Principal structures shall be setback a minimum of ten feet (10') from

and ten feet (10') from all PUD boundaries and residential tracts. Principal
structures shall be setback a minimum of twenty-five (25) feet from Preserve
District boundaries.
5. Replace Section 5.10 (B) of the PUD document with the following stipulation.
All conservation areas shall be designated as conservation/preservation tracts or
easements on all construction plans and shall be recorded on the plat with
protective covenants per or similar to Section 704.06 of the Florida Statutes.
Buffers and setbacks shall be in accordance with 3.2.8.4.7.3 CCLDC.
6. Amend Section 5.10 (C) of the PUD document to read as follows by adding the
underlined language and deleting the .
Buffers around preserved jurisdictional wetlands shall be in accordance with the
State of Florida Environmental Resource Permit Rules. Preserved jurisdictional
wetlands and surrounding buffers shall be incorporated in Conservation Areas

A Gopher Tortoise survey and relocation/management plan shall be submitted to

Minor variations in the development plan as it affects wetland areas will
be permitted to allow for preservation of additional xeric scrub upland habitat,
subject to environmental permitting agency approval.

IV. PROJECT DESCRIPTION:
The petitioner intends to construct a 785 unit residential subdivision within an 18
hole golf course. The total project area is 485.02 acres, and will also include
150,000 square feet of commercial/office space on 15+acres.

Services on October 10, 1997.
V. STAFF COMMENTS:
Water Management:
Naples Forest Golf& Country Club is located in the C-4 canal basin. Drainage in
the area is to the south and west. The water management system will utilize a
series of interconnected lakes and natural retention/detention areas to achieve
water quality improvement and peak flow attenuation.
The project covers 485 + acres total, of which 361 acres, including 69 acres of
lakes and 29 acres of preserve is within the stormwater management area. There
is some concern that historical flows in the area be maintained.
The preserve along the west property line functions as a flowway for drainage
from the region north of Naples Forest Country Club.

Environmental:
The subject property is an undeveloped 485 acre parcel of land located in the
northwest corner of County Road 951 and Rattlesnake Hammock Road. Native
habitats on site include hydric and non-hydric pine flatwoods, cypress forest,
herbaceus/rock outcropping, cypress/pine forest, freshwater marsh and wet prairie.
Past wildfires have left large areas in the northern portion of property severally
burned and heavily invaded by Melaleuca. The southern portion of the property is
less impacted by exotic vegetation. Habitat descriptions for each of the identified
FLUCCS codes on site are included in the environmental impact statement (EIS).
The table on page six of the EIS lists all the upland and wetland plant
communities, their total acres, acres impacted, and percentages of each habitat
modified by the proposed project. Approximately 141 acres (29 percent) of the
habitat on site will be retained as shown on the PUD master plan.
A total of 364.45 acres of Collier County/South Florida Water Management
District (SFWMD) jurisdictional wetlands have been identified on the subject
property. Of these approximately 246.73 acres will be impacted by development.
To offset wetland losses the petitioner proposes on site preservation and
restoration of 117.72 acres of wetlands and 23.23 acres of uplands.
Five soil types have been identified on the project site. These include (11)
Hallandale Fine Sand, (14) Pineda Fine Sand, Limestone Substratum, (21) Boca
Fine Sand, (25) Boca, Riviera, Limestone Substratum and Copeland Fine Sand
Depressional and (49) Hallandale and Boca Fine Sand (slough). Three of the five
soils are considered hydric by the U.S. Department of Agricultural - Natural
Resources Conservation Service (Soil Conservation Service). See the "Soils and
Topographic Exhibit" in the Environmental Impact Statement for the location of
soils on the subject property.
No U.S. Fish and Wildlife Service (USFWS) or Florida Game and Fresh Water
Fish Commission (FGFWFC) listed endangered species were observed on site by
the petitioner. Prior to this study, Turrel and Associates, Inc. also conducted an
endangered species survey, and found no listed species present. Red-cockaded
woodpeckers (RCW) are known to occur in the project area. Listed plant species
identified on site include air plants (Tillandsia spp.) and epiphytic ferns (Vittaria
lineata, Phlebodium aureum). These occur in the cypress domes, which will be
retained as preserve areas.

