To whom it may concern,
This letter is to inform that the property located at 5260 21st Place SW, Naples
Florida, 34116 is currently under reconstruction after the said property suffered severe
damages. In early 2016, the house was brutally affected by a hurricane. Many areas of
the property were damaged completely. Including but not limited to: the entire front of
the house, the fence, the garage area, in addition to serious leakage in the roof. The
repairs came to me unexpectedly. The insurance did not want to cover them. With the
sudden fixes that were imminent, my economy was not prepared to undertake such
strain. Not to mention, that I was also undergoing a personal situation. The mother of
my daughter and I were separating at the time. The split was difficult and it left me both
emotionally and financially crippled. As hard as it is to admit, both situations truly left
me in a very vulnerable position.
I did not have a budget to undertake all of these repair expenses. The incidentals
have been one after the other. For me it has not been easy financially. One is hardly
ever prepare to have an emergency budget for property damages caused my mother
nature, much less when you are undergoing a complex separation. Currently, I am still
working on the property and trying to repair everything. As mentioned earlier, my
economy has really taken a low blow. As far as the code violation goes, it is absolutely
my intention to take the appropriate and corresponding steps necessary to comply with
Collier County's ordinances. I would respectfully request some time to achieve this. It is
my petition that the city allows me at least 6 merrrtils to complete reparations on my
property and allow me enough time to save up to pay for the adequate permits. I want

to make it clear that I have all of the intentions needed to comply and continue to be a
law-abiding citizen. However, I do need some reasonable time in order to take care of
my financial obligations. Thank you in advanced for your understanding in this matter!

Environmental Determination
Michaelle Crowley- 12/15 I reviewed case and researched property. House was built in 2005,thus
requiring removal of any Exotic vegetation in perpetuity.The presumed Exotic vegetation first shows up
in 2010 aerial, so it has grown large. I reviewed the photos by Investigator and there are definitely at
least 3 Brazilian Pepper bushes-- 2 on the right side of the house, and 2 behind the landscape plants just
in front of the house. One of the side Brazilian Peppers is a female plant, marked by the distinctive red
berries. This is an Exotic violation because the house was constructed after November 13, 1991. Since
that time, all development has required removal of Exotics at time of construction and imposes the
requirement that the property remain free of all Exotics forever. I sent email to Investigator containing
description of the violation and Order to Correct.

10.02.06- Requirements for Permits
B. Building Permit or Land Alteration Permit.
1. Building or land alteration permit and certificate of occupancy compliance process.
a. Zoning action on building or land alteration permits. The County Manager or his designee
shall be responsible for determining whether applications for building or land alteration
permits, as required by the Collier County Building code or this Code are in accord with the
requirements of this Code, and no building or land alteration permit shall be issued without
written approval that plans submitted conform to applicable zoning regulations, and other
land development regulations. For purposes of this section a land alteration permit shall
mean any written authorization to alter land and for which a building permit may not be
required. Examples include but are not limited to clearing and excavation permits, site
development plan approvals, agricultural clearing permits, and blasting permits. No building
or structure shall be erected, moved, added to, altered, utilized or allowed to exist and/or no
land alteration shall be permitted without first obtaining the authorization of the required
permit(s), inspections and certificate(s) of occupancy as required by the Collier County
Building Code or this Code and no building or land alteration permit application shall be
approved by the County Manager or his designee for the erection, moving, addition to, or
alteration of any building, structure, or land except in conformity with the provisions of this
Code unless he shall receive a written order from the Board of Zoning Appeals in the form
of an administrative review of the interpretation, or variances as provided by this Code, or
unless he shall receive a written order from a court or tribunal of competent jurisdiction.

B. Building Permit or Land Alteration Permit.
1. Building or land alteration permit and certificate of occupancy compliance process.
a. Zoning action on building or land alteration permits. The County Manager or his designee
shall be responsible for determining whether applications for building or land alteration
permits, as required by the Collier County Building code or this Code are in accord with the
requirements of this Code, and no building or land alteration permit shall be issued without
written approval that plans submitted conform to applicable zoning regulations, and other

Code unless he shall receive a written order from the Board of Zoning Appeals in the form
of an administrative review of the interpretation, or variances as provided by this Code, or
unless he shall receive a written order from a court or tribunal of competent jurisdiction.
e. Improvement of property prohibited prior to issuance of building permit. No site work,
removal of protected vegetation, grading, improvement of property or construction of any
type may be commenced prior to the issuance of a building permit where the development
proposed requires a building permit under this Land development Code or other applicable
county regulations. Exceptions to this requirement may be granted by the County Manager
or his designee for an approved subdivision or site development plan to provide for
distribution of fill excavated on-site or to permit construction of an approved water
management system, to minimize stockpiles and hauling off-site or to protect the public
health, safety and welfare where clearing, grading and filling plans have been submitted and
approved meeting the warrants of section 4.06.04 A. of this Code; removal of exotic
vegetation shall be exempted upon receipt of a vegetation removal permit for exotics
pursuant to Chapters 3 and 10.
i. In the event the improvement of property, construction of any type, repairs or

