I. NAME OF PETITIONER/PROJECT:

II. LOCATION:
The subject property is located on the south side of Vanderbilt Beach Road between
Logan Blvd. and CR 951, within Section 4, Township 49 South, Range 26 East, Collier
County,Florida.
III. DESCRIPTION OF SURROUNDING PROPERTIES:
The subject parcel is bordered by Golden Gates Estates lots on three sides and by the
developing Islandwalk PUD to the north of Vanderbilt Beach Road extension.

IV. PROJECT DESCRIPTION:
The applicant is requesting a rezoning of approximately 25 acres of land from
Agricultural to Planned Unit Development to allow for a public cemetery with associated
ancillary uses. However, if the cemetery use fails to obtain all the required state permits,
the petitioner proposes an assisted living facility (ALF) and/or group care facilities as an
alternative to having a cemetery.
The proposed ALF structure will not exceed the maximum allowed Floor Area Ratio
(FAR) of 0.45 as provided for in Section 2.6.26.1 of the Land Development Code.

n This petition has been reviewed by the appropriate staff for compliance with the
applicable elements of the Growth Management Plan (GMP). The site is currently
designated Urban Mixed Use, Urban Residential on the Future Land Use Element
(FLUE). A description of Urban Mixed Use District in the FLUE advises that residential
uses are permitted at a base density of 4 dwelling units per acre. The Urban Designation
will also accommodate future non-residential uses including essential services. Other
permitted non-residential uses may include: community facilities, churches, cemeteries,
schools, day care and assisted living facilities (ALF). Because the ALF is a non-
residential use, the intensity of use is limited to a maximum floor area ratio (FAR) of.45
times the area of the property as required in Section 2.6.26.2.1 of the Land Development
Code. Since the proposed ALF building will not exceed a FAR of 0.45, this petition is
consistent with the FLUE to the GMP.

V. STAFF COMMENTS:
Water Management:
The water management system for the project will consist of two interconnected lakes.
Runoff from the project will be conveyed to the lakes through catch basins and culvert
systems. Discharge from the site will be through a control structure into the Harvey
Canal which runs along the east boundary of the property, then south to the Green Canal
and eventually west to the I-75 (D-2) Canal. The water management system is designed
for a 25 year 3 day storm event and will meet the requirements for water quality and
water quantity per SFWMD and Collier County criteria. This project will be permitted
for water management by Collier County.
Environmental:
The majority of the site is a Pine flatwoods made up of slash pine (Pinus elliottii),
cabbage palm (Sabal palmetto), saw palmetto (Serenoa repens) and native grasses.
Melaleuca was present in the midstory. The native vegetation requirement for this site is
25%(a minimum of 6.4 acres),which will be accomplished by retaining 4.4 acres on the

south side of the property and providing the additional 2 acres during the Site
Development Plan review process.
The soils on site are made up of two types; they are Malabar fine sand and Holopaw fine
sand. Malabar fine sand is categorized by the NRCS as hydric soils and is typically
poorly drained soil found in sloughs and poorly defined drainage ways. The Holopaw
fine sand is also a poorly drained soil categorized as hydric.
Threatened and endangered species surveys were conducted by Synecological Analysts;
indicating no species of special status were observed on site. However a potential exists
for the Big Cypress fox squirrel to use limited areas of the site.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-99-7,
PRC&M PUD,with the following stipulations:
Water Management:
1. A copy of the SFWMD Right-of-Way and Discharge Permit shall be submitted prior
to final SDP approval.
Environmental:
1. Remove the following Sections from the PUD document: 6.8 A, 6.8 C and 6.8G.
2. Replace Section 6.8 H, of the PUD document with, "A minimum of 6.4 acres of
native vegetation shall be retained on site. The Reserve Tract has been designated to
preserve 4.4 acres; the remaining 2 acres shall be identified at the time of SDP
submittal."
3. Revise Section 6.8 D of the PUD document with as follows " Petitioner shall comply
with the guidelines and recommendations of the U.S. Fish and Wildlife Service
(USFWS) and Florida Game and Freshwater Fish and Wildlife Conservation
Commission..."
4. Add the following language to Section 5.3 E of the of the PUD document, "The listed
permitted uses and structures may be allowed as long as they do not require removal
of native vegetation or evidence can be provided that the minimum 6.4 acres of native
vegetation has been preserved on site."
5. Replace Section 2.11 of the PUD document with the following language, " Pursuant
to Section 3.9.5.5.3 of the Collier County Land Development Code, 25% of the
viable naturally functioning native vegetation on site ( a minimum of 6.4 acres) shall
be retained. The Reserve Tract has been designated to preserve 4.4 acres; the
remaining 2 acres shall be identified at the time of SDP submittal"

Plan in effect at the time of issuance of any development order to which said
regulations relate which authorizes the construction of improvements. Where the
regulations of this PUD Document fail to provide developmental standards then the
provisions of the most similar district in the County Land Development Code shall
apply.

