Discussion on revised LDC Amendment. Motion made by Mr. Hill, seconded by Mr. Espinar and carried 4/1 to reaffirm motion made at last EAB meeting in regards to the administrative ability to grant waivers to preservation requirements. The EAB did however, support the language in the first part of the amendment,which clarified the bona fide agricultural uses definition. 2. Discussion on permit process for spoil bank removal along canal easements. NEW BUSINESS: Discussion on EPTAB. Board members agreed to support the motion made last year regarding the merger of EAB and EPTAB. That motion supported the merger and requested EAB be able to review and give input into any future EAB ordinance amendment. ******* COMMENTS: For a complete record of the proceedings reader is directed to the tape recording of this meeting, located in the Office of the Clerk to the Board, 5t'Floor, Building "F", Collier County, Government Complex. Environmental Advisory Board A Paul Hine•`y' , � hairman Min/h:\EAB Forms D-R-A-F-T 7-1-98 Consolidation of EAB and EPTAB Proposal Outline • Sunset both the EAB and EPTAB and create a new Environmental Advisory Board • Duties and Responsibilities of new board • Combine those currently listed for the EAB and EPTAB in their respective enabling ordinances • Membership • 9 members (EAB has 7; EPTAB has 11) • Same Qualifications as the existing boards. (Membership qualifications are the same for each board.) • Initial Appointing Process • Allow all current members of both boards the opportunity to submit their resumes for the new board. NAME OF PETITIONER/PROJECT: Petition No.: Planned Unit Development Petition No.PUD-98-5 Petition Name: Walgreens PUD Applicant/Developer: Olympia Development Group,Inc. Engineering Consultant: Q.Grady Minor&Associates,P.A. Environmental Consultant: Passarella and Associates,Inc. II. LOCATION: The subject property is an undeveloped 15.6 acre parcel located at the southwest corner of the intersection of Airport-Pulling Road and Vanderbilt Beach Road in Section 2,Township 49 South, Range 25 East,Collier County,Florida.The entire site is also located within an Activity Center as identified on the Future Land Use Map of the Collier County Growth Management Plan. III. DESCRIPTION OF SURROUNDING PROPERTIES: /"'N Commercial properties within the Activity Center are undeveloped at this time. PROJECT DESCRIPTION: The proposed project is a commercial shopping center with a maximum of 156,800 gross square feet of commercial development. STAFF COMMENTS: Water Management: The surface water management system for the commercial project will include a series of inlets and drainage pipes connected to a dry pretreatment area. This area will treat the first V2" of runoff and discharge it into a 0.76+ acre lake where further treatment and attenuation will occur. Discharge through a 4.5 inch circular orifice will be to the Airport Road swale. The swale will convey the discharge south to an existing 36" RCP which crosses Airport Road and discharges into the Airport Road Canal.Discharge from the site will be limited to.06 cfs/acre. Environmental: n The subject property is an upland parcel in its entirety. Native habitats on site include pine flatwoods (8.4 acres) and cypress (<0.lacres). Remaining lands within the PUD consist of disturbed habitat types(primarily fallow farmland). Two soil types have been identified on the subject property. These include (7) Immokalee Fine Sand and(17)Bassinger Fine Sand. Soil Map Unit 17 is listed as hydric by the Natural Resource Conservation Service. A listed plant and wildlife species survey was conducted by Passarella & Associates, Inc. on March 17, 1998. There were no listed plant or animal species identified within the property boundary during the survey. A review of the official Historical/Archaeological Probability Maps for Collier County indicate no archaeological or historical sites to be located on the subject property. Correspondence from the Florida Department of State, Division of Historical Resources, indicates no significant archaeological or historical sites recorded for or likely to be present within the project area. The letter further states that because of the project location and/or nature it is unlikely that any such sites will be affected. VI. RECOMMENDATIONS: Staff recommends approval of Planned Unit Development Petition No. PUD-98-5 with the following stipulations: Water Management: Big Cypress R/W Permit and Discharge Permit shall be submitted prior to fmal SDP approval. EAB Meeting July 1, 1998 PUD 98-5 "Walgreens PUD" Page 3 Environmental: 1. Amend section 2.2(A)of the PUD document by adding the underlined language. Regulations for development of Walgreens PUD shall be in accordance with the contents of this document, PUD-Planned Unit Development District and other applicable sections and parts of the Collier County Land Development Code and Growth Management Plan in effect at the time of building permit application. Where these regulations fail to provide development standards then the provisions of the most similar district in the Collier County Land Development Code shall apply. 