COMMENTS: This Petition was administratively approved by

Dr . Benedict noted that the NRMD approval, as
contained in the Staff Report, indicates that
. . . . the petitioner in designating 1. 0 acre
forested area as a preserve" , and questioned
whether this is an additional stipulation?
Mr . Edwards stated that the 1 acre preserve is
located in the rezone area, and was not
included in the original PUD, or in the origi-
nal stipulations, noting that Staff is in
agreement with this designation.

this point in the meeting, but it was con-
tinued to the end of the meeting, as so noted
in the minutes.

COMMENTS: Mr . Dan Brundage of Agnoli , Barber & Brundage,
Inc. stated that basically, the Staff Report
recommends approval of subject project, but
noted that during the process of discussions
with Staff, questions were raised regarding
the effect that the project may have on the
Coral Reef Aquifer . He indicated that these

questions were addressed in his letter dated
September 15, 1988.
With regard to the landscape requirement, Mr .
Brundage indicated that he is requesting that
the 75% groundcover used for native
landscaping, be reduced to 60%. He stated
that the 75% will create an unnecessary burden
on the project.
Ms. Stevens advised that the subject property
has been previously used for potato farming
for the past 10 years, and ditches and berms
still remain on site. She stated that the
entire parcel has been cleared of native trees
and shrubs for many years, and there are
various grasses and annuals found on site.
She indicated that the primary NRMD concern is
the affect that the land use will have on the
Coral Reef Aquifer , but noted that these
questions have been adequately addressed in
Mr . Brundage' s correspondence dated September
15 , 1988 .
Ms. Stevens noted that NRMD recommends appro-
.-. val of this Petition, subject to Standard
Stipulations 2-4 (noted as 1-3 below) , and the
additional stipulation (No. 4) , regarding the
site landscaping.
STIPULATIONS:
1. Native species shall be utilized, where
available, to the maximum extent possible in
the site landscaping design. A landscaping
plan will be submitted to the Natural
Resources Management Department and the
Community Development Division for their
review and subject to their approval . This
plan will depict the incorporation of native
species and their mix with other species , if
any. The goal of site landscaping shall be
the re-creation of native vegetation and habi-
tat characteristics lost on the site during
construction or due to past activities.
2. All exotic plants, as defined in the County
Code, shall be removed during each phase of
construction from development areas , open

space areas, and preserve areas. Following
site development, a maintenance program shall
be implemented to prevent reinvasion of the
site by such exotic species. This plan, which
will describe control techniques and inspec-
tion intervals, shall be filed with and sub-
ject to approval by the Natural Resources
Management Department and the Community
Development Division.
3 . If, during the course of site clearing, exca-
vation, or other constructional activities, an
archaeological or historical site, artifact,
or other indicator is discovered, all develop-
ment at that location shall be immediately
stopped and the Natural Resources Management
Department notified. Development will be
suspended for a sufficient length of time to
enable the Natural Resources Management
Department or a designated consultant to
assess the find and determine the proper
course of action in regard to its salvageabi-
lity. The Natural Resources Management
Department will respond to any such notifica-
tion in a timely and efficient manner so as to
provide only a minimal interruption to any
constructional activities.
4 . The petitioner shall incorporate a large per-
centage (at least 75%) of native species into
the site landscaping to help restore the
biological integrity of the area which has
been lost through consecutive years of agri-
cultural use.
Ms Stevens noted that the 75% requirement as
indicated in Stipulation No. 4 above was
suggested because there are no native trees or
shrubs on the site, and the Petitioner has
stated a desire to restore the biological
integrity of the area. She noted, however ,
the EAC may evoke this, if so desired.
Dr . Benedict indicated that reference was made
to a memo from Environmental Science and
Pollution Control Director Lorenz , in Mr .
Brundage ' s letter , noting that it is not
included, and questioned whether copy is

