EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with a value of $78,980.13 for
payment of $680.13 in the code enforcement actions entitled Board of County Commissioners v.
Elsa Perdomo. Code Enforcement Board Case No. CEPM20120001293 relating to property located
at 5352 23rd Place SW, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners (Board) accepts an offer to release a code
enforcement lien with an accrued value of $78,980.13 for payment of $680.13 in relation to Code
Enforcement Board Case No. CEPM20120001293.
CONSIDERATIONS: As a result of code violations, the Code Enforcement Board ordered the
imposition of a lien against Elsa Perdomo in Case No. CEPM20120001293 for code violations at 5352
23rd Place SW, consisting of broken windows and a damaged wooden gate. The lien was recorded in the
Official Records on April 29, 2015, at O.R. Book 5145, Page 1137. The lien amount of $78,980.13 is
based on 315 days of accrued fines ($250 per day from March 7, 2015 through January 15, 2016),
$78,750, plus operational costs in the amount of $230.13. The property was brought into compliance on
January 15, 2016.
Following a foreclosure (Case No. 2016-CA-1201), a Certificate of Title was recorded on November 1,
2016, in favor of Wells Fargo Bank National Association as Trustee for Bank of America Alternative
Loan Trust 2004-2 Mortgage Pass-through Certificates Series 2004-2.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when a code
enforcement lien encumbers property that is under new ownership and compliance has been achieved
within 30 days. The property is being actively maintained and $680.13 has been paid in the settlement of
fines. The owner of record, Wells Fargo Bank National Association, is requesting a waiver of $78,300 in
accrued fines. There are currently no known violations.
FISCAL IMPACT: Payment of $680.13 in settlement of fines has been made, representing $450 in
fines plus operational costs in the amount of $230.13. If approved by the Board, accrued fines in the
amount of $78,300 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. KN
RECOMMENDATION: To waive the fines in the amount of $78,300, accept payment in the amount of
$680.13, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien
for recording in the Official Public Records.
