Agenda 02/14/2017 Item #16D502/14/2017 EXECUTIVE SUMMARY Recommendation to increase the estimated annual expenditures for “Recreational Equipment” to Varsity Brands Holding Co, Inc. d/b/a BSN Sports, LLC, from $50,000 to an amount up to $100,000 per fiscal year. OBJECTIVE: To obtain the Board’s approval to increase the estimated average annual expenditure on recreational equipment. CONSIDERATION: On December 8, 2015, the Procurement Services Division released notices of Invitation to Bid No. 15-6535 to 376 vendors for recreational equipment. Fifty-one (51) bid packages were downloaded, and two bids were received on December 29, 2015, as shown in the attached bid tabulation. Bliss Products was deemed non-responsive for not completing the required forms as outlined in the solicitation. On January 14, 2016, the Procurement Services Division awarded ITB #15-6535 to Varsity Brands Holding Co, Inc. d/b/a BSN Sports, LLC, the lowest, responsible and responsive bidder. The annual expenditure under the award was originally estimated at less than $50,000 per calendar year based on historical data. At the time of the award, the annual expenditure estimated by staff was based on available budget historical information and expected needs for the initial contract year. The amount spent under the first year of the contract exceeded $100,000, which exceeds the dollar authority afforded to the Procurement Division to award contracts under the Procurement Ordinance. The larger than anticipated expenditures were caused by an ever-increasing need to acquire new recreational equipment and replace large quantities of existing equipment that has deteriorated due to lack of capital funding in previous years coupled with the increased availability of funds for these needs in the Parks’ Division FY 2017 budget. The awarded vendor, Varsity Brands Holding Co, Inc. d/b/a BSN Sports, LLC, has performed well under the contract to date. Pursuant to the Board's Procurement Ordinance, expenditures in excess of $50,000 per calendar year must be approved by the Board. Therefore, to ensure ongoing compliance with the Procurement Ordinance, staff is updating its annual estimated expenditures for this award. The term of the award was set for one year with two optional one-year extensions. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. FISCAL IMPACT: Funding for the purchase of recreational equipment is provided within existing Parks & Recreation Division budgets. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. - CMG RECOMMENDATION: That the Board of County Commissioners approves an increase of annual expenditures for “Recreational Equipment” up to $100,000 per fiscal year.