available, or if Mr . Lorenz could recall its
content?
Mr . Brundage provided a copy of the memorandum
for Dr . Benedict' s review.
A discussion took place regarding the required
level of native vegetation, and Dr . Benedict
stated that it should be consistent for
everyone.
Dr . Snyder stated that Standard Stipulation
No. 2 indicates that "Native species shall be
utilized, where available, to the maximum
extent possible in the site landscaping
design" , and he feels that the petitioner is
being asked to do as much as is humanly
possible.
Mr . Below commented that he believes the
landscaping should be in accordance with
Stipulation #2, noting that until such time
the language is changed, he believes the issue
could be challenged.
Mr . Lorenz indicated that this topic is part
of the discussion Ms. Muldoon will brief the
Council on, later in the meeting. He noted
that Staff has a problem with that particular
stipulation when it comes down to reviewing
the plans and specs relating to landscaping.
He advised that there is no definition as to
"the maximum extent possible.
Dr . Benedict advised that when Stipulation No.
2 was written a few years ago, it was
understood that soon, thereafter , an Ordinance
would be adopted that would be specific,
adding that he would like to see Staff come
back with specific comments relating to the
landscaping.
There were no speakers, either for or against

MOTION: Made by Ms. Kurgis to recommend approval of
Petition R-88-15C/PU-88-15C, subject to the
Stipulations as stated above, amending
Stipulation No. 4 to read ',The Petitioner

PETITION NO. ST-88-15C
FILED BY/FOR: Robert A. Lee, Trustee
REQUESTING: A Special Treatment Permit for a proposed boat
dock for a single-family residence.
COMMENTS: Ms. Muldoon advised that on September 20 ,
1988 , she inspected the site with Jim Beever
of the Florida Department of Natural
Resources. She stated that the Petitioner is
proposing to construct a boat dock approxima-
tely 54 ' long and 4 ' wide. She noted that
approximate water depths are from 4-5 ' . She
noted that the Petitioner is required by DNR
to lengthen the dock 20 ' to minimize prop
dredging and impact on shallow-water benthos .
She indicated that the extension of the dock
will require that the Petitioner obtain a boat
dock extension through the County, and he must
also apply for an Army Corps permit.
Ms. Muldoon provided a slide presentation of
subject parcel for the proposed dock, noting
that it will not be constructed at the mouth
of the lagoon, should it once again open up.
Mr . Below stated that it appears the proposed
dock will be located where there was a beach
when the Pass was open, adding that if the
configuration went back to where it originally
was, the dock will be attached to land.
Mr . Lee noted that the shore line has not
moved more than 10 ' in the past 11 years .
There were no speakers, either for or against
subject Petition.
MOTION: Made by Dr. Benedict to recommend approval of
Petition ST-88-15C, subject to the Stipulation
as noted below. Seconded by Mr. Below.

STIPULATION: 1. The Petitioner must obtain all the correct
permits from other state, federal, and local
agencies, and must adhere to all standards
mandated by them in construction of the pro-
posed dock.

ITEM: Landscape Committee Recommendations for Site
Development Plan Review For Standard
Stipulation No. 2
COMMENTS: Ms. Muldoon advised that Acting Community
Development Administrator 011iff spoke to her
in July regarding difficulties that the
Landscape Architects were having with the 60%
criteria she had set for the total plants.
She noted that he had asked her to present
this problem to the EAC, and request that the
review process be changed, which would include
the entire area, and suggested that the stan-
dards be set in the language contained in the
Stipulations.
She stated that she attended the Landscape
^ Ordinance Committee Meeting on August 30 ,
1988, to discuss the difficulties of the
review process, and noted that the Committee
is in the midst of rewriting the Landscape
Code, and because these ideas will be incor-
porated into it, they are looking for a "quick
fix" of the review process, rather than
rewriting the entire stipulation. The
Committee has suggested the review of only
the trees and understory, and excluding
groundcover . She stated that basically, both
the methodology of review and the rewriting of
the stipulation needs to be accomplished. She
indicated that the change in the Landscape
Ordinance will be in final form in March, but
adoption of the Ordinance by the Board of
County Commissioners will most likely not take
place until 4-6 months after that.
Mr . Below noted that the EAC needs to decide
what percentage should be adhered to, noting
that the Standard Stipulation, as it currently
reads, is too vague, and is unenforceable. He
indicated that after the percentage is deter-

mined, it would be appropriate for Ms . Muldoon
to review the total landscape plan, and then
apply the percentage to the total area .
Dr . Benedict indicated that he would like to
see Ms. Muldoon come back to the EAC with a
rewritten interim standard. He further indi-
cated that Dr . Snyder knows more about native
vegetation than the other members of the EAC,
and suggested that they meet.
Dr . Snyder questioned whether the system Ms .
Muldoon has been using during the past two
years was a workable one?
Ms. Muldoon replied negatively, noting that
the landscapers prefer that the evaluation of
plants be done by area, rather than by num-
bers, adding that they dislike using native
material, since they feel they do not provide
enough color , they are not pretty, tend to be
sparsely vegetated, etc. She noted that
people generally do not want to change what
they have been doing for a long time, but
indicated that there must be a balance between
what the landscapers want, and what the biolo-
gists want.
In answer to Dr . Benedict, Ms. Muldoon stated
that Anne McCoy, landscape architect, is
willing to interact with her on this subject,
and she feels that the two of them can arrive
at something that will be amenable to both
landscape architects and biologists , during
the interim period.
Dr . Benedict indicated that if Ms. McCoy is
willing to work with Ms. Muldoon, he believes
that interim standards and guidelines could be
used to rewrite the Stipulation. He suggested
that other counties be contacted to learn how
they handle similar procedures. He stated
that after the revisions have been made, Ms.
Muldoon present them to the EAC, and not wait
for the Landscape Code.
MOTION: Made by Dr. Benedict that Staff be directed to
work with Ms. McCoy, landscape architect, to
revise the language in Standard Stipulation

No. 2, and submit the recommendation to the
EAC for review. Seconded by Mr. Below.

ITEM: Addendum - Pelican Bay
COMMENTS: Mr . Below advised that it came to his atten-
tion that Pelican Bay is planning additional
development in the area that the EAC pre-
viously identified as a unique turkey oak
area, noting that they plan to dispose of 1/3
of that area. He stated that he feels this
area needs to be preserved, and questioned
what can be done?
Natural Resource Technician Burch stated that
subject area is being platted, and parts of
the turkey oak hammock will be sold into lots,
and a portion will be preserved.
Dr . Benedict indicated that he recalls
discussions regarding the plat, and Pelican
Bay was going to do what they could to pre-
serve it, before they moved on to the next
plat.
Planner Cacchione advised that the area where
turkey oaks exist is designated on the Pelican
Bay Plan as Group IV Housing. She noted that
the developers worked with Dr . Proffitt in the
past to establish boundaries of the turkey oak
area to be preserved, and they are in the pro-
cess of continuing to plat that area. She
stated that she and Mr . Burch will be meeting
with the parties next week to review the area
to the north that is to be platted, and the
area that is to be preserved as the turkey oak
area .

Dr . Benedict stated that he is curious about
the EAC Ordinance, i .e. establishing new pro-
cedures and meeting monthly, etc. , and
questioned the status of it?

Mr . Burch noted that he recently found a copy
of the proposed ordinance, which was buried in
the shuffle, adding that he forwarded same to
the County Attorney' s office for review.

requesting a provisional use "a" of the " I " zoning classification
for an asphalt plant and material storage.
Petitioner requests a provisional use to build an asphalt
plant and on site storage of material for this activity. The
area has been previously altered , with cleared areas still in
evidence. Vegetation consists of a slash pine ( Pinus elliottii
var . densa) canopy and groundcover consisting of weedy, early

successional , disturbance colonizers. Melaleuca (Melaleuca
quinquenervia> and cabbage palm ( Sabal palmetto ) make up the
sparse understory.
According to DER, the proposed plant design and emission
controls, consisting of a baghouse and stack , are the most
effective for controlling particulate emissions. Other
pollutants that may be produced by this activity, such as
nitrogen and sulfur oxides, are usually absorbed within the
aggregate or are trapped in the baghouse. The plant will have to
meet state and federal regulations concerning particulate
emissions.
NRMD administratively approves petition PU-88-17C subject to
the four standard stipulations as adopted by EAC on 4/1 /87.

Petition: PU-88-20C: Joseph S. Boggs of Bruce Green and
Associates, Inc. , representing Lee Williams; requesting
a provisional use 8. 10 b of MHRP (Mobile Home Rental
Park ) for a sewage treatment plant.
Considerations:
The subject property is a 4.34 acre parcel (387' x 485' )
located to the south of the Hitching Post Mobile Home Park and to
the west of Barefoot Williams Road (S33, 1505, R26E) . An
existing sewage treatment plant abuts the subject property on its
southern boundary, and a canal coincides with the western
boundary of the property.
The site is currently zoned for Mobile Home Rental Park use
(undeveloped ) . The petitioner is requesting approval for a
sewage treatment plant to serve the Mobile Home Park, and as a
permitted provisional use of the existing zoning.
The site was inspected on October 11 , 1988 by Andrea Stevens
(Environmental Resources Staff) . The western and northern

boundary areas of the site, and some interior areas are heavily
infested with noxious exotics (Melaleuca and Brazilian pepper ) .
Otherwise, the parcel supports widely scattered slash pine
(average diameters of 6" ) with a graminoid groundcover. It is
evident that the native habitat on the parcel has become impacted
by past activities.
Recommendations:
The Environmental Resources Staff recommends approval of
petition PU-88-20C subject to the 4 Standard Stipulations, as !
adopted by the Environmental Advisory Council on 4/1/87.

Associates, Inc. , representing Lee Williams; requesting a

The subject property is a 4.34 acre parcel located to the

Petition: PU-88-16C: Robert K. Lockhart, P.E. of Wilson, Miller, Barton, Soil
& Peek, Inc., representing William Higgs; requesting a provisional
use "b" of A-2 for earth mining.
Considerations:
Petition PU-88-16C (the Higgs-Harper PU) is a modification of an existing
approved provisional use petition (PU-81-20C) allowing earth mining; present
zoning is A-2 (PU-2). The existing mine is in the northeastern sector of the
intersection of I-75 and S.R. 951 (S35, T49, R26). The area is surrounded on
the north and east by transitional upland/wetland forest habitat, dominated by
slash pine (Pinus elliottii) and bald cypress (Taxodium distichum); infestation by
melaleuca (Melaleuca quinquinervia) is moderate. The southwestern boundary is
the County landfill access road, adjacent to 1-75. The site was inspected by
James N. Burch (ERM) on 24 October, 1988. The provisional use modification
that has been proposed would allow the existing earth mining operation to
increase the depth of the 70 acre excavation from the permitted 20 feet to a
depth of 30 feet, and hauling of fill off site.
Most of the site has been excavated or is in preparation for excavation, leaving
little viable terrestrial habitat within the project limits. According to the
petitioner's agent, an 11.3 acre wetland area located near the southwestern
border has been designated as a preserve area by the petitioner. Environmental
Resources Management (ERM; formerly Natural Resources Management Department)
has concerns about possible effects on ground water and surface water in the
area; therefore an Environmental Impact Statement (EIS) was required, with
emphasis on water quality in and around the pit.
ERM staff also raised concerns about possible blasting and fracturing of the
confining layer that defines the upper limit of the Lower Tamiami Aquifer.
Current permits for the mining operation will allow further blasting while
removable overburden exists in the mine. According to ERM Hydrogeologist,
Terri Newman and South Florida Water Management District's Log 86-1 report,
data in our area, from tests for natural gamma radiation in the substrate,
suggest that the depth of the dense, less permeable confining layer is irregular,
but is probably 40 feet or more below the ground surface. The proposed mining
and blasting is unlikely to damage the subtending confining layer.
Other concerns include possible compromises to water quality and the project's
proximity to wellfields, intrusion by subsurface trapped saltwater, and possible
effects on migration of water from the nearby County landfill. According to ERM

Specialist Ray Smith, the nearest wellfield is the Florida Cities Golden Gate
Wellfield nearly two miles northwest of the project (S27, T49, R26); according to
Mr. Smith, this project is unlikely to compromise the quality of water currently
being extracted from this wellfield. According to the petitioner, the operation
will be a wetmining project, and will not require dewatering; this will result in
minimal effects to the ground water table. This suggests that there will be
little or no effect on ground water by intrusion or effects on ground water
migration.
Chemical testing of ground water in and around the borrow pit will be done at
the direction of the Water Management Director by authority of County
Ordinance 88-26.
Recommendations:1
With the previous points in consideration, ERM recommends approval of' petition
PU-88-16C with the following suggested stipulations:
1. All exotic plants, as defined by County Ordinance 82-37 shall be removed
from the preserve area, and any other native habitat within the project
limits, upon the initiation of the proposed mining activity.

by A-2 land, to the south by the Edgewild subdivision (REF-2) , to
the west by the Regent Park PUD and to the north by Immokalee

The northern half of the site is a xeric system dominated by
large patches o+ palmetto (S2[EDga repens) , with scattered slash
pines (pi12g� al1igttii var. d2D� ( 10 12" DDH) as the only
canopy species. The understory consists of the palmettos, winged
sumac (RhD cgpllii2�) , and cabbage palm (S0b�l LalfIgttg) , | i-Ie
groundcover consists mostly of gramincids with scattered prickly

Cabbage palms and bald cypress (T�Lg0i'..2M 0..iti;1-1.u1.0) are the
Cominant species in the southern half of the site. Cypress is
'..:he only canopy species in this half . The �nderstory consists
mostly of cabbage palms with scattered Brazilian peppers. The
groundcover is dominated by ragweed (A1bLgi2 ��tg?Ti0iifgli !,) ,
dog fennel (E�1:::!.,.. tg7,iu ��Lillifgli�m) , graminoids, and grape
vine, indicating past disturbance. There is a small , triangular
section in the eastern half that is lower in elevation than the
rest of the site. This area is dominated by cypress ( 12-16" DBH`
with an understory of pop ash (F�.2�iags cargli�if::!,E�) , and
groundsel (Badchas halimifglig) . Groundcover consists of
_'�� ragweed, sedges, gramir`ois, and dog fennel . Petitioner plans to

plan . If feasible, the cabbage palms may be transplanted

Petition: R-88-21C: Cliff Repperger, of Avalon Engineering, Inc. ,
representing Collier Development Corporation;
requesting a zoning change from A-2 to PUD for a
Commercial Activity Center ( "SAND RIDGE" ) .
Considerations:
The subject property is a 31 .9 acre parcel located on the
northeast corner of U.S. 41 and Immokalee Road (C-846) (522,
1488, R25E) . Lands to the east of the parcel are undeveloped
pine woodlands and xeric palmetto habitats (zoned A-2) . A lake
is located to the north of the parcel , as well as open upland
areas (also zoned A-2) . The property was inspected on October
11 , 1988, by Andrea Stevens (Environmental Resources Staff) .
The petitioner is requesting a rezoning of the parcel from
A-2 to PUD to allow for a Community Commercial Shopping Center.
A 70% impervious area is proposed for the development.
The average elevation of the site is 8 feet NGVD. The only
wet area on the parcel is a small man-made lake adjacent to the
eastern property boundary. The littoral areas of the lake have
become overgrown with cattails (Typha spp. ) . The exotic Brazilian
pepper (Schinus terebinthifolius) has become established along
lake shore areas.
The remainder of the site is dominated by drier habitats.
The southern half of the parcel supports a pine woodlands habitat
with a palmetto (Serenoa repens) understory. Slash pines (Pinus
elliottii) have 6"-8" diameters, although several trees with 12"-
14" diameters were noted. In addition to the dense palmetto
growth in this habitat, shrub layer vegetation includes rusty
lyonia (Lyonia ferruqinea) , wax myrtle (Myrica cerifera) , dog
fennel (Eupatorium capillifolium) , and gallberry ( Ilex qlabra) .
Groundcover consists of various grass species, and an occasional
Hypericum spp. , but mostly just scattered pine needles.
In the southwest corner of the parcel , the pine woodlands
have become infested with the exotic melaleuca (Melaleuca
quinquenervia) . Also, the exotic Brazilian pepper (Schinus
terebinthifolius) is encroaching along the southern and part of
the western property boundaries, adjacent to heavily used roads.
Moving north across the parcel , the landscape becomes
dominated by open palmetto areas. Small pines ( 10-15 feet in
height) are found infrequently in this habitat. Pennyroyal
(Piloblephis rigida) , prickly pear cactus (Opuntia spp. ) , love
vine (Cassytha filiformis) , as well as rusty lyonia and wax
myrtle were noted among the palmettos. In addition, the habitat
supports several small oaks (Quercus spp. , 3"-4" in diameter and

10 feet in height) , and the area may provide habitat for the
gopher tortoise, which is a protected species in this state.
Near the northeast corner of the site, several open sandy
patches are evident.
Recommendations:
The Environmental Resources Staff recommends approval of
petition R-88-21C subject to the following stipulations:
1-4. Standard Stipulations 1-4 as adopted by the EAC on 4/1/87.
5. The petitioner shall arrange for a gopher tortoise survey to
be completed by knowledgeable personnel . The necessary
procedures for gopher tortoise relocation (Florida Game and
Fresh Water Fish Commission) shall be followed in the event
a gopher tortoise is found.