The project site is located in an area of historical/archaeological probability as
identified in the official historical/probability maps for Collier County. The
petitioner will need to submit an archaeological survey and assessment as required
in section 2.2.25.3.3 of the Collier County Land Development Code (CCLDC) or
request a waiver(2.2.25.3.10 CCLDC).
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-97-
16, "Naples Forest Country Club PUD" with the following stipulations:
Water Management:
1. The development project area shall be designed to consider regional
stormwater flows and include the passage of offsite flows from the north to
the south through the western portion of the property in a manner consistent
with project development plans.
2. The Developer shall grant the necessary drainage easements outside the
Naples Forest Surface Water Management System and within western
portions of the project to Collier County to provide adequate regional
stormwater management flowways and facilities. The easement shall be
granted after the Naples Forest has received permits from the State and
Federal agencies and within 90 days of receipt of the drainage easement
documents from Collier County. The easement rights shall be subject to and
consistent with Developer's development plans, including Developer's
wetland mitigation plans.
3. The Developer shall be responsible for providing, in a manner consistent with
Developer's project development plans, adequate facilities and/or flowways
necessary to pass through the project boundaries the offsite stormwater which
currently flows towards the Naples Forest property. Design of the
improvements shall be closely coordinated with the County Stormwater
Management Department to endeavor to maintain uniformly with the County's
Lely Area Stormwater Improvement project, currently under design.
A. The offsite flow rate will be calculated by the Developer's engineer and
accepted by the South Florida Water Management District (SFWMD)
based on existing permitted projects upstream. If Collier County
n disagrees with the offsite flow estimate, the County shall provide
supporting documentation to the Developer's engineer and the SFWMD.

A. At Developer election, such facilities may include,but are not limited to:
1. Regrading of the Naples Forest western easement area to
reestablish historic sheetflow along such portion of the property.
2. Excavation of small ponds in the flowway for additional storage
area.
3. Construction of a control structure to detain a portion of the offsite
flows. Design of such a control structure shall be by the
Developer's engineers. The control structure will be maintained by
Collier County and the Developer shall not have liability for
impacts to properties upstream due to the County's control of the
structure's control elevation. Collier County agrees to maintain the
control structure in a manner as described in these stormwater
conditions.
C. Collier County acknowledges that the Developer's commitment to
construct facilities to control offsite runoff may be precluded by the
inability to timely obtain the issuance of necessary permits. The
Developer's failure to timely obtain such permits that include the offsite
stormwater runoff faculties will not be considered a breach of these
stipulations. In such an event, the Developer agrees to provide the
necessary drainage easements (subject to and consistent with
Developer's use of the easement areas as described above) at a later date,
if Collier County obtains construction permits for the facilities as part of
the regional drainage basin improvements.
4. In the event a water level control structure in the flowway and/or
improvements to the capacity of the stormwater conveyance system along
Rattlesnake Hammock Road to regulate or improve off-site stormwater flows
is required by SFWMD as part of the Naples Forest project permitting, the
County shall reimburse the developer for the cost of such control structure
and/or improvements to the stormwater conveyance system along Rattlesnake
Hammock Road(less the developer's proportionate share of such cost) as soon
as reasonably possible and not later than the time an area wide funding
mechanism is established for stormwater improvements. Also, at the time of
such reimbursement, the County shall reimburse the developer for the cost of
excavating a flowway (excluding any cost related solely to aesthetics) along
the western portion of the property. The developer's proportionate share is

calculated based upon the Naples Forest development discharge to such
facility divided by the total regional discharge to such facility.
5. If any of the regional stormwater improvements cause additional wetland
impacts which must be mitigated in the Naples Forest permit, the County
will pay the Developer for the cost of such mitigation.
6. A South Florida Water Management District Surface Water Management
Permit will be required for this project prior to the start of any construction.
Environmental:
1. Amend Section 2.12 of the PUD document to read as follows by
adding the underlined language and deleting the ctruck through