II. LOCATION:
The subject property is an undeveloped 2564 acre agricultural parcel in Sections 1&2,
Township 48 South, Range 27 East, and Sections 35&36, Township 47 South, Range 27 East,
Collier County, Florida. The parcel sits on the east side of CR 846 approximately one mile
north of the Collier County Fairgrounds

IV. PROJECT DESCRIPTION:
The petitioner proposes to excavate an 553 acre lake to a bottom elevation of approximately
+4.0 NGVD on 2564 acres of agriculturally zoned property.An estimated 13.3 million C.Y. of
material will be removed from the 15-foot deep excavation and hauled off-site to be used as fill.
The irregularly shaped finished lake will have a 17 acre island.
V. STAFF COMMENTS:
The proposed commercial excavation will occupy 553 acres of fallow farm field / improved
pasture(Florida Land Use Cover Index and Classification System code 211/261). There is a 17
acre non-functional cypress area that will be preserved as an island in the lake. Soil borings
show a fine sand down to a depth of about 10 to 20 feet. The petitioner intends excavating to
the rock,which will give an average depth of 15 feet. The borings were taken to a depth of 40
ft.. The"fetch formula", (LDC Sec.3.5.7.3.1)would allow a maximum depth of 65 ft.+/- from
original ground.

Since lakes contribute to storage capacity during wet season and have reserves during dry
season,no adverse water management impacts are expected.
A burrowing owl nesting season survey performed in May 1999 found 15 active and 4 old
burrows within 200 feet of the excavation. A total of 12 adult birds and one juvenile were
observed during the survey.
The agriculturally zoned land to the north contains a few small commercial excavations, the
largest of which, Longan Lakes, is an 82 acre lake to a depth of 36 ft on a 105 acre parcel that
will generate 4.5 million CY of material(sand). The remainder of the excavations are less than
20 acres apiece.
Prior to the approval of the Conditional Use portion of this petition by the Board of County
Commissioners,the petitioner shall provide an exotic vegetation removal and maintenance plan
per CCLDC Section 3.9.6.6.5, addressing exotic removal for the entire site for inclusion in the
package to be reviewed by the Board.
VI. RECOMMENDATIONS:
VII.
That the Environmental Advisory Board approve Commercial Excavation Permit No. EX
59.703 with the following stipulations:
1. The petitioner must apply for a Vegetation Removal Permit.Environmental Staff shall
perform a site visit to determine the need for a Vegetation Removal Permit and to check for
any listed species.No work shall be done prior to that site visit.
2. The excavation will be limited to a bottom elevation of-1.0 NGVD
3. No blasting will be permitted.
4. A lake littoral zone equivalent to 10%of the lake perimeter will be planted prior to fmal
acceptance.
5. A 20-foot maintenance easement dedicated to Collier County shall be provided around the
perimeter of the lake.
6. Off-site removal of material shall be subject to"standard conditions"imposed by the
Transportation Services Division in the attached document dated May 24, 1988.
7. Provide all necessary wetland permits prior to obtaining the vegetation removal permit.
8. Prior to obtaining the vegetation removal permit that is required in conjunction with the
excavation permit,the petitioner shall provide letters from US Fish and Wildlife Service
and the Florida Fish and Wildlife Conservation Commission resolving all wildlife issues on
site,i.e.,burrowing owls,Florida panther,Florida black bear,Wood stork,etc.

