A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, TO DISCLAIM, RENOUNCE
AND VACATE THE COUNTY AND THE PUBLIC INTEREST IN
THE LAKE MAINTENANCE AND DRAINAGE EASEMENT
DESCRIBED IN OFFICIAL RECORD BOOK 3989, PAGE 4175 AND
A PORTION OF THE DRAINAGE EASEMENT AS DESCRIBED IN
OFFICIAL RECORD BOOK 4373, PAGE 3774 OF THE PUBLIC
RECORDS OF COLLIER COUNTY, FLORIDA. THE SUBJECT
PROPERTY IS LOCATED NORTH OF THE INTERSECTION OF
OIL WELL ROAD AND HAWTHORN ROAD, IN SECTION 13,
TOWNSHIP 48 SOUTH, RANGE 27 EAST, COLLIER COUNTY,
FLORIDA. (PETITION VAC-PL20160001099)
WHEREAS, pursuant to Resolution 2013-166, Petitioner, Brian J. Thanasiu of
Cheffy Passidomo, P.A., on behalf of the property owner, has requested the vacation of
the County and the public interest in the Lake Maintenance and Drainage Easement
described in Official Record Book 3989, Page 4175 and a portion of the Drainage
Easement as described in Official Record Book 4373, Page 3774 of the public records of
Collier County, Florida, located in Section 13, Township 48 South, Range 27 East,
Collier County, Florida, being more specifically shown in Exhibit A, attached hereto; and
WHEREAS, the Board of County Commissioners, on this day, held a public
hearing to consider the petitioner's request and notice of said public hearing was given as
required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County and the
public interest in the Lake Maintenance and Drainage Easement described in Official
Record Book 3989, page 4175 and a portion of the Drainage Easement as described in
Official Record Book 4373, page 3774 of the public records of Collier County, Florida,
located in Section 13, Township 48 South, Range 27 East, Collier County, Florida, being
more specifically shown in Exhibit A, is hereby vacated, extinguished, renounced and
disclaimed, and this action is declared to be in the public interest and for the public
benefit.
BE IT FURTHER RESOLVED AND ORDERED that the County and the
public interest in the Lake Maintenance and Drainage Easement and the Drainage
Easement shall not terminate until the date of recording of the Ranch at Orange Blossom
Phase 2A plat, which plat shall not be recorded until:

1) The County Engineer has certified that all improvements relating to the
alternate stormwater runoff outfall path have been constructed, inspected and
certified complete; and
2) New drainage easements in favor of the County over the alternate stormwater
runoff outfall path have been accepted by the County and recorded in the
Official Records of Collier County. The new drainage easements shall continue
to take water from Oil Well Road pursuant to the Developer's Agreement
recorded in OR Book 4322 page 2787. The easements and the development's
water management system shall "provide water quality and treatment and
attenuation for stormwater run-off in perpetuity from the Oil Well Road Right
of Way adjacent to the development and an additional 21 acres of Oil Well
Road Right of Way that does not traverse the Development."
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public Records of
Collier County, Florida.
THIS RESOLUTION ADOPTED after motion, second and majority vote

Parcel in

A tract or parcel of land lying in Section 13, Township 48 South, Range 27 East, Collier
County, Florida, being all of a Drainage Easement described in deed recorded in Official
Records Book 4373, at Page 3774, lying within lands described in a deed recorded in Official
Records Book 5053 at Page 474, all of the Public Records of Collier County, Florida and
being more particularly described as follows:
Commencing the Northwesterly most corner of Tract "C" of the record plat of
"ORANGE BLOSSOM RANCH PHASE 1A" as recorded in Plat Book 45, Pages
58-61 of the Public Records of Collier County, Florida, run S89°30'46"W along
the South line of said lands described in said deed recorded in Official Records
Book 5053 at Page 474 for 1,748.52 feet to an intersection with the Easterly
line of said Easement and the POINT OF BEGINNING.
From said Point of Beginning continue S89°30'46"W along said South line for
30.00 feet to an intersection with the Easterly line of lands described in
Official Records Book 1433 at page 509, of the Public Records of Collier
County, Florida; thence run Noo°29'14"W along said Easterly line, also being
the Westerly line of said Easement for 1,552.16 feet to the Northwest corner of
said Easement; thence run along the Northerly and Easterly line of said
Easement the following two (2) courses: N89°30'46"E for 30.0o feet and
Soo°29'14"E for 1,552.16 feet to the POINT OF BEGINNING.
Containing 1.07 acres, more or less.
Bearings hereinabove mentioned are State Plane for the Florida East Zone (1983/NSRS