Where the development of land within Naples Forest Country Club
PUD requires a permit from a local, state, or federal agency with

Pursuant to Subsection 2.7.3.3. of the Land Development Code, upon
adoption of the PUD Ordinance and attendant PUD Master Plan,the

Development Code, and shall be the standards of development for the
PUD. Thenceforth, development in the area delineated as the PUD
District on the Official Zoning Atlas will be governed by the adopted
development regulations and PUD Master Plan. Where-development
standards contained in the PUD document are set forth by reference to
the Land Development Code, at the time of adoption, and are made to
be lesc restrictive by future amendment(s) to the Land Development
Code, those less restrictive ctandards shall apply to this PUD;

3. Amend Section 7.8 D of the PUD document to read as follows by

The petitioner shall comply with the guidelines and recommendations
of the U.S. Fish and Wildlife Service (U&SFWS) and the Florida
Game and Fresh Water Fish Commission (FGFWFC) regarding
potential impacts to "listed species". Where protected species are
observed on site, a Habitat Management Plan for those protected
species shall be submitted to Current Planning environmental staff for

C.Y. of material is to be excavated with approximately 900 C.Y.
to remain on-site and the remainder to be sold and hauled off-
site .

One acre of the site has been reserved for a future homesite.
The portion of the lake, adjacent to the roadways, will be
screened by a natural opaque landscaped buffer. Additional
plantings will be required to effectively buffer the excavation
form adjacent properties.
The off-site hauling will be permitted for a period of 2 years.
Road impact fee will be submitted prior to issuance of the
excavation permit .

V. STAFF COMMENTS:
Water Management:
The excavation on the parcel of land will add to that parcel ' s
ability to retain water during storm events. The minor site
improvements required to serve the excavation operation will
not substantially impact stormwater quality or quantity Post -
development runoff will be less than pre-development runoff .
Environmental:
The subject property is an upland parcel of land located
adjacent to an existing canal within the Golden Gate Estates .
Pine flatwoods cover approximately half the property. The
remainder of the site is generally clear of vegetation.
VI. RECOMMENDATIONS:
Staff recommends approval of Commercial Excavation Permit No.
59-626 with the following stipulations :

Water Management:
1 . The excavation shall be limited to a bottom depth of 20 '
below control . All distributed areas proposed for lake
excavation shall be excavated to a minimum depth of 2 '
below control .
2 . Off-site removal of material shall be subject to "Standard
Conditions" imposed by the Transportation Services
Division in document dated 5/24/88 (copy attached) .
3 . The lake littoral zone shall be created and planted as
indicated on the Plan of Record.
4 . All provisions of Collier County Ordinance No. 91-102 ,
Division 3 . 5 shall be adhered to.
5 . Groundwater shall not be pumped during the excavating
operation.
6 . No blasting will be permitted unless issued a separate
permit by Collier County Engineering Review Services.
7 . Stockpile side slope shall be at a maximum of 4 : 1 unless
fencing is installed around the entire perimeter of the
stockpile area.
8 . No excavation permit shall be issued until all impact fees
have been paid. These fees will be determined by
Transportation Services Division.
Environmental:
1 . Petitioner shall obtain a vegetation removal permit prior to
clearing the property.