"STANDARD CONDITIONS"
EXCAVATION PERMIT APPLICATIONS INVOLVING
OFF-SITE REMOVAL OF MATERIAL
The intent of these "Standard Conditions" are to provide excavation permit applicants a summary of
conditions which may affect their projects and which should be taken into consideration during all
stages of project development:
1. Haul routes between an excavation site and an arterial road shall be private with property
owner(s) approval or be a public collector road built to standards applicable to handle the
resulting truck traffic. Where residential areas front collector roads, appropriate turn lanes,
buffer and bikepath shall be required as minimal site improvements and if recommended for
approval, shall be so with the condition that the Transportation Services Administration
reserves the right to suspend or prohibit off-site removal of excavated material should such
removal create a hazardous road condition or substantially deteriorate a road condition; such
action by the Transportation Services Administration shall be subject to appeal before the
Board of County Commissioners.
2. Haul routes utilizing public roads shall be subject to road maintenance and road repair or an
appropriate fair share by the permittee in accordance with Excavation Ordinance No. 91-102
as amended Div. 3.5 and Right-of-Way Ordinance No. 93-64.
3. Off-site removal of excavated material shall be subject to Ordinance No. 92-22 (Road
Impact Ordinance). A traffic and road impact analysis shall be made by the County to
determine the effects that off-site removal of excavated material will have on the road
system within the excavation project's zone of influence. If appropriate, road impact fees in
accordance with Ordinance No. 92-22 shall be paid prior to the issuance of an excavation
permit.
4. The Transportation Services Administration reserves the right to establish emergency weight
limits on public roadways affected by the off-site removal of excavated material; the
procedure for establishment of weight limits shall be the presentation of an applicable
resolution before the Board of County Commissioners. Should weight limits be instituted,
the permittee shall be responsible to implement measures to assure that all heavy truck
loadings leaving the permit's property conform to the applicable weight restriction.
5. The Excavation Performance Guarantee shall apply to excavation operations and also the
maintenance/repair of public roads in accordance with current ordinances and applicable
permit stipulations.

6. Based on soil boring information per Ordinance No. 91-102 as amended, a blasting permit
may be appropriate. Should a blasting permit application be submitted and should
residential areas exist within one mile of the excavation site, the County reserves the right to
deny a blasting permit based on concerns for off-site impacts from blasting at an excavation
site. Should a blasting permit be considered and approved, the minimum conditions of
approval in addition to conditions per Ordinance No. 91-102 as amended are as follows:
A. Structure inventory/monitoring and applicable property owner release as required by
the Development Services Director.
B. Security bond applicable to private property damage acceptable to the County.
C. Control of size/depth/number of charges per blast by the Development Services
Director.
D. The right of the County to suspend and/or revoke blasting permit authority should it
be determined that blasting activities are creating unacceptable off-site conditions
either in terms of private property damage and/or related physical effects of blasting
operations.
7. No excavation permit shall be issued until receipt of a release from the Transportation
Services Administration applicable to proper mitigation of off-site impacts, meeting of
applicable provisions of Ordinance No. 93-64, Ordinance No. 92-22, and Ordinance No.
91-102 as amended.

IV. PROJECT DESCRIPTION:
The petitioner seeks conditional use approval to allow for the construction of a 36-hole golf
course and related facilities while retaining their entitlement to construct residential dwellings as
permitted in the Agricultural District.It is anticipated that portions of the project will include both
a public and a private golf course and related clubhouse facilities.Because the Agriculture zoning
district permits single family residential dwellings,the petitioner proposes to build dwelling units
on two residential tracts which are depicted on the conceptual land use plan. It should be noted

that the residential component of the proposed development is not part of this conditional use
petition for a golf course. Conversely, a golf course can be an accessory use to the permitted
single family residential development if it serves as an integral part of a residential development.
However, since petitioner also proposes to operate a public golf course for nonresidents, a
conditional use is therefore required.The conceptual land use plan also indicates that the proposed
development is only accessed from Immokalee Road with no interconnection points to the
adjacent properties. In addition,the conceptual plan indicates that the golf course area comprises
314.2 acres while 63.3 acres have been provided for the conservation area and 54.1 acres for
lakes. The remaining land use area include 41 acres for future residential development, 7.9 acres
for other recreational amenities,2.7 acre maintenance facility and 16.8 acres for right-of-way.
The project is proposed to be constructed in two phases with construction planned to begin in June
2000.Phase one will consist of the golf courses and related facilities and phase two will consist of
the residential component. This petition has been reviewed by the appropriate staff for
compliance with the applicable elements of the Growth Management Plan (GMP). The Land
Development Code establishes a procedure which may result in approving a development order
for a golf course in the agricultural zoning district. Consistency relationships with applicable
elements of the Comprehensive Plan are as follows: The subject property lies within the
Agricultural/Rural and Agricultural Residential Sub-district as designated within the Future
Land Use Element(FLUE)of the Growth Management Plan (GMP). This land use classification
provides for those areas that are remote from the existing development pattern, lack public
facilities and services or are in agricultural production. The maximum density in this area is 1
dwelling unit per 5 acres,while non-residential uses such as schools, day care, churches and golf
courses are conditionally permitted. It should be noted that as a result of a Final Order issued by
the Governor and Cabinet, sitting as the Administration Commission, interim development
provisions were adopted for this area that became effective on June 22, 1999. Since this
conditional use application was deemed complete and filed prior to that date, it can be processed
and considered under the Collier County comprehensive plan as it existed and was in effect on
June 22"a as noted above. Therefore, the proposed golf course conditional use is consistent with
the GMP

