Agenda 03/28/2017 Item #16A 103/28/2017 EXECUTIVE SUMMARY This item requires that ex parte disclosure be provided by Commission members. Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve for recording the final plat of Ranch at Orange Blossom Phase 2A, (Application Number PL20150002151) approval of the standard form Construction and Maintenance Agreement and approval of the amount of the performance security. This is a companion to Agenda Item 17.C, (Vacation of Easements) and both items must be approved or both items denied. _____________________________________________________________________________ OBJECTIVE: To have the Board of County Commissioners (Board) approve for recording the final plat of Ranch at Orange Blossom Phase 2A, a subdivision of lands located in Section 13, Township 48 South, Range 27 East, Collier County, Florida, following the alternative procedure for approval of subdivision plats pursuant to Resolution 99-199. This procedure allows for the Board to approve the plat and associated construction documents for construction purposes and recording purposes concurrently. CONSIDERATIONS: The Development Review Division of the Growth Management Department has completed the review of the construction drawings, specifications, and final plat of Ranch at Orange Blossom Phase 2A. These documents are in compliance with the County Land Development Code (LDC) and Chapter 177, Florida Statutes. This project is within the Orange Blossom Ranch PUD, Ord. 04-74, as amended. All fees have been paid. Security in the amount of 10% of the total cost of the required improvements, and 100% of the cost of any remaining improvements, together with a Construction and Maintenance Agreement for Subdivision Improvements, shall be provided and accepted by the County Manager or designee and the County Attorney’s Office prior to the recording of the final plat. This procedure is in conformance with Section 10.02.04 F.2 of the LDC. Staff recommends that the final plat of Ranch at Orange Blossom Phase 2A be approved for recording. The companion vacation item provides that the public interest in the Lake Maintenance and Drainage Easement and the portion of Drainage Easement being vacated shall not terminate until the date of recording of the subject plat, which plat shall not be recorded until: 1) The County Engineer has certified that all improvements relating to the alternate stormwater runoff outfall path have been constructed, inspected, and certified complete; and 2) New drainage easements in favor of the County over the alternate stormwater runoff outfall path have been accepted by the County and recorded in the Official Records of Collier County. The new drainage easements shall continue to receive stormwater runoff from Oil Well Road p ursuant to the Developer's Agreement recorded in OR Book 4322, Page 2787. The easements and development's stormwater management system shall "provide water quality and treatment and attenuation for stormwater run -off in perpetuity from the Oil Well Road Right of Way adjacent to the development and an additional 21 acres of Oil Well Road Right of Way that does not traverse the Development." FISCAL IMPACT: The project cost is $5,885,234.90 (estimated) to be borne by the developer. The cost breakdown is as follows: a) Water & Sewer $2,817,594.00 b) Drainage, Paving, Grading $3,067,640.90 The Security amount, equal to 110% of the project cost, is $6,473,758.39 The County will realize revenues as follows: 03/28/2017 Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327 -- Land Development Services Revenue generated by this project: Total: $178,662.05 The Fees are based on a construction estimate of $5,885,234.90 and were paid in May 2016. The breakdown is as follows: a) Plat Review Fee ($1,000.00 + $5/ac) $ 2,105.00 b) Construction Drawing Review Fee Water & Sewer (.75% const. est.) $21,131.96 c) Drainage, Paving, Grading (.75% const. est.) $23,007.31 d) Construction Inspection Fee Water & Sewer (2.25% const. est.) $63,395.87 e) Drainage, Paving, Grading (2.25% const. est.) $69,021.92 GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public Facilities (COA) prior to the issuance of the construction plan final approval letter and plat recordation, except when the applicant elects to delay obtaining a COA for non-residential developments that are required to obtain approval of a site development plan prior to the issuance of a building permit. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. - SAS RECOMMENDATION: To approve the final plat of Ranch at Orange Blossom Phase 2A (application number PL20150002151) for recording with the following stipulations: 1. Approve the amount of $6,473,758.39 as performance security for the required improvements, or such lesser amount based on work completed, and as is approved by the Growth Management Department. 2. Approve the standard form Construction and Maintenance Agreement and direct the County Manager or designee: a. To withhold Certificates of Occupancy until the required improvements have received preliminary acceptance. b. To delay recording of the plat until suitable security and an appropriate Construction and Maintenance Agreement is approved and accepted by the County Attorney’s Office and the Board or the County Manager or designee on behalf of the Board pursuant to Section 10.02.04 F.2 of the LDC; and until the easements which are required to be vacated have been approved by the Board. c. To delay recording of the plat until 1) The County Engineer has certified that all improvements relating to the alternate stormwater runoff outfall path have been constructed, inspected and certified complete; and 2) New drainage easements in favor of the County over the alternate stormwater runoff outfall path have been accepted by the County and recorded in the Official Records of 03/28/2017 Collier County.