"STANDARD CONDITIONS"
EXCAVATION PERMIT APPLICATIONS INVOLVING
•
OFF-SITE REMOVAL OF MATERIAL
The intent of these "Standard Conditions" are to provide excavation
permit applicants a summary of conditions which may affect their
projects and which should be taken into consideration during all
stages of project development:
1. Haul routes between an excavation site and an arterial road
shall be private with property owner(s) approval or be a public
collector road built to standards applicable to handle the
resulting truck traffic. Where residential areas front
collector roads, appropriate turn lanes, buffer and bikepath
shall be required*as minimal site improvements and if
recommended for approval, shall be so with the condition that
the Transportation Services Administration reserves the right
to suspend or prohibit off-site removal of excavated material
should such removal create a hazardous road condition or
substantially deteriorate a road condition; such action by the
Transportation Services Administration shall be subject to
appeal before the Board of County Commissioners.
2. Haul routes utilizing public roads shall be subject to road
maintenance and road repair or an appropriate fair share by the
permittee in accordance with Excavation Ordinance No. 92-73 and
Right-of-Way Ordinance No. 82-91.

3 . Off-site removal of excavated material shall be subject to
Ordinance No. 92-22 (Road Impact Ordinance) . A traffic and
road impact analysis shall be made by the County to determine
the effects that off-site removal of excavated material will
have on the road system within the excavation project's zone of
influence. If appropriate, road impact febs in accordance with
Ordinance No. 92-22 shall be paid prior to the issuance of an
excavation permit.
4 . The Transportation Services Administration reserves the right
to establish emergency weight limits on public roadways
affected by the off-site removal of excavated material; the
procedure for establishment of weight limits shall be the
presentation of an applicable resolution before the Board of
County Commissioners. Should weight limits be instituted, the
permittee shall be responsible to implement measure to assure
that all heavy truck loadings leaving the permit's property
conform to the applicable weight restriction.
5. The Excavation Performance Guarantee shall apply- to excavation
operations and also the maintenance/repair of public roads in
accordance with current ordinances and applicable permit
stipulations.
6. Based on soil boring information per Ordinance No. 92-73, a
blasting permit may be appropriate. Should a blasting permit
application be submitted and should residential areas exist
within one mile of the excavation site, the County reserves the
right to deny a blasting permit based on concerns for off-site
impacts from blasting at an excavation site. Should a blasting
permit be considered and approved, the minimum conditions of
approval in addition to conditions per Ordinance No. 92-73 are
as follows:
A. Structure inventory/monitoring and applicable property
owner release as required by the Development Services
Director.
B. Security bond applicable to private property damage
acceptable to the County.
C. Control of size/depth/number of charges per blast by
the Development Services Director.
D. The right of the County to suspend and/or revoke
blasting permit authority should be determined that
blasting activities are creating unacceptable off-site
conditions either in terms of private property damage
and/or related physical effects of blasting
operations.
7 . No excavation permit shall be issued until receipt of a
_=^'• release from the Transportation Services Administration

V. STAFF COMMENTS:
Water Management:
This is the next phase of an existing subdivision. The water management system consists of side
and rear lot swales conveying runoff to the lake system.
f'N The only unusual feature is that flow appears to be going north, but it is a localized condition
confined to this phase.
Environmental:
The subject property is primarily undeveloped with the exception of two paved cul-de-sacs on the
north end of the property.Vegetation on site includes 5.94 acres of pine flatwoods and 14.47 acres
of cypress-pine-cabbage palm. A vegetation inventory and FLUCCS map for the project site are
included in the environmental impact statement.
Preservation requirements for the Bretonne Park PUD include 10.3 acres of"Wetland Preserve"
and 48.3 acres of "Upland Recreational Open Space" (UROS). Approximately 42.38 acres of
UROS and 10.46 acres of wetland preserve have been preserved within platted portions of the
PUD.An additional 5.91 acres of UROS still needs to be identified within the PUD.The petitioner
is proposing to preserve 1.52 acres of UROS with this project.
Approximately 14.47 acres of Collier County/South Florida Water Management District
jurisdictional wetlands occur on the subject property. Preservation for impacts to jurisdictional
wetlands have been mitigated for during the original permit process for the entire subdivision.
Four soil types have been identified on the subject property.These include(4)Chobee,Limestone
Substratum and Dania Mucks Depressional, (14) Pineda Fine Sand, Limestone Substratum, (18)
Riviera Fine Sand, Limestone Substratum and (21) Boca Fine Sand. Three of the four soils are
considered hydric by the Collier Soil and Water Conservation District.
A threatened and endangered species survey for the subject property was conducted in July -
August, 1997.Observations were performed during early morning(0730- 1000),mid-day(1100-
1500)and late-day(1500- 1800)time periods.No threatened and endangered fauna were

