Water Management:
1. A copyof the SFWMD Surface Water Permit shall be submitted prior to final
construction plan approval.
2. An Excavation Permit will be required for the proposed lake in accordance with
Division 3.5 of the Collier County LDC and SFWMD rules.
3. Prior to issuance of a Certificate of Occupancy, an 80-foot wide Drainage Easement
along the entire Davis Boulevard frontage, including an unencumbered 25-foot-wide
maintenance access travelway along the north side of the Drainage Easement, shall
be recorded and dedicated to Collier County.
4. In coordination with plans for the Lely Branch Canal,the Developer shall excavate a
55-foot top width canal within the 80-foot Drainage Easement with the bottom
width, bottom elevation, and side slopes as specified by the County Stormwater
Management Department. This shall be completed prior to the issuance of a
Certificate of Occupancy.
5. At time of construction plan submittal the 24" RCP under the project entrance (as
shown on the water management plan) shall be revised to a 30" RCP.
6. A Collier County R/W Permit will be required for construction within the Davis
Boulevard Canal.

Mr. Espinar abstained from the vote.
1. The excavation shall be limited to a bottom elevation of 20 feet below existing grade and
shall be no shallower than 10 feet below existing grade.
2. Offsite removal of material shall be subject to standard conditions imposed by the
Transportation Department(attached).
3. No blasting will be permitted.
4. Petitioner must submit an application for a Vegetation Removal Permit. Upon receipt of
the application, environmental staff shall perform a site visit to check for listed species. No
work shall be done prior to issuance of that Permit.
5. Petitioner shall obtain a jurisdictional determination from ACOE and SFWMD and may
have to modify the excavation plan accordingly. Petitioner shall obtain necessary permits
from ACOE and SFWMD, prior to obtaining the vegetation removal permit from Collier
County.
6. If any portion of the excavation is closer than 50' to the property line, fencing or some type
of access control must be used.
7. Prior to completion of the excavation, all exotic vegetation as defined by Collier County
Land Development Code Section 3.9.6.4.1 shall be removed from the entire site and the
property owner shall be responsible for subsequent annual exotic removal.

Environmental:
1. Under Section 2.3, Table I, of the PUD document,the acreage for tract P shall
be revised to reflect 10.3 acres. That acreage figure shall be revised wherever
necessary throughout the PUD document.
2. Under Section 2.13, of the PUD document, the following language changes
shall be made. "Pursuant to ... a minimum of 10.3 acres ( 25% of the viable
naturally functioning native vegetation on site)is required to be retained. Thio

3. Add the following language to the end of Section 5.8E, of the PUD document,
"A commitment to scheduling of initial exotic vegetation removal within all

shall be consistent with the Environmental sections of the Collier County Growth
Management Plan Conservation and Coastal Management Element and the Collier
County Land Development Code at the time of final development order approval".
5. Add the following stipulation to Section 5.8 of the PUD document, " At the
time of the next development order submittal, the petitioner shall provide
copies of their SFWMD, ERP applications and proposed mitigation for loss of
wetlands on site."
6. Add the following stipulation to Section 5.8 of the PUD document, " The EIS
shall be re-written and submitted for review and approval, within 90 days of
the BCC approval, so that a complete and accurate EIS is on file with Collier
County Community Development and Environmental Services. A new red-
cockaded woodpecker survey shall be conducted in accordance with the
FGFWFC and USFWS guidelines, and submitted for review and approval, as
an amendment to the EIS. Technical assistance shall be requested from these
agencies during the review process. No further Collier County final
development orders shall be approved until a complete and sufficient EIS is
reviewed and approved by County Environmental Staff."
7. Add the following stipulation to Section 5.8 of the PUD document, "The
impacts to the SFWMD delineated wetlands on site shall be mitigated at a ratio
no less than 1:1 (acre for acre)."
Water Management:
1. A SFWMD Surface Water management Permit must be obtained prior to any
construction approvals.

II. LOCATION:
The project is a 261.8 acre largely undeveloped tract north of the east end of Vanderbilt Beach
Road Extension in Section 36,Township 48 South,Range 26 East,Collier County,Florida.
III. DESCRIPTION OF SURROUNDING PROPERTIES:
Surrounding properties are a mix of Golf Course, Agricultural Mobil Home, Estates, and
Agricultural undeveloped.

IV. PROJECT DESCRIPTION : The Conditional Use for this project was approved by the EAB on
7 Oct 98, by the CCPC on 3 Dec 98, and by the BCC as Resolution 99.61 on 12 Jan 99. This
Commercial Excavation Permit is being applied for because it falls over the 500,000 c.y.threshold
in the LDC, and the developer has chosen to do it as a commercial permit with no offsite hauling
instead of as a development permit.
The proposed project includes a public golf course, club house, ACOE Wetland Preserve, and
Lakes. The Conditional Use Site Plan depicts an 18 hole golf course extending north from the
east end of Vanderbilt beach Road Extension. The hydrology and ground water table of the area
has been altered by the existing drainage canals. The Water Management System consists of
several interconnected lakes and excludes the wetland preserve area. The discharge will be to the
south under Vanderbilt Beach Road Extension into the Cypress Canal below the existing weir.
Water will flow west then south to the Main Golden Gate Canal and Naples Bay.

monitoring period the ground water table remained greater than 22" below land surface.
Approximately 86%of the designated wetlands have been preserved.

V. STAFF COMMENTS:
Water Management:
Conditional uses do not have a provision for water management review pursuant to the Land
Development Code. Water management issues will be reviewed at time of construction plan
submittal.

Most of the proposed project is undeveloped native habitat(83%). Pine flatwoods and pine mixed
forests account for most of the native habitat. The ACOE is the only agency exerting jurisdiction
over the wetland habitat due to altered hydrology. The canal systems have lowered the ground
water table such that in the project wetland habitats ground water is greater than 22”below ground
surface even at the end of the wet season in a normal year. The applicant states that withdrawal of
potable and non-potable groundwater for the project will be in accordance with the SFWMD
Water Use Permit which will dictate no adverse effect on groundwater drawdown. Fire has also
impacted the area. Approximately 42%of the project area has been impacted by fire(including
the two areas in the above pictures).
Impacts to the wetland habitat has been limited to 14%of the existing ACOE wetlands.
Six soil types occur on the subject property. These include (2) Holopaw fme sand, limestone
substratum, (10) Oldsmar fme sand, limestone substratum, (11)Hallandale fme sand, (14)Pineda
fme sand,limestone substratum,(16)Oldsmar fme sand,and(18)Riviera fme sand,limestone

substratum. Soils map units number 2,14 and 18 are considered hydric by the Natural Resource
Conservation Service.
The subject property was surveyed on several occasions between July and October of 1997 for the
presence of listed species. In order to review the site for the presence of listed species per Florida
Game and Fresh Water Fish Commission(FGFWFC)guidelines,the site was surveyed during the
morning and evening hours on at least five separate occasions. The survey revealed the presence
of no listed species on the subject parcel.
A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property.
VI. RECOMMENDATIONS:
Staff recommends approval of Commercial Excavation Permit 59.683 with the following
stipulations:
Environmental:
Permits or letters of exemption from the U.S.Army Corps of Engineers(ACOE)and the South
Florida Water Management District(SFWMD)shall be presented prior to fmal site
plan/construction plan approval.
Water Management:
1. The excavation shall be limited to a bottom elevation of 12 feet below the wet season water
table.
2. No material shall be removed from the site.
3. The lake littoral zone shall be created and planted as indicated on the Plan of Record.
4. In order to ensure a minimum eighty percent (80%) coverage of littoral zone planting
areas, a performance guarantee, based on a cost estimate to replace the original installed
littoral zone plants, will be required upon completion and acceptance of the excavation
(Land Development Code 3.5.7.2.5).No Certificates of Occupancy will be issued until this
performance guarantee is submitted.
5. All provisions of Collier County Ordinance No.91-102,Division 3.5 shall be adhered to.
6. Where groundwater is proposed to be pumped during the excavating operation, a
Dewatering Permit shall be obtained from the South Florida Water Management District,
and a copy provided to Engineering Review Services for approval prior to the
commencement of any dewatering activity on the site.
7. No blasting will be permitted unless issued a separate permit by Collier County
Engineering Review Services.
8. The petitioner must apply for a Vegetation Removal Permit.Environmental Staff shall
perform a site visit to determine the need for a Vegetation Removal Permit and to check for
any listed species.No work shall be done prior to that site visit.

9. Stockpile side slope shall be at a maximum of 4:1 unless fencing is installed around the
entire perimeter of the stockpile area.
10. Any stockpile in place for a period exceeding 60 days shall be seeded and mulched and
erosion control devices installed.
11. Preliminary work authorization must be obtained prior to starting construction.

IV. PROJECT DESCRIPTION:
The proposed project is a residential golf course community with a private 36 hole golf course,
552 residential dwelling units, recreational amenities, 3.5 acre neighborhood commercial center,
water management lakes and preserve areas.The neighborhood commercial center is not depicted
on the PUD master plan, but has been provided for in the PUD document, pending future
amendments to the Growth Management Plan and Land Development Code. The subject property
is located half in the Urban Residential Fringe District and half in the Agricultural/Rural area as
designated on the Future Land Use Map of the Collier County Growth Management Plan. Access
to the subject property is provided through Section 12 from US 41 via an 80 foot wide private
road easement.

V. STAFF COMMENTS:
Water Management:
The water management aspects of this project will be reviewed and permitted by the SFWMD.
Environmental:
The subject property is located on the west side of Greenway Road, approximately one mile north
of US 41, immediately south of the Belle Meade Area, and east of the headwaters of Henderson
Creek. The north half and southeastern quarter of the site have been converted to agricultural
croplands and associated land uses (approximately 512 acres), with the exception of two small
wetland areas(approximately 9 acres)within the southeastern quarter section.
Although the north half of the section was placed into cultivation in the 1970's, it was not until
May of 1990 that a Water Management District permit was issued for farming the south half of
the property. This permit authorized the clearing of the entire southeastern quarter section, and
approximately fifty percent(50%) of the southwestern quarter section, with approximately 14.16
acres of wetland impacts. However, only the easterly quarter section was cleared and placed into
cultivation,with only a water management detention area incorporated into the northern portion of
the westerly quarter section. No wetland impacts were associated with this clearing activity, and
only minor impacts were associated with the construction of the water management berms and
ditches.
Existing grades on site vary from over 7 feet in the northeast to approximately 5 feet in the
southwest corner. The control elevation is proposed to be 6.0 feet NGVD, which is the current
permitted shut-down elevation for the agricultural operation. The property is completely bermed
and receives no offsite runoff through the property.
Native habitats on site consist of approximately 101.76 of pine-palmetto associated uplands and
approximately 56.41 acres of cypress/pine.Page 8 of the Environmental Impact Study lists all the
habitat types found on the site,including FLUCFCS codes and acreage for each habitat. The PUD
master plan provides for 68 acres of preserve area, which will include 16.88 acres of wetland
preservation, 37.51 acres of uplands to be preserved or restored to wetlands and 13.64 acres of
created marsh habitat,in areas which were previously farmed.

Mitigation, specifically will involve the following activities: The 50 - 75% exotic invaded areas
will be selectively cleared,regraded where feasible, to establish an irregular grade ranging from-
1.0 to -2.5 feet below maintained water elevation, and revegetated within the cleared areas. The
76%or grater exotic invaded areas will be surveyed for viable vegetative clusters which are to be
flagged and preserved, and the remaining areas will be mechanically cleared and regraded to
establish an irregular grade ranging from-1.0 to -4.5 feet below maintained water elevation. The
average grades for both areas will be -1.5 feet, with occasional depressions at -4.5 feet, having
side slopes at 6:1. All areas which are cleared and regraded to a depth of -1.5 feet will be
revegetated with indigenous wetland vegetation. All viable upland habitats located within the
preserve will be enhanced by exotic removal and preserved to provide ecotonal areas,buffers and
corridors for wildlife.
The U.S. Soil Conservation Service's Soils Map reveals nine (9) soil types on the subject
property. Holopaw fine sand, limestone substratum(2) comprises approximately 40% of the site
and is found throughout the property. Malabar fine sand(3)makes up approximately 3%, limited
to the southeast corner of the property.Another 5%of the site is comprised of Oldsmar fine sand,
limestone substratum(10), this soil is scattered in islands throughout the north half of the subject
property. Pineda fine sand, limestone substratum(14) comprises approximately 20% of the soils,
while Boca, Riveria, limestone substratum(25) comprises approximately 12%,both of these soils
are found throughout the site.Bassinger fme sand(17)and Fort Drum and Malabar High fme sand
(20), comprising 10% of the site collectively, are limited to an island in the southeast quadrant.
Boca fme sand(21)and Hallandale and Boca fme sand,slough(49)collectively comprises 10%of
the site and are limited to the northeast quadrant of the site.
An endangered species survey was conduced during the months of August, 1998 and again in
January and February of 1999.Nine listed endangered or threatened species, or species of special
concern were observed during the two survey events, totaling nine days in the field. No red-
cockaded woodpecker (RCW) cavity trees, or RCW activity were observed during any of the
survey events.Listed species,as observed by the applicant,are as follows:
Two immature bald eagles have been observed on several occasions,flying over the southwestern
edge of the property during the January and February surveys. These may have been attracted to
the numerous large fish located in the agricultural ditches,as the birds have been observed making
several low flights over these ditches.No eagle nests were observed or known to occur in the area.
However,there are nests to the southwest and southeast,near the coastal waters.
On several occasions, three sand hill cranes were observed within the eastern portion of the
northern cultivated field. When observed flying, they typically fly to the east or are coming from
the east. Approximately one and a half mile to the east of the subject property is a large pasture
and native pasture mix, which is prime sand hill crane habitat. It is assumed that they fly to and
from there,and come into the field to forage on frogs,snakes,large insects and small rodents.
There have been two kestrels observed regularly along the eastern portion of the northern
cultivated field, and have been seen landing on the powerlines located along Greenway Road.
They have not been observed anywhere else within the property.
There are approximately 7 miles of ditches which retain water for most of the year. Typically,
during the survey,wood storks,white ibis,great egret, snowy egret and little blue heron would be
observed somewhere along the ditches. Occasionally,following rain events,the farm fields would
• have dozens of wading birds foraging in large flocks.During drier periods they would concentrate
around the deeper ditches,where the fish collect in large numbers and are easy to catch. Evidence
of American alligators has also been observed in the area of the ditches.

A review of the official Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites to be located on the subject property. Correspondence from the
Florida Department of State, Division of Historical Resources, indicates no significant
archaeological or historical sites are recorded for or likely to be present within the project area.
The letter further states that because of the project location and/or nature it is unlikely that any
such sites will be affected.
VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development No. PUD-99-03 "Naples Reserve Golf
Club"with the following stipulations:
Water Management:
A copy of the SFWMD surface water management permit must be received by the Development
Services Staff prior to any construction drawing approvals.
Environmental:
No additional stipulations.

II. LOCATION:
The subject property is an undeveloped 130 acre site located south of Immokalee Road, adjacent
to and east of Interstate 75 right-of way in Section 30,Township 48 South,Range 26 East,Collier
County,Florida.

The subject property is proposed for 8.6 acres of commercially zoned land along Immokalee Road
and 121 acres of residentially zoned land to the south. A mix of single family and multifamily
tracts will surround one large lake, several smaller lakes and the appropriate amount of
preservation areas. Access to the site is proposed off Immokalee Road, 20th Avenue NW and 18t
Avenue NW.

V. STAFF COMMENTS:
Water Management:
The Project utilizes a standard design employing a series of interconnected lakes to provide water
quality retention and peak flow attenuation prior to discharge into a wetland preserve that
sheetflows into the D-2(I-75)Canal. Since the total area is in excess of 40 acres,the project falls
under the jurisdiction of the SFWMD,who will issue the Surface Water Management Permit.
Environmental:
The subject property is approximately 130 acres to be developed as a mix of commercial and
residential uses. The site consists of 23.6 acres of wetlands,a 15.7 acre borrow pit and 90.6 acres
of uplands. A 4.5 acre Willow head exists on site and will be set aside in a preservation area.
The remaining wetland consists of Slash pine-Cypress-Cabbage palm community. The dominant
upland forest types on site include Slash pine/palmetto and Slash pine/Cabbage palm,Cypress.
A thorough plant list is given for each community as a part of the EIS.
The only listed species observed on site by the petitioner were Gopher tortoise(Gopherus
polyphemus). One active burrow was found in the south-east corner of the property. Big cypress
Fox Squirrels(Sciurus niger avicenni4)are known to occur in the project area but were not
observed during the recent survey. Red-cockaded woodpeckers(Picoides borealis)may have used
the site historically,but were not observed throughout the recently completed foraging survey.
The site contains four types of soils. Holopaw FS and Pineda FS are both hydric soils and
Hallandale FS and Boca FS are non-hydic.
A review of the Historical/Archaeological Probability Maps for Collier County indicate no
archaeological or historical sites located within the project area. A letter from the Florida
�'l Department of State,Division of Historical Resources is included in the EIS.
— VI. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No. PUD-99-1, Malibu Lakes,
with the following stipulations:
Water Management:
1. A copy of the SFWMD Surface Water Permit application shall be sent to Collier County
Development Services with the SDP submittal.
2. A copy of the SFWMD Surface Water Permit shall be submitted prior to Final SDP approval.
3. Lake setbacks from the PUD perimeter can be reduced to 25 feet where a 6 ft. high fence or
suitably substantial barrier is erected.

While convened in regular session on April 13, 1999, the Board of County Commissioners
appointed members to the newly created Environmental Advisory Council pursuant to Ordinance
No. 99-6. Section 5.13.1 states that the Environmental Advisory Board is hereby abolished as of
120 days after the effective date of this amendment or the first meeting of the EAC, whichever
occurs earlier. The first meeting of the EAC has been scheduled for May 5, 1999.

agency as defined in Section 112.312(2), Florida Statutes) by whom he is retained.
In any such case a local public officer must disclose the conflict:
(a) PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of his interest in the matter on which he is
abstaining from voting; and
