EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign the Fourth Amendment to
Criminal Justice Mental Health Substance Abuse Agreement with the David Lawrence Mental
Health Center (DLC) to adjust the grant budget by allocating $35,000 from “Personnel” to
“Incidental Expenses” for Program Year 3.
OBJECTIVE: To maintain compliance with Department of Children and Families (DCF) grant standard
and provide successful service delivery to Collier County FIRST clients.
CONSIDERATIONS: The Criminal Justice Mental Health Substance Abuse (CJMHSA) program was
established by the State to provide funding to counties to benefit certain clients entering the criminal
justice system. These funds can be used to plan, implement, or expand initiatives that increase public
safety, avert increased spending on criminal justice, and improve the accessibility and effectiveness of
treatment services for adults and juveniles who have a mental illness, substance abuse disorder, or co-
occurring mental health and substance abuse disorders and who are in, or at risk of entering, the criminal
or juvenile justice systems.
On June 10, 2014, the Board approved the County’s agreement with the DCF and the ensuing
subrecipient agreement with the DLC (Agenda Item 16D9). The agreement became effective July 1, 2014
and expires on June 30, 2017.
On September 23, 2014, (Agenda item 16D11), the Board approved the First Amendment which added
provisions for proper accountability. On June 23, 2015, (Agenda item 16D10), the Board approved the
Second Amendment which included technical revisions and added new grantor requirements. On October
25, 2016, (Agenda item 16D5), the Board approved the Third Amendment which extended the end date.
On March 13, 2017, Community and Human Services received the DLC’s proposed amendment to adjust
its grant budget to reallocate $35,000 from activity identified as “Personnel” to an activity identified as
“Incidentals”. DLC maintains sufficient grant funds in its budget to cover Personnel costs for Program
Year 3. Applying this budget reallocation, the funds are shifted to the incidental expenses line item to
cover the slight increase in client expenses anticipated throughout the end of the grant period. Incidental
expenses are incurred to facilitate the continuation of treatment and community stabilization when no
other resources are available. Examples of these expenses may include medications, groceries, personal
care items, or temporary housing.
The effective date of the Fourth Amendment is retroactive to April 1, 2017.
FISCAL IMPACT: The proposed action has no new fiscal impact. The reallocation of funds has a zero
net effect. The funding source for the grant is DCF. Funds are budgeted within Human Services Grant
(707), Project 33332.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board approval. - JAB

Agreement with the David Lawrence Center.

FOURTH AMENDMENT TO AGREEMENT CJMHSA-001 BETWEEN
COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS
AND
DAVID LAWRENCE MENTAL HEALTH CENTER, INC.
This Amendment, is entered into this
by and between David Lawrence Mental Health Center,
Subrecipient and Collier County, a political subdivision of
referred to as "COUNTY," collectively stated as the "Parties."

WHEREAS, on June 10, 2014, the County and Subrecipient entered into an agreement
for Subrecipient to provide "FIRST grant services" to Collier County residents (hereinafter
referred to as the "Agreement"); and
WHEREAS, on September 23, 2014, the Board of County Commissioners approved the
First Amendment to Agreement which added provisions for proper accountability over state
resources and a property clause for the purchase of tangible personal property; and
WHEREAS, on June 23, 2015, the Board of County Commsisioners approved the
Second Amendment to Agreement which revised the division name, added Board directed
Corrective Action language, removed and replaced Exhibits and added grantor required State
and Federal Laws, Rules and Regulations as Exhibit I; and
WHEREAS, on October 25, 2016, the Board of County Commissioners approved the
Third Amendment to Agreement to extend the contract term, reduce the grant budget, adjust the
match budget, and revise the staffing pattern; and
WHEREAS, the parties desire to modify Exhibit "F" to the Agreement to reduce the
activity identified as "Personnel' by $35,000 and increase the activity identified as "Incidental
Expenses" by $35,000 for Program Year 3; and
WHEREAS, the effective date of this amendment shall be retroactive to April 1, 2017
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and
valuable consideration, the receipt and sufficiency of which is hereby mutually acknowledged,
the Parties agree to modify the Agreement as follows:
3. Exhibit F, Method of Payment, is amended as follows:
F-3 Modifications to the "Budget and Scope" may only be made if approved in advance.
Budgeted fund shifts between budget categories and line items shall not be more than 10% and
does not signify a change in scope. Fund shifts that exceed 10% of budget category or line item
shall only be made with board approval.
