HEARING EXAMINER DECISION
PETITION NO. VA-PL20160001264 — Pauline Christie requests a variance from Section
4.02.01, Table 2.1 of the Land Development Code to reduce the minimum side yard setback
from 30 feet to 18.8 feet for a proposed pool screen enclosure in the Estates zoning district.
The subject property is located at 5095 Palmetto Woods Drive, on the north side of
Palmetto Woods Drive, approximately one-third mile east of Logan Boulevard, in Section
9, Township 49 South, Range 26 East, Collier County,Florida, consisting of 2.27± acres.
DATE OF HEARING: March 9, 2017
STAFF RECOMMENDATION: Approval.
FINDINGS:
Based on the applicant's written petition, testimony at the hearing of the applicant and the
recommendation of staff, the Hearing Examiner finds that each of the criteria set forth in Section
9.04.03 of the Land Development Code has been met and the petition should be approved.
ANALYSIS:
Other than the applicant, there were no members of the public in attendance for this matter. No
objections have been received and one letter of support from the abutting neighbor to the East
was provided to staff
DECISION:
The Hearing Examiner hereby approves Petition No. VA-PL20160001264 filed by Pauline
Christie, for a variance from LDC Section 4.02.01, Table 2.1, to reduce the minimum side yard
setback from 30 feet to 18.8 feet for a proposed pool screen enclosure on the property described
herein, as shown in the Survey Sketch and Site Plan attached as Exhibit "A", and as subject to
the condition(s) set forth below.

LEGAL DESCRIPTION: The West 150 feet of Tract 77, GOLDEN GATE ESTATES, Unit
32, according to the map or plat thereof on file and recorded in the office of the Clerk of the
Circuit Court of Collier County, Florida, in Plat Book 7, page 21.

CONDITIONS:
1. All other applicable state or federal permits must be obtained before commencement of
the development.

APPEALS:
This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as
amended, a Hearing Examiner Decision may be appealed to the Board of County Commissioners
or the Board of Zoning Appeals, as appropriate. Appeals must be filed within 30 days of the date
the Hearing Examiner Decision is rendered.