ORDER TO CORRECT VIOLATION(S): You are directed by this Notice to take the following corrective action(s): 1.
Remove all Collier County Prohibited Exotic vegetation that exists upon the entire property. The use of heavy
machinery to do mechanical clearing of Exotic vegetation REQUIRES a Vegetation Removal Permit to be obtained
in advance. When Prohibited Exotic vegetation foliage is removed, but the base of the vegetation remains,the
base and every stem on the stump must be immediately treated with a U.S. Environmental Protection Agency
approved herbicide containing a visible tracer dye. The continued removal of all Exotic Vegetation shall be
required in perpetuity.
ON OR BEFORE: January 16, 2017

C. Applicability to new structures and to additionson single-family and two-family lots. In addition
to the other requirements of this section, the applicant shall be required to remove all prohibited
exotic vegetation before a certificate of occupancy is granted on any new principal or accessory
structure and any additions to the square footage of the principal or accessory structures on
single-family or two-family lots. This shall not apply to tents, awnings, cabanas, utility storage
sheds, or screened enclosures not having a roof impervious to weather. This shall not apply to
interior remodeling of any existing structure.
The removal of prohibited exotic vegetation shall be required in perpetuity. Upon issuance of a
vegetation removal permit, subject to the provisions in LDC section 3.05.02 F. and G., prohibited
exotic vegetation may be removed prior to issuance of a building permit.

a. Zoning action on building or land alteration permits. The County Manager or his designee
shall be responsible for determining whether applications for building or land alteration
permits, as required by the Collier County Building code or this Code are in accord with
the requirements of this Code, and no building or land alteration permit shall be issued
without written approval that plans submitted conform to applicable zoning regulations, and
other land development regulations. For purposes of this section a land alteration permit
shall mean any written authorization to alter land and for which a building permit may not
be required. Examples include but are not limited to clearing and excavation permits, site
development plan approvals, agricultural clearing permits, and blasting permits. No
building or structure shall be erected, moved, added to, altered, utilized or allowed to
exist and/or no land alteration shall be permitted without first obtaining the authorization of
the required permit(s), inspections and certificate(s) of occupancy as required by the
Collier County Building Code or this Code and no building or land alteration permit
application shall be approved by the County Manager or his designee for the erection,
moving, addition to, or alteration of any building, structure, or land except in conformity
with the provisions of this Code unless he shall receive a written order from the Board of
Zoning Appeals in the form of an administrative review of the interpretation, or variances as
provided by this Code, or unless he shall receive a written order from a court or tribunal of
competent jurisdiction...
e. Improvement of property prohibited prior to issuance of building permit. No site work,
removal of protected vegetation, grading, improvement of property or construction of any
type may be commenced prior to the issuance of a building permit where the
development proposed requires a building permit under this Land development Code or
other applicable county regulations. Exceptions to this requirement may be_granted by the
County Manager or his designee for an approved subdivision or site development plan
to provide for distribution of fill excavated on-site or to permit construction of an approved
water management system, to minimize stockpiles and.hauling off-site or to protect the
public health, safety and welfare where clearing, grading and filling plans have been
submitted and approved meeting the warrants of section 4.06.04 A. of this Code; removal
of exotic vegetation shall be exempted upon receipt of a vegetation removal permit for
exotics pursuant to Chapters 3 and 10.
i. In the event the improvement of property, construction of any type, repairs or

demolition permit,inspections and Certificate of Completion/Occupancy on or before September 22,
2015 or a fine of S250.00 per day will be imposed for each day the violation remains thereafter.

2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before January 19, 2016, or a fine of$200.00 per day would be assessed for each day the violations
continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5179,PG 195)
3. On January 29,2016,Respondent filed a Request/Motion for Extension of Time to Comply.
4. Previously assessed operational costs of$74.25 have been paid.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:

Extension of Time was granted until January 28,2017, as stated in the Order recorded in the public records of
Collier County,Florida in OR Book 5241 PG 1345.

3. That a re-inspection was performed on January 30th,2017.
4. That the re-inspection revealed that the corrective action ordered by the Code Enforcement Board was not in
compliance with the following conditions:No Building permits have been obtained to either keep or remove
the unpermitted structure.
