PETITION NO: Excavation Permit No. EX 59.636
Stan Weeks Homesite& Commercial Excavation
REQUESTING: An excavation of a 1.9 acre lake on 5.6 acres of"Estates" zoned property.
REPRESENTED BY: Stan Weeks
MOTION: Made by Mr. Espinar, seconded by Ms. Dejong and carried 5/0, to approve
Excavation Permit No. EX 59.636 with added stipulations:
1. The excavation shall be limited to a bottom elevation of 16 ft.below existing grade.
2. Off-site removal of material shall be subject to "Standard Conditions" imposed by the
Transportation Services Division in document dated 5/24/88 (copy attached).
3. No blasting will be permitted unless issued a separate permit by Collier County Project Plan
Review,however,blasting appears to be unnecessary.
4. If trees are to be removed as a result of the excavating operation, a Tree Removal Permit,
required by Ordinance No. 92-73, Division 3.9 shall be obtained from Collier County
Project Plan Review before work shall commence.
5. A lake littoral zone may be created and planted if desired by the SFWMD.
6. All provisions of Collier County Ordinance No. 93-73,Division 3.5 shall be adhered to.
7. A 20 ft. maintenance easement dedicated to the SFWMD shall be provided around the
perimeter of the lake.
8. Necessary SFWMD, ACOE &DEP permits must be obtained prior to commencing
construction.
VI. OLD BUSINESS: Staff were directed by the EAB to send an letter, on behalf of the
EAB, inviting the South Florida Water Management District to attend future EAB
meetings. This letter is to be sent out on a monthly basis.
VII. NEW BUSINESS: Discussion on proposed LDC Amendments. A motion was made
by Ms. Dejong, seconded by Mr. Espinar and carried 5/0 for the EAB not to support the
language changes proposed in Section 3.9.5.5.5 CCLDC and that the Code should remain
unchanged. The motion included having petitioners request variances from the board for
exceptions from the preservation requirements in Division 3.9 CCLDC.
