road and Davis Boulevard. Native habitats on site consist of hydric and
non-hydric pine flatwoods, saw palmetto prairie, herbaceous ground cover and mixed
hardwood/shrub communities. Habitat descriptions for each of the identified FLUCCS codes on
site are included in exhibit 8 of the environmental impact statement (EIS). Exhibit 7 contains a
FLUCCS map for the subject property. Approximately eleven acres (32 percent) of the native
habitat on site will be retained as shown on the PUD master plan.
Approximately 5.25 acres of Collier County/South Florida Water Management District(SFWMD)
jurisdictional wetlands occur on the subject property. Of these approximately 0.58 acres will be
impacted by the development.To offset wetland losses the petitioner proposes on site preservation
and restoration of six acres of wetlands and 5.28 acres of uplands(The six acre wetland preserve
also includes wetlands which are jurisdictional to the U.S.Army Corps of Engineers).

Two soil types have been identified on the project site. These include (14) Pineda Fine Sand,
Limestone Substratum and(21)Boca Fine Sand.The first soil is considered hydric by the U.S.
Department of Agricultural - Natural Resources Conservation Service (Soil Conservation
Service).A soils exhibit is included as exhibit 6 in the EIS.
Big Cypress fox squirrels(Sciurus niger avicennia)were the only listed wildlife species observed
on the subject property during the recent threatened and endangered species survey. Three
squirrels were observed,two were found in two different mature slash pines, while the other was
observed in a Melaleuca tree. There were no signs of nesting within the immediate area of the
sightings,nor were there observations of feeding(i.e.chewed pine cones)in the immediate area of
the sightings.
A separate red-cockaded woodpecker (Picoides borealis) survey was conducted in
September/October, 1997. No red-cockaded woodpeckers or cavity trees were found on the
subject property. RCW cavity trees have been documented in the project area (see RCW survey
for details). The development plan proposes to preserve approximately five acres of pinelands to
the north for RCW and Big Cypress fox squirrel habitat. Vegetation in this preserve includes
mature slash pines with little mid-story vegetation.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-90-36(1)
"Saddlebrook Village PUD"with the following stipulations:
Water Management:
1. That Saddlebrook Village PUD must obtain a SFWMD Surface Water Management Permit
prior to SDP approval.
Environmental:
1. Reference section 5.3 of the PUD document next to the land use table on the PUD master
plan.
2. Petitioner proposes to retain five(5)acres of upland preserve and six(6)acres of wetland
preserve as illustrated on the PUD master plan. Revise the land use table on the PUD
master plan accordingly.
3. Add the following stipulation to section 6.8 of the PUD document:
In the event the project does not require platting,all conservation areas shall be recorded
as conservation/preservation tracts or easements dedicated to an approved entity or to
Collier County with no responsibility for maintenance and subject to the uses and
limitations similar to or as per Florida statutes section 704.06.

IV. PROJECT DESCRIPTION:
The petitioner proposes to excavate a 1 . 8 acre lake on a 5 acre
tract in Golden Gate Estates. An estimated 25, 500 C.Y. of
material will be removed from the 20 foot deep excavation, and
hauled offsite to be used as fill for house pads .

V. STAFF COMMENTS:
The site shows on aerial photographs as an abandoned farm field
long since overgrown. The soil survey of Collier County shows
the area as oldsmar fine sand. Prior to agricultural clearing
the site was probably a pine flatwood.
At present, Creative Homes intends to turn the completed
excavation into a single family homesite of 5 . 0 acres with a
1 . 8 acre lake. The buildable land of 2 % (±) acres will be
comparable to the minimum estates lot size of 2 % acres. The
petitioner is willing to stipulate that the end use of the
parcel is as a single family lot . Staff doesn't think the
stipulation is necessary because of the nature of the finished
parcel .
With the average Estates house pad requiring slightly in excess
of 500 c. f . of fill, this excavation should service about 50
house pads . Creative Homes expects the excavation to be
finished in less than a year.
VI. RECOMMENDATIONS:
Staff recommends approval of Commercial Excavation Permit No.
59 . 632, "Creative Homes Commercial Excavation" with the
following stipulations :
1 . The excavation shall be limited to a bottom elevation of 16
feet below existing grade and shall be no shallower than 10
feet below existing grade.
2 . Petitioner must create a 20 ' Easement around the lake bank
so that Collier County can continue to maintain the
existing canal bank upstream and downstream of the project .
3 . Offsite removal of material shall be subject to standard
conditions imposed by the Transportation Department
(attached) .
4 . No blasting will be permitted unless issued a separate
permit by Collier County Engineering Review Services.
5 . If vegetation is to be removed as a result of the
excavation, a separate Vegetation Removal Permit (per
n Collier County Land Development Code, Division 9) shall be
obtained from Collier County Development Services
Department before commencing work.

