EXECUTIVE SUMMARY
Recommendation to approve Lease No. 57-4209-15-003 with the United States of America on behalf
of the United States Department of Agriculture for the continued use of office space within the
Collier County University Extension Office which is being resubmitted to modify the termination
date.
OBJECTIVE: To approve a resubmitted Lease for office space utilized by the United States Department
of Agriculture (USDA).
CONSIDERATION: On July 12, 2016, the Board approved a Lease (Agenda Item 16.E.2) with the
USDA for the continued use of one thousand square feet of office space at the Collier County University
Extension Office (Extension), which is located adjacent to the Fairgrounds. The USDA has leased this
office since 1992.
The Lease was executed by the Board in July, but when presented, the USDA did not execute the Lease
as requested. Staff continued to contact the USDA asking for the executed Lease to be returned. However,
in late December, the USDA advised staff that the Lease term was in question by the Federal Government
and the Lease would have to be resubmitted. Staff requested to process an Amendment to the Lease, but
the USDA requires a new lease to be processed.
The USDA has resubmitted the previously-approved Lease with a revised termination date. The revision
is due to contract requirements and funding within that organization. The attached Lease is the same form
approved in July, but with a revision to the termination date as seen on Page 1 under ‘Lease Term.’ The
new termination date will be July 31, 2025. All other terms and conditions contained in the attached copy
are the same as contained in the previously-approved Lease.
FISCAL IMPACT: The first year's annual rent of $13,254.24, and the subsequent annual rents, which
increase annually by two percent, and include the cost for utilities and janitorial services, shall continue to
be deposited into General Fund (001), University Extension Office (157110), Lease Facilities (362190).
GROWTH MANAGEMENT: There is no Growth Management Impact associated with this Executive
Summary.
LEGAL CONSIDERATIONS: Because the prior Lease approved by the Board was not signed by the
USDA, it is not legally binding. This item is approved for form and legality and requires majority vote for
Board action. - JAB
RECOMMENDATION: To approve, and authorize the Chairman to sign, the attached Lease with the
United States of America on behalf of the United States Department of Agriculture.