observed on the subject parcel.Records of site use by Red-Cockaded Woodpeckers are on file
with the Florida Game and Fresh Water Fish Commission(FGFWFC).Cavity tree reports of
several years ago indicated activity in the original permitting of the subdivision.No cavity trees
were identified on the subject property during this survey.
Several listed plants species(Tillandsia)were found on the project site by the petitioner.
Each is listed by the state of Florida primarily due to commercial reasons.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property. Correspondence from the
Florida Department of State, Division of Historical Resources, lists no archaeological sites,
historical standing structures or field surveys for Section 5, Township 50 South, Range 26 East,
Collier County,Florida.
VI. RECOMMENDATIONS:
Staff recommends approval of"Estate Villas of Embassy Woods", Subdivision Master Plan with
the following stipulations:
Water Management:
1. That the Developer obtain a modification to the SFWMD permit for Embassy Woods.
Environmental:
1. Permits or letters of exemption from the U.S.Army Corps of Engineers(ACOE)and
the South Florida Water Management District(SFWMD)shall be presented prior to
fmal plat/construction plan approval.
2. Upland Recreational Open Space (UROS) areas shall be recorded on the plat as
conservation/preservation areas with uses and limitations similar to or as per section
704.06 of the Florida statues. Conservation areas shall be dedicated on the plat to the
project's homeowners association or like entity for ownership and maintenance
responsibilities and to Collier County with no responsibility for maintenance. UROS
areas must average at least 25 feet wide.
3. An exotic vegetation removal / maintenance plan for the site, with emphasis on the
conservation/preservation areas,shall be included on the fmal construction plan.This
plan shall include the methods of exotic vegetation removal to be used within
conservation/preservation areas.

V. STAFF COMMENTS:
Water Management:
Magnolia Pond is a proposed 42-acre Planned Unit Development
located within the Main Golden Gate Canal Drainage Basin. The
proposed outfall for the project is the Golden Gate Canal
located north of the project which ultimately discharges into
the Gordon River.
The water management system will be permitted by South Florida
Water Management District (SFWMD) through the Environmental
Resource Permit process . All rules and regulations of SFWMD
will be imposed upon this project including but not limited to:
storm attenuation with a peak discharge rate of 0 . 15 cfs/acre,
minimum roadway centerline elevation, perimeter berm and
finished floor elevations, water quality pre-treatment and
wetland hydrology maintenance. Water management will be
provided for Access Road No. 2 .
The engineering consultant has stated that water management
calculations are not necessary at this time and will be
provided at time of development plan submittal .
Environmental:
The subject property covers approximately forty-two (42) acres
n including fourteen (14) acres of jurisdictional wetlands and
twenty-eight (28) acres of uplands .