2. Add the following stipulations to section 4.9 of the PUD document. Petitioner shall retain 1.27 acres of native vegetation on site or mitigate as required in section 3.9.5.5.4 CCLDC. An exotic vegetation removal,monitoring, and maintenance(exotic free)plan for the site, with emphasis on areas of retained native vegetation,shall be submitted to Current Planning Environmental Staff for review and approval prior to final site plan/construction plan approval. This project is located within a Collier County Groundwater Protection Zone and shall comply with the appropriate sections of the Groundwater Protection Ordinance No. 91-103 at the time of final development order approval. PROJECT DESCRIPTION: Windsong is a proposed single family subdivision with a maximum of 145 dwelling units, centrally located water management lake,recreational facilities and preserve areas. STAFF COMMENTS: Water Management: The proposed site will consist of 144 single family attached units served by an internal right-of- way,a central lake and wetland preserve area, and upland native and landscape buffers on all four sides of the property. The site is designed as one drainage basin with impervious areas consisting of residential units, roadways and lake. The lake will be used for water quality and quantity storage. At higher stages, storage will occur in the native vegetation areas and open space. The system will discharge from the lake via a control structure at the west property line.The proposed structure will limit discharge to the allowable 0.06 cfs/acre during the 25-year/3-day storm event. Bleed down of no more than 0.5 inches of the water quality volume per day will also be provided. The site has been isolated from off-site flows by the existing development on all four sides. The site naturally drains to the west toward the existing drainage ditch, then south under Rattlesnake Hammock Road through an existing 7'x4' box culvert. This flow is directed to East U.S. 41, southwesterly through a series of existing drainage ditches within the Lely Canal Basin. Environmental: Native habitats on site include pine flatwoods, pine/cypress mix and cypress forest. Approximately 9.74 acres(26%)of the native vegetation on site will be preserved as shown on the PUD master plan.Preserve areas include both uplands and wetlands. Approximately 5.5 acres of Collier County/South Florida Water Management District jurisdictional wetlands occur on the subject property of which approximately 1.5 acres will be impacted by development. In order to offset adverse impacts to wetlands, the petitioner proposes on site preservation, enhancement and restoration of remaining on site wetlands. Approximately 5.45 acres of mature pine flatwoods will also be preserved on site. Two soil types have been identified on the subject property. These include (16) Oldsmar Fine Sand and(17)Bassinger Fine Sand. The latter soil unit is listed as hydric by the Natural Resource Conservation Service. Approximately 20 hours were spent on the subject site to specifically conduct a threatened and endangered species survey. The daily sampling times varied, but were structured around early n morning (sunrise till approximately 2 hours after) and evening (approximately 1 hour before sunset till approximately 1 hour after).Of the 20 hours spent on the property,5 hours were spent EAB Meeting July 1, 1998 PUD-87-33(2) Page 3 /'\ sampling between 12:00pm (noon) and 2:00pm. There were no listed species observed on the subject property. A review of the official Historical/Archaeological Probability Maps for Collier County indicate no archaeological or historical sites to be located on the subject property. Correspondence from the Florida Department of State, Division of Historical Resources, lists no archaeological sites, historical standing structures or field surveys for Section 17, Township 50 South, Range 26 East, Collier County,Florida. VI. RECOMMENDATIONS: Staff recommends approval of Planned Unit Development Petition No. PUD-87-33(2) with the following stipulations: Water Management: Petitioner shall provide evidence of the adequacy of the outfall ditch along the west side of the development and provide, if necessary, before any development orders are issued, the required drainage easements for the ditch cross-section and adjacent maintenance access travelway. Environmental: 1. Amend section 4.2 of the PUD document by adding the underlined language. Regulations for development shall be in accordance with the contents of this document, PUD - Planned Unit Development District and other applicable sections and parts of the Collier County Land Development Code and Growth Management Plan. Residential areas designated on the Master Plan are to accommodate single family housing, essential services and customary accessory uses. 2. Delete stipulations 5.7(e)and 5.7(f)from the PUD document. 3. Add the following stipulations to the PUD document: Environmental permitting shall be in accordance with the state of Florida Environmental Resource Permit rules and be subject to review and approval by Current Planning Environmental Staff.Removal of exotic vegetation shall not be counted towards mitigation for impacts to Collier County jurisdictional wetlands. All conservation areas shall be recorded on the plat with protective covenants per or similar to section 704.06 of the Florida statues.Conservation areas shall be dedicated on the plat to the project's homeowners association or like entity for ownership and maintenance responsibilities and to Collier County with no responsibility for maintenance. Buffers shall be provided around wetlands,extending at least fifteen(15)feet landward from the edge of wetland preserves in all places and averaging twenty-five(25)feet from the landward edge of wetlands.Where natural buffers are not possible,structural buffers shall be provided in accordance with the state of Florida Environmental Resource Permit rules and be subject to review and approval by Current Planning Environmental Staff.