COLLIER COUNTY TRANSPORTATION SERVICES
"STANDARD CONDITIONS"
EXCAVATION PERMIT APPLICATIONS INVOLVING
OFF-SITE REMOVAL OF MATERIAL
The intent of these "Standard Conditions" are to provide excavation permit applicants a summary of
conditions which may affect their projects and which should be taken into consideration during all
stages of project development:
1. Haul routes between an excavation site and an arterial road shall be private with property
owner(s) approval or be a public collector road built to standards applicable to handle the
resulting truck traffic. Where residential areas front collector roads, appropriate turn lanes,
buffer and bikepath shall be required as minimal site improvements and if recommended for
approval, shall be so with the condition that the Transportation Services Administration
reserves the right to suspend or prohibit off-site removal of excavated material should such
removal create a hazardous road condition or substantially deteriorate a road condition; such
action by the Transportation Services Administration shall be subject to appeal before the
Board of County Commissioners.
2. Haul routes utilizing public roads shall be subject to road maintenance and road repair or an
appropriate fair share by the permittee in accordance with Excavation Ordinance No. 91-102
as amended Div. 3.5 and Right-of-Way Ordinance No. 93-64.
3. Off-site removal of excavated material shall be subject to Ordinance No. 92-22 (Road
Impact Ordinance). A traffic and road impact analysis shall be made by the County to
determine the effects that off-site removal of excavated material will have on the road
system within the excavation project's zone of influence. If appropriate, road impact fees in
accordance with Ordinance No. 92-22 shall be paid prior to the issuance of an excavation
permit.
4. The Transportation Services Administration reserves the right to establish emergency weight
limits on public roadways affected by the off-site removal of excavated material; the
procedure for establishment of weight limits shall be the presentation of an applicable
resolution before the Board of County Commissioners. Should weight limits be instituted,
the permittee shall be responsible to implement measures to assure that all heavy truck
loadings leaving the permit's property conform to the applicable weight restriction.
5. The Excavation Performance Guarantee shall apply to excavation operations and also the
maintenance/repair of public roads in accordance with current ordinances and applicable
permit stipulations.

6. Based on soil boring information per Ordinance No. 91-102 as amended, a blasting permit
may be appropriate. Should a blasting permit application be submitted and should
residential areas exist within one mile of the excavation site, the County reserves the right to
deny a blasting permit based on concerns for off-site impacts from blasting at an excavation
site. Should a blasting permit be considered and approved, the minimum conditions of
approval in addition to conditions per Ordinance No. 91-102 as amended are as follows:
A. Structure inventory/monitoring and applicable property owner release as required by
the Development Services Director.
B. Security bond applicable to private property damage acceptable to the County.
C. Control of size/depth/number of charges per blast by the Development Services
Director.
D. The right of the County to suspend and/or revoke blasting permit authority should it
be determined that blasting activities are creating unacceptable off-site conditions
either in terms of private property damage and/or related physical effects of blasting
operations.
7. No excavation permit shall be issued until receipt of a release from the Transportation
Services Administration applicable to proper mitigation of off-site impacts, meeting of
applicable provisions of Ordinance No. 93-64, Ordinance No. 92-22, and Ordinance No.
91-102 as amended.