Fourteen acres were identified as jurisdictional wetlands.
The canopy of the Pine-Cypress area was dominated by bald
cypress (Taxodium distichum) , slash pine (Pinus elliottii) and
cabbage palm (Sabal palmetto) with occasional melaleuca
(Melaleuca quinquenervia) . The balance of the vegetation
included wax myrtle (Myrica cerifera) , swamp fern (Blechnum
serrulatum) , saw grass (Cladium lamaicensis) , Brazilian
pepper (Schinus terebinthifolius) , myrsine (Myrsine floridana)
and salt bush (Baccharis halimifolia) .
The hydroperiod for the wetland has been altered due to the
construction of the Golden gate canal to the north and I-75 to
the south. The project will attempt to improve the hydroperiod
of the remaining portions of the isolated wetlands on the south
side of this development . Forty-three percent of the
identified wetlands will be impacted for this project
The uplands on site are divided between three major vegetative
communities. Pine flatwoods cover eighteen acres with the
remainder of the uplands being a one acre cabbage palm hammock
and sight and a half acres of palmetto islands. Slash pine and
cabbage palm made up the canopy of the flatwoods with an
understory of palmetto (Serenoa repens) , gallberry (Ilex
glabra) , myrsine, bracken fern (Pteridium actuilinum) melaleuca
and Brazilian pepper. Grape vine and poison ivy covered a fair
amount of this area. The cabbage palm hammock included Sabal
palms, palmetto, Sweet bay (Magnolia virginiana) , and Balsum
apple (Momordica charanita) . The palmetto islands included saw
palmetto, winged sumac (Rhus copallina) , gallberry and
occasional slash pine.
Protected species surveys were conducted on site in accordance
with the Florida Game and Fresh Water Fish Commission
guidelines . The only protected species observed on site were
Gopher tortoise (Gopherus polyphemus) . Seven active and one
inactive burrows were identified and mapped. The burrows were
found in the pine flatwoods and palmetto areas . All tortoises
will be relocated into the upland preserve.
VI. RECOMMENDATIONS:
Staff recommends approval of PUD 97-19 "Magnolia Pond" with
the following stipulations :
WATER MANAGEMENT:
SWFWMD Right-of-Way Permit and Discharge Permit for out-fall
into the Golden Gate Canal shall be submitted prior to
Development Plan approval .

ENVIRONMENTAL:
1 . The following language shall be added the environmental
section of the PUD document Section 4 . 10 :
A. "This PUD shall comply with the environmental sections
of the Collier County Land Development Code and Growth
Management Plan conservation and Coastal Management
Element at the time of final development order
approval . "
B. A Gopher tortoise relocation/management plan shall be
submitted to Current Planning Environmental Staff for
review and approval . A copy of the approved plan
language shall be included on the final Site Development
Plan. "
C. Prior to final development order approval (FSDP) the
petitioner shall submit a copy of the Florida Game and
Fresh Water Fish Commission Gopher Tortoise Permit .

V. STAFF COMMENTS:
Water Management:
The project consists of 11 each, 3-unit commercial office buildings and appurtenant parking
draining into a bermed preserve that discharges into the Airport Road canal.
Environmental:
The subject property is a rectangular shaped parcel of land located on the northeast corner of the
intersection of Airport-Pulling Road and Pine Ridge Road,just north of the Sports Authority.The
northwest corner of the site has an Special Treatment (ST) overlay. Impacts to ST designated
lands have been minimized and consist of a water management berm, as required by the South
Florida Water Management District (SFWMD). Proposed site improvements consisting of 11
commercial office buildings and associated parking have been placed outside the ST area.
Native plant communities on the subject property include cypress forest,pine-cypress transitional
wetlands and pine/palmetto flatwoods. Habitat descriptions for each of the FLUCCS codes
identified on site are included in the environmental impact statement. Lands within the ST area
consist primarily of a cypress forest.
Approximately 0.74 acres of Collier County/South Florida Water Management District(SFWMD)
jurisdictional wetlands occur on the subject property. The majority of the wetlands are located in
the ST area and will been preserved as shown on the proposed site plan. A mitigation plan is
included in the environmental impact statement.
The only soil type identified on the subject property is (21) Boca Fine Sand. This soil type is
considered non hydric by the Collier Soil and Water Conservation District.
An endangered species survey was conducted during the month of March, 1997. No endangered
animal or plant species were observed on the property during the survey.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Special Treatment Permit No. ST-97-2 "Enclave Professional
Center" with the following stipulations:
