At the time the property owners, were told by building and zoning officials, said that they did not need permits for these; however, the county now believes that they do need permits. 5. The tents and other matters should only have to meet the codes that were in effect at the time that they were constructed. 6. The property owners agree that in the event of a hurricane they will remove the canvas vinyl coverings so that only the supporting structure has to meet wind code. 7. The homeowner by this affirmative defense, affidavit and motion, hereby swears to the above. 8. Further they would indicate that the electrical and air conditioning for the metal warehouse, that was properly permitted, was installed when the metal warehouse was originally built by a licensed contractor who was paid to pull a permit for the same, but it appears that said license contractor who is no longer in business did not pull the necessary permits . 9. The parties hereby apply for and request, after the fact permits on these 4 matters, 2 tents electrical and air conditioning pursuant to the requested affirmative defense to apply the code when they were constructed and not the current code and also prior to 2000 when these tents were constructed there was no limit on the number or size of said tents. I should have watched this more carefully and made sure it was done. After speaking to both gentlemen, I am requesting a continuation of 60 days for the hearing. The respondents would also object to the order in that it is vague to the point where they cannot comply with it, as it does not tell them which alleged structures are not permitted and the order is so vague as to be a improper delegation from the board to code enforcement to say what structures are unpermitted rather than the board ruling which structures are unpermitted. - 14. The order impermissibly delegates to code enforcement the determination of which structures are permitted or unpermitted. 15. This is especially true since all structures on the property are either permitted or exempt from permitting or are not structures per se as they are only temporary tents. 16. The only other issue that may be a problem is that the fact that a licensed collier county contractor, who is no longer in business, who was paid to obtain permits and do work, who did acceptable work but failed to pull the permits that they were paid by the homeowners to pull and were assured were pulled, this is for electrical and air conditioning only. 17. There is insufficient time in the order giving the building boom,to have an after the fact _ permit for these matters obtained! 18. The structures in which these improvements exist are in.fact permitted. 19. Code enforcement board has been extremely aggressive in this matter, to the point that both of these elderly parties have ended up in the hospital over these matters. 20. I also communicated and have been communication with Mr. Blanco by email and phone previously. 10. Mr.Blanco assured me that under the circumstances that he would have the hearing on February 23,2017 continued for at least 60 days and that it was not necessary for me to attend the code hearing as it definitely would be continued. 11. Mr.Blanco did not say that you have to apply for continuance and that it is up to the board. 12. Mr. Blanco said unequivocally that the hearing would be continued for 60 days. 13. The order of code enforcement board found, because we were not there to defend ourselves,that we had"multiple unpermitted structure on the property". 18. This is untrue. 19. Every structure on the property is either permitted or was ruled by code enforcement and the building department on several occasions to not require a permit. 20. We have multiple permits on the property. 21. These permits are as set forth on the attached property appraisal print out and legacy property card. 22. These buildings have all been here since the 1990's. 23. I used to be the Finance Director for the Clerk of Courts. 24. As such, I was required and did everything in my life in a legal and proper manner. 25. All of the permanent buildings have permits that were co'd. 26. The only issue that we have discovered is that the electric and air on one of the buildings which my husband and I paid a licensed contractor to install, which was installed up to and beyond code and we paid them to obtain a permit and LAW OFFICE DOUGLAS L. The only other alleged issue,we think, since the order is so vague,which we hereby object to,is 2 tents which was ruled by the building department in the 1990's to not require a permit as they are not permanent structures. These tents are only temporary and this similar ruling was made by code enforcement in 2008 and at the beginning of this proceeding. 29. Code enforcement indicated that all we had to do was remove the hurricane anchors for the tent and that everything would be fine. 30. We removed the hurricane anchors and then they changed their mind. 31. These tents cover my husband's hobby cars,which is his retirement hobby which is restoring cars and motorcycles. 32. We have been told by many engineers that such tents are impossible to bring to current standards and are used throughout the county without penuiit, 33. These tents are agricultural tents and are the same as those used to cover fragile plants and crops. 34. It appears that code enforcement found an easy way to win a disputed case by assuring me that I had a continuance. 38. Due to code enforcement board not having a secretary or clerk, according to code enforcement, or at least that is what they tell people on the phone, homeowners such as myself are at risk at being mislead like this. 39. Even the code enforcement notes on my case indicate that the tents may not need, permits. 40. My husband and I have been repeatedly harassed by code enforcement about these matters,to the point where both of us have ended up in the hospital due to the stress imposed upon us. 41. We have had many demands to inspect our property and they have even flown a helicopter over our property. 42. All my husband and I are trying to do is enjoy our retirement and pursue his hobby of restoring cars and motorcycles, all of which are owned by us. 43. As soon as we learned that the electrical and air conditioner permits were never pulled, we immediately set forth to have this corrected; but, in the current state of affairs of Collier, you simply cannot get anybody either engineers or trades people to do any work in less than a few months due to the building boom.
