EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign the Utility Facilities Quit-Claim
Deed and Bill of Sale between Collier County, as Ex-Officio Governing Board of the Collier County
Water-Sewer District, and Gordon R. Jenkins, in order to reconvey to Gordon R. Jenkins, all
potable water utility facilities associated with the development project at Carica Water Main
Extension, PL20150001113, which were previously erroneously conveyed to the County.
OBJECTIVE: To correct the erroneous conveyance of potable water utility facilities to the County for
the Carica Water Main Extension development project.
CONSIDERATIONS: The Utility Facilities Warranty Deed and Bill of Sale from Gordon R. Jenkins
(Mr. Jenkins), recorded on August 4, 2015 at OR 5181, PG 509, conveyed potable water utility facilities
located within Lot 21, Block 3, of Pine Ridge Second Extension (Plat Book 10, Page 86) to the Board of
County Commissioners (Board), as ex-officio Governing Board of the Collier County Water-Sewer
District.
These conveyance documents were recorded after preliminary acceptance of the utility facilities for the
project, in accordance with the Utility Facility Standards and Procedures Ordinance No. 2004 -31.
However, prior to Mr. Jenkins requesting the Board's final approval and acceptance of these utility
facilities, the Development Review Division determined that the potable water utility facilities should not
have been conveyed to the County because the legal description attached to the Utility Facilities Warranty
Deed and Bill of Sale is incorrect. Therefore, the attached Quit-Claim Deed will reconvey the County’s
interest in these potable water utility facilities back to Mr. Jenkins.
Mr. Jenkins is aware of the error and has agreed to accept reconveyance of these utility facilities.
Mr. Jenkins will convey the potable water facilities to the County over the correct legal description at a
later date.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval - SAS
