EXECUTIVE SUMMARY
Recommendation to approve Amendment # 1 to Agreement # 13-6016 for Special Magistrate
Services for Code Enforcement with Brenda C. Garretson to extend the term for one additional
year and to increase the hourly rate of compensation from $175 to $200.
OBJECTIVE: To approve Amendment # 1 to Agreement # 13-6016 (the “Agreement”) for Special
Magistrate Services for Code Enforcement with Brenda C. Garretson to extend the term for one additional
year and to increase the hourly rate of compensation from $175 to $200.
CONSIDERATIONS: Brenda C. Garretson has been providing Special Magistrate services under
contract with the County since March 10, 2009. Ms. Garretson’s most recent contract with the County
(Agreement # 13-6016), has already been renewed for one two-year term and is scheduled to terminate on
May 15, 2017. Further, Ms. Garretson has never requested nor received any increase in her hourly rate of
compensation since the effective date of her initial contract with the County in 2009 . Copies of
Agreement # 13-6016, a related Assumption Agreement, and an Addendum to the Agreement are all
attached to the proposed Amendment.
Staff is requesting that Ms. Garretson’s term be extended one additional year to May 15, 2018, and that
her hourly rate of compensation be increased to $200 since there were no prior adjustments to her hourly
rate in over ten years and the requested increase is consistent with the low end of the hourly rate paid to
other general legal counsel employed by the County. A copy of the proposed Amendment Number 1 to
the Agreement providing for the term extension and rate increase is attached for review.
FISCAL IMPACT: There will be an additional fiscal impact of $25 per hour of services provided by the
Special Magistrate.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to
this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote
for Board approval. -SRT
RECOMMENDATION: To approve and authorize the Chairman to sign Amendment # 1 to Agreement
# 13-6016 (the “Agreement”) for Special Magistrate Services for Code Enforcement with Brenda C.
Garretson to extend her term for one additional year to May 15, 2018, and to increase the hourly rate of
compensation from $175 to $200.
