Recommendation to approve Petition VAC-PL20160002287 to disclaim, renounce and vacate the County and the public interest in a portion of the 15-foot Utility Easement recorded in Official Record Book 1835, page 637 of the Public Records of Collier County, Florida, located in Section 21, Township 48 South, Range 25 East, Collier County, Florida, and to accept a replacement utility easement. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the 15 - foot Utility Easement recorded in Official Record Book 1835, page 637 of the Public Records of Collier County, Florida, located in Section 21, Township 48 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A, and to accept a replacement easement. CONSIDERATIONS: Petition VAC-PL20160002287 has been received by the Development Review Division from Daniel Moyer, P.E. of CPH, Inc., as agent for the Petitioner, WAL-MART STORES EAST, LP. This request is to vacate a portion of the 15-foot Utility Easement recorded in Official Record Book 1835, page 637 of the Public Records of Collier County, Florida, located in Section 21, Township 48 South, Range 25 East, Collier County, Florida. According to the General Warranty Deed dated May 27, 2009, and recorded in OR Book 4460, Page 498, Wal-Mart Stores East, LP has fee simple title to the real property where the subject easement is located. The applicant proposes to vacate a portion of the existing 15-foot utility easement in order to accommodate the construction of a liquor store addition that will be attached to the existing Wal-Mart. There is an existing County water main facility within the easement, and it must be rerouted in order to allow for the addition. There is no public detriment caused by the vacation because the existing water main facilities will be rerouted and the applicant will provide a replacement utility easement to the County. A copy of the replacement easement is attached hereto and will be recorded upon approval by the Board of County Commissioners (Board) of this vacation request. The County will retain a temporary easement over the vacated area until the water main facilities are relocated into the replacement easement, as described in the attached Resolution. The applicant has received letters of no objection from various entities, copies of which are attached hereto. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: The application fee of $2,000 covers staff review and processing. The applicant is also responsible for advertising fees. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. LEGAL CONSIDERATIONS: Pursuant to Resolution 2013-166 and Florida Statutes Sections 125.01 and 125.37, the Board may adopt resolutions to extinguish, vacate, abandon, discontinue, and close any easements, or any portion thereof, granted to the County or public by any instrument recorded in the public records of Collier County and to renounce and disclaim any right of the County and the public in and to any land in connection therewith; when such interest is granted to the County or public by any instrument recorded in the public records other than on a subdivision plat, when the following criteria are 04/25/2017 met: 1. Public benefit is established or no public detriment is established. 2.