V. STAFF COMMENTS:
Water Management:
The surface water management for this project will be reviewed by the South Florida Water
Management District and therefore is exempt from review by the Environmental Advisory
Council(5.13.6 CCLDC).
Environmental:
Native habitats on-site consist of a mix of pine flatwoods with graminoid understory, pine
n flatwoods with palmetto understory, palmetto prairie, mixed pine and cypress, cypress, and
cabbage palm. Also present on-site are areas which have been cleared or partially cleared in the
past and in various stages of succession. Melaleuca and Brazilian pepper are also present to
varying degrees.

Pre-development surface water flow patterns consist of overland flow to on-site depressional areas
within the project and to the southwest boundary. The existing topography ranges from elevations
of 14.0 feet-NGVD along the project's northern boundary abutting the Immokalee Road right-of-
way to an elevation 13.0 feet-NGVD located on the project's southern side.
The approximate soil map-unit boundaries as originally mapped by the Natural Resources
Conservation Service at a 1:24,000 scale are shown on exhibit F in the EIS.According to the map,
four soil types occur on the subject property, Oldsmar fme sand, limestone substratum(Unit 10),
Hallandale fme sand(Unit 11), Riviera fme sand, limestone substratum(Unit 18), and Boca fme
sand (Unit 21). Only one of the soil types, Riviera fine sand, limestone substratum(Unit 18), is
considered hydric by the Natural Resources Conservation Service.
The applicant proposes impacts to approximately 39.3 acres of approximately 83.9 total acres of
South Florida Water Management District(SFWMD)/Collier County jurisdictional wetlands. The
project was designed to avoid wetland areas as much as possible,while maximizing
use of the site. Conservation areas were designed to be contiguous and continuous with natural
areas adjacent to the property boundary to preserve habitat and maintain a wildlife corridor for the
area.
In order to compensate for impacts resulting from development activities in wetlands, the
petitioner proposes to preserve and enhance approximately 44.0 acres of on-site wetlands.
Enhancement of wetlands will consist of removal of exotic vegetation together with planting of
desirable native species to restore historic vegetation associations. It may also be possible to
enhance the degraded hydrologic conditions within the preserved wetlands. Final mitigation will
be determined during State and Federal permitting.
The petitioner estimates, based on preliminary site design, that approximately 106 acres of
uplands will be incorporated into the golf course open space. Approximately 19.3 acres of these
uplands will be incorporated into the proposed conservation areas for the project. These uplands
will act as buffers to the wetlands within the conservation areas and will also provide some habitat
diversity.
A listed species survey was performed during March 1999 for plant species and in June 1999 for
wildlife species. Plant communities were surveyed by using a combination of aerial photo
interpretation and extensive ground-truthing via pedestrian transects. The aerial photos were
blueline prints at a scale of 1":200'. No Federally listed threatened or endangered plant species
were observed. Plant species that are protected from unauthorized harvest and commercial
exploitation by the Florida Department of Agricultural (FDA) were observed on site. These
include dahoon holly(Ilex cassine)and three species of air plants(Tilandsia setacea,T.balbisiana
and T.circinata).
For wildlife species surveys,aerial photographs were used to identify potential habitat and to plan
transects.Pedestrian transects were conducted on seven days in early morning and evening during
the period from June 4 through June 12, 1999. No State or Federal endangered wildlife species
were observed. The gopher tortoise is listed as a "Species of Special Concern" and the Big
Cypress fox squirrel is listed as Threatened by the State of Florida.Both species are present on site
in small numbers. The eastern indigo snake was not seen but could be present due to suitable
habitat. It is listed as Threatened on both the State and Federal lists. Locations for observations of
Big Cypress fox squirrel, gopher tortoise burrows, and a red-tailed hawk's nest are plotted on
Exhibit D in the EIS.

VI. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No. CU-99-17 "Section 25 Conditional
Use"with the following stipulations:
Environmental:
1. An appropriate portion of native vegetation shall be retained on site as required in section
3.9.5.5.4 of the Collier County Land Development Code.
2. An exotic vegetation removal,monitoring, and maintenance (exotic free)plan for the site,
with emphasis on areas of retained native vegetation, shall be submitted to Current
Planning Environmental Staff for review and approval prior to fmal site plan/construction
plan approval. This plan shall include methods and time schedule for removal of exotic
vegetation within areas of retained native vegetation.
